2.1. The terms defined in this procedure are defined as follows:

2.2. CERTIFICATION: Written testimony of qualification.

2.3. CERTIFICA TIONAUTHORITY: The person(s) property designated by NEW YORK CITY TRANSIT to sign certifications. This designation shall be in wr~ing and shall be kepi on file.

1.2. Certifications issued prior to the effective date of this revision, shall remain valid until recertification in that method is required. Recertification shall be in accordance with the latest revision of this procedure.

1.1. This procedure establishes requirements for the qualification and certification of NEW YORK CITY TRANSIT NOT personnel and is based on the recommendations of The American Sociely for Nondestructive Testing Recommended Practice SNT· TC-1A 2006 Ed~ion and earlier editions (1992 and 2001).

2.7. EXPERIENCE: Work activities accomplished in a specific NOT melhod under the direction of qualified supervision including the performance of the NOT method and

related activities but not including time spent in organized training programs.

2.8. LEVEL 11/ EXAMINER:A certified NOT Level III individual heving the responsibil~

for preparing, administering and grading the examinations for certification. The Level III Examiner shall be certified for the specific test method.

2.9. OUTSIDE AGENCY: A company or individual who provides 1II0T Level III services and whose qualifications to these services have been reviewed by IIIEW YORK CITY TRANSIT.

2.10. QUAL/FICATlON: Demonstrated skill, demonstrated knowledge, documented training. and documented experience required for personnel to proper1y perform the duties of a specific job.

2.11. SUBCONTRACTOR.- Any organization under contract to NEW YORK CITY TRANSIT to provide nondestructive test services.

2.12. TRAINING: An organized program developed to imparl the knowledge and skills necessary for qualification.

2.13. WRITTEN PRACTICE: A written practice developed by NEW YORK CITY TRANSIT that details the requirements for qualification and certification of their employees.

3.0. REFERENCES

3.1. Unless otherwise specified, the following document forms a plan of this procedure.

3.1.1. SNT-TC-1A 2006 Edition

3.2. In the event of a conflict between this procedure and the referenced document, this procedure shall take precedence.

4.0. GENERAL REQUIREMENTS

4.1. Written Requirements: This procedure shall be used as a written practice for the control and administration of NEW YORK CITY TRANSIT NDT personnel, training, qualification, examination and certification.

4.2. All NEW YORK CITY TRANSIT personnel performing any nondestructive testing shall be trained, examined, qualified and certfied in accordance with this procedure.

4.2.1. The Topical Training Outline is contained in Appendix A of this document

4.2.2. Records of indlvidualtralninq, experience, qualification examinations and vision aculty examinations shall be current and available for audit purposes.

4.2.3. All initial certifications shall be by means of examinations as described in Section 8.0 of this written practice.

4.3. All subcontractors providinq NOT services will make available to NEW YORK CITY TRANSIT a copy of their nondestructive testing personnel qualification and certification program for review and approval.

1---------------L-----------1 4.3.1. NEW YORK CITY TRANSIT will be responsible for reviewing any

subcontractor's personnel qualification and certification records.

4.4. The NOT Level III individual preparing the qualification and certification program, conducting the training, preparing and administering examinations for qualification in accordance with this procedure must be knowledgeable of the procedures, codes and specfications utilized by NEW YORK CITY TRANSIT.

4.4.1. NEW YORK CITY TRANSIT shall be responsible for reviewing and approving any Outside Agency's personnel qualification and certification programs.

5.0. LEVELS OF qUALIFICATIONS

5.1. There shall be three basic levels Ofqualifications in NOT methods.

5.1.1. NOT Level I - An NDT Levell individual shall be qualified 10properly perform specific calibrations, specific examinations and specific evaluations for acceptance or rejection detenninations and to record the results according to written instructions. The NOT Levell shall receive the necessary instruction and supervision from a certified Level II or Level III individual.

5.1.2. NOT Level II. An NOT Level II individual shall be qualified 10set up and calibrate equipment and to interpret and evaluate results with respect to applicable codes, standards and specifications. The NOT Level II shall be thoroughly familiar with the scope and limitations of the methods for which qualified and shall exercise assigned responsibility for on-the-job training and guidance of trainees and NOT Level' personnel. The NOT Level II should be able to organize and report the results of NOT tests.

