Legal Humming
Legal humming is an initiative to provide a platform to all lawyers, critics, poets, journalists and for all those who write to express their voice for a better change in society. We believe that one should e-publish to reach the audience because social connection and public network is today's voice. With a motto to provide a voice to every young and budding lawyer and for anyone who writes for a change, Deshana Doshi (Founder) came up with a 100% authentic website for publishing on 31st May 2020. Legal Humming reaches 200 unique visitors every day and has collaborated with students of 35 different colleges and universities so far. We at Legal Humming believe in high-grade quality content and publish articles every Wednesday and Saturday.

To enhance the proper standard of practical training through the Moot Court the School of Law, Arka Jain University(AJU) and Legal Humming proudly announces First International Virtual Arbitration Moot Court Competition,2021 on 11th and 12th September,2021 with proud knowledge partner All India Reporter India and All India Reporter Legal Academy and Research Centre. We all know the importance of Moot Court in legal education and it is compulsory part of curriculum as prescribed by Bar Council of India. To be witnessed the proceedings about the courts by moot court practical sessions is always worth while for the law students of any School of Law. The Moot Court Competition develops the analyzing power, research aptitudes and interpretation of concerned statutes amongst the law students. The School of Law, AJU is committed exclusively to encourage for the advancement of Legal Education by providing the proper training to develop the advocacy skills through Moot Court Competitions. Hence, to organise the First International Virtual Arbitration Moot Court Competition is the serious efforts of School of Law,(AJU). Our learned faculty members named Ms. Amrita Srivastava has conducted various Moot Court Competitions at university level. Mr. Nehru Beniwal won the Best Researcher Award at National Level three times and Ms Dipshreeya Das was the member of State Level Moot Court Winning team of Assam. The School of Law(AJU) is providing online access for research by SCC Online, LexisNexis and AIR to the law students. Has adopted new pedagogy to give the legal education by its well furnished Moot Court Hall, Best Library, High Tech Computer Labs and well qualified faculties to develop the entire personality of a law student and face the challenges from classroom to courts. 3.)Mahindra resort is seven star hotel and resort has a good reputation for providing the best
services which meet the requirements of the novel customers as well as Indicia is also one of the
India’s leading resort where it has renowned its efficient service to the customers as trademark.
Indicia have supplied various other good restaurants in other parts of the country as a result India
has maintained the high quality and quantity which has to be produced to the customer required
services.
4). On 1st of February 2019, the parties entered into an agreement which follows a contract suggested by the Mahindra and Indicia (The general clauses are similar to general contract). The Contract includes place of Arbitration in Madras and Force Majeure clauses and the Agreement is governed by the Law of India.
5).1As per the Agreement, Mahindra Resorts paid 40% as consideration. Thereafter, subsequently Indicia has accepted terms of the Agreement, where Mahindra Resorts intended to accept reservations for guest stays from 2019 onwards as condition.

. 6)Mahindra resort has entered into the agreement with Indicia where they have gone
for the consideration with the conditions for the services provided to the customers with the
Indicia. Mahindra has gone for the execution of services obligation in this agreement and
they have agreed to have the service obligations through consideration into stages and each
stage has to be done after the completion of the condition by Mahindra.
7)The agreement provides with the continuation, and it includes the exchange of the
conditions for the services provided, the agreement containing the arbitration clause
provided for arbitration in London, and the law governing the arbitration agreement is not
going to be set into two agreements and it also contained a provision that if any of the party
with the right to approach to the court for seeking any interim relief.

. 8) Because of COVID-19 a huge pandemic has occurred and given a major attack to both of the parties
and it has been assessed that COVID-19 can be seen for long period of time by March 2020 Even though
both the resorts have come up with the peak of their promotion and marketing activities but due to the
publicity of the resorts there was a massive inflow reservation in the resorts and it has given a lots of
business but in March 2020 it has been seen that the government of India has come up with the lockdown
from March till November due to which the resorts was closed.
9) Country has operated the regular manner during the other months with safety protocols of Covid -19 on
priority. For the first several months of postcovid-19 the resort has successfully completed the targets within
the time frame and the certain aspects have been settled for certain payments. In meanwhile some
transaction has been found false on behalf of the failed transactions.
10) By early December 2020, over 80% of the transaction was completed; However, Indicia were not within
the stipulated time frames for transferring the amounts. Following the Covid-19 protocols, the management
of Indicia Resorts determined the business of 8 crores has been completed by February 2021. Due to cause
of action and arising of dispute, Indicia has initiated the arbitration proceeding against Mahindra of one
crore on the basis that the part of the consideration has not been paid.26
11) During the course of the arbitration, Mahindra has come to know that the Arbitrator proposed
by Indicia have continuously been proposed as an arbitrator in several other arbitrations, in which
Indicia is been represented by the Firm of Attorneys at the said Arbitrations. As such, Mahindra
made a separate application that there is apparent bias in respect of the Arbitrator appointed by
Indicia.
12) So Mahindra has filed a counterclaim and on the basis of that, Indicia has disclose all the
transactions at the time of due diligence which has been conducted by Indicia but Mahindra
claim that all the transaction has gone only for 8crores but Indicia has claimed that Mahindra has
done some fraud and the matter has to be decided by the civil court at this juncture Indicia has
filed an application under section 9 of arbitration and conciliation act seeking a direction against
Mahindra but this application has been dismissed by the single judge of Ahamadabad High
Court on the basis of maintainability that-

○ The dispute is not going for arbitration because of fraud.
○ The consequence of choosing the seat in London was to include the
Indian arbitration and conciliation act as there may not be anything
against the public policy for two Indian parties.
○ Even any part of the arbitration and conciliation act does not apply to
the given situation.
○ Party has waived section 9 of the act.
13. Now the matter is in front of division bench for the next hearing in
Ahmedabad High Court.

