While the reality is that our public challenge to crossbench Senators to vote to restore the Australian Building and Construction Commission (ABCC) will probably be unsuccessful (at the time we’re going to print, the issue is still to be debated in federal parliament), this national campaign is the most recent example of how we regularly go into bat for the industry and members.

Culminating in extensive front page coverage in the Courier-Mail and papers across the country, we were in complete support of the campaign, which included advertisements and media coverage from Tasmania right up to Darwin. Headlines like ‘Worksite ‘bullies’ hammered’ and ‘Tension builds – construction firms confront dodgy union tactics’ featured around the country and spoke loudly about our cause.

The campaign called on crossbench Senators Lambie, Lazarus, Muir, Wang, Xenophon, Day, Leyonhjelm and Madigan, to vote to re-establish the ABCC.

At a national level, each and every Master Builders association agrees that a vote for the ABCC is a vote for more affordable schools, hospitals, childcare centres, aged care facilities and roads.

On the flip side, a vote against the ABCC will give the construction unions free rein to continue their industrial thuggery to the cost of all Australians.

After lobbying for the return of the ABCC for the past 12 months, we decided it was the right time to make one final attempt to convince the Senate crossbench to stand up for the rights of the community and not give in to the union thugs and bullies.

The reality is that the Gyles and Cole Royal Commissions and the Productivity Commission each concluded that there is an undeniable link between the industrial thuggery of the CFMEU and increased costs of public infrastructure.

We lobbied so strongly on this crucial issue because we believe it is central to ensuring long-term future productivity for our industry.

It was vital for us to join builders around the country and unite with a single voice, and we are proud to have lobbied so strongly on your behalf.

Our vital lobbying role

The recent campaign that saw Master Builders associations from around Australia unite to lobby for the best interests of the industry is a prime example of one of our most important roles as a membership association representing the building industry.

However, we don’t just get involved on the political front.

We are also dedicated to responding to issues as they arise. Our response to the damage wreaked by Cyclone Marcia in Central Queensland is a great example of this vital work we do.

Read more on page 12 about how our team on the ground in Rockhampton recently faced up to one of their biggest challenges and provided advice, support and essential services to the industry and community during the recovery and rebuilding stage.

Politics, like the cycles in our industry, has its ups and downs and the federal government is facing a difficult period as leadership tensions grip the Liberal Party.

But they are not the only ones to feel the pain. Political uncertainty dents fragile business and consumer confidence and holds up investment which, for our industry, is particularly vital.

While Master Builders Australia has little say over the settling of the government’s internal disputes, we have voiced our concern about its impact on business conditions for our members.

We’ve also had much more to say about how the government should shape the May Federal Budget, and its outcomes for our industry.

Front and centre is the urgent need for a more pragmatic budget reform agenda to arrest the slide in business confidence. Rebooting confidence will help to create prosperity in our industry and generate economic growth, investment and jobs, which are needed to fill the gap left from the retreating resources boom.

Our industry is a proven catalyst for kick-starting economic activity, given its multiplier effects, and must play a significant role if the economy is to successfully rebalance. But while the housing sector is generally performing well, the commercial building sector continues to suffer from a lack of confidence and investment.

missing link and Master Builders’ Survey of Industry Conditions confirms this.

But there can be no positive change in outlook while the legislative difficulties in the Senate continue, and Master Builders has made it clear to the government that this cannot be allowed to continue. The budget must be a circuit breaker.

We have pleaded with the federal government and the Treasurer to be more pragmatic with the nature and timing of measures to repair the budget.

There is a looming structural budget deficit and it must be fixed to effectively respond to the challenges set out in the recently released Intergenerational Report.

If the past 12 months has proven anything, it is the difficulty of the political challenges facing the government. Convincing the community of the need for action to tackle a problem which won’t be fully felt for a few years, while maintaining confidence, is a big ask.

The message to the Federal Treasurer in Master Builders’ pre-budget submission reflects our confidence in the fundamentals of the Australian economy, our concern about instability in the government and the need for it to implement pragmatic reforms to ensure the government delivers a circuit breaker budget in May.

In the submission we have called on the government to:

• Reconsider the timing and architecture of budget repair measures

• Introduce short-term tax incentives for commercial builders and other businesses

• Ensure realistic and responsible fiscal management

• Retain the tax exempt status of home ownership and negative gearing

• Provide greater investment in more productive forms of infrastructure

• Productivity boosting workplace relations reforms, such as the re-establishment of the ABCC

• Make the building and construction industry a ‘priority industry’ for the Industry Skills Fund, including maintaining the level of government investment in apprenticeships and skills acquisition, while making this expenditure more efficient and targeted to industry needs. This will involve introducing target financial and increase incentives and assistance to employers to take on new apprentices and review current pathways into trades.

• Implement recommendations for reform of the 457 visa system set out in the report of the Independent Review of the 457 visa system: Robust New Foundations: A Streamlined, Transparent and Responsive System for the 457 Visa Program.

• Adopt a national housing affordability agenda and take up the opportunities presented by the White Papers on Taxation and Reform of Federation.

When it comes to non-compliance in our industry, the Queensland Building and Construction Commission (QBCC) has to flex its regulatory muscles when required; but I’d much prefer to help licensees and contractors to be compliant, than punish them.

I’d rather be commending licensees for the quality of their work and their compliance with the law, than issuing demerit points and fines, or suspending and cancelling licences.

I don’t shy away from our responsibility as the regulator to be the tough guy when necessary but we’ve also always maintained a role as educator and helper to the industry.

We’ve improved the way we do business in these areas, and will continue to enhance our information delivery and the way we perform our role for our stakeholders, from licensees and contractors to home owners and suppliers.

As part of this, we now publish a weekly Disciplinary Action Report on our website. The report includes a list of suspended and cancelled licences, licensees who have not paid debts and other information.

As I mentioned above, the Commission prefers to work with licensees to help them achieve compliance rather than punish them, and we did that during our amnesty for Notifiable plumbing works, which ended on 31 March.

