Foster Family Home Insurance Fund The Foster Family Home (FFH) and SmallFamily Home (SFH) Insurance Fundprovides liability insurance coverage forfoster parents related to incidents inproviding foster care services. The Fund’sliability coverage is to licensed FFH, SFH,and, on or after January 1, 2019, approvedresource family homes as definedin Section 16519.5 of the WIC.

FOSTER FAMILY HOME AND SMALL FAMILY HOME INSURANCE FUND

EXPLANATION AND SUMMARY OF COVERAGE The State of California provides the Foster Family Home and Small Family Home Insurance Fund (“Fund”) to pay certain liability claims on behalf of foster parents for certain activities relating to licensed foster family homes and licensed small family homes, and, on or after January 2019, approved resource family homes as defined in Section 16519.5 of the Welfare and Institutions Code. This document only summarizes the Fund. For specific details and a legal interpretation, please see California Health and Safety Code Section 1527, et seq. COVERAGE PERIOD: For licensed foster homes and small family homes, claims arising from covered incidents occurring on or after October 1, 1986. For approved resource family homes, claims arising from covered incidents occurring on or after January 1, 2019. COVERAGE LIMITS: $300,000 per home for occurrences due to one or more occurrences during any consecutive 12-month period. COVERAGE FOR LICENSED FOSTER FAMILY HOMES AND LICENSED SMALL FAMILY HOMES (“covered home”): The Fund will pay on behalf of covered homes the claims of foster children, their parents, guardians, or guardians ad litem for damages arising from, and peculiar to, the foster care relationship and the provisions of foster care services or reimburse covered homes for those damages. The Fund is liable, if a claim is approved, to pay all sums which the covered home is obligated to pay as a result of a valid claim of bodily injury or personal injury arising out of the activities of a foster parent or foster parents, which occurs while the foster child resides in the covered home. EXCLUSIONS: The Fund shall not be liable for the following: • Any loss arising out of a dishonest, fraudulent, criminal or intentional act of a foster parent • Any occurrence which does not arise from the foster parent relationship. • Any bodily injury arising out of the operation or use of any motor vehicle, aircraft or watercraft owned

or operated by or rented or loaned to any foster parent. • Any loss arising out of licentious, immoral or sexual behavior on the part of the foster parent intended

to lead to, or culminating in, any sexual act. • Any allegation of alienation of affection against a foster parent. • Any loss or damage arising out of occurrence prior to October 1, 1986, for licensed foster homes or

small family homes or prior to January 1, 2019, for approved resource family homes. • Punitive or exemplary damages. • Any liability of a foster parent which is uninsured due solely to the foster parent’s failure to obtain

insurance specified in Section 676.7 of the Insurance Code (homeowners or tenant’s polices). Nothing in this subdivision shall be construed to expand the liability of the Fund with respect to insured foster parents. Incidents covered by a homeowners or tenants policy are excluded from coverage under the Fund, whether or not the foster home has such insurance.

• Any damage to property owned by the foster parent or any other person or party. WHO MAY FILE A CLAIM: The foster child, the natural parents, the child’s guardian or the guardian ad litem. All other persons or entities are excluded. Notes: Bill SummaryThis bill would revise the Foster Care Bill of Rights and would include additional rights, including, among others, the right to be referred to by the youth’s preferred name and gender pronoun, the right to maintain the privacy of the youth’s lesbian, gay, bisexual, transgender, queer, and questioning status and gender identity, except as provided, and the right to have reasonable access to computer technology and the internet.

CA - AB337 Foster care payments: reasonable travel reimbursement for school.

Notes: Bill SummaryThis bill would require a county to provide a foster care provider with a notice of action regarding whether a child or nonminor dependent is eligible for the reasonable travel reimbursement. This bill would additionally require a county to provide emergency caregivers with a payment to cover the cost of reasonable travel for the child to remain in the school in which the child or nonminor dependent is enrolled at the time of placement.

CA - AB395 Child abuse or neglect: foster children.

Notes: Bill SummaryThis bill would, when a receiving entity receives a reported allegation of child abuse or neglect that involves a child in foster care in which the alleged abuse or neglect occurred in a community care facility, require the receiving entity to coordinate investigation efforts with the licensing agency, as specified, and notify the Office of the State Foster Care Ombudsperson within 24 hours of receiving the report. The bill would require an investigation conducted by the receiving entity or the licensing agency to be completed no later than 30 days after the initial report was received by the entity.

Notes: Bill SummaryThis bill would authorize a resource family, foster family home, certified foster home, approved relative caregiver or nonrelative extended family member of a participant to be automatically converted to a host family without additional certification. The bill would require, if anonminor dependent receiving transitional housing services lives with a host family, payment for those services to be split between the transitional housing placement provider, the host family, and the nonminor dependent, unless a different apportionment is agreed to by all parties.

Notes: Bill SummaryThis bill would instead require counties to include a minimum of 2 hours of in-person training on understanding how to use best practices to provide care and supervision to children who have been trafficked as part of the mandatory preapproval caregiver training described above. The bill would require the training to be survivor informed, culturally relevant and appropriate, and to address issues relating to stigma. The bill would also require the training to include specified topics, including, among others, recognizing indicators of human trafficking and providing trauma-informed care.
