I looked at the date of the party, September 16, 1986. After doing some quick math in my head, I realized that the retirement party for my dad took place before he had even reached the age of 60! He would not turn 60 until October 19, 1986. I stood there in the basement of my childhood home, looking at that announcement in utter disbelief. I am now only seven short years from being at that same age as my father was in those photos, and yet as I write this I can’t imagine retiring before I turn (gulp) 60. I mean 60 is the new 45, isn’t it? I started to think about all the permutations of that party, at that time in his life, and in mine. So All You Lawyers Out There…. Do You Feel It Still?

As I was cleaning out my parents’ basement in preparation for the estate sale of their home that they lived in

for nearly 50 years, I came across a photo album of my Dad at some sort of party. It looked like he was the guest of honor in one of the photos, so I looked a bit further. There was a page that contained an announcement of the party and it stated that it was my father’s retirement p a r t y f r o m h i s service with the State of Maryland. I looked at the date of the party, September 16, 1986. After doing some quick math in my head, I realized that the retirement party for my dad took place before he had even reached the age of 60! Criminal evidence - Frye-Reed expert qualifi-cation-procedure & standard: 1) Facts - Neither State nor defense requested a pretrial hearing in child sex-abuse case for defense expert (psychologist as to children’s memory) so judge excluded witness without a hearing, holding that witness failed the Frye-Reed standard. Holding - Trial judge erred by ruling based on proffer without evidentiary hear-ing; burden should have been placed on proponent. Alford v. State, --Md.App.—(3/2/18). 2) Frye-Reed approval does not require that “scientific commu-nity” is unanimous in acceptance of (here, “shaken-baby”) theory and trial court properly could make fact-finding as to general acceptance despite conflict. Sissoko v. State, -- Md.App.—(2/21/18).

Criminal procedure – pretrial home-detention – credit for time served: Because defendant could have been charged with escape for violation of pre-trial home-detention, he should have been granted credit for time served against his sentence. Johnson v. State, --Md.App.—(3/2/18).

Criminal procedure – hearings required-1) discharge of counsel & 2) plea withdrawal: 1) Where defendant sent two pretrial letters to Court asking to discharge counsel, trial judge erred by not inquiring about these before accepting plea, even though they were not raised in open court. State v. Weddington, -- Md. – (2/21/18). 2) Ten days after sentencing, defense counsel alleged that Defendant had just entered mental-hospital and that counsel now had concerns about his competence at time of plea. Trial judge erred denying motion without a hearing. Harding v. State, 235 Md.App. 287 (2017).

Criminal procedure – in banc review of in limine ruling – preservation: When State failed strictly to follow the procedural requirements of Rule 2-551 for in banc review, the Court of Appeals held the ruling not properly preserved. State v. Phillips, -- Md. – (2/2018).

ship would be a good precursor to my career as an intelligence officer (spy?) in the U.S. military. That never did come to pass since I decided to go to law school instead, and the closest I got to my spy career was marrying a beautiful, German-born brunette named Natasha, so I think I came out way ahead in the end anyway. Considering the Soviet Union dissolved in 1991, it seemed like a good move in retrospect. And we never hear about Russia in the news anymore. But I digress.

My father would go on to live 30 years after he retired, succumbing to old age at the age of 90 in December 2016. It struck me that living for 30 years after you retire sounds great, but it doesn’t even sound that long really, does it? Then I figured that since my Dad joined the Army in 1944, at the age of 17, he actually “worked for a living” for less than half of his 90 years (43, al-though he would’ve argued that he worked plenty as a kid picking beans and any other crops that needed seasonal workers while he grew up dur-ing the depression). But that is about as good a work-life balance as anybody could ever achieve. In retirement, my dad traveled to Hawaii many times to visit his first set of grandchildren who grew up there, he played A LOT of golf, and he even came to visit me in Europe in the back of an Air Force Cargo Ship (a C-141 as I recall), fly-ing free as a Space Available passenger (retiree) out of Andrews AFB and landing in Mildenhall, England in July of 1995. In fact, he made three trips to Europe that summer. He and mom came to visit me in England in June via the traditional commercial flight route; while there, my dad and I planned his return a month later on Space A. During that visit, we played golf and attended the Open Championship being held that year at St. Andrews. Although John Daly won that year, I will never forget watching Jack Nicklaus take a 10 on a Par 5 because he took four shots to get out of “Hell’s bunker.” I actually saw that. But I digress some more. My Dad returned again to Europe with Mom in September of 1995 for my wedding to that beautiful brunette. Three visits to Europe in 4 months. Probably couldn’t have done that if he wasn’t retired.

