The Annual Reorganization Meeting of the Board of Education of the Township of Bedminster was held on April 29, 2010 at the Bedminster Township School.. Board Secretary, Debe Besold, called the meeting to order at 6:30 P.M. and announced that in compliance with the “Open Public Meeting Act of the State of New Jersey” adequate notice of this meeting of the Board of Education of the Township of Bedminster was provided in the following manner: On April 5, 2010, adequate written notice of this meeting was:

Mrs. Besold administered the Oath of Office to Dr. Anagnostis during the week, as he was not able to attend tonight’s meeting. Roll Call Mrs. Besold then took roll call as follows:

Executive Session The following resolution was introduced by Ms. Goetz, seconded by Ms. Creelman and unanimously adopted by the following roll call vote: Yes: Casella, Caspersen, Creelman, Cunningham, Goetz, Haggerty, Parker, Carter; No: None; Abstain: None (Yes – 8; No – 0; Abstentions – 0).

BE IT RESOLVED by the Board of Education of the Township of Bedminster that an Executive Session be called to discuss personnel and negotiations; and BE IT FURTHER RESOLVED that said Executive Session shall be held on April 29, 2010 at 6:45 P.M; and BE IT FURTHER RESOLVED that if action of the Board of Education is necessary as a result of such private discussion, a disclosure to the public shall be made at the time of such action; and

BE IT FURTHER RESOLVED that if no action is required by the Board of Education as a result of such private discussion, a disclosure to the public shall be made at the time of such action; and BE IT FURTHER RESOLVED that the disclosure to the public in all events shall be made at the earliest possible public meeting following said private session.

The Board adjourned to executive session at 6:45 P.M. Moved by Mr. Haggerty, seconded by Mr. Casella, with all in favor, the meeting adjourned Executive Session at 7:43 P.M. Election of Officers Nomination - President: Mrs. Besold opened the floor for nominations for the position of President of the Bedminster Township Board of Education. Ms.Goetz nominated James Carter for this position. With no further nominations from the floor, moved by Ms. Goetz seconded by Mr. Haggerty and approved by the following roll call vote that James Carter be appointed as President of the Bedminster Township Board of Education. Roll call: Yes: Anagnostis, Casella, Caspersen, Creelman, Cunningham, Goetz, Haggerty, Parker, No: None; Abstain: Carter (Yes – 7; No – 0; Abstentions – 1). Mrs. Besold passed the gavel to Mr. Carter. President Carter thanked the Board for their continued support. Nomination - Vice President: President Carter then opened the floor for nominations for position of Vice President of the Bedminster Township Board of Education. Ms. Creelman nominated Louis Casella Jr. for this position. With no further nominations from the floor, moved by Ms. Creelman seconded by Ms. Cunningham and approved by the following roll call vote that Louis Casella Jr. be appointed as Vice President of the Bedminster Township Board of Education. Roll call: Yes: Caspersen, Creelman, Cunningham, Goetz, Haggerty, Parker, Carter, No: None; Abstain: Casella (Yes – 7; No – 0; Abstentions – 1). Budget Defeat: President Carter reviewed the process that will take place regarding the budget defeat. The Board and Township are working toward an early resolution, with meetings beginning in early May. President Carter presented the following Code of Ethics to the Board: A school board member shall abide by the following Code of Ethics for School Board Members:

a. I will uphold and enforce all laws, rules and regulations of the State Board of Education, and court orders pertaining to schools. Desired changes shall be brought about only through legal and ethical procedures.

b. I will make decisions in terms of the educational welfare of children and

will seek to develop and maintain public schools that meet the individual needs of all children regardless of their ability, race, creed, sex, or social standing.

c. I will confine my board action to policy making, planning, and appraisal, and I will help to frame policies and plans only after the board has consulted those who will be affected by them.

d. I will carry out my responsibility, not to administer the schools, but, together with my fellow board members, to see that they are well run.

e. I will recognize that authority rests with the board of education and will make no personal promises nor take any private action that may compromise the board.

f. I will refuse to surrender my independent judgment to special interest or partisan political groups or to use the schools for personal gain or for the gain of friends.

g. I will hold confidential all matters pertaining to the schools which, if disclosed, would needlessly injure individuals or the schools. In all other matters, I will provide accurate information and, in concert with my fellow board members, interpret to the staff the aspirations of the community for its school.

h. I will vote to appoint the best qualified personnel available after consideration of the recommendation of the chief administrative officer.

i. I will support and protect school personnel in proper performance of their duties.

j. I will refer all complaints to the chief administrative officer and will act on the complaints at public meetings only after failure of an administrative solution.

