Introduction about Than Giap Hydropower Plant
Than Giap Hydropower Plant is a new construction project on the tributary of Bac
Vong river in the area of Than Giap commune, Trung Khanh district and An Lac
commune, Ha Lang district, Cao Bang province. It is far around 70km away from Cao
bang city, and 12km away from Trung Khanh town in the South.
Bac Vong River originates from China and flows into Vietnam in Tri Phuong
Commune, Tra Linh District, Cao Bang Province. The total length of the river is about
35 kilometers, the width is from 20 to 30m. Water flow varies by the seasons: in the
rainy season, the flow is 85m3/s, in the dry season, the flow is 5 m3/s. The main source
of this river flows from China, through Tri Phuong and Quang Trung Communes in Tra
Linh district, and then Trung Phuc, Thong Hue, Than Giap communes in Trung Khanh
district, An Lac commune in Ha Lang district, Hong Dai and Trieu Au communes in
Phuc Hoa district and then merges with Bang river in Ta Lung town, Phuc Hoa district,
Cao Bang province.
Geographical location of the project area:

Installation capacity of Than Giap hydropower plant is 6 MW, average annual output
is approximatetly 21.49 million kWh, is diversion hydropower plant with daily regulated
reservoir. The main specifications are: catchment area to the slected route: 496.8 km2,
total average annual flow is Qo: 8.93 m3/s; reservoir area at normal water level is 8 ha;
normal water level is 465m; dead water level is 460m; volume of the whole reservoir is
0.702 x106m3; useful volume is 0.285x106m3; dead volume is 0.416 x106 m3; the
largest flow Qmax: 14.10 m3/s; ensure flow is Q đb: 0.94 m3/s, output voltage is 35 kV.
The project shall be implemented for 2.5 years, open in June 2016 and complete in
the second quarter of 2018.
Truong Minh Limited Company is responsible for construction, management and
operation of the plant. Funding source for the project implementation is from World
Bank (WB).

Necessary scope to recover land and other assets for the project. According to
inventory of loss (IOL), there is 351,251.4m2 land of many types that are affected
permanently, 63,373.2 m2 is affected temporarily. No damage of house, no household has
to replace.
What will happen to the households losing property and livelihoods? Affected people
will be compensated in cash at replacement cost for land and assets on land (eg, trees,
crops...) along with other supports, including support for livelihood recovery based on
the impact level.
The benefits of households affected by the project? After considering the factors
affecting the market price, replacement cost calculations for compensation of land and
property on the land, Cao Bang PPC issued Decision No. 40/2014 / QD-Committee
December 19, 2014 about the issuance of price list for land in Cao Bang province.

assistance of VND2,000,000/labor.

Relocation assistance fee: VND 2,000,000 /HH and transition
subsistence allowance in cash equal to 30kg of rice/member/month
for 3 month period.

Economic organizations, family business enterprises with
registered industries are to stop production due to land
acquisition for the project, they are entitled to get assistance
equivalent to 30% of 1 year’s income after taxes, calculated
according to the average income level for last three years.

Local policies on families are entitled to social assistance when
the State acquires land and relocate
The revolutionary activists prior to 1945, Hero of the People's
Armed Forces, Vietnam heroic mother, Labor Hero, relatives
of martyrs receiving monthly assistance, invalids, sick soldiers,
social policy beneficiaries such as war invalids losing 81%
onward of labor is assisted with 5,000,000 VND/householder

Assistance policy of the project
(i) Assistance for job transformation (Working at the factory)
and (ii) recovery of income by livestock technical training
Grievance and grievance redress mechanism.
Grievances related to any aspect of Than Giap Hydropower project will be handled through
negotiation aimed at achieving consensus. (i) Stage 1: At commune level, the APs will address
the complaint to the reception office of CCP for guidelines on necessary procedure. CCP will
work with the APs and CCP has 30 days after receiving the complaint to solve. CCP is
responsible for documenting and storing documents on all complaints that it handles.
When CPC makes a decision that the household can appeal within 30 days. If the second
decision has been issued and the household is still not satisfied with the decision, they can
appeal to District People’s Committee (DPC). (ii) Stage 2: At district level: Upon receipt of
complaint from the household, the DPC will have 30-45 days after receiving the complaint to
resolve the case. DPC is responsible for documenting and storing documents on all complaints
that it handles. When DPC makes decision, households can appeal within 30 days. If the second
decision has been issued and the household is still not satisfied with the decision, they can
appeal to the PPC. (iii) Stage 3: At provincial level: Upon receipt of complaint from the
household, PPC will have 30 - 45 days after receiving the complaint to resolve the case. PPC is
responsible for documenting and storing documents on all complaints that it handles. When
PPC DPC makes decision, the households can appeal within 30 days. If the second decision has
been issued and the household is still not satisfied with the decision, they can appeal to the
court within 45 days. (iv) Stage 4: Civil Court: If the APs submit the case to the court and the
court’s decision to side with the APs, provincial government will have to increase the
compensation as much as the level decided by the court. In case the court sided with PPC, the
APs will be refunded with the amount paid to the court.

