The videos are hard to watch; middle and high school students exchanging blows. Some parents and advocates say that discipline for school fights is different depending on what the child looks like. “They keep fighting the same kid, over and over, for what?” said Staci Washington. A girl on the video can be seen attacking Washington's daughter, whose identity News 4 has chosen to conceal. “The video speaks for itself,” Washington told News 4. Washington said it was far from the first time her daughter had been bullied at school.“I was disgusted with the school district,” she said. In a lawsuit filed against administrators at Hazelwood School District, Washington's lawyers outline multiple times they say Staci's daughter was attacked: In August 2016, twice in October that year and again in March 2017. Each time, Washington says she tried to get the school district to do something. She says she pointed outposts the other girls made, some that she says were entitled "adventures in fighting." “Do you think the school district should have done more to prevent these fights?” asked Investigative Reporter Lauren Trager. “Absolutely,” answered Washington. Instead of getting at the root causes and figuring out who was really responsible, according to the lawsuit, the school district suspended those involved after each fight, including Washington's daughter. “How could you get an education when you are steady getting suspended from school?” Washington asked. She believes the punishment was unfair and feels it's because of her daughter's race. “I just feel like if it had been young black girls fighting young white girls, it wouldn't have been these incidents through the school year,” said Washington. “They didn’t care because it's black kids fighting black kids, why would they care?” Washington's beliefs, according to legal experts like Luz Maria Henriquez, may be supported by startling statistics. “I think her experience resembles what the data is saying is that there is disproportionality,” said Henriquez. School discipline has historically come with disparities. National data from the Department of Education shows black boys are three times more likely to be suspended than white boys, often for the exact same offense. New studies have recently broken the data down by gender. According to an ACLU study, black girls are six times more likely to receive out of school suspensions compared to white girls. “It's really surprising to me that the target population is girls of color,” Henriquez said. “L.W. was absent from school for 125 days and earned no credits towards high school graduation for the year. “We had a lot of concern about whether this was in fact an education at all.” Legal Services attorney Luz Henriquez said. “These unjust disciplinary practices are common, especially for students of color like L.W., and represent a deep legacy of racial inequality in education. Accessing education is really important for our children and our Community,” Henriquez added.

The low-80s afternoon weather was so spectacular earlier this month, Janese and Mark decided one day to sit out on their front porch along with their three daughters. Their porch was immaculate. Their fenced yard was nicely mowed and weed-free. By all appearances, these homeowners have spent a lot of effort over the years to keep their property looking good. But the view looking outward from the porch spoiled everything, as it has pretty much every day for as long as the couple can remember. Right across the street in the 2400 block of Coleman Street stand no fewer than three crumbling, vacant houses with heavily overgrown lots. The houses, Mark said, are full of “squirrels and crackheads.” Though they are mostly boarded up on the front, “the whole back is off,” meaning trespassers can easily enter for whatever nefarious purpose they have in mind. Janese says she wouldn’t dare let her kids play outside unsupervised because of the dangers — this despite what she says is a

heavy police presence in the neighborhood. The danger doesn’t come from any of the six or seven neighbors in either direction, all of whom are taking pains to keep their properties in order. The problems emanate specifically from unsightly and dangerous vacant properties registered to NorthSide Regeneration LLC, the largest private property owner in north St. Louis. “It makes the whole neighborhood look bad,” Janese complained. “You think somebody wants to buy when they come by and see all this? Hell no!” And that’s the whole point. Responsible property owners don’t just take care of their yards and keep their houses painted. They work hard and pay taxes. Mark works as a meat cutter; Janese works for a company that manufactures parts for airplanes and railroad cars. They declined to give their last names. Neither had heard the name of NorthSide Regeneration’s owner, Paul McKee, nor did they know of the sweetheart deal that McKee cooked up years ago to evade responsibility for maintenance of scores of derelict buildings among his nearly 1,700 properties. The effect is that the property tax dollars paid by people like Mark and Janese have allowed McKee to evade his responsibilities as a property owner. They get the privilege of paying so McKee can drag down their property values. It doesn’t get any more unfair than that. They have rights, too.

Expanding Community Partnerships

Awarding Prosperity ConnectionLegal Services partners with more than 150 community organizations to increase our impact in the community and fully serve the needs of each client. In 2018, Legal Services recognized Prosperity Connection with the Eddie Mae Binion Community Service Award for outstanding service to the community.

Every day, Legal Services’ Consumer Law Program represents clients caught in rapidly escalating payday loans, or unfair consumer loans that leave them unable to keep up with payments and facing the loss of the resources they need to provide for their families. Once their legal issues are settled, Prosperity Connection can step in to provide services and tools clients need to build better credit, understand their financial rights and avoid future problems.

