Inaugural Session

The inaugural session began with the formal welcome address given by Dr. I.N. Mukherjee,

Secretary, U.P. Council of Agricultural Research, Lucknow followed by introductory remark of

our Hon’ble Director General, UPCAR, Lucknow Prof. Rajendra Kumar. He focused the need

of various IPR issues especially in relevance of agricultural scientists of the state. The inaugural

session was graced by the apparition of our chief guest Dr. R.R. Hanchinal, Chairperson,

Protection Plant Varieties & Farmer’s Rights Authority (PPVFRA), New Delhi. Our chief guest

relinquished his precious time to us and said that Intellectual Property is the creation of human

mind which should be protected without innocence and ignorance. He also made us aware about

the availability of landraces, hotspots and varieties of various crops which are abundantly present

as the domestic biodiversity in the state. At the end of inaugural session, vote of thanks was

proposed by Dr. Sujit Kumar, Organizing Secretary/Scientific Officer (Plant Breeding),

UPCAR, Lucknow.

Summary of Lectures

Ten lectures were delivered by scientists/experts on various aspects of IPR, GI, PPVFRA,

trademark, copyright, prior art search etc. These lectures are summarized here as follows:

Day One (March 27, 2015)

Lucknow elaborated different aspects of IPR like Patenting, Geographical Indications, Protection

of Plant Varieties & Farmer’s Rights, Patenting in CSIR regime, etc.

Dr. R.R. Hanchinal, Chairperson, Protection Plant Varieties & Farmer’s Rights Authority

(PPVFRA), New Delhi, delivered lecture on “Protection of Plant Varieties and Farmers’

Rights”. In his lecture he made us aware about the role of Protection Plant Varieties & Farmer’s

Rights Authority (PPVFRA) related to intellectual property rights and their implications. While

delivering his valuable lecture, he said that innovation is the key for production as well as

processing of knowledge. He further added that Protection and Plant Varieties and Farmers’

Rights Act, 2001 protect the rights of farmers in respect of contribution made at any time in

conserving, improving and making available plant genetic resources for development of new

plant varieties. Article 27.3 (b) of this agreement requires the member countries to provide the

protection of plant varieties either by a patent or by an effective sui generis system or by a

combination thereof. Thus, the member countries had the choice to frame legislations that suit

their own system and India exercised this option. The sui generis system for Protection of Plant

Varieties was developed integrating the rights of the breeders, farmers and village communities

and taking care of the concerns for equitable sharing of benefits. This is the only intellectual

property law in India that gives dual proprietorship of Intellectual Property on variety and its

denomination. He told that the process of registration of plant varieties under Protection Plant

Varieties & Farmer’s Rights Authority (PPVFRA) is very simple. We all should support seed

varieties of farmer’s and encourage him to register their varieties. He apprises us that we have

treasure of wealth in the form of plant varieties which should be protected. He also said to

conserve our plant genetic resource for sustainable use.

Dr. Ankur Agarwal, Assistant Controller of Patent & Design, Indian Patent Office (IPO), New

Delhi, expressed his views by presenting a lecture on the topic “Patenting in India” in which he

apprised us about all rules and regulations of Indian Patent Act.

Dr. Rahul Srivastava, Marketing Officer, South Asia, GALVmed South Asia Office, Jasola

District Center, Jasola, New Delhi, gave lecture on “Commercialization of agro-based

Technologies through Business Incubation” in which she discussed about the importance of

vaccination for the livestock. He defined various aspects of IPR in a very easy way. In his view,

value and commercial utility is the critical requirement for IPR issues and incubation facilities is

the necessity of today’s agricultural research. He further added that efficient management of

agricultural technologies is urgently required to fulfill the needs of all stakeholders from small

and marginal farmers to entrepreneurs and even commercial houses, therefore, coupling of

agriculture research and development with the new explorative developmental concepts is need

of the hour for benefit of stakeholders encompassing researchers, scientists, entrepreneurs and

start-ups in particular and Indian economy in general. These initiatives in Indian agricultural

research system are in very nascent stage and need long term vision for sustainable establishment

of specialized platform for idea transformation. Greater collaboration among all stakeholders as

agricultural universities, research institutions, farmers groups and private organization in such

initiatives will give new heights and wider scope to budding entrepreneurs and technology

developers in the field of agriculture in Uttar Pradesh.

Mr. Vivek Srivastava, Sr. Scientist / Nodal Officer (IPR), National Botanical Research Institute

(NBRI), Lucknow emanated us a informative presentation on the topic “IPR in CSIR System”

in which he told that The IPU (Innovation Protection Unit) looks after the protection of

intellectual property rights at national and international level for the results of important R&D

carried out in the various CSIR Laboratories. CSIR IP policy, first by any entity in India was

declared in 1996. It encompasses protection of intellectual creations by all means that includes

patents, trademark, designs and copyrights. Effective management of Intellectual Property Rights

has placed CSIR as an organization on the global IPR radar. CSIR adopted a centralized

operation for IPR protection of the Intellectual property generated in its laboratories and CSIR

scheme. It was CSIR that initiated the action in 1995, with the US PTO for the re-examination

and revocation of the patent granted on turmeric as a wound healing agent. The turmeric patent

was granted in 1995 to two researchers, Soman K. Das and Harihar Kohli of the University of

Mississippi Medical Center. Their six patent claims covered the oral and topical use of turmeric

powder to heal surgical wounds and ulcers. Das and Kohli contested CSIR's objections, but the

patent office rejected all their claims. This involved meticulous and strenuous efforts in

exploration, compilation and evaluation of voluminous scientific data, patents and legal options –

to pose a formidable challenge to the US patent. The result was the successful revocation of the

US Patent in 1998. CSIR being leader in R&D in India has also taken leadership in IP protection

for wealth creation and Indian knowledge protection. It has been successfully doing it since its

inception.

