    1. CALL TO ORDER

    CITY COUNCIL MEETING OCTOBER 4, 2018- 7:00 P.M.

    MINUTES -

    Mayor Tyson called the City Council Meeting to order at 7:00p.m. and asked the Clerk to call the roll.

    2. ROLL CALL PRESENT: Council Member Fernando Herrera, Council Member Inocensia Hernandez, Council Member Sara J. Savage, Council Member Jessica Salgado, City Manager Jason R. Nunemaker, Attorney Warren W. Dill and Mayor Joel Tyson. ABSENT: None.

    3. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge was recited.

    4. INVOCATION Mayor Tyson gave the Invocation.

    5. PROCLAMATION : River of Life Church. Mayor Tyson introduced the proclamation and Attorney Dill read it in its entirety. Chief Touchberry added this was a fund raiser and it created a lot of work and dedication. It provided benefits to seven (7) agencies in Indian River County in the sum of $1,000.00 each. Pastor Ron Combs added that the folks around the podium were the volunteers for the Church, they organized the activities, packed up all the goods for transportation including grills, cooked the delicious Bar-be-que, and he thanked them and Council for the recognition.

    6. PRESENTATIONS: Swearing in of David E. Dozier, Police Officer Mayor Tyson introduced the Officer Dozier and called him to the podium, his wife accompanied him and Mayor Tyson swore in Officer Dozier and Mrs. Dozier held the Bible.

    Chief Touchberry called the Officer's up to the podium they attached his service bars and Mrs. Dozier pinned on his badge. Chief Touchberry added that Officer Dozier is retired from I.R.C.S.O. and is knowledgeable and has lots of experience, he welcome Officer Dozier.

    7. APPROVAL OF MINUTES: (a) Council Budget Meeting of September 20, 2018 at 6:00 p.m. and (b) City Council Meeting of September 20, 2018 at 7:00p.m. Mayor Tyson introduced the minutes and entertained a motion to approve.

    MOTION by Council Member Savage, Seconded by Council Member Salgado, to approve the Council Budget Meeting of September 20, 2018 at 6:00p.m. and the City Council Meeting of September 20, 2018 at 7:00p.m. ALL AYES: MOTION CARRIED 5-0

    8. BUDGET AND FINANCE REPORT: for the month ending August 31, 2018. Mayor Tyson introduced the finance report and asked if there were any questions, hearing none, he moved on.

PUBLIC HEARINGS: (a) ORDINANCE 2018-09/AN ORDINANCE OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA, ADOPTING AN AMENDMENT TO THE ANNUAL BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2018 AND ENDING SEPTEMBER 30, 2019; APPROPRIATING FUNDS FOR THE ANTICIPATED RECEIPT OF TWO GRANT FUNDS (FURTHER DESCRIBED BELOW) IN THE APPROPRIATE FISCAL YEAR; AUTHORIZING THE TRANSFER OF FUNDS HEREIN APPROPRIATED SO LONG AS THE TOTAL COMBINED APPROPRIATIONS SHALL NOT BE INCREASED THEREBY; PROVIDING FOR AN EFFECTIVE DATE/Public Hearing and 2nd and Final Reading, Thursday, October 4, 2018 beginning at 7:00 p.m., in the Council Chambers, 21 S. Cypress Street, Fellsmere, FL. Mayor Tyson introduced the Ordinance and Attorney Dill read Ordinance 2018-09, by title only.

    City Manager Nunemaker interjected this is action is to incorporate two (2) Grant funds received during the ending process of adopting the budget.

    Mayor Tyson opened the public hearing at 7:14 p.m. and asked that anyone wishing to speak on the ordinance to please come to the podium and state your name and address for the record, hearing none he closed the public hearing.

    Mayor Tyson entertained a motion to adopt.

