ITB 101614 - 2015 Pavement Marking Project

MACOMB COUNTY BASED PREFERENCE

A local preference percentage credit from the following allowance table will be applied to the bid of any County-based Enterprise. This credit will be subtracted from the bid of the County-based Enterprise. In comparing bids, the bid of the County –based Enterprise after subtraction of the credit shall be considered the official bid. Drug Screening

To the extent not prohibited by law, all contracts for construction, repair, alteration, or rebuilding of a County building or other property shall include a provision requiring the contractor and any subcontractor providing services under the contract to conduct pre-hire screening for illegal drug use by their employees who provide services under the contract. ADVERTISEMENT FOR2015 COUNTY-WIDE PAVEMENT MARKING PROGRAM (PROJECT #101614)

The MacombCounty Department of Roadswill accept sealed bids until January 20, 2015 at 11:00a.m. EST, at the Macomb County Department of Roads Administration Building, 117 SouthGroesbeck Highway, Mount Clemens, Michigan 48043, at which time and place all bids will bepublicly opened and read.

PROJECT: This project will consist of the following approximate materials/quantities. Thisproject will include longitudinal pavement markings only. Specialty markings such as crosswalkswill not be part of the project.

Specifications will be on file and will be available on or after, January 5, 2015 at the MacombCounty Department of Roads, Administration Building, 117 South Groesbeck Highway, MountClemens, Michigan. Prospective bidders must have current prequalification with the MichiganDepartment of Transportation in the proper classification and numerical rating for the work bid.

NOTE: Bids which do not comply with the following pre-qualification requirements may not beread at the discretion of the Board. The pre-qualification rating shall be attached to the bid.

1. The pre-qualification rating shall be on file at the MacombCounty Department of Roads,or shall be attached to the bid. However, a letter from the Michigan Department ofTransportation may be accepted if the letter discloses that the pre-qualification ratingwith MDOTis extended, is currently in effect, and has not lapsed.

2. A contractor whose pre-qualifications have expired, and is unable to supply with theproposal a letter of extension from the Michigan Department of Transportation pre-qualification unit, as described in number one (1) above, shall certify in writing thattheir pre-qualification has been extended by the Michigan Department of Transportationuntil such time as their new rating can be issued. Certification means a written,notarized affidavit under oath, setting forth facts (dates, times and individuals), whichwill serve to substantiate the contractor's claims of classification. If this certificationdoes not accompany the bid, the Board in its discretion may elect not to read the bid.

NET CLASSIFICATION: 475 N3 (Pavement Marking)

A satisfactory bid bond, certified or cashier's check, bank money order, or certificate of depositon an open, solvent bank, in the amount of not less than five (50/0) percent of the total bid,payable to the Board of County Commissionersof the County of Macomb shall be submitted witheach bid.

The Macomb County Department of Roadsat its discretion, reserves the right to reject any or allbids and to waive any irregularities in the bidding process, and to make the award as may appearto be in the best interest of the County of Macomb. No bid may be withdrawn after thescheduled closing time for receiving bids for at least 45 days.

INSTRUCTIONS TO BIDDERS

The contractor shall complete the work herein described in strict accordance with the planstherefore and in strict conformity with the requirements of the Michigan Department ofTransportation's 2012 Standard Specificationsfor Construction, and such other special provisionsand supplemental specifications as may be a part of this bid. For the purpose of this bid,Michigan Department of State Highways, Michigan Department of State Highways andTransportation, and Michigan Department of Transportation shall be considered one and thesame. The published Invitation for Bid or Advertisement for the proposed work is to beconsidered a part of the "Instructions to Bidders".

PREPARATION OF BIDThe bid must be properly signed and the address of the bidder given. If the bidder is a co-partnership, each member shall sign the bid. The Board, at its discretion may require that theco-partnership file in the office of the Board a duly executed certificate of co-partnership. Acorporation who shall present the bid shall do so by its duly authorized officers in accordancewith its articles of incorporation. The Board at its discretion may require that the corporation filewith the office of the Board a certified copy of the incorporation and authority of officers'signature. SeeArticle 102.05 of the 2012 Standard Specificationsfor Construction. Bid pricesshall be en ered to the nearest one cent (0.01).

BID REJECTIONAttention of Bidders is directed to the 2012 Standard Specification for Construction Article102.11, relating to Bid Rejection and 102.06, relating to Irregular Bids.

NUMBER OF COPIES OF CONTRACTThree (3) copies of the contract with the bonds will be required to be executed by the Contractorand the Board of County Commissionersof the County of Macomb.