Compliance over disciplinary action

The amnesty was offered to plumber and drainer contractor licensees who had not submitted Notifiable work registrations (Form 4s or Form 4As) for work undertaken since 1 November 2012.

Through the amnesty, we helped a Brisbane plumber avoid potential fines of $350,000 after he admitted he’d failed to lodge more than 600 Form 4s’ for work undertaken over the past two years.

We came to an agreement that he’d lodge the outstanding forms and pay the appropriate fees, which came to more than $15,000.

Whenever possible, we’ll help you to find a solution to any compliance issues, rather than wielding a big stick.

However, sometimes we need to do just that to protect consumers against unscrupulous and unlicensed individuals, and to ensure licensees are competing in an even playing field.

For example, we recently detected an unlicensed individual performing fire protection work at a community centre. The man, and the company that employed him, were eventually fined a total of $10,250 for breaching the QBCC Act.

An unfortunate fact of this case was that the employee was previously licensed to perform this work but had decided not to renew his licence.

We always urge our licensees to seriously consider whether it’s really worth letting their licence lapse. There’s almost always going to be a time when you’ll need to use your skills again – for yourself, your family, your friends, or in this case, for a new employer.

It’s at those times you’ll wish you still had your licence. You worked hard to get it, so you should think hard about letting it go.

This significant honour is one of the highest recognitions an Australian can get for outstanding achievement and service. 

John has been acknowledged for his lifelong and selfless commitment to the construction industry in Queensland, frequently going above and beyond his employment responsibilities to give back to the people and communities in which he lives and works. In that regard he has set a benchmark for us all.

In his career, John has contributed to the construction industry and the wider community through his professional appointments and his voluntary participation of boards and industry committees, including Master Builders, Construction Training Centre (CTC), Queensland Building Services Authority (QSBA), and the Australian Institute of Building (AIB), just to name a few.

He has also led and participated in a number of disaster recovery task forces, including the Mackay Flood Recovery Task Force and the South East Queensland Storm Recovery Task Force after major flood and storm events in 2008.

This is only a small glimpse into the achievements that have led John to receiving this award.

His success has been accomplished with the unwavering support of his wife Christine. Together John and Christine form a steadfast partnership.

Master Builders congratulates John on this wonderful and well-deserved achievement.

Construction heavyweights join forces on major sustainability initiative

In a unique industry collaboration, a number of construction and infrastructure companies are working together to improve industry standards and promote their shared vision of a more sustainable supply chain with the launch of the Supply Chain Sustainability School in Australia.

Leveraging the standout success of a similar model in the UK, the School is launching an online self-assessment tool for businesses, e-learning modules and a resource library – addressing topics such as waste, water, carbon and energy, environmental management and climate adaptation.

The Australia-wide industry-led initiative is being launched by eight founding partners – John Holland, Mirvac, Stockland, Downer Tenix, McConnell Dowell, Infrastructure Sustainability Council of Australia, DuluxGroup and Laing O’Rourke – with additional funding and support provided by NSW Government, Sustainability Victoria and Construction Skills Queensland. The School is being delivered by the Net Balance Foundation, with support from Ernst & Young.

According to CSQ’s CEO, Brett Schimming, the trend towards doing more with less will not only reduce the industry’s impact on the environment but will also drive affordability for customers and cost reductions for business.

John Holland’s Group Manager for Sustainability and Co-Chair for the School, Renuka Sabaratnam said there is a growing expectation that construction and infrastructure projects will be built in a sustainable manner and in line with international best practice. 

“The Supply Chain Sustainability School has been set up in Australia to provide training and resources to ensure the broader supply chain has a common understanding of best industry practice.”

Mirvac’s Procurement Manager for Construction and Co-Chair for the School, Roderick Petre, said the founding partners are encouraging their supply chains to engage with the School to benefit from the training and wide range of free resources available.

“As well as addressing some obvious knowledge gaps, the School offers a unique and innovative way for the construction and infrastructure industry to work collaboratively to educate our contractors and suppliers, and to enhance the efficiency of the supply chain,” he said.

The School is inviting industry suppliers, particularly Small to Medium Enterprises (SMEs) including smaller contractors, suppliers and service providers, to complete the online training for a better understanding of sustainability standards for the industry.

The School is a national initiative with a commitment to leading the construction and infrastructure industry into a brighter, more sustainable future.

Key safety leaders to gather in Brisbane

More than 2,500 decision makers from workplace health & safety (WHS), operations, maintenance, technical and engineering backgrounds will gather in Brisbane on 22–23 April for Safety in Action.

This workplace health and safety event will feature an exhibition with more than 80 exhibitors and a unique seminar program at the Brisbane Exhibition and Convention Centre.

It’s estimated that work-related injuries cost the Australian economy more than $60 billion a year, specifically impacting small businesses. The event will explore the latest in work health and safety measures, as well as discuss how to minimise the economic burden of work-related injuries.

Mental health and wellbeing will be a key focus of the seminar series, which will feature an impressive line-up of industry professionals discussing the 2015 theme ’Realising proactive safety methods to encourage workplace health and wellbeing‘.

One of these speakers is Sally Kirkright, CEO of AccessEAP. Here’s a sneak peek of what she will talk about:

“Recent studies have highlighted why organisations need to be paying particular attention to wellbeing and mental health as the cost of not doing so is significant. Absenteeism and presenteeism amounts to six and a half lost days a year, costing businesses at least $1,500 per employee per annum.

Managers and leaders need to focus on what wellbeing is and what causes stress or contributes to wellbeing, and then learn what they can do in the workplace to achieve this.

OHS Harmonisation Laws states that organisations need to be responsible for both physical and psychological safety, so we need to encourage organisations to take a proactive approach to improving the mental health of their employees.

One in five people will experience a mental health issue in their lifetime. The National Mental Health Commission has recently established the Mentally Healthy Workplace Alliance to encourage Australian workplaces to become mentally healthy.