    MOTION by Council Member Savage, Seconded by Council Member Herrera, to adopt ORDINANCE 2018-09/AN ORDINANCE OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA, ADOPTING AN AMENDMENT TO THE ANNUAL BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2018 AND ENDING SEPTEMBER 30, 2019; APPROPRIATING FUNDS FOR THE ANTICIPATED RECEIPT OF TWO GRANT FUNDS (FURTHER DESCRIBED BELOW) IN THE APPROPRIATE FISCAL YEAR; AUTHORIZING THE TRANSFER OF FUNDS HEREIN APPROPRIATED SO LONG AS THE TOTAL COMBINED APPROPRIATIONS SHALL NOT BE INCREASED THEREBY; PROVIDING FOR AN EFFECTIVE DATE ROLL CALL: AYES: Council Member Herrera, Council Member Hernandez, Council Member Savage, Council Member Salgado and Mayor Tyson.     lO.PUBLIC COMMENTS: Mayor Tyson opened the Public comments at 7:15p.m. and asked if anyone wished to address the Council to please come to the podium and state their name and address for the record.

    James Womack, 107 N. Magnolia Avenue, the Pastor's house, the congregation would like to rent portions of it out for services to assist the elderly and underprivileged in the Community, adding there is a large parking area available for use by the business.

    Council Member Savage recommended that the use be a low intensity use, the area is residential and there's the Day-Care right next to it. This could be a positive step for the City but we must be careful what's allowed.

  • Kenny Godfrey, 10Pt Street, he expressed concerns regarding the road material being used on the streets.

    11.MANAGER'S MATTERS: City Manager Nunemaker updated as follows:

    • Fellsmere Elementary is looking for volunteers to read to the classes, from 1 to 3 p.m., Friday, call Brittney if your available her number is 772-564-6032.

    • Marian Fell Library, see the attached approval by the I.R.C. B.O.C.C .. • CDBG VII • Development Updates

    o Ag Industrial 20 to 40 jobs. o Residential Management (Kahn) o Tractor Supply o Fellsmere 392/Ferber

    • Upcoming Events/Meetings o 10/10 SRID 164 Conversation (1:30 p.m.) o 10/16 Night Out on Crime (5pm - 7pm)

    12.MAYOR'S MATTERS: Mayor Tyson updated as follows:

    • Attended the TCCLG and we addressed the Constitutional Amendments.

    • Discussed the issues with Mail-In-Ballots and • Thanked the Church of God for their Fellowship.

    13.COUNCIL MEMBER'S MATTERS: Council Member Herrera had no matters.

    Council Member Hernandez had no matters.

    Council Member Savage updated as follows: • Would like to be the Liaison for Beautification to assist in reviving the

    Committee, they are experiencing membership issues. • Expressed concerns of Pine Street and recommended core samples be

    taken.

    Council Member Salgado had no matters.

    15. CITY ATTORNEY'S MATTERS: Attorney Dill had no matters.

    16. NEW BUSINESS: (a) RESOLUTION 2018-23/ A RESOLUTION OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION FLORIDA RECREATION DEVELOPMENT ASSISTANCE PROGRAM REQUESTING $50,000 FOR THE SENIOR LEAGUE PARK; AND FURTHER AUTHORIZING AN AMOUNT OF $7,500 AS THE CITY'S GRANT MANAGEMENT FUNDS; AUTHORIZING THE MAYOR TO EXECUTE SUCH GRANT IF AWARDED; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Tyson introduced the Resolution and Attorney Dill read RESOLUTION 2018-23, by title only.

    Mayor Tyson entertained a motion to adopt.

    MOTION by Council Member Salgado, SECONDED by Council Member Savage, to adopt Resolution 2018-23/A RESOLUTION OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION FLORIDA RECREATION DEVELOPMENT ASSISTANCE PROGRAM REQUESTING $SO,OOO FOR THE SENIOR LEAGUE PARK; AND FURTHER AUTHORIZING AN AMOUNT OF $7,SOO AS THE CITY'S GRANT MANAGEMENT FUNDS; AUTHORIZING THE MAYOR TO EXECUTE SUCH GRANT IF AWARDED; AND PROVIDING FOR AN EFFECTIVE DATE. ALL AYES: MOTION CARRIED. S-0

    (c) Authorize the Mayor to execute Change Order #08 with Blue Goose Construction to balance final quantities verses plan quantities. Mayor Tyson introduced the Change Order and City Manager Nunemaker interjected this is the final Change Order, we are awaiting As-Built Drawings. They've reduced the price some $7,700.00.