12. Move that the Bedminster Township Board of Education approve the Superintendent and the School Business Administrator/Board Secretary or their designees be designated as the individuals to be the Board agents to request State and Federal funds under the existing State and Federal laws for the 2010-2011 school year.

Students will be required to complete forty (40) hours of community service for eighth grade graduation, which can be earned as follows: • Forty (40) hours during the eighth grade year; or • Up to five (5) hours during the second semester of seventh grade, and • Up to twenty (20) hours total by the end of the summer prior to eighth grade

which includes hours earned during the seventh grade, and the balance earned during the eighth grade.

17. Move that the following resolution be adopted for the 2010-2011 school year:

WHEREAS, Chapter 231 of the Public Laws of New Jersey (1975) known and hereinafter designated as the “Open Public Meetings Act” requires notification of meetings of public bodies, as therein defined, in the manner therein set forth; NOW, THEREFORE, BE IT RESOLVED that for the purpose of compliance with the “Open Public Meetings Act”, the Board of Education of the Township of Bedminster hereby makes the following designations: a. The Bernardsville News and The Courier News are hereby designated as the two

(2) newspapers to receive notice of meetings as required by any and all sections of the “Open Public Meetings Act”, it appearing that those newspapers are most likely to inform the local public of such meetings, and meet the requirements of NJSA 35:1-2.2.

b. The location for posting of notice of meetings shall be the bulletin board in the Township Clerk’s office located in the Township Municipal Building, One Miller Lane, Bedminster, New Jersey, and the Main Office of the Bedminster Township School, 234 Somerville Road, Bedminster, New Jersey.

RESOLVED, that the Hunterdon County Educational Services Commission (HCESC) be approved to provide Child Study Team (CST) services, as needed, in accordance with New Jersey Administrative Code (NJAC): Title 6A: Chapter 14, Special Education, for the 2010-2011 school year.

26. Move that the following resolution be adopted:

RESOLVED, that the Somerset County Educational Services Commission (SCESC) be approved to provide Child Study Team (CST) services, as needed, in accordance with New Jersey Administrative Code (NJAC): Title 6A: Chapter 14, Special Education, for the 2010-2011 school year.

Contract: SCESC – Chapters 192/193

27. Move that the following resolution be adopted:

WHEREAS, the Somerset County Educational Services Commission (SCESC), by authority of the Board of Directors acting on approval of the State Board of Education, is capable of providing auxiliary services to eligible students attending nonpublic schools, said services being limited to examination and classification of potentially handicapped students, and instructors, and the necessary equipment, supplies, administration and supervision in connection with programs for Compensatory Education, Supplemental Instruction, English as a Second Language, Speech Correction, and Home Instruction; and WHEREAS, the SCESC services are in accordance with N.J.S.A. 18A:46-6.8, 19.1 et.seq. (Laws of 1977, Chapter 193), N.J.S.A. 18A:46-1 et. seq. (Laws of 1977, Chapter 192), and the Rules and Regulations governing auxiliary services to nonpublic schools; and WHEREAS, the Bedminster Township School District is under obligation to provide said services to all eligible students, attending nonpublic schools within its district; and

WHEREAS, the Bedminster Township School District has by resolution of its Board agreed with the SCESC to provide said services pursuant to N.J.S.A. 18A:46-19.7 and N.J.S.A. 18A:46A-7; NOW, THEREFORE, BE IT RESOLVED, that the Bedminster Township Board of Education approve the Somerset County Educational Services Commission to provide auxiliary services as described above for the period July 1, 2010 through and including June 30, 2011; and BE IT FURTHER RESOLVED, that all services will be provided based on available state funding and the economical allocation of staffing resources available.