Dr. Chetan Keswani on behalf of the Prof. H.B. Singh, Head, Department of Mycology and

Plant Pathology, Institute of Agricultural Sciences, BHU, Varanasi delivered a lecture on

“Patenting A Way of Success of in Research” elaborating latest information about patenting in

India as compared to other developed countries. He explained that Intellectual property involves

inventions, fictional and creative work, industrial designs for article, symbols, etc. utilized as a

part of trade. He added that today, it is widely accepted that any new result of a man's brain work

need to be secured as private property. Patenting life forms bring with them imperious issues of

pious and ethical values. In present globalized and competitive world, uprising in biotechnology

is a fulcrum of national economic growth. All patentable inventions must satisfy essential criteria

that are, the invention must be novel and not obvious, it must have some industrial use, and the

description part of the patent application must enable a person skilled in the relevant area of

technology to put the invention into practice. Under concluding remark, he expressed his concern

that the present political, technological and socio-economical situation is very complicated to

build up national system of IPR according to that of developed nations.

Day Two (March 28, 2015)

Technical Sessions:

Second day Dr. J.S. Chauhan, Assistant Director General (Seed) Indian Council of Agricultural

Research (ICAR), New Delhi; Dr. Puneet Kumar, Principal Scientist & Incharge, Zonal

Technology Management Center, IVRI, Izzatnagar, Bareilly; Mr. Vikas Asawat, Registered

Patent & Trade Mark Attorney, Noida; Dr. Om Prakash, Ex- Examiner of Patent & Design and

Dr. Sujit Kumar, Scientific Officer (Plant Breeding), U.P. Council of Agricultural Research

(UPCAR), Lucknow made us aware about the intricate aspects of IP issues like patent filing,

processing and granting in a very gullible way.

Dr. J.S. Chauhan, Assistant Director General (Seed) Indian Council of Agricultural Research

(ICAR), New Delhi also the chief guest of valedictory session of the training programme

presented a marvelous lecture on the topic “Intellectual Property Rights in Seed in Indian

context”. He emphasized on the role of IPRs related to seeds and said that many national

projects are running by ICAR to protect the seeds. He said that the main legal instruments to

facilitate implementation of Seed Treaty and other treaties in India are:

1. Protection of Plant Varieties & Farmers Right Act 2001

2. Biological Diversity Act, (BDA), 2002

3. Plant Quarantine (PQ) Order 2003,

4. Seeds Act, 1966 and

5. Environment Protection (EPA) Act, 1986. Policy development will require coordinated

actions by the concerned ministries and organizations

He further added that there is a need to harmonize the provision of the Biological Diversity

Act,2002 with India’s commitment to provide facilitated access to plant genetics resources in the

multilateral system, and more particularly, to enable providers within India to use the standard

material transfer agreements (SMTA) when exchanging such resources. He said that presently,

the Standard Material Transfer Agreement is used in India only for the exchange of germplasm

with CGIAR Centers. For other exchanges of germplasm, a different Material Transfer

Agreement is used. There is a need to harmonize rules in view of various international treaties to

which India is signatory making efforts to develop suitable MTA in consonance with accepted

Standard Material Transfer Agreement such as Easy SMTA developed by ITPGRFA secretariat

for the exchange of plant genetic resources under multilateral system. Commercialization of seed

varieties may antagonize the interest of farmers since seed varieties directly benefit the resource

poor farmers of the country

Dr. Puneet Kumar, Principal Scientist & Incharge, Zonal Technology Management Center, IVRI,

Izzatnagar, Bareilly fetched his experience in the field of animal husbandry by dispensing a lecture

entitled “Intellectual Property Rights (IPRs) Related to Livestock”. He explained that how

we increase our income by using technology commercialization. He discussed that technology

commercialization is the process of moving research results from a research place to a

successfully marketable product. The ability to move a technology from /to market quickly and

efficiently is crucial in transferring technologies from public laboratories. Commercialization is

often thought to involve steps such as building a prototype, testing its feasibility and progressing

to completing product development and design. In India, in the field of veterinary and animal

sciences, many technologies are generated by the public funded institutions but technology

commercialization and entrepreneurship development is quite low. Indian Council of

Agricultural Research (ICAR) institutes and State Agricultural Universities (SAUs) and NGOs

have created knowledge in animal and veterinary science that has intrinsic IP with potentially

significant benefits to the society. Many technologies have been patented and commercialized by

ICAR institutes and universities working in the field of agricultural sciences. Atlast he said

Intellectual Property Rights encourage innovation and reward entrepreneurs.