    MOTION by Council Member Herrera, SECONDED by Council Member Hernandez, to authorize the Mayor to execute Change Order #08 with Blue Goose Construction to balance final quantities verses plan quantities.

    (d) Authorize the Mayor to execute Work Authorization #24 with Carter Associates, Inc. to provide Construction Engineering inspections grant in excess of original completion date. in the Cultural Facilities. Mayor Tyson introduced the Change Order and City Manager Nunemaker interjected this is a close-out credit.

    MOTION by Council Member Herrera, SECONDED by Council Member Hernandez, to authorize the Mayor to execute Work Authorization #24 with Carter Associates, Inc. to provide Construction Engineering inspections grant in excess of original completion date in the Cultural Facilities. AYES: Council Member Herrera, Council Member Hernandez and Mayor Tyson NAYS: Council Member Savage, Council Member Salgado.

    CASE STATUS

    Code Enforcement focuses on health and safety issues such as unpermitted work, delapidated structures and excessive junk and debris. Given workload, not all health and safety issues can be processed immediately. Lower safety concerns are prioritized as possible. When other cases are identified during code enforcement drive-bys, they are added to the list of pending cases . These are mostly fences, driveways, culverts, sheds, etc. These other cases move through system as workload allows. Other types of cases include expired permits, businesses without a tax receipt, fowl, etc. Occassionaly, staff will do a focused code enforcement effort. These have included in the past- grass, temporary car canopies, road edge damage. Areas of ongoing concerns are address numbers, unpermitted work and illegal accessory structures.

    AN ORDINANCE OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA, AMENDING CHAPTER 2, ARTICLE VII, PROCUREMENT, DIVISION 1. GENERALLY, SECTION 2-236 PURCHASING AND AMENDING SECTION 2-237 BIDDING PROCEDURES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION AND PROVIDING FOR AN EFFECTIVE DATE.

    WHEREAS, the City of Fellsmere, Florida is a duly constituted municipality having such powers and authority conferred upon it by the Florida Constitution and Chapter 166 Florida Statutes; and

    WHEREAS, the City Council held a duly adve1iised public hearing and has determined that the amendments to the Code of Ordinances of the City of Fellsmere, Florida are in the best interest of the City and that the public health, safety, environmental and general welfare of the citizens of the City will be furthered by the amendments to the Code of Ordinances.

    NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA, AS FOLLOWS:

    SECTION 1. RATIFICATION. The above recitals are hereby ratified, adopted and incorporated herein as legislative findings of the City Council.

    SECTION 2. AMENDMENT. That Sections 2-236 and 2-237 of the Code of Ordinances of the City of Fellsmere, Florida are amended to read as set forth in Exhibit "A" attached hereto and by this reference made a part hereof.

    SECTION 3. CONFLICTS. All previous ordinances or parts of ordinances, resolutions, or motions ofthe City which conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.

    SECTION 4. SEVERABILITY. If any section, part of a sentence, phrase or word of this Ordinance is for any reason held to be unconstitutional, inoperative or void, such holdings shall not affect the remaining portions hereof and it shall be construed to have been the legislative intent to pass this Ordinance without such unconstitutional, invalid or inoperative part.

    SECTION 5. CODIFICATION.     EXHIBIT "A" TO

    (a) City manager. Except as otherwise provided by Florida Statutes and in the Code, the city manager is granted authority to purchase or contract for supplies, materials, equipment or services costing $7,500.00 or less for the city, after taking such action the city manager shall deem necessary to obtain the best price for the city. Any such purchase or contract may be executed by the city manger in the name of the city without council action. Copies of any such contracts shall be available to the council for inspection. In the event of an emergency, pat1s or repairs to then existing city equipment or machinery may be purchased or contracted for by the city manager, providing the cost does not exceed $25,000.00 where general fund and all non-utility enterprise fund monies are to be expended, and $50,000.00 where utility fund monies are to be expended. The finance director shall certify that the funds are available, for such pat1s or repairs, the city manager shall cet1ify that a true emergency exists and shall route a copy of such transactions to the council for its inspection with a memorandum describing the emergency situation. These purchasing procedures include and incorporate all Federal, State and Uniform Guidance standards.