Prosperity Connection, a local nonprofit partner, provides free financial coaching for low-income clients struggling with debt and bad credit to help them on the path to financial stability. It also offers an affordable alternative to payday loans, through their social enterprise, RedDough Money Center.

Paul Woodruff, Executive Director at Prosperity Connection, says, “We want to give people a way to get out of predatory lending and be able to afford an emergency loan when they need it. But we also help them build credit so they can afford larger assets like a car or a home.”

He cites the case of a Prosperity Connection client who had a payday loan with 1,500% interest which trapped her endlessly in debt. Prosperity Connection was able to refinance the loan with affordable repayments so she could get out of debt and work towards financial stability. Woodruff says, “We want to give people in a very hopeless situation, hope, and by offering a payday loan alternative through RedDough. Ultimately, we want to put payday lenders out of business, so no-one else is taken advantage of.”

“It is incredibly unfortunate that we live in a financially inequitable society. But to have a partner like Legal Services, who understands these issues and cares about its clients as much as we do is truly powerful,” Woodruff added.

In 2018 Legal Services Board of Directors elected Maria V. Perron as their President. Ms. Perron is a partner in The Perron Law Firm, P.C., located in St. Louis County.

She is a 1981 graduate of Saint Louis University School of Law and has been a member of the Legal Services Board of Directors since 2007, serving as Vice-President since 2012. She practices personal injury, medical malpractice and employment law. She is a member of the Missouri Bar, Illinois Bar, the Missouri Association of Trial Attorneys and the Bar Association of Metropolitan St. Louis. In 2013 she received the F. Wm. McCalpin Pro Bono Award from Legal Services for her dedication to pro bono service.

Dear Friends,

Through our ACTIONS in 2018 Legal Services and our community partners:

• Finalized efforts to insure that low-income Missouri Medicaid recipients can receive access to life-saving medications to cure chronic hepatitis C. • Secured students the right to an alternative education after being disciplined. • Negotiated a settlement to restore and enhance a child’s education after the loss of more than a year of schooling. • Established a new right for Missouri tenants to refuse to pay rent if the living conditions are unbearable and deplorable. • Launched the Neighborhood Vacancy Initiative to address blighted and abandoned property in St. Louis City neighborhoods.

JUSTICEIMPACT litigation and advocacy such as these examples greatly amplifies the number of people, families and neighborhoods who benefit from our work. Just one of these examples, the hepatitis C advocacy, immediately helped more than 12,000 Missourians living with the disease.

Other cases, such as the housing and education cases, changed the procedures and policies that negatively impacted thousands of people statewide. In all of these cases, families benefit from more equitable treatment now and into the future.

HOPEThe new Neighborhood Vacancy Initiative is a creative approach to the growing and intractable issue of blight in St. Louis neighborhoods. This unique project is a collaborative effort to mobilize neighborhood associations and residents to take control of their communities by reclaiming property for affordable housing. The early enthusiasm and community support for the project in the first year bodes well for broad participation.

Importantly, more of this work can be accomplished with the collaboration of a wide group of partners, community agencies and generous donors who share our vision for stronger, healthier and more equitable communities. In September 2018 Lisa D’Souza was selected as the new Hon. Richard B. Teitelman Chair attorney. This is an endowed position named for the late Missouri Supreme Court Judge Richard B. Teitelman who also served 18 years as Executive Director for Legal Services of Eastern Missouri. The Teitelman Chair attorney focuses on legal advocacy that addresses systemic issues impacting low-income families.

“Lisa is uniquely qualified for this position. A graduate of Harvard Law School, Lisa has broad experience as a public interest lawyer,” stated Dan Glazier, Executive Director and General Counsel for Legal Services of Eastern Missouri.

D’Souza’s 22-year legal career includes working with migrant farmworkers at Texas Rio Grande Legal Aid, advocating for health care for low-income clients with the Tennessee Justice Center and, most recently, serving as a staff attorney to the Eighth Circuit U. S. Court of Appeals.

A native St. Louisan, Lisa received her undergraduate degree in Philosophy from Texas A&M, and returned to St. Louis with her family in 2013.

Dutchtown South Community OrganizationDutchtown South Community Corporation is a nonprofit Community Development Corporation that serves four socially and culturally diverse, economically challenged neighborhoods in south St. Louis City – Dutchtown, Gravois Park, Marine Villa and Mt. Pleasant. Sixty percent of residents live below the area’s median income and one third of residents live below povertylevel.

Dutchtown South’s goal is to combine community empowerment with revitalization and development, to allow residents to grow and prosper. Executive Director, Amanda Colón-Smith says, “We are a community asset, working to tackle the impact of redlining and disenfranchisement. We want to improve the structure of the community and improve conditions for our residents, while maintaining a racially and economically diverse neighborhood.”