Mr. Vikas Asawat, Registered Patent & Trade Mark Attorney, Noida, while delivering a lecture

on “Intellectual Property Rights with Special reference to Patent Filing and Drafting in

Indian Context” told us that patent is granted for functional aspect and the patent rights will be

deemed only when the application is published. He apprised us that from the month of March

2015 Office of the Controller General of Patents, Designs & Trade Marks have launched the e

filing of Industrial Design and Geographical Indication Applications. So, now Patents, Trade

Marks, Copyrights and Geographical Indication can be filed online. In case of Patent

Application, there is rebate in fee of 10% if it is filed online. In last 2-3 years online filing has

increased and Patent Attorneys are using Digital signature to file various IPR applications as it is

convenient, saves paper, saves postal/courier charges, fee rebate of 10% in case of Patents,

receipt and application number generation online and so on. After presenting his lecture he

interacted with the audience through a simple and interesting quiz on IPR.

Dr. Om Prakash, Expert of Patent & Design, delivered a lecture on “Patentability criteria

a practical approach in view of Indian Patents Act” and threw light on the dos and don’ts of

patenting inventions especially related to biological systems. He explained in very astonishing

way that how a patent is filed for effective granting by giving several easy examples. He

informed that patents in India are less popular because of our ignorance and the belief that

science is for all mankind and not just for the scientist alone. At the end he encouraged the

researchers by saying that it’s the time to protect our intellectual wealth because in this century,

an individual’s future standings will be determined by his/her ability to convert his/her

knowledge into wealth and creativity, ultimately into social goods.

Dr. Sujit Kumar, Scientific Officer (Plant Breeding), U.P. Council of Agricultural Research

(UPCAR), Lucknow and also the Organizing Secretary of the workshop galvanized us to

aggrandize the intellectual property management in agriculture for the scientific and economic

development of our state while delivering a lecture on “Searching for Prior Art: Moving From

the Search Room to the World Wide Web”. He said that for prior art search, a thorough search

should also include both patent and non-patent references such as journals and other

publications. The Internet is an excellent source for prior art information. A patent search is not

an infringement search.. He made us aware that inventions that combine two or more elements

already known in prior art can still be patentable, provided the combination is non-obvious.

Valedictory Session

The closing session of the training programme was glorified by the presence of Dr. J.S. Chauhan,

Assistant Director General (Seed) Indian Council of Agricultural Research (ICAR), New Delhi

as chief guest and Prof. Rajendra Kumar, Director General and Organizing Chairman of the

workshop. All of them congratulated and felicitated Dr. Sujit Kumar, Organizing

Secretary/Scientific Officer and his team for successful completion of the two days workshop.

Dr. Sujit Kumar expressed his gratitude towards all the dignitaries and the trainers for gracing

the occasion and guiding the participants. He also thanked the participants for their contributions

for making the workshop victorious. At last, certificates were awarded to all the participants by

our Hon’ble chief guest of the session. The programmes was ended with inspiring slogan “Patent

system adds fuel of interest to fire of genius”

Concluding Remark

Scientists and researchers had some very good discussions after each presentation which

stimulated a lot of thought process. It was great and rewarding to see that this workshop with the

help of these beneficial lectures gave satisfaction to the participants by providing them sufficient

information to conserve their intellect. As we talked a lot, we discussed a lot and we also

recommended a lot of things numbering at least eleven concrete deliberations, a few things can

be immediately followed up to protect our intellectual property when participants return back to

their respective place to disseminate the updates that shared here during various sessions.

The main highlights of the workshop are summarized in the points listed below:

• Better understanding of IPR principles and jurisprudence is necessary for economic

growth and development of the country.

• Need structured approach in technology generation, protection and commercialization.

• Policy framework and legal system need to be more dynamic.

• Developing high level skills in IPR management through education and training

especially in IP licensing.

• Potential to support technology based Entrepreneurship in Agriculture in U.P.

• Protection of Plant Varieties & Farmer’s Rights Authority (PPVFRA) recognizes

contribution in agro-biodiversity conservation and recognition of farmers similar to

breeders.

• The sui generis system for Protection of Plant Varieties was developed integrating the

rights of the breeders, farmers and village communities and taking care of the concerns

for equitable sharing of benefits.

• Commercialization of seed varieties may antagonize the interest of farmers since seed

• CSIR-IP has led to creation of wealth and also has wide spread impact on society. It has

helped domestic Industry to avoid infringement and have strong IP support to have

competitive edge.

• Generation and analysis data is essentially important for any potential IP so it should be

critically examined.

• Patenting life forms bring with them imperious issues of pious and ethical values. In

present globalized and competitive world, uprising in biotechnology is a fulcrum of

national economic growth.

• It is the duty of every citizen of India to protect and conserve their innovation and

biodiversity.

• At the end, it’s the time to protect our intellectual wealth because in this century, an

individual’s future standings will be determined by his/her ability to convert his/her

knowledge into wealth and creativity ultimately into social goods.
