Subject: An overview of Rule 707 requirements for increased bond amounts for excess inactive wells and report regarding the Financial Assurance Staff’s recent audit results.

Martha Ramos: Reviewed COGCC bonding rules and their requirements. All operators are required to have a bond under Rule 706 and 707, ensuring that the State is protected from financial risk. Operator has option of blanket or individual bonding. Inactive well bonding is greater than the operator’s Blanket Plugging Bond. Also reviewed warning letter and NOAV procedures related to bonding as well as compliance plans.

Commissioner Compton: Asked the reasons operators are requesting variances.

Martha Ramos: They usually want time for compliance.

Commissioner Craig: Asked if Staff looks at financial viability of an operator.

Martha Ramos: Yes, finances are considered.

Director Lepore: In most cases when operators are asking for a variance, they are looking to pay less than the total amount than would be required, in part by reducing the number of inactive wells.

Jane Stanczyk: Engineering group is involved in the review of the plan, including requirement that operator has current MIT compliance and has identified that there aren’t any potential environmental risks. Financial ability and costs to plug are all identified and considered. Priority is determined through a risk evaluation undertaken by Staff. To date, staff has reviewed 108 operators. The good news is that it appeared that some operators might be at risk, but many of them turned out to have adequate financial assurance. To date, $2.3 million in financial assurance has been added as a result of the audit. Public Comments: (late public comment was accepted by the Commission) 1) Jeri Sheperd: Is a homeowner and received a pooling notice and is concerned that because oil is less than $40, taxpayers may get left holding the bag when operators cannot afford to take care of facilities. The perception is that the process is a fait accompli. Was made leasing offers, but asks that the Commission proceeds carefully. Staff Presentation: Thomas Spring Reclamation Update Staff: Peter Gowen, Enforcement Supervisor Denise Arthur, PhD, Reclamation Supervisor Ryan Costa, Reclamation Specialist

Subject: At the October 2015 meeting, Commissioner Alward requested an update on the compliance status of Thomas L Spring, LLC regarding requirements imposed under Order No. 1V-437, entered October 28, 2013.

Peter Gowen: In October 2013, the Commission imposed a $20,000 penalty and suspended $18,000, pending compliance with the Order regarding reclamation. Inspections in mid-2015 revealed the site has not met final reclamation requirements. As a result, in late October 2015, Spring and Staff prepared a mutually agreeable reclamation plan with aggressive deadlines. Staff inspected the site in early December 2015 and all tasks had been performed. Although not yet reclaimed, with ongoing monitoring and management, the site should achieve full reclamation. Margaret Ash: Denise Arthur, Ryan Costa, and Mike Leonard have all been involved in this matter and are also available to comment. Staff has conducted site inspections over the last three years documented with photographs and reviewed plans from qualified experts. The current plan was revised several times, last on October 23, 2015, which included thorough conditions of approval, and is currently underway.

Commissioner Alward: Asked how the operator took care of the soil loss.

Margaret Ash: Operator mostly did recontouring, the sand did not travel very far. Commissioner Alward: Stated that he was a little disappointed in the lack of progress, but looks forward to a final report.

Commissioner Compton: Thanked Staff for their good work.

The Commission took a break. Reclamation Report Staff: Matthew Lepore, Director Margaret Ash, Field Inspection Unit Manager Denise Arthur, PhD, Reclamation Supervisor Subject: During the Commission’s May hearing, the Commission requested Staff review

the status of reclamation for oil and gas sites and provide a preliminary presentation to the Commission during the September hearing and a final presentation during the December hearing.

Margaret Ash: Gave an update from the preliminary presentation in September and overview of wells that passed final inspection and those still requiring final inspection. Most frequently identified problems include lack of vegetation, debris, and noxious weeds. Analysis of our rules compared BLM’s revealed our rules are rigorous and we are well staffed. After reviewing our rules as applied, there are opportunities for clarification of some ambiguities; a stakeholder group might help us to do this work. Subject areas include topsoil protection, surface owner waiver, weed management, triggers for final reclamation, and monitoring. Additional improvements could include a database for reports, final inspections, additional operator guidance, and data management projects, all of which are included in the final report.

Commissioner Compton: Asked if Ms. Ash was referring to all three categories of noxious weeds in her report.

Ms. Ash: Yes, but there are also undesirable species that are not on the “noxious weed” lists. These other weed species have also proved to be very problematic for reclamation.

Commissioner Compton: Asked if the current rules are clear enough when operators don’t want to reclaim where they didn’t drill, even if the operator disturbed the land.

Ms. Ash: I think these rules are clear in this regard, but industry may not accept it. This may be an area for fine tuning and could be tied into the Form 2A rules.

Commissioner Compton: Inquired whether Staff is encountering difficulty with landowners using areas of pad for gravel, etc., and any thoughts on solution for that.

Ms. Ash: We have to take a look at safety issues. Oil and gas locations shouldn’t be co-located with other industrial operations

Commissioner Benton: Asked if a surface owner is happy with condition of the pad, can they sign off.

Ms. Ash: That is part of the ambiguity of the surface owner waiver issue and interim reclamation. Vehicles, hay, and other items on a pad can interfere with reclamation.

Commissioner Compton: Asked how much leeway Staff has in approving requests for landowners to use land however they want.

Ms. Ash: Surface owner variance for final reclamation is available, but there are complexities, for example, the variance has to be protective of public health, safety and environment. We look at each one on an individual basis, looking at things like stormwater as priorities.