5.1.3. NOT Level Ill. An NOT Level III individual shall be capable of developing, qualifying and approving procedures, establishing and approving techniques, interpreting codes, standards, specifications and procedures and designating the particular NOT methods, techniques and procedures to be used. The NOT Level III shall be responsible for the NOT operations for which qualified and assigned and shall be capable of interpreting and evaluating results in terms of existing codes, standards and specifications. The NOT Level III shall have sufficient practical background in applicable materials, fabrication and product technology to establish techniques and to assist in establishing acceptance criteria when none are otherwise available. The NOT Level III shall have general familiarity with other appropriate NOT methods as demonstrated by an ASNT Level III Basic examination or other means. The NOT Level III, in Ihe melhods for which certified, shall be capable of lraining and examining NOT Levell and Level II personnel for certification in those methods.

5.1.4. Outside Agency Level III services shall be provided at the request of NEW YORK CITY TRANSIT.

5.2. At the discretion of the NOT Level III, an individual may be qualified for a limited certification in such cases where the individual only perfonns a portion of the NOT operation (i.e., Program or Calibrate UT Equipment Only or Yoke Only). In such cases the training and experience factors specified in paragraph 6,0 or this procedure may reduce as deemed applicable by the NOT Level III. Any reduction I training and experience factors and any limitations to any certification shall be documented and noted on the certification records.

6.0. EDUCATION. TRAINING and EXPERIENCE for INITIAL QUALIFICATION

6.1. Candidates for certification in NOT shall have sufficient education, training and experience to ensure qualification in those NOT methods in which they are being considered for certification.

6.2. Table 1 lists the minimum training and experience factors to be considered by NEW YORK CITY TRANSIT in establishing the initial qualification of Levell and Level II personnel.

6.3. The NOT Level III candidate should satisfy one of the following criteria for the applicable NOT method.

6.3.1. Have graduated from a minimum four-year college or university curriculum with a degree in engineering or science, plus one additional year of experience beyond the Levell! requirements in NOT in an assignment comparable to that of an NOT Level II in the applicable method(s), or;

6.3.2. Have completed with passing grades at least two years of engineering or science study at a university, college or technical school, plus two additional years of experience beyond the Level II requirements in NOT in an assignment at least comparable to that of NOT Level II in the applicable NOT method(s), or;

6.3.3. Have four years experience beyond the Levell! requirements in NOT in an assignment at least comparable to that of an NOT Level II in the applicable NOT method(s}.

6.4. Previous Training and Experience

6.4.1. Where the candidate's work history shows previous NOT training, experience and certification at another employer, the candidate shall be tested to determine the competence to the previous certified level for that particular NDT method.

6.4.2. Previous training and (or) experience may be accepted if verified by the NOT Level III.

6.4.3. Education, training and experience shall be documented on Fonn NDT-011-2; Certificate of NOT Personnel Qualification.

NEW YORK CITY TRANSIT personnel considered for initial certification shall complete sufficient organized training to become thoroughly familiar with the principles and practices of the applicable NOT method related to the level of certification desired and applicable to the processes to be used and the products of being tested.

The training program shall include sufficient examinations to ensure understanding of the necessary infonnation.

Training course outlines shall include, as a minimum, those areas detailed in Appendix A, and additional training topics that are applicable to NEW YORK CITY TRANSIT operation.

NOT training programs shall be conducted by an individual who is a certified NOT Level III in the applicable method or his designated representative, which will include the basic principles and theory of the specific NOT method. The program will also include practical training to help the individual develop the practical skills necessary to carry out the responsibilities of the applicable level of certification.

Initial training and experience factors are shown in Table 1.

8.3.3. Practical Examination - level I

8.3.3.1. Proficiency shall be demonstrated in performing the applicable NOT on one or more specimens or machine problems approved by the NOT Level III and in evaluating the results to the degree of responsibility as described in this procedure. At least ten (10) different checkpoints requiring an understanding of test variables and NEW YORK CITY TRANSIT's procedural requirements shall be included in this practical examination.

8.3.2. Specific Examination - A written examination consisting of questions relating to the equipment, specifications, codes, test procedures, NOT techniques and acceptance criteria the individual may encounter during their work assignments in the applicable method as it pertains to NEW YORK CITY TRANSIT. The minimum number of questions shall be as stated in Table 2.

8.1. To be considered eligible for certification, the candidate shall meet the qualification requirements stipulated in this procedure.