Rules of the Competition
#Language: The language of the Competition shall be English.
#Eligibility Criteria:● Law schools/Colleges/ Institutes/ Universities, recognized by the Bar Council of India,
are eligible to participate. The participants should currently be pursuing their degree in law i.e., Three Year/Five Year Law/LLM Courses.
● Students who have completed their law courses are not eligible to participate in the competition.
● There shall be two speakers and one researcher designated for each team. In case of illness of the designated speaker, the researcher may be allowed to argue for the team with prior permission of the Committee.

Rules of the CompetitionRegistration:● General● Every team has to register for Arka Jain University in Collaboration with Legal
Humming and Center for Rule of Law International Virtual Arbitration Moot Court Competition by filing the registration form, in the prescribed manner by 30th August, 2021.

Rules of the CompetitionClarification:● Clarifications can be sought on any part of the moot proposition by 1st September,
2021. These clarifications are to be send via e-mail at, [email protected] or [email protected] clarifications will be released by , 3rd September,2021.
● It is at the discretion of the Governing Council to decide whether a clarification sought for is valid and to be clarified.
ANONYMITY OF TEAMS:● The teams shall not indicate their names or the names of their college or the
university on memorials. For all communications purposes, only the team code shall be specified.
● The team code allotted to all teams shall be indicated at top right corner of the memorial, which will be communicated by way of Email.

Written Submissions/Memorials● All participating team shall submit memorial from Prosecution and
Defendant side in both Pdf and Word format.● The cover page of memorials for the Prosecution shall be in Blue and
the Defence shall be in Red.● All participating teams must submit a soft copy of their memorial in
PDF format and word format, for both sides by 11:59 P.M. IST on or before 7th September,2021.
● Non- compliance with this rule would entail negative marking which may also attract disqualification.
● Decision in this regard shall be taken by the Committee.

Format of the memorial● The Memorial should not exceed 25 typed pages

Format of the memorial
#Font and Spacing:● The font of the body of the Memorial must be Times New Roman, size 12, with
1.5 line spacing and the font-size of footnotes, if any, must not be less than size 10.
● Each page must have a margin of at least an inch on all sides.#Citation:
● Blue Book mode of citation (20th Edition) must be followed.
#Submission of Soft Copies:● All participating teams must submit a soft copy of their memorial in PDF format
and word format, for both sides by 11:59 P.M. IST on or before 7th September,2021.

Format of the memorial # Assessment of Memorials:
● Each side of the memorials shall be assessed out of 100 marks, by a team of experts on the predetermined criterion, as specified hereunder:a. Identification of Issues and Nature of relief sought (10 marks)b. Knowledge of fact and Law (15 marks)c. Use of Authorities/Precedents (20 marks)d. Argumentation and Clarity of Thoughts (20 marks)e. Proper Citation and Correct Format (15 marks)
#Compendiums:The teams are required to send their compendium, along with their memorials. The compendium shall not exceed 5 pages, wherein, if the teams are referring to any books then the material of the book shall be quoted in following format “Name of the book/Author/Page number/Paragraph”, and if the teams are referring to any website, only link of the website shall be quoted.The compendium will be shared to the judges only via organizing committee and the participants shall refrain from using screen share.

# Dress Code: As prescribed by Bar Council of India (White Shirt, Black Trousers, Blak Tie, Blazer is optional).
#Structure of the competition: ● The competition shall have one Preliminary Rounds, one Quarter Final Round, one Semi Final
Round and the Final Round which will be followed by the valedictory ceremony. Preliminary Rounds:
● The Petitioners shall be allotted a total of 15 minutes to speak. The Respondent shall be allotted 15 minutes for the arguments. Any extension of time beyond the specified period shall not be allowed.
Quarter Finals:● Each team shall get a total time of 20 minutes to present their case and this shall include the
time for 'rebuttal' and 'Surrebuttal'. Any extension of time beyond the specified period shall be subject to the discretion of the judges.Semi Finals:
● Each team shall get a total of 25 minutes to present their case. This time will include the time for 'rebuttal' and 'Surrebuttal'. Any extension of time beyond the specified period shall be subject to the discretion of the judges. The division of time between the speakers is the discretion of the team members, subject to a maximum of 15 minutes for one speaker.Finals:
● Each team shall get a total of 25 minutes to present their case. This time will include the time for rebuttal and Surrebuttal.