In male dominated industries, such as construction and material handling, a culture exists where men are not being encouraged to talk about their problems and feelings. The impact of stress on wellbeing is not being discussed or recognised in these industries. I hope to increase awareness of mental health in the workplace and get companies talking about it and understanding the cost to the business.

I would also like to show how implementing some basic strategies can have a great impact of employee mental health. We need to raise awareness to help de-stigmatise mental health. Happy employees are productive employees which in turn benefits the organisation.”

Are you interested in offering a former Australian Defence Force (ADF) member a work experience placement that could assist them in developing skills and preparing them for suitable civilian employment?

The Department of Veteran Affairs (DVA) is looking for employers from any industry who may be interested in doing their bit to support an injured former ADF member to return to the civilian workforce.

The DVA provides support to injured former members of the ADF, including the provision of rehabilitation initiatives and assistance in their transition to civilian work. This can include vocational assessment and training, work preparation activities and work experience with suitable employers.

There are extensive benefits to having a former ADF member join your business for either a work trial or permanent employment.

ADF members acquire a broad range of skills through their military service and training that are transferable to civilian employment. These include their ability to learn new skills quickly, communicate effectively with staff of all levels, complete tasks efficiently and on time, work independently or as part of a team, demonstrate leadership and take personal responsibility, and work with a variety of people from different backgrounds and with varying levels of experience.

During the work trial, DVA will continue to pay the former member an income replacement payment. The employer does not make any contribution to the participant’s pay; however, the employer is responsible for fulfilling their usual obligations under work health and safety laws.

Following the completion of the trial, the employer can offer ongoing paid employment to the participant.

Intergenerational report releasedThe Intergenerational Report 2015 released recently by the Australian Government outlines the challenge of encouraging greater participation in the workforce as Australians live longer and healthier.

In the wake of one of the region’s worst natural disaster in years, the Master Builders’ team in Central Queensland has responded to the disaster with much-needed advice, support and essential services. Master Builders plays an important role in these kinds of situations and our response to Cyclone Marcia is indicative of the important role we play.

Master Builders’ Central Queensland Regional Manager, Dennis Bryant, said that it’s easy to feel helpless and overwhelmed in these situations, but the team has focused on getting on with the job and offering practical and useful advice relevant to the situation.

“We obviously don’t play any significant role during the disaster recovery mode – that’s the job of the SES and other government agencies, like the Queensland Building and Construction Commission and Work Health & Safety Queensland, who did a fantastic job to deploy staff to the region quickly and proactively.

“However, it was once the recovery phase was underway that we quickly realised the kind of support and advice the industry and community needed. We fielded a lot of initial questions relating how to get damaged areas cleaned up so that repairs and rebuilding could get underway quickly.

“Once we had our own office back up and running, we armed ourselves with the right information needed by the industry and home and building owners. We mainly responded to questions about the right process for having rebuilding and repair work done, the correct contracts to use, waiver notices and cooling off periods, and the insurance process.

“When asbestos was detected in some buildings, an issue that was reported extensively in the media, that situation added a level of risk that no-one needed. However, it’s obviously not something that can be ignored and we had to respond quickly.

“We worked very hard, in conjunction with one of our important industry partners, CSQ, to fast track some additional asbestos training courses, and have since trained more than 50 industry participants to ensure asbestos could be removed safely and legally.”

With the rebuild and repair stage of Cyclone Marcia now underway, Master Builders’ team on the ground in Central Queensland have been working hard to respond to industry and community needs.

Dennis adds that while the damage sustained was obviously significant, the region was fortunate that they didn’t also have to contend with flooding.

“The damage is extensive enough as it is, without adding the complexity of dealing with flooding into the mix. Unfortunately, our friends in Biloela weren’t so fortunate, so we are trying to offer assistance to them where we can also.

“Our focus now is to help the industry and community rebuild and hopefully get back to normal.”

Good times ahead for residential construction

The result was a record and the first time approvals in Queensland have ever broken through the 5,000 dwelling mark for a single month.

Drilling down to a regional level shows that the spike can be largely attributed to south east Queensland, with the surge of 47.8% over the month almost entirely due to significant growth in approvals for multi-unit residential construction on the Gold Coast.

While it’s impossible to say for certain at this stage, we are confident the spike is associated with infrastructure for the Gold Coast Commonwealth Games, which is the most significant project in the region at present.

Putting the Gold Coast figure aside (where an astounding 568.5% growth was recorded for the month), there was still a strong rate of growth in January, with the figures overall representing a good start to

2015 and a significant improvement on the two previous months which had been relatively quiet.

Greater Brisbane and the Sunshine Coast also showed strong improvement, growing by 7.2% and 13% respectively and Wide Bay also bounced back with growth of 26.3% after a quiet December.

Elsewhere in the state saw approvals slow, with Cairns and Townsville experiencing a sluggish start to the year, dropping by 15.1% and 12.1% respectively, on the back of a busy 2014.

Unfortunately, there is still no good news for the resource regions of Central Queensland and Mackay, which both fell once again.

However, despite the slowing of growth in the regions, we stand by our positive forecast that there are good times ahead for the residential sector in Queensland.

The latest Queensland building approvals figures broke the 5,000 dwelling mark, representing a massive 47.8% increase for January.

Judging processOnce all entries have been received, the judging process can begin!

First, you will be allocated a judging time – Master Builders will contact you to advise your allocated inspection time.

We receive lots of entries and only have a short period of time to view them all, so we appreciate your cooperation. Flexibility around judges’ inspection dates and times is limited; however, we will endeavour to give as much notice as possible to allow for arrangements with staff and building/home owners.

Next, our independent judges will inspect and judge your entry according to Master Builders’ judging criteria. Then the judges will deliberate and choose a winner for each category.

From July through to August, the regional winners will be announced at each regional award ceremony. Don’t forget to purchase tickets to your regional awards ceremony, where you can enjoy a night of great food, entertainment and atmosphere, celebrating the wins of your industry. Invitations will be out soon.

Regional winners will then be short-listed by a panel of judges and re-evaluated against all other regional winners for the state awards.

State winners will be announced at the State Housing & Construction Awards at Brisbane City Hall on Friday, 9 October.

