A Message from your Chamber PresidentAccording to the local offices of Workforce Alliance, 85 percent of Boca Raton’s business community consists of companies that employ no more than 10 people. That is the exact percentage of the entire State of Florida’s business community and the membership of the Boca Chamber.

That statistic reinforces the fact that economic recovery depends on the innovation,

drive and sustainability of small business and the revival of our area’s entrepreneurial spirit.

The Boca Chamber has long touted the positive impact of the Chamber’s education, programmatic and networking opportunities on business development and overall success of small, medium and large businesses. And the word is getting out.

The Boca Raton business community is starting to grow once again. People are referring their associates to the benefits of being a Chamber member and because of that, we have recently seen one of our strongest quarters of new membership enrollment. We look forward to sharing the value of membership with these new members and continuing to make strides in improving the member experience.

One of our many membership benefits is the Chamber Business Advantage program with Office Depot, Inc. With this free-to-enroll program, members have used the enhanced purchasing power to save more than they imagined possible - some have told us that they saved more than the cost of their Chamber membership dues - simply by purchasing supplies they needed anyway.

This year has been a great time for program revitalization, in the areas of government affairs and economic development. After playing a key role in successfully defeating Amendment 4, our sights turned to creating a comprehensive pro-business Legislative Agenda. With budget deficits on all levels of government, we will be strong advocates of our priorities.

We are embarking on our Washington D.C. Fly-In during the later part of May. This is the first time

that the fly-in will be co-hosted by both of our District Congressmen - Ted Deutch (FL-19) and Allen West (FL-22). The trip will include issue meetings and agency briefings with key members of Congress, staffers and various officials, plus plenty of networking opportunities with local business leaders like Charles Shane, President of Bryason Realty and Chair of the Chamber's political action committee, BLU-PAC; Cheryl Budd, Chief Communications Officer of NCCI Holdings, Inc and the Chamber's Chair-Elect; and local dignitaries such as the Mayor of Boca Raton Susan Whelchel.

Our Economic Development Committee meets monthly to discuss the business development and retention issues that are essential to ensuring a strong economic climate for our area. Through this committee, business leaders are learning about groups that drive business to Boca Raton, increase the amount of available jobs, and showcase the many assets of our area to companies that are looking to relocate.

On the technology side, we have opened up new resources on www.bocaratonchamber.com, so you, our Chamber member, may elevate your presence within the membership and the community by using this dynamic tool. With our new Members-Only section, you can use your personalized log-in information to update your business directory listing, submit coupons that are viewable to other members or the general public, and add business, educational, cultural, or philanthropic events to our Community Calendar. With approximately 40,000 unique hits per month to our website, utilizing these services can make a significant difference to your business.

Lastly, I, along with the Board of Directors and the entire professional team, are glad to welcome Beth A. Johnston to the Chamber in the role of Executive Vice President. Beth brings her 12 years of industry knowledge and local business expertise and will begin contributing immediately. For more about Beth, please see page 18.

As you know, it is a long, challenging path to economic prosperity, but through our continued resilience and dedication to economic enhancement – there is bigger and better business ahead. And your Chamber will be here to support all of your business efforts.

Seeing Positive Signs for Economic Success


Boca Festival Days The Chamber's Non-Profit Outreach looks to continue more than 20 years of highlighting our community!

Boca Festival Days is a true example of community partnership! Non-Profit Boca Chamber Members get together with For-Profit Chamber Members to hold a fun-filled event during the month of August!

The Goal? To raise awareness and funds for the Non-Profit Member’s philanthropic efforts. All month long, residents of Boca Raton will travel from event to event, participating in everything that is great about this City - from the smaller events to the grand!

This series of fun-filled events are held at different locations in the greater Boca Raton area during the month of August. The Greater Boca Raton Chamber of Commerce (GBRCC) helps to facilitate these events that are created and run by a pairing of non-profit members with for-profit members to raise funds and awareness for the non-profit organizations during their specific Boca Festival Days event.

Events:• Are planned and run by non-profits• Are supported by for-profits• Raise awareness and funds for the non-profits• Are held throughout the month of August at various locations in the greater Boca Raton area• Offer a unique and fun advertising and philanthropic opportunity to for-profits -- at a fraction of the usual cost!

Boca Festival Days is facilitated and marketed by the Greater Boca Raton Chamber of Commerce.

Here's what's new:Participants are now able to control their own event listing through their online account on www.bocaratonchamber.com!

Log-in to the Members-Only page.