CONSULTANT
TERMS OF REFERENCE FOR EXTERNAL MONITORING CONSULTANCY OF
RESETTLEMENT
I. Introduction
1. The general objective of the Renewable Energy Development Project is to support the
development of renewable energy sources producing electricity with lowest costs in sharing
with the national total electricity generation under commercial sustainability and ensuring
social and environmental sustainability.
2. Than Giap Hydropower Plant is a new construction project on the tributary of Bac
Vong river in the area of Than Giap commune, Trung Khanh district and An Lac commune,

8. This resettlement plan is prepared to ensure that: (i) Involuntary resettlement must be
avoided where possible, or be reduced to the lowest possible extent by selecting appropriate
design options, (ii) Where involuntary resettlement is unavoidable, the resettlement
activities must be prepared and executed with sustainable development programs and
sufficiently provided investment supports, enabling displaced people to benefit from the
subproject. The displaced people will be fully consulted and allowed to participate in
preparing and implementing activities in Resettlement Plan.
II. Objectives
9. The general objective of the external monitor is to provide a third party periodic
review and assessment of:
(i) Resettlement activities, including:
- Achievement of resettlement objectives;

- Changes in living standards and livelihoods;
- Restoration of the economic and social base of the affected people;
- Effectiveness, impact and sustainability of entitlements and income restoration
programs; and
- Strategic lessons for future policy formulation and planning will also be drawn from
the monitoring and evaluation of resettlement;
(ii) The issues relevant to development for ethnic minority groups:
- How are the mitigation measures proposed and implemented;
- Is there any other negative impace on ethnic minorities that have not been evaluated,
not identified mitigation measures;
- How are the Community Development Supports for ethnic minorities set and
implemented;
- Is the information provided adequately, is the consultation process with ethnic
minorities implemented or implement effectively or not; and
- The grievance redress process about the development plan for ethnic minorities and
other issues that they are facing.
III. Approaches
10. The methods for external monitoring and evaluation of land acquisition, compensation
and resettlement activities include:
- Review of Detailed Measurement Survey (DMS): As soon as the detailed design is
finalized and staked to the ground by Truong Minh Limited Company and CARB,
data collection from all APs to establish their eligibility and entitlements will be
carried out. The data that will be entered into a database to document the following:
a) socio-economic status of affected households; b) nature and extent of losses; and
c) entitlements to compensation and other assistance. These data will be made
available to the EMA, to enable them to establish a baseline for monitoring and
evaluating project benefits. During the conduct of the DMS, the EMA will also
monitor the DMS process to determine and assess if DMS activities are being
carried out in a participatory and transparent manner
- Socio-Economic Survey (SES): The SES is designed to provide a clear comparison
of the success and/or failure of the resettlement program to restore their livelihoods
and living standards. In general, if a lag of 3-5 years or more occurs between census
and SES and actual land acquisition, demographic and socio-economic factors may
change significantly. In this Project, if land acquisition is not carried out within two
years after SES, Truong Minh Limited Company and CARBs will carry out another
SES. A post resettlement survey will also be undertaken by the EMA 6-12 months
following completion of resettlement activities. Special attention will be paid to the
inclusion of women, ethnic groups, the very poor, the landless and other vulnerable
groups, with set questions for women and other target groups; and, the database
disaggregates information by gender, vulnerability and ethnicity.
- Participatory rapid appraisals (PRA): The PRA will involve obtaining information,
identifying problems and finding solutions through participatory means including: a)
key informant interviews; b) focus group discussions on specific topics such as
compensation payment, income restoration and relocation; c) community public
meetings to discuss community losses, integration of resettled households in host
communities or construction work employment; d) structured direct field
observations, for example, of resettlement site development; e) formal and informal

interviews with affected households, women, ethnic minority, and other vulnerable
groups; and, f) in-depth case studies of problems are identified by internal or
external monitoring and required special efforts to resolve
- Verification of Replacement cost survey: The EMA will also verify whether
compensation paid were at replacement cost. A special market study to validate
whether the rates used in compensation in land and other non-land assets were at
replacement cost will be undertaken.
IV. Capacity requirements to external monitoring agency (EMA)
11. External monitoring agency is a unit who is capable and experienced in the field of
resettlement and social development or ethnic minority. External monitoring agency is
established from those who have experience of implementing monitoring of resettlement,
social and ethnic minority development projects funded by ADB, World Bank, and JICA.
They must have a University degree/postgraduate (social sciences or related field), with at
least 5 years experience in preparation and implementation of resettlement plans,
development plans for EM and can use English very well (writtingn and read).
V. Report
12. The external monitoring agency or EMA, conducted by an experienced resettlement
and social development consultant and selected by PMU (under MOIT). External
monitoring, inspection and evaluation will be made on a yearly basis, except for the first
stage, it is requested to be made twice/year. All external monitoring reports will be made
available to the affected households by placing reports in the commune / ward and field
offices and will be uploaded on WB website. Table 1 and Table 2 below describe
Monitoring and Evaluation Indicators for implementation of resettlment pland and ethnic
minority development plan.