WHS goes digitalMaster Builders is excited to be making a range of our workplace health and safety documents more easily accessible and user-friendly.

We have long helped members manage their workplace safety by providing legally required documents, such as safe work method statements and work, health and safety management plans, on disc.

The discs were the best way for builders and subcontractors to meet their obligations. However, they were hard to update with changes to legislation and were difficult to personalise for individuals.

Over the past six months Master Builders has updated and moved the safety documents to eDocs, where they can now be created easily, faster and more intuitively.

The Commercial WHS Management Plan, with its combined suite of around 30 supporting documents, is the newest addition to the safety suite of documents on eDocs, which also includes the Residential WHS Management Plan and Safe Work Method Statement template and their associated supporting documents.

The WHS management plans are largely written for the user, providing the details required by legislation or industry best practice, but allowing room for movement so the principal contractor can customise the plan to the project.

Further, the Safe Work Method Statement template allows members of all trades to fulfil their obligations, as required, for all tasks that are considered high risk construction work or as deemed appropriate by principal contractors.

While Master Builders does not write complete documents for use, as we encourage active engagement in the development of safety documentation and consultation with relevant stakeholders, such as employees and subcontractors, we are happy to provide advice on the kinds of information that needs to be incorporated.

Legislation requires principal contractors to have a WHS management plan for all work in excess of $250,000. However, we suggest having a plan for as many projects as possible, as it is an easy way to help manage the safety of the site and ensures that relevant parties are aware of the expectations, procedures and policies prior to the start of works.

All safety documents on eDocs can be accessed 24/7 online, which allows for completion and revisions to be finalised as required and either emailed to subcontractors or principal contractors (in the case of safe work method statements), printed or saved.

The documents are a true working document that can be changed as the project progresses.

The interactive nature of the documents also means that they can be co-branded with the Master Builders logo and your business logo, while photos of the site can also be incorporated into the plans (where an upload is called for).

When members login to eDocs, they can view a listing of any changes to the documents, based on updated to legislation or industry best practice, meaning new documents will also be current.

The overall cost of the WHS management plan and safe work method statement templates covers access to the 30 supporting documents, which are also accessible by all members.

These supporting documents allow members to show that they are managing safety and are an essential tool for recording health and safety on site.

When and why did you get involved in the industry?

I became involved in the industry in January 1994 as an apprentice bricklayer/block layer. I took on the apprenticeship as I wasn’t interested in doing more study after completing year 12, and my family wouldn’t let me join the family cray fishing business in the Torres Strait without a trade or a degree behind me first.

What company do you work for, and what is your role there?

I’m self-employed as a bricklaying /block laying subcontractor in Cairns and have recently started a local temporary lintel hire business called Arch Template Head Hire. This is a franchise of the Townsville-based business. It was pretty full on trying to get a business off the ground whilst doing the Cert IV.

Where did you grow up?

I was born in Cairns, and grew up there and in the Torres Strait. I did most of my schooling in Cairns and spent school holidays on Thursday Island, working in my grandparent’s general store/bakery and family cray fishing business.

Have you done any other training courses with Master Builders?

Yes, I did the Electrical Testing and Tagging course, which in the long run has saved me a lot of money as I’ve been able to tag by own tools.

See where the CERT IV can take youThe latest Certificate IV in Building & Construction course has just wrapped up in Far North Queensland and we were interested to see what our students have taken out of it. Here’s Cairns local, Joseph Christopher’s thoughts on how the course can help tradies.

Why did you decide to enrol in a Cert IV course?

I tried to do the full course by correspondence when I was an apprentice in 1995 and found it quite difficult managing the course workload, so I decided to pull out. When the course was offered face-to-face and within such a short time frame, I decided that I needed to complete something I started a long time ago.

What were the most challenging and rewarding aspects of the course?

The contract section of the course is quite full on, and the assessments for it were very hard and time consuming. The most rewarding part was definitely finishing the course!

What would you say to tradies who are thinking about completing their Cert IV?

Give it a go! But you may have to slow down on weekend activities for a while as it does take up a lot of time for the eight months or so.

Any advice on the process/things you wish had been told to you?

Keep on top of your assessments. The course is full-on, but it does give you a great overall view of where your responsibilities lie when you become a builder and shows you what you will have to deal with when you are out there building houses for the public.

It also highlights your legal responsibilities in all aspects of the building game. The variety of trainers with many years’ experience in the industry and their different backgrounds also gives you insight into the building industry and where it can take you.

My first job was…

With Ansett Australia. I started my apprenticeship as an Aircraft Structural Maintenance Engineer in Melbourne. The opportunity arose to complete my apprenticeship in Brisbane. The plan was to finish my apprenticeship and move back to Melbourne. However, plans change and I met my, now, wife and continued my employment in Brisbane until their collapse in 2001. I worked for Ansett for over 11 years.

I love my job because…

It gives me satisfaction. When I initially attend to quote for a customer to find out their exact needs for the job, during the consultation period and then at the final building stage, I am there every step of the way. That’s what sets our business apart, we don’t subcontract our work out.

If I wasn’t in fencing construction I would be…

Making pizzas. I love cooking and have always dreamed of owning my own pizza and pasta restaurant – Pucci’s Pizza and Pasta Restaurant.

In my spare time I…

Love to go camping, boating, fishing and 4WDing. We are heading up to Cape York later this year and looking forward to combining all my interests in the one go!

I’m having trouble with cash flow, mainly because I’m waiting on payment for a big job. What can I do?

One of the biggest causes of financial problems amongst tradies is not getting paid on time. We find that in many cases, there is usually a simple remedy for getting payment through on time – from ensuring your contract documentation includes the correct payment provisions, right through to just knowing your rights and the correct process to follow to ensure payment is made.

I think the job I’m working on is about to turn ugly. Can Master Builders help me if there is a dispute?

Often, disputes arise because of a lack of communication or documentation and can be resolved informally.

A company and one of its employees have been fined a total of $10,250 for offences relating to the unlawful installation of fire protection at a Brisbane community centre.