CONSTRUCTION PROGRESS SCHEDULEThe bidder shall complete the Construction Schedule, as provided in the bid, by indicating thedates for completion of the major items of work. This schedule shall become a part of thecontract. As the work progresses, the Traffic Engineer will check the construction program and,from time to time, order such modifications as may in his opinion be necessary to comply withthe completion date and general construction progress. See Article 102.14 of the 2012 StandardSpecifications for Construction.

PREQUILIFICATION OF BIDDERSProspective bidders must be pre-qualified by the Michigan Department of Transportation andmust have the proper classification and numerical rating required for the work on which heproposed to bid. See Article 102.01 of the 2012 Standard Specifications for Construction.

SUB-CONTRACTING OF CONTRACT WORKPrior to naming a sub-contractor for any of the designated items or specialty items listed underSubcontract Provisions, the principal Contractor must assure himself that the requirements ofArticle 108.01 of the 2012 Standard Specificationsfor Construction will be met.

SUPPLEMENTAL SPECIFICATIONS

101 TERMS, FORMAT AND DEFINITIONSThe intent and meaning of terms shall be in accordance with Section 101 of the 2012 StandardSpecifications for Construction, except as herein provided.

102 BID SUBMISSION, AWARD AND EXECUTION OF CON RACTThese requirements shall be in accordance with Section 102 of the 2012 Standard Specificationsfor Construction, except as herein provided.

102.17 BID GUARANTY PAYMENTNo bid will be considered unless accompanied by a bid bond, certified or cashier's check orCertificate of Deposit on an open, solvent bank in the amount of not less than five percent (5%)of the total bid, payable to the Board of County Commissioners of Macomb County as aguarantee that the bidder will enter into contract.

102.15 EXECUTION AND AWARD OF CONTRACTThese requirements shall be in accordance with Section 102 of the 2012 Standard Specificationsfor Construction, except as here in provided.

102.16 REQUIREMENTS OF CONTRACT BONDPerformance and Lien Bonds shall be furnished in accordance with Article 102.16 of the 2012Standard Specifications for Construction, except that the amount of such bonds shall be 100% ofthe total contract price.

107.10 INDEMNIFICATION, DAMAGE LIABLITY AND INSURANCEThe contractor shall safe harmless and indemnify the Macomb County Department of Roads andits employees, and each Township, City or Village in which work is done, against all claims fordamages to public or private property and for injuries to persons or property arising out of andduring the progress and to the completion of the work.

The contractor and subcontractor (Type A Insurance Only) will be required to furnish 3 copies ofthe Certificate of Insurance on forms furnished by the Macomb County Department of Roads, and3 copies of the Owner & Contractors Protective Policy, prior to execution of the contract (seesample).

Failure on the part of the contractor to provide the proper Insurance Policy (Owners andContractors Protective Policy) within the time limits provided in the insurance binder issued bythe insurance carrier will be reason for the Traffic Engineer to order all work to stop and thecontractor to remove all equipment from the road right of way until such time that the properinsurance policy has been received by the Macomb County Department of Roads.

THE OWNERS AND CONTRACTORS PROTECTIVE PUBLIC LIABLIITY AND PROPERTYDAMAGE INSURANCE POLICY MUST BE ISSUED BY A COMPANY WHO HAS BEENADMITTED BY THE STATE OF MICHIGAN AND HAVE AN A. • BEST'S RATING OF NOTLESSTHAN "A-".

109.04 PROGRESSAND PARTIAL PAYMENTSArticle 109.04 of the 2012 Standard Specifications for Construction shall be revised as follows:

From the total amount earned, the Department of Roads will deduct and retain ten (100/0)percent of the amount earned until fifty (500/0) percent of the contract is completed. After fifty(500/0) percent of the contract is completed, additional retainage will not be withheld unless thecontractor is not making satisfactory progress or for other specific cause relating to thecontractor's performance under the contract. Should additional retainage be withheld, it will notexceed ten (100/0) percent of the amount earned.

For contracts having a value of Thirty Thousand ($30,000.00) Dollars or more, or having four ormore partial payments, the Macomb County Department of Roads will deposit the retained fundsin an interest bearing account in a regulated financial institution in this State, where in all suchretained funds are kept by the Macomb County Department of Roads, which shall account forboth retainage and interest on each construction account separately.

The bidder and the Macomb County Department of Roads, upon entering into a contract,mutually agree to abide by the rules as set forth in the State of Michigan Act No. 524, Public Actsof 1980.

