Furloughs, sequestration raise uncertainties for small vendors In the final weeks of the rush of contracting activity that typically ends a federal fiscal year, the mood among small vendors has turned circumspect. While fourth-quarter spending is surging roughly as anticipated, there are growing concerns that small vendors might be poorly po- sitioned to take full advantage of the boom. With four weeks to go until the fiscal year’s end on Sept. 30, bil- lions of dollars remain unspent. Forecasts for fourth quarter spending have been relatively op- timistic. However, the impacts of sequestration and furloughs are wild cards. A troubling scenario being dis- cussed is that federal contracting officers, facing a huge end-of-year workload and limited time, may be forced to prioritize the largest con- tracts. As a result, some small con- tracts may be pushed to the back of the line and fall by the wayside. “There can be a tendency to focus on awarding the larger con- tracts first,” Molly Brogan, spokes- woman for the National Small Busi- ness Association, told Set-Aside Alert. “A $90 million contract takes the same amount of time to com- plete as does a $5 million contract.” That trend happens every year to some degree. But this year the time crunch appears to be worse because of time lost to furloughs, and the backlog of work is likely greater, due to delays from seques- tration and budget uncertainty, she said Small vendors, typically last in line for awards anyway, may lose out more, proportionately, Brogan suggested. Fourth quarter surge dampened?Furloughs, sequestration raise uncertainties for small vendors

In the final weeks of the rushof contracting activity that typicallyends a federal fiscal year, the moodamong small vendors has turnedcircumspect.

While fourth-quarter spendingis surging roughly as anticipated,there are growing concerns thatsmall vendors might be poorly po-sitioned to take full advantage ofthe boom.

With four weeks to go until thefiscal year’s end on Sept. 30, bil-lions of dollars remain unspent.

“I’m really worried about oursmall business numbers thisyear,” the executive said. “It is notlooking good.”

As of Aug. 26, the government’sSmall Business Dashboard showedthat $45.5 billion had been spenton small business contractors,about half the amount anticipatedfor the full fiscal year. The totalrepresented 20.35% of eligibleawards, falling short of thegovernment’s 23% goal.

While those numbers are notfinal, they may portend a trend.

John Shoraka, the SBA’s asso-ciate administrator for governmentcontracting and business develop-ment, said budget uncertainty, de-lays and sequestration are ex-pected to reduce small vendor par-ticipation in fiscal 2013. Last year,the administration awarded 22.12%of eligible contracts to small ven-dors.

"We do anticipate fewer con-tracts and fewer dollars to be allo-cated to small businesses due toa number of challenges facing fed-eral agencies in planning their pro-curements, in addition to operat-

ing under a Continuing Resolution,and now, forced budget cuts as aresult of sequestration,” Shorakawrote in an email to Set-Aside Alert.

“We will not know what theexact impact will be on these smallbusinesses until the end of the fis-cal year but, from the beginning,we have been clear that seques-tration would have severe impactsacross the government and forsmall business.”

Small vendors also are feeling“moderate anxiety” these days be-cause of the tense anti-spendingmood in Washington, AlbertKrachman, partner at Blank Romelaw firm, told Set-Aside Alert. Somelawmakers have urged a govern-ment shutdown and a fight over thenational debt ceiling, and the nega-tivity is trickling down, he said.

In such an environment, “thefourth quarter surge is happening,but people do not want to promoteit for fear of drawing fire,” he said.

Still, there are reasons for op-timism. “The important things are:how easy is it to award to your com-pany, and where does the agencysit in terms of small business goalattainment?” Krachman added.

Agencies falling short of theirsmall business goals for the yearcan make an extra effort to makeup for it in the fourth quarter. Lastyear, the Veterans Affairs Depart-ment made those goals a top prior-ity late in the year, for example.

As of July 30, Deltek predicted$48.6 billion in pending contractsto be awarded to small businessesin the remainder of fiscal 2013.About $39 billion was availablefrom civilian agencies, and $9.4 bil-lion from defense.

