Southern California Edison Company (SCE) respectfully submits these reply comments

in response to the Administrative Law Judge’s May 18, 2017 Ruling (the Ruling) Seeking

Comments on the Joint Staff Proposal (the Proposal) by the California Public Utilities

Commission (Commission) and the California Independent System Operator (CAISO) on

Multiple Use Applications (MUA) for Energy Storage Devices.

I.

INTRODUCTION

SCE is pleased to see general agreement among parties on many of the principles guiding

MUAs for energy storage, including principles for ensuring reliability, maintaining flexibility,

and including timing considerations into determinations of incremental value of services for

storage devices.

As noted in SCE’s and other parties’ opening comments, an important consideration for

energy storage MUA rules is achieving a balance that ensures reliability while also allowing

enough flexibility for energy storage devices to provide maximum value to the grid and end

users.1 To this end, SCE reemphasizes its positions from its opening comments that: (1) to

ensure reliability services for storage devices with MUA, decisions may require analysis on a

case-by-case basis to determine more precise rules for the future;2 and, (2) timing considerations

must be incorporated into value determinations for energy storage resources.

As such, although SCE does not disagree with the five service domains and services

identified in the Proposal, SCE encourages the agencies to avoid overly prescriptive rules that

may preclude a resource from providing all the potential services that it can provide, or,

alternatively, attempting to provide two simultaneous services, which may be incompatible.

Despite agreeing in principle on many issues, there were a few specific topics where SCE

and other parties did not appear to agree in opening comments. SCE’s Reply Comments focus

on those key areas of discrepancy, and offer further recommendations for consideration,

including:

• Recommendations that any considerations for restructuring rates be addressed in

existing, open rate-making proceedings, rather than within this proceeding;

• Need for Commission-approved standards for ensuring the safety, accuracy, and

reliability of internal metering and related meter and data services before they

could be used in lieu of existing systems to bill end-use customers;

• Opposition to the California Energy Storage Alliance’s (CESA) recommendation

for the Commission to direct investor-owned utilities (IOUs) to pursue changes in

their Wholesale Distribution Access Tariffs (WDAT) to accommodate MUAs,

due to jurisdictional violations;

• Opposition to CESA’s “Look back” proposal – which creates opportunities for

gaming and market manipulation; and,

• Recommendation to address various jurisdictional and operational issues

associated with Net Energy Metered (NEM) Solar paired storage projects before

expanding MUA cases for such devices.

SCE expands on these recommendations in section II, below.

II.

REPLY COMMENTS TO SPECIFIC PARTY RESPONSES

A. Rate Design Structures Associated with Demand Charges or Demand Response

Programs Should be Addressed in the Appropriate Rate Design Proceedings – Not

in the Energy Storage Proceeding

In response to Question 6, parties—including Tesla, SunRun, Center for Sustainable

Energy (CSE), Advanced Microgrid Solutions (AMS), Calpine, and NRG Energy (NRG)—made

proposals for changes to current rate designs that could accommodate the timing example

outlined in Question 6. These comments include: Tesla’s recommendation that the Commission

consider promulgating rate structures where demand charges are not imposed during anticipated

or actual times of over generation;3 CSE’s recommendation for the Commission to explore

“rates and demand response programs that are more dynamic and reflective of the needs of the

grid;”4 and, AMS’s recommendation to align demand charges with periods when the grid is not

in an oversupply condition.5

Some, if not all, of the rate design considerations raised by parties in comments are

already being addressed in various rate design proceedings. For example, SCE is addressing the

subject of electricity pricing during periods of generation oversupply by proposing new time-of-

use (TOU) periods in its 2016 Rate Design Window (RDW) Application (A.16-09-003) that

align with the oversupply generation cost profile. SCE is also proposing new distribution

demand charge structures in its 2018 General Rate Case (GRC) Phase 2 Application.6 The new

demand charge structures would recover distribution-related cost through a fixed, dollar-per-

kilowatt grid component7 and a time-variant component recovered through dollar-per-kilowatt-

hour energy charges, or peak period dollar-per-kilowatt demand charges, depending on the

option. Furthermore, SCE is exploring new demand response rates through its 2018-2022

Demand Response Funding Application (A.17-01-022) and in the New Models for Demand

Response OIR (R.13-09-011).

The cost causation principle of setting electricity prices means that retail rate and demand

response program structures are inexorably tied to the marginal cost of service associated with

the respective groups customers in each program. The link between cost of service and retail

rates helps to mitigate inappropriate cost shifts between customer groups, and enables the

Commission to achieve equitable cost-based price signals. Because rate design proceedings

properly address the related issue between cost of service and rate structures, SCE recommends

the rate design and demand response program proposals made by various parties be addressed in

the appropriate ongoing proceedings. The Commission can also avoid duplication of effort by

continuing to address demand charge structures and demand response program design in the

ongoing proceedings rather than introducing a new record in this proceeding.