28. Move that the following resolution be adopted: WHEREAS, the Somerset County Educational Services Commission (SCESC), by authority of its Board of Directors, acting on approval of the State Board of Education, is capable of providing auxiliary services to eligible students attending nonpublic schools; and WHEREAS, the SCESC services are in accordance with Chapter 226, Laws of 1991, and the Rules and Regulations governing nursing services to nonpublic schools; and WHEREAS, the Bedminster Township School District is under obligation to provide said services to all eligible nonpublic schools within its district to assure equal access to specified nursing services; and WHEREAS, the Bedminster Township School District has by resolution of its Board, agreed to contract with the SCESC to provide said services pursuant to said legislation; NOW, THEREFORE, BE IT RESOLVED, that the Bedminster Township Board of Education approve the Somerset County Educational Services Commission to provide nonpublic nursing services for pupils in grades K-12 (ages 5 years and older) who are enrolled full time in the nonpublic school for nursing services as described above for the period July 1, 2010 through and including June 30, 2011, and BE IT FURTHER RESOLVED, that all services will be provided based on available state funding and the economical allocation of staffing resources available; and

BE IT FURTHER RESOLVED, that the Bedminster Township School District agrees to pay to the Somerset County Educational Services Commission a sum equal to the full funding that is allocated by the State Department of Education for nursing services to nonpublic schools within its district pursuant to the provisions of Chapter 226 Laws of 1991.

Contract: SCESC – Nonpublic Technology Initiative Program

29. Move that the following resolution be adopted:

WHEREAS, the New Jersey Nonpublic School Technology Initiative Program has been authorized in the Appropriations Act for Fiscal Year 2010-2011; and

WHEREAS, Nonpublic School Technology Initiative Aid shall be paid to school districts and allocated for nonpublic school pupils in a manner that is consistent with the provisions of the federal and state constitutions; and

WHEREAS, said program requires the Board of Education in each public school district in New Jersey to provide technology to all students attending a nonpublic school located in the public school district; and WHEREAS, it is the responsibility of the chief school administrator of the public school district or designee to confer with the administrator of each participating nonpublic school within the district to advise the nonpublic school of the limit of funds available and to agree upon the technology to be provided to the nonpublic school within the limits of the funds that are available for the nonpublic school; and WHEREAS, it is the responsibility of the public school district to send written verification that conferences were held with each nonpublic school; and

WHEREAS, it shall be the responsibility of each public school district to provide the agreed upon technology which may include equipment, software, professional development and/or maintenance of equipment; and WHEREAS, the Somerset County Educational Services Commission (SCESC) has agreed to administer the responsibilities associated with this program for the purpose of greater cost effectiveness through joint purchasing and centralized administration; NOW, THEREFORE, BE IT RESOLVED, that the Bedminster Township Board of Education enter into an agreement with the SCESC whereby the SCESC will administer the Nonpublic School Technology Initiative Program for nonpublic schools located within the boundaries for the 2010-2011 school year; and

BE IT FURTHER RESOLVED that the Bedminster Township Board of Education pay five percent (5%) of the allocation for the Nonpublic School Technology Initiative Program to cover the SCESC’s cost for administering the program. The total amount allocated by the State for the New Jersey Nonpublic School Technology Initiative Program will be paid to the SCESC on or before July 31, 2010 and five percent (5%) will be deducted for the SCESC’s administrative expenses. Any unexpended funds will be refunded to the local district.

Contract: SCESC – Nonpublic Textbook Program

30. Move that the following resolution be adopted:

WHEREAS, 18A:58-37.1 et seq., as amended by Chapter 121, Laws of 1984, requires that the state and local community purchase and loan textbooks upon individual request to all students enrolled in grades kindergarten through 12 in nonpublic schools located within the local school district; and WHEREAS, no Board of Education is required to expend funds for the purchase and loan of textbooks in excess of the amounts provided in state aid; and WHEREAS, the Somerset County Educational Services Commission (SCESC) has agreed to administer the purchasing and processing of nonpublic school textbooks for local public school districts for the purpose of greater cost effectiveness through joint purchasing and centralized administration; NOW, THEREFORE, BE IT RESOLVED, that the Bedminster Township Board authorize the Somerset County Educational Services Commission (SCESC) to administer the Nonpublic School Textbook Program, on behalf of the Bedminster Township School District, for the 2010-2011 school year; and BE IT FURTHER RESOLVED, that the Bedminster Township Board of Education agrees to pay the total amount allocated by the State for the New Jersey Nonpublic School Textbook Program to the SCESC on or before July 31, 2010. WHEREAS, the services provided by SCESC shall be limited to those permitted under the grant application and pertinent regulations; and WHEREAS, the terms of the Agreement between the Bedminster Township Board of Education and the SCESC shall be in effect from the date of adoption by the Board (April 29, 2010) until June 30, 2011; and WHEREAS, the Bedminster Township Board of Education agrees to pay the Commission the full amount of the Nonpublic School IDEA proportionate share grand funding in support of the Nonpublic School IDEA Grant.