So now I am thinking about how long is long enough in this profession of ours? I believe that

lawyers can continue to make contributions to our profession and our community long after hitting the 6-0 mark, or the 7-0 mark. I am sure that some of you reading this consider the 8-0 mark the time when you will start thinking about retirement. God bless you.

I started my own solo practice in West An-napolis in March 2015, two months after I turned 50. In many ways, I feel like I am starting my legal career all over again, and it is exciting, exhausting, nerve-racking, fulfilling, and rewarding. I really haven’t had this much fun since I ran my own office as the Area Defense Counsel (i.e. military public defender) at Lowry AFB in Colorado in 1994. Every day carries with it a new challenge and a new responsibility. I was a partner with a couple of Baltimore firms since the early 2000s, but I think this endeavor is just more… personal. I just pray for the energy to do it as long as I can, and at a level that best serves my clients.

So what is the appropriate age to consider retirement as an attorney? Judges in Maryland face mandatory retirement at age 70; although I still see many in the courthouses of the state continuing to serve in some capacity. Federal and state attorneys can face (or is it “are rewarded”) the same mandatory retirement options that my Dad accepted in 1989 after his 30 years of service to the State of Maryland. Partners sometimes stay on at their firms as “Of counsel” or just keep plugging away until they can’t work anymore. I watched Mel Sykes argue a case in the Court of Special Appeals when he was well into his 80s. And he was still as sharp as a tack. So there is no right answer.

This article was originally titled Work-Life Balance. But that was an incredibly boring title, and there wasn’t a good song that came to mind. Last year, an indie rock band called Portugal the Man came up with a very-catchy song called “Feel it Still.” The chorus goes:

Ooh woo, I’m a rebel just for kicks, now I been feeling it since 1966, now Might be over now, but I feel it still Ooh woo, I’m a rebel just for kicks, now Let me kick it like it’s 1986, now Might be over now, but I feel it still

The two “time” references were the band har-kening back to the Motown sounds of 1966, and the Beastie Boys of 1986. For me, it goes back to (roughly) when I was born, and when I was 21 years old, being in a great college thanks to Air Force ROTC, the world laid out in front of me, and for one night, hanging out at Dad’s retirement party. It’s a great song that my teenage kids love as much as I do. I plan to keep on “kickin’ it” as long as I feel it still.

One of the ways to keep feelin’ it is to be en-gaged with your fellow bar members. Play softball with the kids who are also actually lawyers. As an AABA member, come to the Crab Feast in Sep-tember, but this year introduce yourself to some-one you don’t know just for the heck of it. Come to a Pub Quiz. Go talk to middle school students on Law Day. Come to the next Barrister’s Ball (in 2020) or better yet, plan on coming to our next Bar Weekend in 2019 (to be hosted by our next President Stacey Rice). More on that in the fall.

At the Barristers Ball in March, we held a wonderful event at Navy-Marine Corps Memo-rial Stadium, which honored many in the bar association, as well as our family members who have served this country. If you ever served in the military, perhaps are retired but miss the courtroom, come to a Veteran Mentor training session held at the Vet Center in West Annapolis. I can get you in touch with the guy who runs it. You will be trained to work with veterans in the new Veteran Treatment Docket held every month in Judge Miller’s courtroom in Glen Burnie. You will get more out of it than you put in, I promise. If you work in Annapolis, walk down to the harbor occasionally at lunchtime, and marvel at all the people who come from all over the world to see our beautiful city.

Stay balanced. Work, play, rest, repeat. And hold off on the retirement party as long as you can, or as long as you want. As long as you can feel it still.

As most of you know, I was designated as the Family Law DCM Judge in February of this year with Judge Stacy W. McCormack

as the back-up Family Law DCM Judge. Although no major policy changes have taken place over the past few months, I wanted to take the opportunity to share some tips and best practices with you in order to assist you in navigating Motions to Shorten Time/Motions to Postpone/Motions to Appear by Telephone and proposed Consent Orders/Judgments of Divorce filed in family law cases. These seem to be two areas where attorneys, as well as, self-represented litigants, run into difficulty.