    (b) City council. Any non-emergency city purchase of supplies, materials, equipment, or ser-vices costing more than $7,500.00 shall be approved by the city council. Purchase orders covering such purchases shall be noted as approved by the city council and then executed by the city manager. If a formal written, integrated contract is required for such purchases, said contract shall be approved by the council, signed by the mayor or city manager, the city clerk and approved as to form and legal sufficiency by the city attorney. Any purported contract not so executed shall be void ab initio and shall have no force and effect whatsoever. The city council may enter into contracts under this paragraph based on the recommendations of the city manager, bidding procedures, or such other methods that the city council determines are in the best interest of the city. In addition, the city council may direct the city manager to take several bids and negotiate with these bidders to obtain an offer that is most advantageous to the city

    (c) Bids not required. Nothing in this division shall be construed as requiring the city to go out for bids, or, if bids are invited, that the lowest bidder be selected; provided, however, that it is recognized that for certain projects and services the Florida Statutes specifically required bidding and in such cases the applicable Florida Statutes shall be followed .

    (d) Contract employment. The city manager shall have the authority to execute contractual employment agreements for specific needs of the city. This contractual employment agreement shall be deemed in the best interest of the city, and shall provide for short and long term services by the contractor. The annual payment to any contractual employee shall be within the budgeted range and benefits for such position. The contractual employee shall provide the city worker's compensation and professional liability insurance cet1ificates. The city manager shall report to the council at the next regular meeting his/her action in contracting employment.

    (e) Piggybacking. When procurement for goods or services has been the subject of another Florida public entity bid process, the item shall be considered exempt from section 2-237, bidding procedures.

    (f) Conflict o[Jnterest. This Conflict of Interest Statement (COl) is in addition to Chapter 112, Florida Statutes. Where there is a conflict between Florida Statutes and this Code, the more stringent requirement shall apply. All City Council Members and City Employees (hereinafter persons) are subject to the COl provisions. A COl is broadly defined as a situation in which a person may use their public office for private gain: give preferential treatment to any outside person; or make government decisions outside of nonnal official channels. A person shall not solicit or accept, directly or indirectly, any gift, gratuity, favor, entertainment, loan or any other thing of monetary value from anyone doing business with, or seeking to do business with the City. For those instances where a perceived COl exists for a covered person that individual must disclose the cor or potential cor to their immediate supervisor, or in the appropriate public

    Sec. 2-237. Bidding procedures.

    The following procedures shall be followed if bidding is used and the procedures are not other-wise modified.

    (a) Notice inviting bids. Any notice for bids shall be considered an invitation to potential bidders to submit offers to the city in conformity with the city's invitation. All bids received shall be considered irrevocable offers until such time as the city council accepts an offer or rejects the offer. Uniform Guidance standards stipulate that purchases where the aggregate dollar amount does not exceed $3,000 (or $2,000 if the procurement is construction and subject to Davis-Bacon) are defined as "Micro-purchases". Where practical, the City will distribute micro-purchases equitably among qualified suppliers. No competitive quotes are required if management determines that the price is reasonable. Florida Statute 287.057 stipulates that purchases for commodities or contractual services in excess of $35,000 (presently) requires competitive solicitation. A sole source or sole brand purchase may be authorized by the City Manager (without bidding) after receipt of proper documentation for the Originating Department and a review of the available brands or sources has been completed. A record of the sole source of sole brand request is maintained in Finance.

    (b) Publication of notice. Notice shall generally be by publication in at least one newspaper of general circulation in the city. In addition, the city manager may solicit bids directly from prospective bidders.

    (c) Bid bonds. When deemed necessary by the city manager, bid bonds may be prescribed in the public notice inviting bids. Unsuccessful bidders shall be entitled to return of surety after final action. A successful bidder shall forfeit any surety required by the city upon failure on his pa1i to enter a contract with ten days after receipt of a proposed contract from the city, unless such time is extended by the city.