8.3.1. General Examination - A written examination consisting of questions relating to the basic principles and techniques of the applicable NOT method. The minimum number of questions shall be as stated in Table 2.

82. The NOT Level III individual shall be responsible for preparing, administering and grading all NOT examinations for certification in those methods for which the candidate is certified. The NOT Level III may delegate the administration of examination to a qualified representative of NEW YORK CITY TRANSIT; however, the final grading of examinations shall be completed by the NOT Level III. If the administration of examinations is delegated by the NOT level III, it shall be recorded.

8.3. NOT Levell and Level II examinations shall consist of the following:

8.3.4. Practical Examination - Level II

8.3.4.1. Proficiency shall be demonstrated in selecting and performing the applicable NOT technique within the method and interpreting and evaluating the results on one or more specimens or machine problems approved by the NDT Level III. At least ten (10) different checkpoints requiring an understanding of test variables and NEW YORK CITY TRANSIT's procedural requirements shall be included in this practical examination.

NDT Level III examinations shall consist of the following:

8.4.1 Basic Examination - A written examination consisting of appropriate questions to verify that the candidate has knowledge of SNT-TC-1A, materials, fabricalion and product technology and other NDT methods. The examination shall consist of alleast fifty five (55) questions wtth at least:

8.4.1.1. Fifteen (15) questions relating to understanding the SNT-TC-1A document and

8.4.1.2. Twenty (20) questions relating to applicable materials, fabrication and product technology and

8.4.1.3. Twenty (20) questions that are similar to published Level II questions for other appropriate NDT methods.

8.4.2. Method Examination - A written examination covering the fundamentals and test principles of the applicable NOT method. The examination shall consist of at least fifty five (65) questions with at least:

8.4.2.1. Thirty (30) questions relating to fundamentals and principles that are similar to published ASNT Level III questions for each method and

8.4.2.2. Fifteen (15) questions relating to application and establishment of techniques and procedures that are similar to the published ASNT Level III questions for each method and

8.4.2.3, Twenty (20) questions relating to capability for interpreting codes, standards and specifications relating to the method.

8.4.3. Specific Examination - Twenty (20) questions relating to specifications. equipment, techniques and procedures applicable to NEW YORK CITY TRANSIT's product(s) and methods employed and to the administration of NEW YORK CITY TRANSIT's written practice.

Vision Examinations - All NDT personnel shall be given vision examinations to assure visual acuity as follows:

Individuals failing to attain the required grades shall wail a minimum of thirty (30) days prior to retaking the examination.

8.7.2. Color Contrast Differentiation - The examination shall demonstrate the capability of distinguishing and differentiating contrast among colors or shades of gray used in the method as determined by NEW YORK CITY TRANSIT.

a) Near-Vision Acuity intervals shall be conducted upon initial certrtication and annually thereafter.

8.7.1. Near-Vision Acuity - The examination shall ensure natural or corrected near­distance acuity in at least one eye such that the applicant is capable of reading a minimum of Jaeger Number 2 or equivalent type and size letter at lhe distance designated on the chart but not less lhat 12 inches (30.5 cm) on a standard Jaeger test chart. The ability to perceive an Ortho-Rater minimum of 8 or similar test pattern is also acceptable.

8.7.3. Vision examination results shall be recorded on Form NOT-Oll-1 and shall be kept on file for the period of time identified in Section 16.0.

a) Color Contrast Differentiation examination shall be conducted upon initial certification and al five year intervals thereafter.

8.4.4. A valid endorsement of an ASNT NOT Level III certificate or ACCP Professional Level III certificate fulfills the examination criteria described in 8.4.1 and 8.4.2.

Levell, Level II and Level III written examinalions shall be closed-book excepl the necessary data such as: graphs, tables, specifications, procedures, codes, etc., may be provided with or in the examination. Questions utilizing such reference materials shall require an understanding of the information rather than merely locating the appropriate answer. All questions used for Levell and Level Uexaminations shall be approved by the responsible NOT Level III.

9.0. GRADING OF EXAMINATIONS

9.1. The NDT Level III shall be responsible for administering and grading of examinations. The grading of examinations may be delegated to a qualified representative of the NOT Level III Examiner and so recorded; however, the NOT Level III Examiner shall perform the finalgrading and sign off all examination grades. Under no circumstance shall an NOT Level III candidate administer and grade hisor her own examination.

92. NOT Levell and Level II - Examinations administered for qualification shall result in a passing composite grade of a least 80 percent, with no individual examination having a passing grade less than 70 percent.