If you do not have your personal log-in, click on the link that reads, 'Click here for personal login information', enter your email address (the one where you receive Chamber emails) and your information will be sent to you immediately!

After you log in, click on Submit your Event and follow the instructions. IMPORTANT: Under Event Category, choose BOCA FESTIVAL DAYS. This is critical because the events that are under that heading will be what is included on the Chamber Calendar and in marketing efforts.

Events are alotted on a first-come, first served. While we cannot stop a second event in a certain timeslot, we strongly discourage it as we try to help each event get the maximum amount of attendees. Therefore, all marketing priority will be given to the first event to fill out and return the application with the $250 payment.

There are many non-profit agencies that are seeking the assistance of for-profit event sponsors. Gain exposure for your business and become socially conscious by supporting a charitable organization during Boca Festival Days.

Show your support for your community. There are so many

ways to help - and many different levels at which to contribute. • Become an event sponsor• Provide raffle items to a non-profit for an event• Provide a venue• Provide the entertainment• And, of course, show up! Attend as many events as possible.

Please contact a participating non-profit if you would like to get involved. (List will be up on www.bocaratonchamber.com in early May and additions will be made throughout the month.) Please be sure to have your application and materials submitted by June 10.

2011 Small Business Leader of the Year Marsha Rimokh,

Founder and Managing Director, Mathnasium

While on a return flight from overseas in 2007, she read an article in the International Wall Street Journal about a consortium of U.S. CEOs who

were lobbying Congress to loosen visa restrictions for high-level personnel in the fields of math and science. She asked herself, "Why wasn’t the emphasis on raising the level of math and science education here so that we could develop our own highly skilled work force?" Mathnasium learning centers in Boca Raton and Weston were founded in 2009 as the result of her determination to do something about bringing greater focus to math education. Prior to that, she served as Founder and President of Aquarius International, Inc., an international corporate relationship marketing company specializing in strategic marketing events directed at corporate stakeholders including employees, customers and suppliers. Received Motorola Supplier Award of Excellence, 1993; Office Depot Vendor of the Year award, 1997. She is a graduate of the Leadership Boca Class of 2010.

Jerry Fedele, Chief Executive Officer, Boca Raton Regional Hospital

Jerry Fedele has more than 25 years of health care experience as both a health care lawyer and chief executive officer. His expertise includes executive leadership, operations, quality and patient satisfaction improvement initiatives, physician recruitment and network development, clinical program development, strategic planning, insurance and law. Mr. Fedele has experience in both academic and community hospital settings. Over the last 13 years he has focused on restructuring and improving financially challenged hospitals. Mr. Fedele is credited with saving a major academic hospital and three community hospital affiliates from the largest health care bankruptcy in US history through removing the hospitals from bankruptcy proceedings, restructuring debt, implementing a financial turnaround exceeding $140 million dollars, and completing a transformational refinancing exceeding $750 million.

2011 Business of the Year U.S. Foodservice - South Florida

U.S. Foodservice-South Florida supplies the highest quality food and related products to more than 2,300 restaurants, healthcare facilities, hotels, schools, and government agencies. Headquartered in Boca Raton, the division employs approximately 300 people and services

customers in more than 180 South Florida communities from Vero Beach to Key West, Florida. Thier new, 373,000-square-foot facility sits on 20 acres in Boca Raton and features 283,832 sf. of warehouse space, including 39 loading docks 96,000 square feet of freezer space, 48,000 square feet refrigerated space, 100,000 square feet of dry space. U.S. Foodservice is committed to giving back to the communities it serves. Since July 2009, U.S. Foodservice-South Florida had donated nearly 360 tons of food to Feeding South Florida, Florida’s largest food bank. It’s hard to imagine a world without workers comp — a world where fires erupted regularly on factory floors and children worked the looms. But 100 years ago, workers risked their lives every day on the job.

When workers were injured, they had to seek compensation for lost wages from the courts. Most employees could not afford to bring these cases, but when they did so successfully, employers had to pay lawsuit costs—in addition to the injured worker’s wages and medical bills. Workers compensation, the country’s first form of social insurance, was the solution for both sides. It served as an agreement that employers would pay for on-the-job injuries if workers gave up their right to sue.

The idea originated in Germany in 1881, but was adopted by Wisconsin in 1911. By 1948, every state, and the territories of Alaska and Hawaii, had enacted a workers compensation system.

The new legislation and coverage required the cooperation of insurance companies, ratemaking agencies, and regulatory officials among the states. To meet the need for a body to coordinate industry activities with government, the National Council on Workman’s Compensation Insurance was founded in 1919.

