1 BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF G U M

2 Section 1. (a) Legislative intent. The Legislature finds that funds

appropriated by Public Law 20-14 to construct the Inarajan Boat Ramp are

inadequate to complete the project. The Legislature intends to carry out the

mandate of such law and hereby provides for additional funding.

(b) Appropriation. Three Hundred Thousand Dollars ($300,000) are

hereby appropriated from the General Fund to the Department of Public

Works to complete construction of the Inarajan Boat Ramp as funded by

Public Law 20-14.

Section 2. Appropriation for lights. Four Hundred Thousand Dollars

($400,000) are hereby appropriated' from the General Fund to the Department

of Public Works to install lights at the Inarajan High School Baseball Field.

BILL NO. 340

AN ACT TO APPROPRIATE THREE HUNDRED THOUSAND DOLLARS ($300,000) TO COMPLETE CONSTRUCTION OF THE INARAJAN BOAT RAMP AS ESTABLISHED BY P.L. 20-14.

PURPOSE AND ESSENTIAL ELEMENTS.

Bill No. 340 is to provide $300,000 in addition to the $250,000 appropriated in P.L. 20- 14 to construct of the Inarajan Boat Ramp. The original funding was inadequate to complete the project.

PUBLIC HEARING

The Committee on Ways and Means conducted a public hearing on Friday, May 24, 1991 at 1:30 p.m. in the Legislative Public Hearing Room to gather testimony on Bill No. 340. Present at the hearing were the Chairman, Senator Carl T.C. Gutierrez, Chairman of the Committee conducted the hearing, being joined by Senators Doris F. Brooks, Joe T. San Agustin, David L.G. Shimizu, Anthony C. Blaz, Don Parkinson, Ernesto M. Espaldon, and Marilyn D.A. Manibusan.

TESTIMONY

Mr. Sabino Flores offered oral testimony at the public hearing indicating that P.L. 20-14 appropriated $250,000 for the construction of the Inarajan Boat Ramp but that this amount is inadequate, and Bill 340 would provide the necessary amount needed to put the project out for bid. He testified in favor of the bill.

Eduardo C. Paul&o, Acting Mayor of Inarajan testified in favor of the bill. He pointed out that many residents of the southern villages rely on fishing and the fishermen are anxious to launch boats without going to Agana to do so. Acting Mayor Paulino feels that the boat ramp will enhance the fishing activity in the south.

Peter Barcinas, Director of the Department of Commerce, testified in favor of Bill 340. He pointed out that the Department of Commerce is overseeing the development of boat ramps throughout the island in conjunction with federal funding. He also indicated that the design and construction plans are in order and that it can go forward with the additional appropriation.

COMMITTEE RECOMMENDATION.

The Committee on Ways and Means, after due consideration of the testimony in support of Bill 340, recommends to do pass Bill 340, as introduced.

The Department of Public Works fully supports the intent of Bill No. 340 which appropriates $300,000 towards the construction of a boat launching ramp in Inarajan. This proposed funding together with the funds ($250,000) previously appropriated under Public Law 20-14 will enable the department to proceed with the solicitation of construction bids for the project once the necessary permits are secured.

This a c t i o n was necessary pr imar i ly because everybody working f o r t h e Publ ic welfare Programs were i d e n t i f i e d a s Assistance Payment Workers inappropira te ly . The p o s i t i o n desc r ip t ion f o r t h e Claims and E l i g i b i l i t y processors and Medicaid S p e c i a l i s t i s much more than those p r - e s c r i b e d f o r t h e APW Ser ies .

An aud i t was done during t h e period of 12/90 through 2/91 which ccnfirmed o r j u s t i f i e d t h e r e a l l o c a t i o n of pos i t ions . However supervisory p o s i t i o n s one of which I am occupying i s going t o be u n f a i r l y subjected t o t h e Merit Promotion Plan.

I a m here not t o speak only f o r myself but f o r t h e o the r employees who a r e i n t h e same dilemma. We've been i n supervisory p o s i t i o n s and doing t h e job and performing t h e r e s p o n s i b i l i t i e s of t h e p o s i t i m w occupy. It i s going - t o be ur,.fair t h a t now t h a t we have t h e p o s i t i c n by v i r t u e of our knowledge and work experience anu tha t t;,e a u d i t has determined t h a t we a r e q u a l i f i e d a.id art doing t h e job, why n w 11o ve have t o compete f o r our pos i t ion?

The f a c t is, the. government i s saving funds on t r a i n i n 3 p e r s e t ; t h e q u a l i t y of work is maintained, and done accura te ly and on a t imely b a s i s , with us who a r e knowledgeable and experienced i n doing t h e job.

Since t h e c r e a t i o n of p o s i t i o n s was intended t o r e c l a s s i f y personnel based on t h e d u t i e s and r e s p o n s i b i l i t i e s t h a t they a r e doing, and compensation be a l loca ted accura te ly , now t h a t a u d i t has determined us q u a l i f i e d f o r t h e job, why again then, do w e have t o compete f o r our pos i t ions .

Good afternoon Mr. Chairman and members of the Committee on Ways & Means. My name is Eduardo C. Paulino, I am the acting Mayor of Inarajan.

I am here today to testify in full support of Bill 340 which will appropriate $300,000 to complete construction of the lnarajan boat ramp.

I have been advised that an additional amount of $300,000 is necessary to cover the costs of building a boat ramp in Inarajan.

It is generally known that there is a large number of fishermen from the South who rely heavily on the ocean for food for their families, and then there are those who fish for sport. Many fishermen from lnarajan and neighboring villages are anxious to be able to launch their boats without having to go across the island or to Downtown Agana to do so safely.

We are grateful for the efforts being made by the Legislature to enhance the local fishing potential in the South, and commend Senator Shimizu and the co-sponsors of Bill 340 for their sensitivity and care for the people of Malojloj, Inarajan. I urge your support in passing this Bill in order that construction of the boat ramp will commence in the very near future.

Legislature intends to carry out the mandate of PL 20-14 and

hereby provides for additional funding.

Section 2. There is hereby appropriated from the General Fund

to the Department of Public Works the sum of Three Hundred

Thousand Dollars ($300,000) to complete construction of the

Inarajan Boat Ramp as established by PL 20-14.