9.2.1. A composite grade shall be detennined by a simple averaging of the General, Specific and Practical examinations.

9.3. NDT Level 111- A composite grade shall be determined by a simple averaging of the Basic, Method, Specific and Practical examinations.

9.3.1. ASNT Certificate Holders - When an ASNT NDT Level III certificate is substituted for the Basic and Method examinations (see 8.4.4), a grade of 80 percent shall be used for the Basic and Method examinations.

9.3.2. A passing composite grade of a least 80 percent is required for certification, and no individual examination shall have a passing grade less than 70 percent.

10.0. CERTIFICATION

10.1. The certification of all levels of NOT personnel is the responsibility of NEW YORK CITY TRANSIT.

10.2. An Outside Agency may be used to provide NOT Level III services. NEW YORK CITY TRANSIT shall be responsible for the certification of their personnel.

10.2.1. NEW YORK CITY TRANSIT shall assure that the training and examinations provided by the Outside Agency are in accordance with this procedure.

10.3. Personnel records of the certified individuals shall be maintained on fi~ by NEW YORK CITY TRANSIT for reference and shall include:

10.3.1. Name of the certified individual.

10.3.2. Level of certification and NOT method, including limitations.

10.3.3. Educational background and experience of certified individuals.

10.3.4. Statement indicating satisfactory completion of training in accordance with this procedure.

10.3.5. Results of the vision examination for the current certification period.

10.3.6. Current copy (ies) or evidence of successful completion of examinations.

10.3.7. Composite grade(s) or suitable evidence of grades.

10.3.B. Signalure of the Level III that verified the qualifications of the candidate for certification.

10.3.9. Dates of certification and (or) recertification and the dates of assignments to NOT.

10.3.10. Certification expiration date.

10.3.11. Signature of NEW YORK CITY TRANSIT certifying authority.

10.4. A copy of Forms: NDT-011-1, NDT-011-2, NDT-011-3, NDT-011-4, NDT-01 1-5, NDT-Ol1~, (NOT-011-7 and NOT-011-B as applicable) shall be completed for each individual certified and shall be maintained on file.

11.0. TECHNICAL PERFORMANCE EVALUATION

11.1. NOT personnel may be reexamined at any time at the discretion of NEW YORK CITY TRANSIT and to have their certifications extended, suspended or revoked.

11.2. The technical performance of Level I and Level II personnel shall be evaluated by the NOT Level III as requested by NEW YORK CITY TRANSIT.

11.2.1. For personnel applying for recertification by leller, documentation stating satisfactory performance becomes the basis for the recertification letter.

a) Personnelwith unsatisfactory technical evaluations shall require additional training and recertification by examination methods.

11.2.2. For personnel applying for recertification by examination, documentation stating satisfactory performance becomes a prerequisite for request for examinations.

a) Personnel with unsatisfactory technical evaluations shall require additional training prior to request for examinations.

11,3. The technical performance evaluation shall follow the format and guidelines in paragraphs 8.3.3 and 8.3.4.

11.4. The checklist shall be completed by a Level III on Form NOT-Oll-7.

11.4.1. Successful completion of the checklist on Fonn NOT-Oll-7 in the applicable method satisfies this requirement.

12.0. RECERTIFICATION

12.1. All levels of NOT personnel shall be recertified every five (5) years in accordance with one of the following criteria:

12.1.1. Recertification by Leifer. As permitted by the referencing code or specification, an individual may be recertified by Jetter.

a) Levell and Level II Recertification by Letter request, Form NDT-011-8 shall include documentation of the individual's satisfactory performance for the current certification period. Recertification by this method Will be based on a satisfactory review by the NOT Level III. If this option is used. recertification by examination will be required at the next scheduled certification interval. Employees may be recertified by this method if the following are met:

1) Recertification by letter was not used at the previous certification interval.

2) Documentation (Forms NDT-011-2, NDT-011-7, NDT-011-8 and other applicable documentation) is dated prior to the expiration date and is reviewed by the NOT Level III prior to the date of the individual's certification expiration date.

b) The Recertification by Letter Form shall be initiated and signed by the responsible authority of NEW YORK CITY TRANSIT.

Note: Some standards (e.g. military or other government agencies) do not allow recertification by letter. It is NEW YORK CITY TRANSIT's responsibility to ensure that all customer requirements are met.