First, in regard to Motions to Shorten Time filed with a related Motion to Postpone or Motion to Appear by Telephone, the process is as follows: • You must follow the relevant rules related to

giving the opposing party(ies)/counsel twenty-four (24) hours’ notice, etc. (See Maryland Rules 1-204, 1-351, and 1-203);

• The motion to shorten time must be “walked through” in order to be considered;

• To walk through a motion, an attorney must first electronically file the motion through the MDEC system. The attorney must then appear in the Civil Clerk’s Office (room 100) with the

envelope number of the electronic filing. After appearing in the Clerk’s Office, the attorney shall appear in the chambers of the Family DCM Judge or outside of Courtroom 2D at the time designated in the Motion;

• Once ruled on, the DCM Judge’s Chambers will notify you via email or telephone of the ruling. Please note: if the Motion to Shorten Time is granted, you do not have to walk through the underlying Motion to Postpone or Motion to Appear by Telephone. These motions will be presented to the DCM Judge when ripe for ruling.

• Please note that these are not changes to the postponement instructions on the Circuit Court’s website located at: www.circuitcourt.org. This is simply intended to clarify the “walk through” process and as a reminder of all relevant rules that apply to these ex parte motions.

Second, in regard to proposed Consent Orders and proposed Judgments of Divorce, the following process is in place:

• Consent Orders and proposed Judgments of Divorce filed within 2 weeks of a scheduled hearing must be electronically filed through the MDEC system and first reviewed by the Fam-ily Law Office of Case Management. They do not get directly submitted to the DCM Judge or the Chambers Judge.

• If applicable, all proposed Consent Orders and proposed Judgments of Divorce shall include a child support guidelines worksheet. If the par-ties have agreed to a deviation from the amount of support in the guidelines, the Consent Order and proposed Judgment of Divorce shall clear-ly set forth a legally acceptable explanation for the deviation. The DCM Judge will review the proposed Order/Judgment and make a determi-nation as to whether the deviation is in the best interest(s) of the minor child(ren).

This is being written after the General Assembly adjourned sine die but before the end of Governor Hogan’s post-

Session bill signings. Although not yet signed, it is a safe bet that amendments to the Maryland estate tax will become law. These amendments will impact Maryland estate planning practice in important ways.

Two identical bills sailed through the Senate (SB 646) and the House (HB 308). The legisla-tion was prompted by the new federal Tax Cuts and Jobs Act of 2017, signed into law late last year. The federal legislation increased the federal estate tax unified credit thereby from $5 million (indexed—the threshold was $5.49 million in 2017) to a new threshold of approximately $11.2 million for 2018 (after indexing). The increase of the federal unified credit, however, sunsets in 2025.

The Maryland estate tax had been ratcheting up by $1 million each year for tax years 2016-2018 to catch up with the federal threshold. The Maryland estate tax exemption (Tax-General § 7-309) was due to match the federal threshold in 2019 and years thereafter. The Maryland changes were made under an assumption that the federal unified credit would be the $5 million (indexed) amount, not an amount over $11 million per the new law. Since the Maryland law, as written, would have resulted in a significant loss of tax revenue due to the drastically increased federal unified credit, the General Assembly turned its attention to the issue in the 2018 session.

The legislative “fix” to this shock to the state’s fisc is to freeze the Maryland estate tax threshold at $5 million (not indexed). This means that a gap between the federal threshold and the Maryland threshold will continue. Even after the sunset date for the federal law (assuming it remains as part of the law), presumably the federal unified credit will be indexed to amounts well beyond the (new) Maryland threshold. For wealthy clients’ planning documents probably should retain provisions dealing with the gap amount.

The Maryland estate tax changes, however, add a powerful new tool for clients whose estates exceed the $5 million Maryland estate tax thresh-old. Assuming the Governor will sign the legisla-tion (which appears very, very likely) the legisla-tion will permit portability of the Maryland estate tax. This means a surviving spouse can use his/her deceased spouse’s unused Maryland threshold amount at the second death. The portability rules for the state are somewhat analogous to the federal rules. Notably, a timely Maryland estate tax must be filed (MET-1) electing the portability.

The state portability provisions offer ad-ditional planning opportunities for our clients effective next year, assuming that a timely return is filed and portability elected. It is a truism, of course, that political winds blow this way and that and any prediction is risky. Nevertheless, these changes appear very likely to become law and a planning committee ought to give advice and craft documents anticipating such changes

Spring Golf at South River Sets Record

Everyone hates a Monday morning, unless it is a beautiful spring morning spent on the golf course. Perhaps that’s why the AABA

had record-breaking participation in this year’s Spring Golf Tournament on Monday, April 23. For this tournament, we welcomed 19 foursomes to the Golf Club at South River. Our members, sponsors

and guests enjoyed an outdoor breakfast of donuts, bagels, fruit and coffee before heading out to the greens.

The foursome of Scott Forney, Randy Sroka, Ryan Chamberlain and Steven Hyatt claimed the top spot in the tournament. They faced tough competi-tion, including second-place finishers Bill Sporre,