The Queensland Building and Construction Commission (QBCC) action followed an audit of fire-protection installation at building sites around Brisbane.

Fire protection licences have been required since 2011, in line with the findings of a report into the Palace Backpackers Hostel fire in Childers in 2000, when 15 people perished.

This penalty is a reminder to companies and individuals that fire protection is a serious matter and must always only be undertaken by appropriately licensed entities.

During a compliance audit, QBCC inspectors interviewed a man performing fire-protection work at a Brisbane community centre. Their subsequent enquiries revealed that he did not hold the appropriate licence for the work.

The employee eventually pleaded guilty to one count of unlawfully carrying out fire protection work and was fined $2,750.

The company pleaded guilty and was fined $3,000 in Magistrates Court in November 2013 to one count of a breach of section 42D of the QBCC Act. That is, as a licensed contractor, the company engaged or directed an employee

to carry out fire protection work, where the employee was not authorised to do so.

However, the Commission successfully appealed that decision in District Court, and the company was subsequently fined $7,500 for the same offence in September 2014.

Who can request flexible working arrangements?

Under the Fair Work Act 2009 (the Act), full-time employees can request flexible working arrangements (such as changes in hours, patterns or location of work) if they:

a) Are a parent, or have responsibility for the care, of a child who is of school age or younger

b) Are a carer (within the meaning of the Carer Recognition Act 2010)

c) Have a disability

d) Are aged 55 years or older

e) Are experiencing violence from a

How must a request be made and what action must I take?

When requesting flexible working arrangements an employee must make the request in writing and include:

• Details of the change, and

• The reasons for the request.

If you receive a request of this kind from one of your employees, you must consider and provide a written response within 21 days,

confirming whether you have approved or refused the change in working arrangements.

A request for flexible working arrangements may only be refused on ’reasonable business grounds’.

What are ’reasonable business grounds’?

Reasonable business grounds for which a company may reject a request for flexible working arrangements include:

• The new working arrangements would be too costly for the employer

• There is no capacity to change the working arrangements of other employees to accommodate the request

• It would be impractical to change the working arrangements of other employees or recruit new employees

• The new working arrangements would be likely to result in significant loss in efficiency/productivity, or

• The new working arrangements would be likely to result in a significantly negative impact on customer service.

By setting these boundaries the Act appears to accept that there will be some cost or some loss in efficiency for providing flexible work arrangements.

However, it further suggests that this cost or loss in efficiency should not deny an employee the opportunity for flexible working arrangements, unless the impact on the business is ‘significant’.

As a result, other criteria, such as the size of the business (and ability for it to absorb variations in available labour), the skill set, level of seniority of the employee and the nature of the work should also be taken into account when determining the practicalities of this type of request.

The changes, which came into effect from 9 December 2011, allow a building certifier to rely on competent persons to help inspect all aspects of the footing stage. The changes also include a requirement for competent persons to have specific qualifications for particular aspects. Mandatory stage for footings:

Footing stage – after excavation of foundation material and before footings for the building are laid.

A building certifier can accept inspection help for all aspects of the footing stage. Aspects relating to boundary clearances must be inspected by a cadastral surveyor. The reinforcing of the steel in the footing system must be inspected by a registered professional engineer.

There is confusion involving the role of the cadastral surveyor. The problem seems to arise when the builder presumes the set-out certificate only refers to the set-out of the building when in fact the certifier most likely requires confirmation of the boundary clearance to the building.

Therefore the builder needs to ensure they clarify with the certifier if they need evidence of the boundary clearance because they will

require a cadastral surveyor to undertake the inspection for this aspect.

Other mandatory stages (as described in the Building Regulation 2006)

Slab stage – is after the placement of the formwork and steel for the slab, but before the concrete for the slab is poured.

Frame stage:

1. To the extent the bracing for the frame of the building consists of cladding or lining, after the cladding or lining has been fixed to the frame

2. To the extent the bracing for the frame of the building does not consist of cladding or lining, before the cladding or lining

3. If reinforced masonry construction is used for the frame of the building, before the wall cavities are filled.

Final stage (at the completion of all aspects of the works)

Always ensure the person who is undertaking the inspection is a competent person approved by the certifier, who can provide the builder with a Form 16. If in any doubt, clarify this with your certifier at the start of the job.

Owners expect construction will cost more and take longer than promised because of design discrepancies and latent conditions. If this is true, then there is an opportunity for builders to offer a higher price for a Warranted Lump Sum as an alternative to a hard dollar build-only contract.

For builders, this is a huge leap because they sit in a highly price-competitive market and, experience says, build-only contracts are always decided on price.

Tradition dictates that resolution of design inconsistencies is not a reasonable risk for a builder to carry without novation of the designers. But the establishment of Building Information Modelling (BIM) as a robust Virtual Design and Construction (VDC) process means under-pricing of risk should be a thing of the past.

Fast and reliable tools now exist for interrogation, validation and review of extensive design information. BIM is a tool that provides the greatest level of certainty the industry has ever known and at all levels of design and construction.

If adopted early, with the entire supply chain engaged, it becomes a critical tool in managing risk and cost overruns during construction. Yet, builders continue to offer the same marginalised product.

Warranted Lump Sum – head contractor risk and return

Typically, 83% of a contractor’s price is made up of the subcontracts, and controlling time and cost will generate significant savings. Our

goal must be to bring decisions forward when the ability to change elements is high and the risk to the programme and to budgets is low.

BIM and the technology supporting every member in the supply chain have a direct impact on creating cost, design and time certainty.

Poor risk estimation and management should be a thing of the past. Builders have a unique opportunity to take on known risk, push the project program, and create a virtual build to identify clashes and design changes much earlier and for much less than dealing with problems during construction where rework, delay and disruption explode costs.

The builder that masters VDC can offer a higher alternative price for a Warranted Lump Sum in lieu of a traditional lump sum.