PREVAILING WAGE AND FRINGE BENEFIT RATESThe contractor and his subcontractor's shall be required to pay each class of employeesemployed in this project not less than the wage and fringe benefit rates prevailing in the localityin which the work is to be performed as determined by the Michigan Department of Labor, perthe prevailing Wage Law, Act No. 166, PA of 1965.

PROGRESS CLAUSE

The Contractor shall start work within 10 days after May 1, 2015 or on the date agreed upon withthe Engineer. In no case shall any work begin prior to receipt of formal notice of award or priorto formal certification of the Contractor's equipment, if required. The entire project shall becompleted on or before July 31, 2015.

The low bidder(s) for the work covered by this bid will be required to meet with the MacombCounty Department of Roads representatives to work out a detailed progress schedule. Theschedule for this meeting will be set after the low bidder is determined. The namedSubcontractor(s) for Designated and/or Specialty items, as shown in the bid is recommended tobe at the scheduled meeting if such items materially affect the work schedule.

The Project Engineer will arrange the time and place for the meeting.

The Progress Schedule shall include, as a minimum, the controlling work items for the completionof the project and the planned dates (or work day for a work day project) that these work itemswill be controlling operations. When specified in the bidding bid, the date the project is to beopened to traffic as well as the final project completion date shall also be included in the projectschedule.

If the bidding bid specifies other controlling dates, these shall also be included in the ProgressSchedule.

Failure on the part of the contractor to carry out the provisions of the Progress Schedule, asestablished, may be considered sufficient cause to prevent bidding future projects until asatisfactory rate of progress is again established.

MEASUREMENT AND PAYMENTThe completed work, as measure for Maintaining Traffic will be paid for under the pay item for"Minor Traf Devices" in accordance with the 2012 Standard Specifications for Construction, whichshall be payment in full for all labor material and equipment needed to accomplish this work.

The individual locations included in this project will be considered as part of one comprehensiveproject. Minor Traf Devices will be based off the total contract price, not each individual location.

Any additional traffic control not listed in the 2012 Standard Specifications for Construction underMinor Traf Devices, Section 812.04, shall also be paid as part of Minor Traf Devices.

The description, measurement, and payment for Mobilization Max. 5% will be in accordancewith the 2012 Standard Specifications for Construction.

The Macomb County Department of Roads Standard for Construction consists of the 2012Michigan Department of Transportation Standard Specifications for Construction. GENERAL RESPONSISILmES

COUNTY

Supervision - all work done under this contract will be under the supervision of the ProjectEngineer or authorized representative.

Layout - the MCDR's will be responsible for all layout work needed identifying the properlocations for pavement markings.

Daily Work Sheets - the Contractor will provide daily work sheets to the Macomb CountyDepartment of Roads for their completion each work day. They are to be submitted to theProject Engineer or this authorized representative the following work day for approval. Thesework sheets will be the principle method for determining payment.

CONTRAcrOR

General - the contractor shall furnish all material, labor and equipment necessary for therequired pavement preparation, marking application, protection of the work and traffic control.

Storage or Pa king - Equipment will be permitted to be stored or parked on county propertywith prior approval by the Project Engineer.

Safe Handling of Materials - the contractor shall provide the Project Engineer with MATERIALSAFETY DATA SHEETS for all material and containers in accordance with the Federal ResourceConservation Recovery Act (RCRA) of 1976 and the Michigan Hazardous Waste Management Act(Act 69).

Traffic Control &. Safety - proper Traffic Control is a mandatory requirement for working onthe roads of the Macomb County Department of Roads. The design, placement and requirementfor traffic control devices shall be those found in the current edition of the Manual on TrafficControl Devices. The Contractor is solely responsible for maintaining traffic at all time for theiroperation.

All vehicles used in the marking operations shall be equipped with rotating or oscillating flasherswhich are visible from both the front and rear of the vehicle. The pavement marking vehicle shallbe equipped with the illuminated Target Arrow, Type S, visible from rear of the vehicle.

The trailing vehicle shall also be equipped with an appropriate sign visible from the rearindicating the following or equivalent legend: "Wet Paint Do Not Cross Lines". The trailingvehicle shall also be equipped with an illuminated Target Arrow, Type S, which shall be visiblefrom the rear.

Protection of Wet Markings - the protection of wet marking shall be the responsibility of theContractor, until such markings are sufficiently dry to permit traffic to travel upon.