12.1.2. Recertification by Examination: Where required by the referencing code or specification, qualification examinations, equivalent to those required for initial certification, as described in Section B.D. shall be given prior to recertification. Individuals seeking recertification by examination shall provide documentation of the individual's satisfactory perfonnance for the current period.

12.2. NOT Personnel may be reexamined at any time at the discretion of NEW YORK CITY TRANSIT and have their certifications extended, suspended or revoked.

12.3. Individuals shall be reexamined and recertified when service in a particular NOT discipline is interrupted by a period of six (6) months or more as described in section 8.0.

13.0. INTERRUPTED SERVICE

13.1. Interrupted service includes expired, suspended, revoked or terminated certificates. No person who holds an expired, suspended, revoked or terminated certificate may exercise the privileges of that certificate in which certified.

13.1.1. Certification shall expire:

a) When the certification interval has lapsed with no recertification certrlcate issued. Certification is considered to expire on the next corresponding day after the date of expiration listed on the certificate;

b) At the end of five years for all Levels of NOT.

13.1.2. Certifications shall be suspended:

a) When the near vision acuity examination interval exceeds one year;

b) If, in a period of twelve (12) consecutive months, the certified individual has not performed any examinations in the method certified;

c) When the certified individual's performance is found to be deficient in any manner; or

d) For personnel who hold an ASNT certificate and has not been renewed.

13.1.3 Certifications shall be revoked:

aj When employment with NEW YORK CITY TRANSIT is tenninated.

b) If, in a period of twenty-four (24) consecutive months, (he certified individualhas not performed any examinations in the method certified.

cj When the individual's conduct is found to be unethical or incompetent; or

d) If a suspended certification is not reinstated within twelve (12) months of suspension; or

e) For personnel who hold an ASNT certificate which has not been \ renewed. ~

14.0. TERMINATION

14.1. NEW YORK CITY TRANSIT NOT certifications shall be deemed revoked when employment is terminated.

14.2. Levell, Level II or Level III personnel whose certification has been terminated may be certified 10 the former NOT level by NEW YORK CITY TRANSIT based on examination, as described in Section 8.0, provided all of the following condition are met to NEW YORK CITY TRANSITs satisfaclion:

14.2.1. The employee has proof of prior certification.

14.22. The employee was worl<ing in the capacity to which certified within six (6) months of termination.

14.2.3. The employee is being recertified within six (6) months of termination.

14.2.4. Prior to being examined for certification, employees not meeting the above requirements shall receive additional training as deemed appropriate by the NOT Level III.

15.0. REINSTATEMENT

15.1. Levell, Level II or Level III personnel whose certification has been terminated may be reinstated to the former NOT level, without a new examination, provided all of the following conditions are met:

15.1.1. NEW YORK CITY TRANSIT has maintained the personnel certification records required in Section 10.3.

15.1.2. The employee'S certification did not expire during termination.

15.1.3. The employee is being reinstated within six (6) months of termination.

. The following questions were received and the answers to the questions are hereby made part of the contract:

0.1 Whose responsibility is it to pick up and deliver each truck frame, NYCT or the Contractor?

Ans. 1 The Contractor shall be responsible for pick-up and delivery to and from locations specified in Article 104 of the Specific Contract Provisions. NYCT will be responsible for loading/offloading the frames at the designated pick-up and delivery points.

0.2 On the fabricated truck, in order to repair the motor mount weld failure, will NYCT provide detailed fabrication drawings?

Ans. 2 No, NYCT does not have drawings for the fabricated truckfames.

0.3 Will NYCT provide their historical Magnetic Particle Test data for each truck?

Ans. 3 No, NYCT does not have the historical Magnetic Particle Test data.

0.4 Will NYCT provide traming procedures and dimensions?

Ans. 4 Yes, tram is checked by measuring the diagonal and longitudinal distances between reference points on the axle bearing housing. The truck frame assembly, when loaded through normal load paths, shall maintain the axles parallel to within 0.09 inches (2.29 mm) at the journal center..., and shall limit the difference between diagonally opposed bearing locations to 0.20 inches (5.1 mm). These limits shall apply both at the A WO load

and a load condition of 130% ofAW3. All frames shall have tram marks above and below (where applicable) each journal bearing location, locate within 0.005 inches (0.13 mm) ofthe true position.

Q.5 As NYCT procedures reference "the reduced wall thickness cannot be less than 3/32" of the nominal dimensions", will NYCT be providing data showing nominal thickness?