The alternative could be as simple as altering the standard clauses that appear in most hard dollar contracts and entitle the builder to additional payments for:

• An inconsistency, ambiguity or discrepancy in a contract document; and

• A material difference in a physical condition to that which could be anticipated by a reasonably competent contractor.

Build-only contracts continue to be the construction industry’s biggest deterrent to delivery of better and leaner buildings, with greater certainty.

What about subcontractors and the supply chain?

With traditional design + bid + build procurement there is no ability to engage with subcontractors during design, other than some limited interactions driven by progressive designers.

One approach is to go back to the nominated subcontractor (NSC) clauses which were common in the 1980’s in Australia. With the advent of BIM those NSC clauses are likely to have far more upside than downside.

With design + construct there is a greater ability to engage subcontractors during design, but there is no contractual obligation.

The issue is more about culture. Often the behaviour is to avoid letting a subcontract early because there is a perception that a better financial outcome will be achieved by maintaining competition for as long as possible.

This means that any head start is lost because subcontractors are unlikely to hand over information and expertise without a guarantee that the subcontract will be won.

Knowledge and understanding of the certainty offered through early collaboration is the missing ingredient here, not so much the contractual frameworks.

There are plenty of design and construct (D&C), construction management (CM), early contractor involvement (ECI) and alliance contracts that can accommodate early involvement of subcontractors.

The problem lies in the appropriate level of risk taken on by the head contractor. Traditionally, risk has been shifted down the chain of supply, which results in tight margins for head contractors and less incentive to become immersed in the virtual build.

The first builder to own the risk and become famous as Australia’s “BIM Builder” stands to gain significantly, not only in the successful delivery of their projects but in the increase in profit margins in correctly identifying the level of risk prior to allocating any risk to subcontractors.

The amending legislation [1], which was passed on 15 October 2014, confirms that the Act will apply to engineers outside Queensland who provide engineering services in relation to Queensland-based projects. The Act commenced by proclamation on 10 November 2014.

The requirement to be registered

Under the Act [2], a person who is not a registered professional engineer must not carry out professional engineering services, unless that person carries out the professional engineering services under the direct supervision of a registered professional engineer.

The Act does not currently have extraterritorial application. As such, it is unclear whether the requirements of the Act extend to engineers performing professional engineering services outside Queensland in relation to projects carried out (or to be carried out) in Queensland.

The amended position

The amendment Act will clarify this position by inserting a new section [3] which provides that the Act applies both within and outside Queensland.

According to the Explanatory Notes, this amendment is specifically intended to clarify that engineers who provide professional engineering services outside Queensland for the purposes of Queensland-based projects must be registered under the Act (or be appropriately supervised).

Consequences for engineers

Under the Act, an individual engineer performing professional engineering services bears the risk of ensuring he or she is appropriately registered or supervised.

Consequences for contractors

All engineers within Australia will now need to ensure they are registered in accordance with the Act, or are supervised by an appropriately registered person, before providing professional engineering services in relation to Queensland-based projects.

A failure to do so may result in an engineer being unable to recover payment for the performance of those services. [4]

Further, if a contract for a project in Queensland contains (as most do) a clause requiring the contractor to ‘comply with all applicable laws’, that contractor will need to ensure that all engineering work performed pursuant to the contract is performed by an engineer registered (or supervised) in accordance with the requirements of the Act.

The greatest challenge for builders, however, is ensuring the lighting solution specified for residential or commercial projects strikes a balance between aesthetics, and reducing energy and maintenance costs.

LED lighting supports achieving this important balance desired and expected by purchasers and lessors, but also makes a critical contribution to achieving compliance with Australian building regulations and standards associated with energy efficiency.

Energy efficiency The final energy efficiency of any lighting system depends on more than the efficacy of the light source itself. It is important to consider the entire system: the efficiency of the LED device itself (source efficacy); and how well the device and fixture work together in providing the necessary lighting (luminaire efficacy).

Because LEDs are sensitive to thermal and electrical conditions, they must be carefully integrated into lighting fixtures. The efficiency of a poorly designed fixture that uses even the best LED will be only a fraction of what it would be if the fixture were well designed. Use metrics such as watts per square metre (W/m²) to compare LED lighting solutions, as this takes into account all of the components of the LED system and the system design.

Light output Light output is an informal term for how much light a fixture produces, and how the fixture emits and distributes that light and has a critical impact on lighting compliance to Australian regulations and standards.

The formal term for data describing the quantity and distribution of the visible light produced by a light source or fixture is photometrics.

For a number of reasons, lumen output is not the best measurement of an LED lighting fixture’s capabilities. In fact, evaluating an LED lighting fixture solely or primarily on the basis of its lumen output can underestimate or otherwise give a distorted picture of the fixture’s performance and suitability for a given task or application.

Instead of lumen output, the best and most relevant measurement for evaluating LED lighting fixtures and for making accurate comparisons with other LED or conventional lighting fixtures is ‘delivered light’.

The formal term for measurements of delivered light is illuminance. Roughly speaking, illuminance is the intensity of light falling on a surface area. For areas measured in square metres, the unit of illuminance is lux (lx).

Compliance In Australia, minimum energy performance standards (MEPS) apply to lighting products, such as fluorescent ballasts, linear fluorescent lamps, incandescent lamps (tungsten filament, tungsten halogen lamps), compact fluorescent lamps, ELV lighting converter/transformers and mains voltage reflector lamps including halogen (PAR, ER, R type lamps etc.).

MEPS and energy rating label requirements are reviewed on an ongoing basis to ensure they keep up with advances in technology. Currently, there are no minimum energy performance standards (MEPS) requirements for LED components and luminaires. MEPS for LEDs are currently being developed.

Although there are currently no MEPS for LED, there are other safety requirements, which are applicable. The Australian government requires that all imported or locally produced electrical and electronic equipment comply with electromagnetic compatibility (EMC) emission requirements. Compliant products must bear the C-Tick logo.

Plan for lighting Lighting has a critical impact on the aesthetics and functionality of a building, not only on a building’s energy consumption. Planning for lighting enables builders to take into consideration the purpose of a building, and for the most part, buildings exist as a space for human interaction and experience.