Pavement Preparation - prior to the application of pavement marking materials, it shall be thecontractor's responsibility to ensure that the pavement surfaces are clean, dry and free of allforeign materials, which are easily removed by a power broom or blower.

Daily notification - Prior to the start of each day's work, the Contractor must notify the ProjectEngineer or authorized representative of the location where the painting crew will be working.No work is to begin without the Project Engineer or authorized representative on site or priorauthorization to begin such work from the Project Engineer.

Daily Records - accurate daily records shall be kept by the Contractor with a copy for theMacomb County Department of Roads indicating roadways marked, length, materials used,equipment used and employeesworking.

FOR PAVEMENT MARKING, CENTERLINE AND EDGELINEEQUIPMENT

The pavement marking equipment shall be self-propelled when used to apply longitudinal lines ofthe specified marking material. Where the configuration or location of a pavement marking issuch that the use of a self-propelled pavement marker is unsuitable, the specified material andglass beads may be applied by other methods and equipment approved by the Project Engineer.The Engineer will determine if other equipment is suitable for a particular use such as specialmarking etc.

All self-propelled equipment must be certified by the Michigan Department of Transportation priorto use. A valid certificate will be presented to the Project Engineer prior to the start of work.

All pressurized air lines shall have water and oil traps installed and operating at all times. Ingeneral, the equipment shall be that necessary to accomplish the marking in a safe and efficientmanner.

The self-propelled pavement marker used to apply centerlines shall be capable of applying threeyellow four-inch minimum width lines on a two lane road in one pass of the equipment. Theequipment shall have sufficient material capacity to enable sustained pavement markingoperations and shall be equipped so as to assure uniform application of the paint and beads.The equipment shall have pressurized bead dispensers.

The contractor shall use a dashing mechanism, capable of being easily adjusted to retraceexisting lane or centerline markings as shown on the plans or in the bid or as directed by theEngineer. The pavement marking machine shall be equipped with a method of measuring theflow rate of the material to the applied line. A flow meter, graduated tanks or other methodapproved by the Engineer is acceptable for measuring flow rate.

The self-propelled pavement marker shall allow pavement marking to be applied either directionon a given roadway and the skip cycle shall be continuous. The cycle control unit shall not zeroor return to the beginning or start of a new cycle even thought the skip line markings areinterrupted by intersections, dual line no passing zones, school/pedestrian crossings, railroadgrade crossings, etc.

It is also necessary to maintain the cycle through "no passing zones' where the centerline skipmarking is omitted in double yellow markings. In most cases, this will allow for more accurateretracing and maintaining the cycle of the center skip line. The contractor's equipment shallinclude a linear footage meter to measure the length of each applied line.

Waterborne Paint - the paint used for the centerline, lane line and edgeline shall bewaterborne pavement marking material.

Certification - the paint manufacturer(s) shall certify to the County that the paint meetscurrent Michigan Department of Transportation specifications.

Each container shall plainly show in weather resistant markings, the name of the producer,description of the material, batch number, and date of packaging and volume of contents.

GLASS BEADS

Certification - the manufacturer shall certify to the County that the glass beads meet currentMichigan Department of Transportation Supplemental Specification for Glass Beads for use inPavement Marking with the exception of bead coating for waterborne pavement marking paint.The bead used in waterborne pavement marking shall have a moisture resistant coating and anadhesion promoting silane coating.

APPLICATION SPECIFICATIONS

GENERAL

Conformance - pavement markings placed by the Contractor shall conform to the requirementsof the current edition of the Michigan Manual on Uniform Traffic Control Devices.

Workdays - pavement markings shall not be placed on Sunday's or legal holidays unless priorapproval is granted in writing by the Project Engineer.

Weather Limitations - waterborne paint (May 1st to September 1st) shall be applied when thesurface temperature of the pavement is 50°F or higher and the pavement is dry. The contractorshall be responsible for making the decision to apply waterborne paint on any specific day wherethere is a high probability of rain in the forecast. If lines are washed away the contractor shall beresponsible for reapplying the lines at no additional expense to the Macomb County Departmentof Roads.

Project Work Schedule - the Contractor is responsible for submitting in writing a project workschedule prior to beginning work. A beginning date and completion date for the project shall beincluded in the schedule.

Flow Meters - the material used for centerline, lane line and edgeline markings shall be runthrough a flow meter as applied to determine actual gallons used. The Contractor shall not resetthe flow meter when refilling the paint, unless it is first recorded.

Linear Foota e Meter - a linear footage meter shall be used to measure the length of appliedline. The Project Engineer may check calibration of any metering device at the RoadCommission's discretion.