Contract: SCESC – Joint Transportation Contract

32. Move that the following resolution be adopted:

WHEREAS, the Bedminster Township School District desires to transport special education, non-public, public and vocational school students to specific destinations for the 2010-2011 school year; and WHEREAS, the Somerset County Educational Services Commission, hereinafter referred to as the SCESC, offers coordinated transportation services; and WHEREAS, the SCESC will organize and schedule routes to achieve the maximum cost effectiveness; NOW, THEREFORE, BE IT RESOLVED, that it is agreed that in consideration of pro-rated contract costs, plus an administration fee of five percent (5%) for member districts as calculated by the billing formula adopted by the SCESC’s Board of Education; said formula shall be based on a route cost divided by home to school mileage of students allocated to each participating district. The total amount to be charged to district will be adjusted based on actual costs. Payments will be due within thirty (30) days of receipt by the district and deemed late after sixty (60) days with an additional one percent (1%) fee for late payments. At the discretion of the Commission Superintendent, late fee charges may be waived for extenuating circumstances. BE IT FURTHER RESOLVED, that the SCESC will provide the following services:

a. Routes coordinated with other districts to achieve a maximum cost reduction while maintaining a realistic capacity and travel time;

b. Monthly billing and invoices; c. Computer print-outs of student lists for all routes coordinated by SCESC; d. All necessary interaction and communication between the sending district,

receiving school, and the respective transportation contractors; e. Constant review and revision of routes;

f. Timely notification to parents of route description, transportation provider and pick-up/drop-off times;

BE IT FURTHER RESOLVED, that the Bedminster Township School District will provide the SCESC with the following:

a. Requests for any additional transportation on approved forms to be provided by the SCESC, completed in full and signed by previously authorized district personnel;

b. Withdrawal for any transportation must be provided in writing and signed by authorized district personnel; no billing adjustments will be made without this completed form and will become effective on the date the form is received;

c. All additional costs generated by unique requests such as mid-day runs or early dismissals will be borne by the district. All such costs must first be approved by the Bedminster Township School District.

BE IT FURTHER RESOLVED, that the length of the Agreement, obligations and requirements therein shall be in effect between July 1, 2010 and June 30, 2011.

Public Questions/Comments Angus Miller, parent questioned if there is a public dialog regarding budget reductions. President Carter indicated budget meetings will continue starting this Sunday, May 2 at 9:00 A.M. Ultimately it is the Board of Education’s responsibility to review the recommendations made by the Bedminster Township Committee and make the final reductions that total the dollar amount specified by the Bedminster Township Committee. Executive Session The following resolution was introduced by Mrs. Caspersen seconded by Ms. Creelman and unanimously adopted by the following roll call vote: Yes: Casella, Caspersen, Creelman, Cunningham, Goetz, Haggerty, Parker, Carter; No: None; Abstain: None (Yes – 8; No – 0; Abstentions – 0).

BE IT RESOLVED by the Board of Education of the Township of Bedminster that an Executive Session be called to discuss personnel and negotiations; and BE IT FURTHER RESOLVED that said Executive Session shall be held on April 29, 2010 at 9:17 P.M; and BE IT FURTHER RESOLVED that if action of the Board of Education is necessary as a result of such private discussion, a disclosure to the public shall be made at the time of such action; and

BE IT FURTHER RESOLVED that if no action is required by the Board of Education as a result of such private discussion, a disclosure to the public shall be made at the time of such action; and BE IT FURTHER RESOLVED that the disclosure to the public in all events shall be made at the earliest possible public meeting following said private session.