For these reasons lighting should be considered during the initial design phase of a new build or major retrofit, rather than at the point of installation.

Lighting: an introduction to LED Since its invention in 1963, LEDs have become highly evolved lighting solutions that offer excellent efficacy, usability and reliability.

This is particularly the case when considering incorporating controls into a project for lighting or HVAC. Use of lighting control systems can significantly impact on wattage allowances under the Building Code of Australia and on whether or not a project, for example, qualifies for voluntary energy efficiency ratings and government grants.

BCA energy efficiency requirements The Building Code of Australia (BCA), specifically Part J6 – Artificial Lighting and Power, outlines energy efficiency requirements for lighting in residential and commercial buildings.

In 2010 the BCA introduced considerable changes to what is permitted in relation energy consumption from lighting per square metre of floor space. Concessions relating to consumption are available if certain lighting controls are used and vary depending on

both the lighting design and hardware incorporated into the project. The changes to the code ensure that more energy efficient types of lighting are used in order to reduce unnecessary energy use. An LED may be 4 to 5 times more efficient than the typical incandescent or halogen equivalent.

Qualified lighting designers (MIES – Member Illuminating Engineering Society or RLP – Registered Lighting Practitioner) will be aware of these lighting requirements. Not meeting them will mean failure to comply and failure during final inspection.

Australian Standards In addition to compliance with the energy efficiency requirements of the Australian Building Code there are also minimum light levels required for each space set by Standards Australia. The Australian Standard associated with interior lighting for both residential and commercial projects is AS/NZS 1680.2.2 – Interior and workplace lighting.

What is key to the Australian Standard is an understanding of how the Standard should be applied and that means ensuring light is, where light is needed.

Those unfamiliar with the application of AS/NZS 1680.2.2 will tend to take a uniform approach to lighting, often over-lighting a space. Whereas, a qualified lighting designer will take the Standard, and apply the appropriate level of light to each function and task area within a space.

For example, on an office floor the light levels (lux) appropriate for breakout areas, circulation areas, corridors, meeting rooms and workstations all differ. In addition to light level considerations, other LED lamp and luminaire factors should also be taken into consideration, such as the colour quality of the light (CCT and CRI).

Commercial Building Disclosure scheme There are also the mandatory obligations under the government’s Commercial Building Disclosure scheme, a national program designed to improve the energy efficiency of Australia’s large office buildings (managed by the Australian Government Department of Climate Change and Energy Efficiency).

Under the Building Energy Efficiency Disclosure Act 2010, most sellers or lessors of office space of 2,000m² or more are required to obtain and disclose a current Building Energy Efficiency Certificate (BEEC).

How to avoid issues By working collaboratively with a lighting designer or lighting engineer, builders have access to crucial product knowledge and product application knowledge that will ensure compliance.

A practicing lighting designer with MIES or RLP industry recognition, can work with a builder or project manager from the initial lighting design concept through to the end lighting solution including certification of the lighting design, required for building approvals.

James began immersing himself in carpentry and joinery qualifications while living in the UK, completing his carpentry and joinery apprenticeship there. He then went on to achieve multiple qualifications in construction management and business.

Seeking jobs throughout the UK, James worked on everything from 1,000-year-old castles and heritage properties, including thatched homes and full oak framed structures, to high-rise, commercial projects.

He established Red Dog in response to the need for excellence in service and quality in the construction industry. James’ vision was to provide superior built quality, while still adhering to the financial requirements of a project.

This vision brought James back to Australia in 2009, when he successfully established Red Dog on the Gold Coast.

Since then Red Dog has proceeded in development, construction management and other sectors, with a focus on housing developments. But if the road to success has taught James anything, it’s that the industry is one that is ever-changing and comes with many challenges.

“I was a very naïve apprentice who thought I knew it all. It was a bombshell and I got brought back to reality very quickly,” James said.

“It’s so important to be transparent. The industry has its fair share of disputes and unfortunately many builders have been tarred with the ‘rip off merchant’ brush many times. Given the detailed, high value and often unknown work we do for clients, transparency is critical.

Since establishing Red Dog Group 15 years ago, Founder and Managing Director, James Elliot, has grown the company to one that creates inspiring, life changing and innovative spaces across Queensland.

“The speed of construction has also increased dramatically. Technology and innovation can be thanked for this and it has helped our company greatly.

“We are now doing a lot of work with pre-fabricated modular homes and kit homes. This allows us to complete builds in a very short space of time, giving us a real edge over competitors.”

Red Dog recently formed a partnership with Australian-owned and operated kit home designer, Kitome, which James believes will make kit homes more accessible to every-day home buyers.

“These home options have been around for years but have mainly been targeted to owner-builders who were able to complete the build themselves, or those who were happy to then hire a contractor builder,” James said.

“Our partnership with Kitome means we are now making these homes more accessible to the average home-buyer, by providing the complete construction package.

Aside from their move towards building modular homes, Red Dog aims is to continually grow and deliver inspiring

buildings. They have a bold plan for the future, but with the team they have, James expects to get there, whilst having a lot of fun along the way.

“We’re about creating inspiring, life-changing and innovative spaces. Spaces where lives and memories are experienced for generations to come,” James said.

“It’s all about planning your route and keeping your eyes on the destination. You’ll definitely come across hurdles and walls to go around, but deal with them and keep moving forward.”

The project is being undertaken by food manufacturing facility specialist, Wiley.

Covering 10,500m² over the iconic Brisbane Produce Market trading floor in Rocklea, the roofing project will increase shelter for more than 600,000 tonnes of fruit and vegetables traded each year.

Brisbane Markets Limited (BML) recently awarded Wiley the contract to design and build stage two of the project comprising a $3.7 million roof extension covering 2,500m².

This follows Wiley’s work on stage one involving a $6.3 million roof upgrade covering 8,000m², which is on schedule for completion in April this year.

As the third largest Central Market in Australia and Queensland’s major marketing and distribution hub for the supply of fresh fruit, vegetables, and flowers, Wiley Managing Director Tom Wiley is pleased to have secured the contract with BML.