The agency was supplanted by the National Council on Compensation Insurance (NCCI), which was organized in 1922 and became operational in 1923. At that time, it established prices for companies writing workers compensation insurance in 10 jurisdictions.

NCCI Holdings, an integral part of the history of workers compensation history, now serves as a repository for workers compensation data, statistical information, and research.

The 88-year-old company delivers rating information and provides statistical agent services for insurance departments, independent insurance bureaus, and other affiliates in nearly 40 jurisdictions.

Factor Test? This is a list of twenty statements, many of which are conflicting, that were supposedly created to assist businesses in determining whether a position or job should be classified as independent contractor or not. Trust me, they are very confusing, making this fertile ground for the DOL to come in and audit your business, and then the IRS potentially charging you back taxes and huge penalties for independent contractors that should have been paid as employees, according to them. Similarly, they are cracking down on unpaid internships using the same reasoning.

Worried? You should be if you use independent contractors. What can you do? Do an internet search on Twenty-Factor Test, and you will find a nice long list of articles, many written by prestigious universities, that will help you sift through the vague language intended to create ambiguities for the IRS and DOL. Once you have performed your own research, you should contact an employment lawyer and revise your independent contractor agreements.

As long as unions have been around, small business hasn't really had to worry about them. We were too small for them to bother with. That may be rapidly changing. Regardless of your personal philosophy about the advantages or disadvantages of unions in the US, unions have recently taken the spotlight in the news, but have also started to take a more shadowed approach in the regulations that small businesses rely on - specifically independent contractors and unpaid internships.

Since failing to pass Card Check legislation in recent years, which would have removed secret ballots from employees unionizing votes, Organized Labor has turned to "Plan B" to strengthen their ranks with a strategic shift from attempting to pass legislation, to the much less public, but significantly more effective route, of regulatory changes.

How does this affect you as the small business owner? The National Labor Relations Board and the Department of Labor (DOL) are starting to crack down on the use of independent contractors, an extremely useful tool for small businesses to accommodate the often unpredictable flow of project within small pools of employees. Living in the Sunshine State is a beautiful thing. And although we relish in the warmth of the sun year ‘round, we must be mindful of the harmful effects of the sun’s rays on our skin. Many of you may not know about a type of skin cancer called Melanoma!

Test your knowledge and gain valuable insights for your health and those you love:

TRUTHS ABOUT MELANOMA: 1. When detected early, Melanoma has an excellent cure rate.2. The most common location for Melanoma to be found on the body in women is on the legs, and for men it is on the back.3. A changing lesion should be examined and evaluated by a dermatologist.

One of the key educational tools used to train physicians, medical personnel and the general public on how to recognize early melanomas is the ABCDEs of Melanoma Detection. The A stands for Asymmetry; (one half of the sight is unlike the other half;) The B stands for Border, (the border of the sight is irregular in shape, scalloped or poorly defined;), The C stands for Color (The color varies from one area to another and may appear in shades of tan and brown, black; sometimes white, red or blue;)The D stands for Diameter (the size of a pencil eraser or larger.) The American Academy of Dermatology recently added E for Evolving, referring to change in size, shape or color.

To summarize, a dermatologist should evaluate anything you notice on your skin that is new or changing. 4. One of the best ways to prevent Melanoma is to practice good ultraviolet light protection, especially if you have fair skin, light eyes and light hair. Facts about skin cancer prevention: use sunscreen with a sun protection factor of at least 30, reapply every 90 minutes, wear protective clothing such as a long sleeved shirt, wide brimmed hat and sunglasses. 5. Often, melanomas do not exhibit all the ABCDEs. Anything that stands out as unusual should be checked. We call this the “ugly duckling” sign. This is helpful especially if you have a lot of moles and freckles. We recommend self-skin exams every couple months. In keeping with the duck theme, a familiar adage could be a life saver: "If it looks like a duck, quacks like a duck…" In other words, check it out if you have the least bit of concern!

Beth A. Johnston officially joined the Greater Boca Raton Chamber of Commerce as Executive Vice President on May 9th.

Beth Johnston, a 12 year seasoned Chamber professional, started her career in Chamber work at the Delray Beach Chamber of Commerce. At the start of her career, Beth was actively involved in the recruitment of Chamber members and programming. As her career progressed, she became Membership Director, adding to her responsibilities communications, Chairman’s Club and management of key employees. Beth became Executive Vice President in 2005 and was responsible for the effective and efficient administration of the activities at the Chamber, including Government Affairs, Economic Development and the Chamber’s Golden Bell Education Foundation.