    (d) Bid opening procedures.

    (1) Sealed. Bids shall be submitted to the city clerk sealed and shall be identified as bids on the envelope.

    (2) Opening. Bids shall be opened in public at the time and place stated in the public notice.

    (3) Tabulation. A tabulation of all bids received shall be available for public inspection.

    (e) Rejection of bids. The city council shall have the authority to reject any or all bids, or pat1s thereof, or any or all bids for any one or more supplies or contractual services included in the proposed contract, when the public interest shall be served thereby. Further, after rejection of all bids, the city council may solicit for new bids. The city manager shall have this same authority with respect to bids for contracts under $7,500.00

    (f) Bidders in default to city. The city council may reject the bid of a contractor who is in default of the payment of city taxes, licenses, or other monies due the city. The city manager shall have this same authority with respect to bids for contracts under $7,500.00.

    (g) Local bidders. Local bidders may be afforded a preference by the city council if this is in the public interest. The city manager shall have the same authority with respect to bids for contracts under $7,500.00.

    (h) Award of contract. The city council, after review of bids received, may award the contact to the bidder who, in the view of the city council, has submitted the bid that is in the overall best interest of the city. The city manager shall have the same authority with respect to bids for contracts under $7,500.00.

    (i) Payment and performance bonds. The city manager shall have the authority to require a payment and performance bond before entering into a contract in such amount as he/she shall find reasonably necessary to protect the best interest of the city. Any requirement under this section shall be included in the bid specifications. See. F.S. § 255.05.

    U) Waiver of bidding procedures. The city council may waive or modify the bidding procedures on specific contracts except as prohibited by state law.

    (k) Professional services. Public announcement and qualification procedures, competitive selection, and competitive negotiation for professional services of architects, professional engineers, landscape architects, or registered land surveyors shall be as specified in F.S. § 287.055, as applicable, and as said section exists or may be amended.

    (I) Public works. Public works contracts as defined in F.S. § 180.24, shall be bid m accordance with that section to the extent the section is applicable.

    AN ORDINANCE OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA, AMENDING CHAPTER 2, ARTICLE VII, PROCUREMENT, DIVISION 1. GENERALLY, SECTION 2-236 PURCHASING AND AMENDING SECTION 2-237 BIDDING PROCEDURES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION AND PROVIDING FOR AN EFFECTIVE DATE.

    WHEREAS, the City of Fellsmere, Florida is a duly constituted municipality having such powers and authority conferred upon it by the Florida Constitution and Chapter 166 Florida Statutes; and

    WHEREAS, the City Council held a duly advertised public hearing and has determined that the amendments to the Code of Ordinances of the City ofF ellsmere, Florida are in the best interest of the City and that the public health, safety, environmental and general welfare of the citizens of the City will be furthered by the amendments to the Code of Ordinances.

    NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA, AS FOLLOWS:

    SECTION 1. RATIFICATION. The above recitals are hereby ratified, adopted and incorporated herein as legislative findings of the City Council.

    SECTION 2. AMENDMENT. That Sections 2-236 and 2-237 of the Code of Ordinances of the City of Fellsmere, Florida are amended to read as set forth in Exhibit "A" attached hereto and by this reference made a part hereof.

    SECTION 3. CONFLICTS. All previous ordinances or parts of ordinances, resolutions, or motions of the City which conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.

    SECTION 4. SEVERABILITY. If any section, part of a sentence, phrase or word of this Ordinance is for any reason held to be unconstitutional, inoperative or void, such holdings shall not affect the remaining portions hereof and it shall be construed to have been the legislative intent to pass this Ordinance without such unconstitutional, invalid or inoperative part.

    SECTION 5. CODIFICATION. The provisions ofthis Ordinance may be incorporated into the Code of Ordinances of the City of Fellsmere, Florida and the word "ordinance" may be changed to "section", "article" or other appropriate word, and the sections of the ordinance may be re-titled, re-numbered or re-lettered, to accomplish such codification.