“More than 7,000 growers supply produce for sale at the Brisbane Markets and up to 4,000 people work or do business there on a daily basis so this project has been highly complex.

“We were part of a collaborative process of engagement undertaken by BML over a three-year period to ensure the trading floor tenants were consulted and were part of the process.

“The first stage has involved installing two roofing structures of around 4,000m² each, individually supported by a single row of 10 columns. It has also involved refurbishing the flanking building facades.

“We have finished the design and construction began for stage two recently, which we expect to have complete by August.”

BML Chief Executive Officer, Andrew Young is equally pleased to be fulfilling their goal of upgrading and redeveloping the site to ensure its relevance in the fresh produce supply chain.

More than one billion dollars’ worth of fresh produce traded annually at the state’s largest wholesale fruit and vegetable marketplace will receive greater protection thanks to a $10 million roofing project.

“We have focused on improving site operations, maintenance and administration, as well as developing a master plan to guide the site’s future upgrade and development,” Mr Young said.

“The roofing over our trading floors, where more than 50 primary, multi-million dollar wholesalers do business, is a vital component of that.

“We are pleased with the progress Wiley is making on stage one, and we look forward to continuing to work together on stage two to ensure we keep providing international-standard facilities and services.”

Wiley Senior Project Manager, Barry Murphy says the project has been progressing successfully thanks to the co-operation of the vendors in this unique construction environment.

“We have scheduled our work outside of market trading hours to minimise impacts on vendors’ operations. This has meant planning and managing each column placement point as a micro-construction site,” Mr Murphy said.

“With only one millimetre allowance on every template, the cages for the column footing and head stocks were precision laser-cut, fabricated, and welded off site, and scheduled for installation using high precision techniques.

“Each micro-site has also been contained to a 12m² area to provide the surrounding vendors with as much space as possible to carry out their trade.

“However, this presented a challenge for us to work at heights on the head stocks of the columns.

“In response, we designed and ordered manufactured custom stairwells on wheels so we could mobilise and de-mobilise our construction team as quickly as possible.

“Another interesting challenge we had was the heavy load our cranes and other machinery were placing on the bitumen.

“To address this, we innovated and installed runners made from recycled conveyor belts that could take the weight and prevent cracking.

“Most recently we successfully completed the erection of the structural steel on stage one. This was achieved with the assistance of a 100 tonne crane, which lifted and held each truss in place as the team worked to slot 16 bolts at one end of the truss, and eight bolts at the other end, which was more than 20 metres away.

“Unlike most structural steel projects, we weren’t able to use a template solution due to the distances between each column and the varied lengths of the trusses.

“We look forward to continuing to use an elite combination of site management, teamwork, and precision craftsmanship as we progress towards completing stage one, and move onto stage two.”

Business Management for Builders has been specifically developed by Master Builders to equip new builders with the skills they need to master the many aspects of establishing and managing their own business. Asthma sufferers to breathe sigh of reliefGround-breaking research at QIMR Berghofer Medical Research Institute could make wheezing, breathlessness and extreme fatigue a thing of the past for people struggling with asthma.

The disease afflicts one in 10 Australians and on average results in the death of one Australian every day.

Dr Manuel Ferreira, who heads QIMR Berghofer’s Asthma Genetics Laboratory, said many patients have difficulty managing their asthma, and current treatments do not adequately control their symptoms.

He is leading an Australian-first clinical trial in which patients will have their asthma induced to identify new treatments.

The trial follows Dr Ferreira’s discovery that a specific gene is particularly active in asthma patients, increasing the immune system’s production of the protein IL-6.

Volunteers selected for the trial will be given either a drug that suppresses that specific immune response, or a placebo medication.

They will then inhale a safe dose of an allergen such as dust mites to trigger a mild episode of their asthma, and the episode and their recovery will be monitored.

“This approach is extremely safe, and allows us to test in a matter of days – instead of months

– whether the drug reduces the severity or duration of asthma,” Dr Ferreira said.

The drug being used – tocilizumab (TCZ) – is already registered to treat rheumatoid arthritis and acts by supressing the immune response to IL-6.

If the trial shows that TCZ can be used effectively against asthma, researchers can give patients real hope that better treatments are on the way.

“TCZ would only need to be administered once a month, not daily or weekly as is the case for other asthma drugs,” Dr Ferreira said.

“It could help people with severe asthma to manage their symptoms more effectively if they are not responding well to current treatments.

“It is also likely to work for asthmatics with the ‘faulty’ IL-6R gene – and we can identify that with a blood test.”

Dr Ferreira established the Australian Asthma Genetics Consortium in 2008; a collaborative project to improve asthma management through genetic research.

“Asthma has such a big impact on the lives of so many Australians,” he said.

“We would be thrilled if we could secure additional funding so we can ensure any breakthroughs are made accessible to patients as quickly as possible.”

Volunteers in the trial will participate in 10 visits across six weeks over the course of the trial, with results expected in 2016.

Researchers expect to screen approximately 40 volunteers to find 16 suitable patients.

Adults who have mild asthma, or suffered from the condition when younger, may be eligible to participate if they only require relievers such as Ventolin to manage their asthma.

Dr Ferreira’s research has been published in prestigious scientific journals, including Lancet, Nature and Nature Genetics.

A first for the termite industry in Australia, the Bayer Protection Program offers homeowners total termite protection -- a combination of regular termite inspections (e.g. annually) to detect the presence of termites; and a physical barrier (Kordon®) to prevent entry via areas that can’t be inspected.

The Bayer Protection Warranty starts with an inspection of the home by a Bayer Accredited Timber Pest Inspector. If the home is termite-free, and possible conditions which may be conducive to termite attack are addressed, your Bayer Protection Warranty can be renewed. The same inspection takes place each year to give the homeowner total termite protection. This warranty can be renewed annually (fee applies) for the life of the structure.

The Bayer Protection Warranty covers homeowners for up to $1 million worth of termite damage due to product failure or any other means of termite entry.