Commissioner Benton: Asked if Staff ever accepts sites in an “as is” condition.

Ms. Ash: No, it has to be for a specific purpose like road access or a water pond.

Commissioner Benton: Asked if an operator and a surface owner want to do something different, then does that information need to be on the Form 4.

Ms. Ash: Yes, there should be consultation between land owner and operator. More information is helpful up front, but operators also ask for surface owner waiver when reclamation doesn’t work.

Commissioner Alward: Asked when the Commission should weigh in on these variance requests.

Margaret Ash: We haven’t approved very many of these.

Denise Arthur: Outreach to stakeholders will help surface owners and operators better understand the rules and process.

Commissioner Compton: Whatever we do, we need to protect the soil. Asked how do we balance that with, for example, a situation where a rancher wants to keep an access road.

Ms. Ash: It needs to be stable and account for stormwater when we do our final inspections. On an individual basis, this is not too complex, but it can be when considering a network of roads.

Commissioner Alward: Noted that cumulative impact is difficult to determine if we are looking at each site case-by-case. It is important to think of how much production we are losing decade by decade to un-reclaimed land. Commissioner Compton: Thanked staff for this report and their time and effort.

Enforcement Hearing Matters: Docket No. 151000469, Black Resources, Inc. (Operator No. 8725) Staff: David Beckstrom, Enforcement Officer Kyle Davenport, Assistant Attorney General Black Resources, Inc: Bill Black, Principal and Sole Proprietor Subject: Staff request for approval of an Order Finding Violation against Black Resources,

Inc. (“Black”), imposing a $18,402 penalty for violating Rules 309, 319.b., and 326 at the State 36-11 well (API No. 05-083-06519) in Montezuma County, Colorado.

David Beckstrom: Staff requests that the Commission find Black Resources, Inc., in violation of Rules 309 (Operator’s Monthly reports of Operations), 319 (Temporary Abandonment – Annual Sundries), and 326 (Mechanical Integrity Testing) at the State 36-11 well, which has been shut-in since 1990. Black Resources was previously issued an NOAV for violations of Rules 319 and 326 in 2009 after which it came into compliance. Black Resources then failed to comply with rules 309, 319, and 326 from December 2009 until NOAV No. 2618134 was issued on June 10, 2015. Black Resources is currently in compliance with Rules 309, 319, and 326, but has demonstrated financial distress. Given Black Resources’ financial distress and current compliance, a suspension of a portion of the penalty is appropriate contingent on Black Resource’s continued compliance with Commission rules. Bill Black, Black Resources: Black Resources is financially distressed and unable to pay a penalty. Despite attempts to bring the State 36-11 well back online, there is no available market and thus the well must remain shut-in. Black Resources requests that the Commission not impose any penalty for these violations so Black Resources can stay in operation. Kyle Davenport: Although Black Resources has demonstrated financial distress, it has still violated Commission rules and only came into compliance after receiving an NOAV. As such, a penalty of $18,402 is appropriate for these violations even if a portion of the penalty is suspended and some portion should not be suspended and any suspension should require that Black remain in compliance.

Docket No. 151000483, Chris Glade Oil & Gas LLC. (Operator No. 10378) Staff: David Beckstrom, Enforcement Officer Jeremy Ferrin, Enforcement Officer

Subject: Staff request for approval of an OFV against Chris Glade Oil & Gas LLC

(“Glade”) which: 1) imposes a $66,636 penalty for violating Rules 309 and 326 at the Karis-Government 1 well (“Karis Well”) in Rio Blanco County, 2) orders Glade to plug and abandon the subject well, and 3) authorizes Staff to work with the BLM to address the subject well, in the event Glade fails to comply with the OFV.

David Beckstrom: Chris Glade Oil and Gas, LLC, was properly noticed of this hearing, but is not represented and submitted no prehearing documents except Stipulated Facts, marked as Exhibit 14. Staff requests that the Commission approve an order finding violation against Chris Glade Oil and Gas, LLC for violations of COGCC Rules 309 and 326 at the Karis Well in Rio Blanco County. The Karis Well is operated on federal lands and minerals and Bureau of Land Management terminated the lease in December 2011. Mr. Glade discovered a leak in the Karis Well in September 2011. To date, Glade has failed to repair the Well and conduct a successful mechanical integrity test. Glade Oil and Gas has also failed to submit the required Form 7s (Operators’ Monthly Report of Operations) for the Karis Well since May 2014. Therefore Staff requests that the Commission adopt its proposed order finding violation. Motion: Commissioner Alward moved to approve the Order Finding Violation in Docket No.

151000483 as proposed by Staff, but striking paragraph (g). Second: Commissioner Craig Yea: Unanimous Abstain: None

(“Black”) in Docket No. 151000469, imposing a $18,402 penalty for violating Rules 309, 319.b., and 326 at the State 36-11 well (API No. 05-083-06519) in Montezuma County, Colorado with the entire $18,402 penalty suspended pending the continued compliance of Black Resources with Rules 309 and 319 for a period of two years.

Presentation: Skid-Mounted Vapor Recovery Units By: Peter Mueller, President of EcoVapor Recovery Systems Hans Mueller, CTO of EcoVapor Recovery Systems Hans Mueller: Presented on the novel technology developed by EcoVapor and outlined the system’s oxygen conversion performance, and its benefits compared to flaring. The system also helps maintain lower tank pressure and produce lower emissions. Peter Mueller: Commented on the gas recovered and its present value, even in today’s market.
