On 11/28/12 a t approximately 1845 hrs , I responded to 619 N SR 7 inre fe rence to a h i t and run t r a f f i c crash .The defendant , i de n t i f i e d through a Flor ida Dr ive r s License asMitche l l Pel lecchia , made a r igh t hand t u rn out of the driveway of 550N SR 7 without h i s headl igh ts on. Pel lecchia f a i l ed to y i e ld to ab i c yc l i s t r id ing southbound on the sidewalk, and the f ron t of h i svehic le impacted with the b i c yc l i s t . Pel lecchia cont inued to dr ivenorthbound with the bicyc le under his vehic le .Sergeant Bar t wi tnessed the b i c yc l i s t being thrown in the a i r andlanding in the cente r thru lane on N SR7. Sgt Bart then got behind thes i l ve r Subaru, and he observed the vehic le make a wide u- tu r n a t the700 block of N SR 7 in to the r igh t th ru lane . I ex i t ed my vehic le as another po l ice veh ic le(Sgt. Bart) pu l led up to the crash scene. I ye l led f o r him to go gethim and po in t ed nor th toward the SUV. Sgt . Bar t con t inued nor th andcaught up to the SUV a t W 7 S t a n d NSR7. Sgt . Bart s topped the SUV inthe 700 block of NSR7. The b i c yc l i s t s tood up and walked out of theroadway. I moved my vehic le to the Burger King driveway and checked onthe b ic yc l i s t who i de n t i f i e d himsel f as Juan Aguirre 3-24-80. Mr.Aguirre s t a t e d he was not in jured however, I requested over po l icerad io for Margate Fire Rescue to respond to check him.Mr. Aguirre t o ld me he was r id ing h i s bicyc le south bound on the e a s ts ide s idewalk of NSR7. He saw the SUV a t the driveway e x i t and thoughtthe d r ive r had seen him. As he began to cross the driveway, the SUVpu l led out s t r i k ing him and knocking him from h is b icyc le .Margate Fi r e Rescue responded and Mr. Aguirre re fused t rea tment fromthem for a sore l e f t elbow. I a l so met with wi tness Robbie M Judkins .Mr. Judkins s a i d he saw the SUV s t r i ke Aguirre and l eave the scene,nor th on NSR7.I responded to the SUV t r a f f i c s top loca t ion and observed the SUV,which was a s i l v e r 2003 Subaru For res t e r FL t ag F819EB. The dr iverwho was l a t e r i de n t i f i e d as Mi tche l l Pe l lecch ia 2-25-63, was s tandingnext to the SUV. Mr. Pel lecchia was the person I had seen dr iv ing theSUV a t the t ime of the crash . After he was a r r e s t e d by Ofc. Blantonfor DUI, I looked in s ide the SUV for the cup I had seen him dr inkingfrom. I did not see a cup, however, I d id observe a Burger King f r enchf ry conta iner t ha t was the same color and s ize as the ob jec t tha t Ithought was a cup.

On Wednesday, 11/28/12 a t 1845 hours , I was t r ave l ing Northbound on NSR 7 a f t e r having j u s t tu rned from W At lan t i c Blvd, in my markedpa t r o l un i t uniformed, en- route to an off duty de t a i l . As Iapproached the en t rance to Burger King, 550 N SR 7, I observed ab i c yc l i s t st ll a t tached to the f ron t of a vehic le tha t had j u s tex i t ed the Burger King park ing l o t . The b ic yc l i s t and bicyc le wereknocked to the ground by the vehic le and pushed almost i n to the l e f tthrough l ane of N SR 7. I d id not see the i n i t i a l impact, only themoment af te rwards . The vehic le then turned Northbound onto N SR 7 andf l ed without stopping. The veh ic le s i l v e r 2003 Subaru Fores te r FLTag F819EB d id not have any l i gh t s on though t was dark outs ide . Istopped momentarily to check on the b i c yc l i s t who picked up h i s bikeand ex i t ed the roadway. I to ld him tha t help was on the way and Icont inued to fol low the Subaru. The dr iver cont inued Northbound andente red the l e f t through l ane on N SR 7. In the 600 block, the dr ivermade a U - t u r n and ente red the r i gh t through l ane Southbound on N SR 7.