Air Jet - pavement marking equipment shall be equipped with a pressure regulated air jetcapable of removing all debris from the pavement in advance of the applicator gun. The air jetshall be equipped with a moisture separator.

MARKING DE IGN

Centerline - a three line system shall be used. The lines shall be four (4) inches in width. Theskip centerline shall have a cycle of 50 feet, with a 12.5 foot yellow segment and a 37.5 foot gap.

Edge Line - the edge line shall consist of a solid six (6) inch white place on the pavementadjacent to its' edge.

Skip line - the four (4) inch white lane lines shall have a cycle of 50 feet, with a 12.5 foot withsegment and a 37.5 gap.

APPLICATION RATE

Waterborne Pavement Marking - Waterborne paint and glass beads shall be applieduniformly at the rate shown in the following table. Application rates will be determined bydividing the quantity used by the length of line painted.

New markings shall be applied as specified. Unless otherwise directed, existing line markings areto be retraced with lines of equal length, allowing for a longitudinal tolerance of one-fo0t with atransverse tolerance of two inches. The width of line applied shall be width specified plus orminus 1/4 inch.

Applied markings shall be sharp, well defined, provide uniform retroreflectivity, be free of unevenedge, over spray, or other readily visible defects which, in the opinion of the Project Engineer,detract from the appearance or function of the pavement markings.

Markings that are improperly located shall be corrected. Improperly located markings shall beremoved at the Contractor's expense, in a manner acceptable to the Project Engineer andreapplied in the correct locations at the Contractor's expense.

MATERIAL APPLICATION DEFICIE CIES

Markings which are applied with material shortages shall be properly reapplied at the Contractor'sexpense or be subject to acceptance with applied deductions.

DEDUCTION FOR MATERIAL DEFICIENCIES

Material application shortages exceeding six percent (6%) will not be permissible withoutdeductions. Any determination of pay deductions resulting from shortages in marking materialsor glass beads shall be based on measurements obtained under Measurement and Payment.

If material shortages exist, the markings shall be reapplied at the Contractor's expense or thecontract unit price will be reduced in direct proportion to the deficiency up to fifteen percent(15%) maximum.

If the deficiency of any material is more than fifteen percent (15%) that day's work shall beconsidered unsatisfactory and that day's markings shall be reapplied at full expense to theContractor, including all labor, equipment and materials.

Any reapplied markings requested or authorized by the Project Engineer shall be applied at theminimum gallons per mile rate described in Application Rate.

Payment for accepted in place quantities will be made at contract unit prices, or prices adjustedas described herein. Payment shall be full compensation for all materials, labor and equipmentnecessary for placement for the material.

Method of Payment

Contractor payment will be based on the daily work sheets as approved by the engineer andinspector for the Macomb County Department of Roads within 2 weeks after completion of eachpainting session, excepting a 10% retainage to be paid upon the Contractor finishing the finalpaining session and removing all supplies, materials, empty drums, etc. from the Department ofRoads storage facilities.

After the completion of each days painting activity and before beginning the next days activitythe Contractor shall furnish to the engineer or inspector the "Daily Work Sheet".

CONSTRUCTION Influenced Area (CIA)The CIA boundaries shall include the area within the right-of-way and/or cross street within thelimits of the construction signing.

TRAFFIC RESTRICTIONSNo work shall be performed or lane closures allowed during legal holidays as observed by theMacomb County Department of Roads. The contractor shall coordinate their work schedulearound special events that take place in local communities in accordance with the Engineer. Thecontractor shall be responsible to contract the Macomb County Department of Roads to acquirespecific dates and locations for these events and the events that are listed below or yet to bedetermined:

If it becomes necessary for the contractor to perform installation activities in the middle of theintersection where it is impractical to place lane closures, police assistance shall be obtained. All traffic signals shall be fully operational before the Contractor leaves the work site.

TRAFFIC CONTROL DEVICESAll traffic control devices shall conform to the current Michigan Manual on Uniform Traffic ControlDevices (MMUTCD), 2011 edition as revised. All signs shall be 48 inches x 48 inches unlessotherwise noted. All temporary signs shall be installed on portable supports. All signs shal havea minimum bottom height of seven (7) feet. Barricade spacing shall conform as indicated onthe appropriate attached typical. Traffic cones, when called for, shall be clean and have aminimum height of 28 inches. Traffic cones will be paid for as part of "Minor Traf Devices". ALighted Arrow, Type C, shall be used when closing a traffic lane.