They first learned of Legal Services’ Neighborhood Vacancy Initiative (NVI) in 2018 and saw the opportunity to turn abandoned property into affordable housing in their community.

“We haven’t added to our property portfolio since 2008, because we don’t have the funds to purchase properties,” says Colón-Smith. “This is a unique opportunity to both transform problem properties and expand our portfolio of affordable housing,” she added.

The first property they tackled is 5032 Alabama, which has been vacant for several years. Ownership was successfully transferred to Dutchtown South in 2019 and it is currently being renovated to add to Dutchtown South’s affordable rental housing portfolio.

“What was once an eyesore, and a magnet for problems in the community, can be fixed and given a purpose again,” Colón-Smith says. “Sustainability is as much about the community as it is about the building.”

“The Neighborhood Vacancy Initiative has been an invaluable tool to allow us to be stewards of our neighborhood, and to lay the groundwork to maintain an equitable and diverse community in the future. My hope is that by maintaining affordability, we have a genuine opportunity to decrease the wealth gap in St. Louis,” Colón-Smith added.

The Neighborhood Vacancy Initiative was launched in April 2018 to help neighborhood associations, community groups and low-income residents deal with abandoned and vacant properties in St. Louis City’s blighted neighborhoods.

Financial support is provided by the Bar Association of Metropolitan St. Louis, The St. Louis Development Corporation, and others.

One of the first properties to be reclaimed for development by the Neighborhood Vacancy Initiative for client Collin Garrity in the Marine Villa neighborhood. This property was featured in a June 8, 2019 St. Louis Post-Dispatch article.

Project staff and pro bono attorneys provide:Vacancy Prevention and Title Clearance: • Five free legal clinics hosted to provide residents with vacancy prevention tools like beneficiary deeds. More than 30 clients received legal representation to clear titles or prevent them through our services.

Community Education and Organization: • More than 200 community meetings and outreach events attended to foster working relationships with the communities impacted by blight and vacancy.

Problem Property Litigation: • Seventeen cases were opened and seven lawsuits filed against absentee property owners on behalf of four different neighborhood associations.

A key component of the Neighborhood Vacancy Initiative is engaging the community and working with the many components and partners that are necessary for neighborhood revitalization. The project staff is working closely with the newly formed St. Louis Vacancy Collaborative and is utilizing legal strategies, including the little-used Missouri Abandoned Housing Act, to reclaim badly dilapidated property for redevelopment. Results include regainingmuch-needed affordable housing and/or other constructive use of the properties to benefit neighborhoods.

More than ten percent of all clients served with direct case work in 2018 were served by volunteer attorneys, and many more were assisted through community legal clinics. In 2018, the Volunteer Lawyers Program expanded the number of legal clinics provided, as a way to reach more people and to engage new attorneys and law partners in pro bono work for the first time.

Volunteers are the backbone of our mission to provide equal access to justice, and we thank all our volunteers – lawyers, social workers, board members, administrative support and event committee and volunteers too.

The Family Court Program provides advocacy and legal representation to parents who otherwise would not have the resources to fight for their children.

Ben DeGonia is a 55 year old Navy and Coast Guard veteran who came to Legal Services for help to reunite with his son, whom he had not seen since the baby was six months old, when Ben moved to Colorado to focus on recovery from addiction.

In 2014 Ben suffered a stroke and brain aneurysm while at work. This prompted his sobriety and Ben returned to St. Louis with hopes of playing a role in his son’s life.

On his return he filed a family access motion with the Court. However, without funds for an attorney, he was unsuccessful in reuniting with his son. Shortly after, his son was adopted by the mother’s new husband without Ben’s knowledge.

Luckily for Ben, he was referred to Kathleen Dubois with Legal Services’ Family Court Program for help.

Ben says, “From the first time I met with Kathleen, she made me feel supported and gave me hope. She understood that I was fighting for my parental rights, not fighting the child’s mother.”

With Legal Services’ support, Ben was able to have the adoption overturned, and a family access motion was also granted. “I was amazed at the support, confidence and level of knowledge that all the staff working on my case displayed,” he noted. “I always felt like I was deserving of a chance and that they understood what I was going through,” he added.

Ben is expected to reunite with his son, now 11 years old, later this year. “He doesn’t know me at all, and I don’t expect an immediate relationship,” Ben says, “He’s doing great with his current family, and the last thing I want is to take that away. But he deserves to know who I am and I just want to let him know I’m here and I’m open to building a relationship if and when he does.”

Although the aneurysm left Ben disabled, thanks to surgery he is able to work part-time. Ben is a Peer Wellness Coach for people with developmental and intellectual disabilities in Madison County, and an advocate and support resource for other recovering addicts.
