AFFIDAVIT

I, FLORENTINO MAGTIBAY y SALANDANAN, of legal age, and a resident of _______________________________________________, after having been duly sworn to on oath in accordance with law, hereby depose and say:

1.That I am one of the heirs of GUADALUPE S. MAGTIBAY, who left a certain parcel of land located at No. 879 E. Pantaleon St., Brgy. Barangka Itaas, Mandaluyong City covered by TCT No. 461501 with more or less Two Hundred (200) square meters;

2.That sometime in 1974, my late mother, GUADALUPE S. MAGTIBAY purchased the above-stated parcel of land and only registered under our names for the reason that among her siblings, we are the eldest and elder son (my brother Mario S. Magtibay and I), but the truth of the matter, my sister, Teresita Magtibay-Ramos, Leovino S. Magtibay and Henry S. Magtibay are also co-owners of that particular land wherein their house are also built;

3.That we did not give any amount of money in the said purchases nor any gift to our mother, Guadalupe S. Magtibay, thus, she is the sole vendee of the aforesaid property;

4.That I learned that sometime on September 1988, a General Power of Attorney executed by our brother, Mario S. Magtibay in favor of our mother, Guadalupe S. Magtibay granting her among other power to sell the property herein described with respect to the share of the herein grantor, in accordance with Doc. No. 2057, page 72, s. of 1988 of the counsul of the Phil. for Chigaco Illinois, U.S.A. Edgardo Fernandez, dated Sept. 22, 1988 and to take effect the transfer of his share in favor to our brother, Leovino S. Magtibay;

5.That only the share of my brother, Mario S. Magtibay being the co-owner of the aforesaid parcel of land transferred his right to our brother Leovino S. Magtibay (Fifty square meter) and not the share of the other co-owners, hence, the sale of the TCT No. 461501 shall not be cancelled by TCT No. 1620;

6.That I have no knowledge of the said sale nor the tranfer of the TCT No. 461501, being the co-owner of the aforesaid parcel of land, therefore, the sale of the TCT No. 461501 shall not be cancelled by TCT No. 1620;

7.That I am executing this affidavit to attest the truthfullness of all the foregoing facts and circumstances and to support the filing of Adverse Claim of my sister, Teresita Magtibay-Ramos and for other legal intent it may serve best.

2.That sometime in 1974, my late mother, GUADALUPE S. MAGTIBAY purchased the above-stated parcel of land and only registered under our names for the reason that among her siblings, we are the eldest and elder son (my brother Mario S. Magtibay and I), but the truth of the matter, my sister and my brothers namely, Teresita Magtibay-Ramos, Leovino S. Magtibay and Henry S. Magtibay are also co-owners of that particular land wherein their house are also built;

3.That we did not give any amount of money in the said purchases nor any gift to our mother, Guadalupe S. Magtibay, thus, she is the sole vendee of the aforesaid property;

4.That I learned that sometime on September 1988, a General Power of Attorney executed by our brother, Mario S. Magtibay in favor of our mother, Guadalupe S. Magtibay granting her among other power to sell the property herein described with respect to the share of the herein grantor, in accordance with Doc. No. 2057, page 72, s. of 1988 of the counsul of the Phil. for Chigaco Illinois, U.S.A. Edgardo Fernandez, dated Sept. 22, 1988 and to take effect the transfer of his share in favor to our brother, Leovino S. Magtibay;

5.That only the share of my brother, Mario S. Magtibay being the co-owner of the aforesaid parcel of land transferred his right to our brother Leovino S. Magtibay (Fifty square meter) and not the share of the other co-owners, hence, the sale of the TCT No. 461501 shall not be cancelled by TCT No. 1620;

6.That I am executing this affidavit to attest the truthfullness of all the foregoing facts and circumstances and to support the filing of Adverse Claim of my sister, Teresita Magtibay-Ramos and for other legal intent it may serve best.

This has reference to your indorsement letter dated 17 October 2011 (Code No. GL-LAG-10-11-2011-001) referring to our office the concern of Ms. NANCY LINI R. ONG, an inmate at the Correctional Institution for Women (CIW) for appropriate action.

Please be informed that the undersigned visited the inmate on 11 November 2011 and during the interview with her, I gathered that she was already convicted of the crime of Murder and was sentenced to a Penalty of Reclusion Perpetua. She has been confined at the CIW since the year 2000. Said inmate is seeking the help of your office if it would be possible that she be deported to China, where according to her she is a national of the said country and to serve the remaining period of her sentence in that country.

The undersigned advised the inmate that her request that she be deported to China and to serve her sentence there is not feasible as of this time considering that at present, the Philippine Government has no Transfer of Sentenced Person Agreement (TSPA) with the government of Peoples Republic of China.

Under the foregoing circumtances, it was further advised that the inmate should await first the conclusion of a similar agreement with the Government of Peoples Republic of China before she could apply for a transfer and in the meantime, that said inmate should coordinate with the Board of Pardons and Parole for any application of commutation of sentence or Presidential Pardon.