Ans. 5 Upon award, NYCT will make available additional drawings to the Contractor.

Q.6 To allow bidder to estimate property insurance costs please advise of replacement cost for both a fabricated and a cast truck frame.

Ans.6 The approximate cost for fabricated and cast truck frames range from $150,000-$175,000.

Q.7 Can NYCT please provide the approximate weight of the frames?

Ans. 7 Cast Iron truck frames range from 3,725-4,000 pounds depending on the car class. Fabricated truck frames range from 2,550-4,825 pounds depending on the car class.

Q.8 The Technical Specification, Section 3.1 sites, "Personnel performing Magnetic Particle inspections shall be trained by an experienced certified NDT Level I personnel in accordance with MCD 11-02 requirements." Will NYCT accept trained and qualified personnel under ASNT SNT-TC-IA Magnetic Particle Examination Level II as an alternate?

Ans. 8 No, NYCT will not accept any variation to the established specifications. The Contractor shall comply with the specifications in its entirety.

Q.9 We respectfully request clarification to the scope of work regarding responsibility and cost allotment for ­Receipt, handling, loading and unloading of subway car truck frames at NYCT-Coney Island Overhaul Shop.

Ans.9 The Contractor shall be responsible for the receipt, handling, and transportation to andfrom the Coney Island Shop and/or 201h Overhaul Shop. NYCT will be responsible for loading/ofjloading the frames at the designated pick-up and delivery points.

Q.I0 Can NYCT provide a copy of the attendance sheet?

Ans. 10 Please see attached attendance sheet from the Pre-Bid/Site Tour.

Description: Repair and Return of Subway Car Truck Frames

In accordance with Executive Order No. 177, the Authority requires that all Bidders, Proposers, Contractors and Consultants make the following Certification prior to the award of any Contract or Contract extension.

CERTIFICATION

The New York State Human Rights Law, Article 15 of the Executive Law, prohibits discrimination and harassment based on age, race, creed, color, national origin, sex, pregnancy or pregnancy-related conditions, sexual orientation, gender identity, disability, marital status, familial status, domestic violence victim status, prior arrest or conviction record, military status or predisposing genetic characteristics.

The Human Rights Law may also require reasonable accommodation for persons with disabilities and pregnancy-related conditions. A reasonable accommodation is an adjustment to a job or work environment that enables a person with a disability to perform the essential functions of a job in a reasonable manner. The Human Rights Law may also require reasonable accommodation in employment on the basis of Sabbath observance or religious practices.

Generally, the Human Rights Law applies to:

• all employers of four or more people, employment agencies, labor organizations and apprenticeship training programs in all instances of discrimination or harassment;

METROPOLITAN TRANSPORTATION AUTHORITY VENDOR CODE OF ETHICS

The Metropolitan Transportation Authority has revised its Vendor Code of Ethics (the "Code"), and all Bidders will certify in their Bid as per Paragraph M of the Bid regarding their receipt of the Code, that they will comply with its provisions, and will provide the Code to their employees and will obtain their employee acknowledgment of receipt. Additional information concerning these requirements is contained in Paragraph M. The revised Code has been included in the solicitation documents.

PAYMENTS VIA ACH

The Bidder's attention is directed to ARTICLE 108 PRICE TO INCLUDE / INVOICES AND PAYMENTS / PAYMENTS VIA ACH of the SPECIFIC CONTRACT PROVISIONS, which provides that all payments to the Contractor under this Contract will be made by the MTA Business Service Center ("MTA BSC") via an Automated Clearing House ("ACH") designated by the MTA BSC.

COMPLIANCE WITH SECTION 1269-g OF THE PUBLIC AUTHORITIES LAW

If this Contract includes elements of public work, SCHEDULE L, New York State Contract Provisions - Construction, will be appended. SCHEDULE L has been revised to include provisions implementing Section 1269-g of the Public Authorities Law, which requires both our contractors and their subcontractors to take affirmative steps to notify their employees of the relevant provisions of Chapter XIII of the State Finance Law (the New York False Claims Act) that are designed to protect the public from the filing of false claims and to provide a civil forum to commence actions relating to any such claim. Please be advised that material compliance with Section 1269-g is a material condition of payment for both contractors and subcontractors under this Contract. See ARTICLE 7 of SCHEDULE L for the applicable provisions.