B. Standards Must be Developed for Internal Metering Before Allowing Devices to Be

Used in Lieu of Utility Owned Meters

In their comments, Tesla recommends that device internal metering could be used in lieu

of utility-owned meters to assist in mitigating system costs;8 however, standards for such

metering devices and related meter and data services must be developed and implemented, akin

to the Commission adopted Direct Access Standards for Meter and Meter Data (DASMMD)9 for

third party owned or serviced meters, or to the protocols used in the third-party owned EV

submeter pilots,10 before such devices could be used to bill utility customers under Commission-

approved retail electricity tariffs. Importantly, such devices need to be revenue-grade, and the

related meter and data services need to conform to minimum standards developed by the

Commission for safety, accuracy and reliability of meter equipment, communications, meter data

management and meter reading, including rules for validating, editing and estimating meter

usage data, and meter installation, maintenance, testing and calibration.11

Other considerations include:

1) Internal meters, which are internal to inverters, cannot yet be accurately tested

with existing field testing equipment. Internal metering must be tested for

calibration on a routine basis as required by the Commission;

2) Internal inverters cannot currently be integrated with existing billing systems;

3) Certification procedures to allow internal meters to meet requirements for

communication, testing, and calibration must be further developed.

C. CESA’s Recommendation for the Commission to Authorize All Forms of Allowed

Performance Measures for MUAs Violates Jurisdictional Regulations and Should

Be Dismissed

In their comments, CESA acknowledges that some performance measurement structures

established and enforced in the WDAT are not jurisdictional to the CAISO or the Commission.

In these cases, CESA recommends that the Commission “exercise its jurisdictional authority

over distribution system investor-owned utilities to direct them to pursue changes needed in their

WDAT to reasonably accommodate MUAs.”12

The concept of jurisdiction applies to government agencies, and the CAISO is not such

an entity. As such, any tariff rule or obligation relevant to this proceeding, including a

"performance measurement structure" would be subject to the jurisdiction of the Commission or

the Federal Energy Regulatory Commission (FERC). FERC is the agency that has jurisdiction

over the CAISO Tariff; the CAISO does not have jurisdiction over itself as CESA implies. The

WDAT is FERC-jurisdictional and, thus, just like any performance measurement structure in the

CAISO Tariff, any such structure in the WDAT, to the extent any even exist, would be subject to

FERC's jurisdiction.

Second, the recommendation that the Commission order the IOUs to amend their

WDATs should be dismissed, as such action is outside of the jurisdiction of the Commission. A

state commission does not have the authority to compel the utilities that it regulates on what they

may file at FERC. In Western Massachusetts Electric Company, 23 FERC ¶ 61,025 (1983),

reh’g denied, 23 FERC ¶ 61,345 (1983), aff'd Massachusetts v. FERC, 729 F.2d 886 (1st Cir.

1984), FERC rejected a utility’s filing on the grounds that it was made under duress at the order

of the Massachusetts Department of Public Utilities (DPU) and was therefore contrary to the

Commerce Clause and the Federal Power Act (FPA). The First Circuit affirmed, finding that

allowing a state commission to order a utility to make a FERC filing would be "to allow a state

to do what FERC itself cannot, namely, to change an interstate rate practice that FERC has not

found unreasonable." 729 F.2d at 888.

D. CESA’s “Look back” Proposal Creates Opportunities for Market Manipulation and

Should Be Dismissed

In their comments, CESA proposes a “look back” or “LIFO” approach to BTM wholesale

charging rules.13 Under this “look back” approach, the rate treatment of charging energy (i.e.,

wholesale or retail) is not determined at the time of charging, but is instead determined following

the discharge of energy, depending upon whether the energy is exported to the grid or consumed

on site. Thus, the charging transaction would be determined retroactively based on the discharge

transaction: “Only when energy is supplied to the grid is a customer eligible for wholesale

treatment. It is not possible to know a customer’s future performance so only when they meet

this requirement is a wholesale settlement activated.”14 Under CESA’s proposal, if a customer

exports to the grid, the device would “look back” and find the most recent charging activity.

This activity would then be deemed wholesale, and a wholesale transaction would be created

retroactively.

CESA’s proposed approach results in the potential for a gaming opportunity whereby a

customer could determine retroactively whether the charging energy will be wholesale, after the

price is published, simply by modifying operations to export energy (or not). Thus, if the

customer observes a favorable wholesale price, the customer may choose to export the energy

and take advantage of that price. If the customer observes the price is unfavorable, the customer

could consume the energy onsite, and pay the regular retail rate. This after-the-fact choice is not

allowed in the current marketplace; schedules are determined in advance, and deviations are

handled by settling at the real time price, not by modifying (or creating new) transactions that

that take place in past time periods.