The bulk of the civilian workavailable was at the Homeland Se-curity Department, with $22 billionunspent, and VA, with $12.4 billionunspent, Deltek said.

The rule allows vendors an op-portunity to rebut the charge thatthey willfully misrepresentedthemselves. Whether a misrepre-sentation was made is a questionthat a judge or jury will decide.

Attorneys are warning that re-buttal might be challenging.

“As a result of this new real-ity, contractors need to take extraprecautions when making size orstatus representations as of Aug.27,” PilieroMazza PLLC wrote in itsrecent Legal Advisor publication.

However, House Speaker JohnBoehner, R-OH, is pushing for atemporary spending bill that wouldavert a shutdown on Oct. 1, accord-ing to Reuters. He and other GOPleaders have said they are con-cerned about their party beingblamed for a federal shutdown, re-calling the negative repercussionsof the 1995 and 1996 shutdown.

Boehner and other GOP lead-ers also are pressing for deeperbudget cuts in exchange for rais-ing the nation’s debt ceiling thisfall.

The only way to edit your DSBSrecord is to update or confirm yourrecord in SAM. At the end of thatprocess you have the option tosupplement your info in DSBS.Don’t poop out now. You absolutelyneed to do this!

Make sure your NAICS codeand size status for each industryis correct. Put keywords in therecord so buyers and specialistscan find you when they are lookingfor “cybersecurity” or “snow re-moval.” Enter past contract info inthe performance history section, sobuyers know you have federal (orcommercial) experience and haveperformed contracts recently. Oth-erwise, you’re just another “fly-by-night” outfit trying to break into thefederal market.

Get ready to file annual employ-ment info filings

Annually, you must file yourEEOC and VETS-100A forms to stayon Uncle Sam’s good side. You mayneed to have an affirmative actionplan, and maybe even a small busi-ness subcontracting plan. Avoidcompliance risk — take care ofthese things now. Generally theyare good for a year.

File GSA Schedule Sales ReportsIf you hold a GSA Schedule

contract, even if there have beenno sales, you must file quarterlywith GSA’s Schedule Sales Querysystem using Form 72A. Don’t ne-glect this task, as your schedulecontract will quickly be terminatedfor failure to report – it’s even worseif you’ve had sales and haven’t paidthe Industrial Funding Fee on time.

Monitor Past Performance Re-ports

Past performance reporting bycontracting officials is being en-forced more rigorously. Be sure tomonitor new filings on yourcompany’s contract performanceand utilize the short window of op-portunity to request correction ofany errors.

Contracting officials will be re-lying more and more on this sys-tem to help them identify good per-

formers and to weed out poor per-formers as well as those with littleor no past experience.

The window for challenging poorreports and enabling revisions islimited so get your responses inimmediately and be dogged aboutcorrecting any errors.

Review your balance sheet andincome statement

Many small companies, pri-vately held, look at financial state-ments as internal documents, butUncle Sam will reach into that in-ner sanctum to assure your com-pany is capable of remaining inbusiness and delivering on the con-tract over a term that is often mul-tiple years. Do you have an outsideaccounting firm that at least looksover your shoulder, or writes up areview, if not an opinion?

Check your Quick Ratio andDebt/Equity ratio. Have you beenprofitable over the last two years?If not, do you have an explanationand a marketing plan to stabilizeyour future?

Consolidate each contract fileMake absolutely sure you have

a comprehensive, clean, consoli-dated contract file for each and ev-ery contract you’ve won. The filemust contain everything: State-ment of Work, Request For Pro-posal, proposal, quotes, mods, in-voices, indirect rate determina-tions, escalation rate documenta-tion, audits, claims and right up tothe closeout document.

Finally, look over your recentcontracts and make sure that youhave covered all the necessarydeliverables, signed all mods, ex-ecuted contract close-out docu-ments, and invoiced every nickelyou are due.