CESA later appears to recognize this issue in their comments, noting that “under the

hypothetical example, a customer would presumably contemplate this if they saw they had

charged during a period of negative wholesale prices, and so would want exposure to those

prices. The bad-actor would then theoretically take actions to make their past charging

categorized as ‘wholesale.’ ”15 CESA proposes this situation could be remedied by basing the

device’s charging activity on a pre-determined schedule into the wholesale market. SCE

strongly supports a requirement that any wholesale activity for a BTM device must only occur

according to a pre-determined CAISO schedule and be settled appropriately. Such requirements

were key elements of SCE’s proposed protocols to enable BTM wholesale charging.16 The

requirement for such a schedule – and the fact that CAISO settlements will be created according

to this schedule regardless of actual operations – help avoid the potential for gaming

opportunities to occur via retroactive transactions.

As CESA rightly points out, CAISO participants have the option to deviate from the

schedule, but they cannot retroactively modify the previous schedule. As CESA clarifies:

“market schedules are binding, and any failure to deliver on a schedule will be settled through

‘buying back’ one’s position at wholesale prices in the applicable intervals.”17 In other words,

deviations are handled by appropriate settlements in the present; a customer may never void a

settlement in the past, or retroactively create a new settlement.

Should a predetermined CAISO schedule be required (with CAISO settlements

determined to occur according to the schedule), then CESA may be correct that “this concern is

inapplicable.” However, CESA’s proposed “look back” approach contradicts CESA’s previous

assumption that a predetermined CAISO schedule is required: As noted above, the “look back”

approach explicitly states that “a wholesale settlement [is] activated”18 for the charging energy

only after the discharge has occurred. This indicates that a pre-determined wholesale schedule

has not been established for the resource. Thus, because of the opportunity created for gaming

and market manipulation, CESA’s look-back approach should be rejected.

E. State and Federal Jurisdictional and Operational Issues Associated with NEM-

Paired Storage Projects Need to be Addressed Before Expanded MUA Case are

Permitted

SunRun claims that the Joint Staff Proposal correctly points out (contrary to SCE's

urging) that the Commission has no policy prohibiting "NEM storage resources"19 from

"participating in wholesale energy markets."20 SCE logically assumes that "participating in

wholesale energy markets means selling energy at wholesale." It responds to SunRun based on

that understanding. The notion of a NEM resource selling energy at wholesale to a party other

than its interconnected utility raises several legal and jurisdictional issues.

In real-time, a NEM resource provides the energy it produces that is not consumed by the

load of its associated retail customer (i.e., its "excess energy") to its interconnected utility in

exchange for a retail bill credit and surplus compensation at an avoided cost rate if the excess

energy exceeds the delivered energy over a 12-month period. The current NEM tariffs do not

permit the NEM customer to pick and choose how to dispose of its excess energy or to sell such

energy to an entity other than the host. If a NEM resource—which is required to be a qualifying

facility—were to sell energy to a third party, FERC law would first require the resource to have

a FERC-jurisdictional interconnection agreement.21 If the NEM resource lacks a FERC-

jurisdictional interconnection agreement (which they all do), it would first need to acquire one to

sell to an entity other than its host.

Later in its comments, SunRun indicates that it was not discussing NEM resources selling

excess energy into the CAISO, but a non-NEM storage system (that is behind the same meter as

an NEM resource) that is selling energy to the CAISO market.22 Any such storage device would

likely not be considered an eligible qualifying facility, such that the storage resource selling

energy to the CAISO market would need FERC-jurisdictional interconnection service under the

WDAT. It would also need to have a market-based rate tariff on file at FERC, under current

FERC policies. Multiple meters separately measuring the storage and NEM resources might be

required by the WDAT under such a scenario, and, in any case, likely would be needed to ensure

that energy produced by the non-qualifying facility storage resource is not credited at the retail

rate or provided surplus compensation under the NEM Tariff.

SunRun also suggests allowing NEM customers to forego bill credits to provide an

incremental basis for compensation.23 The existing NEM tariffs would have to be amended to

provide for this optionality and implementation could prove impractical or cost prohibitive. For

example, there would have to be provisions to address how far in advance the NEM customer

would have to decide whether it was seeking NEM bill credits versus another form of

compensation and the net surplus compensation true-up process would also need to be modified.

Additionally, if the NEM customer has the ability under the NEM Tariff (a CPUC-jurisdictional

tariff) to sell a FERC-jurisdictional product to an entity other than its interconnected utility, it

would need FERC-jurisdictional interconnection service. For example, the very reason that the

interconnections of NEM resources that can receive Net Surplus Compensation are state-

jurisdictional is that the relevant tariff limits the ability of the customer to sell to entities other

than the host utility.

In sum, there are both state and federal jurisdictional and operational issues associated

with NEM-paired storage projects participating in MUAs that need to be considered and

addressed before any expanded MUA use cases are permitted.

III.

CONCLUSION

SCE appreciates the opportunity to file these Reply Comments and looks forward to

continuing to work with the Commission, CAISO, and stakeholders to realize the vision of

energy storage systems to stack incremental value and revenue streams by delivering multiple

services to the wholesale market, transmission system, distribution grid, and end users.
