CHARLEVOIX: At thelengthy meeting of City

    Council on Monday night

the issue of outdoor din-ing came before the board

    yet again, with little re-sults.

Since the Cool Citiesinitiative in 2007 the City

    of Charlevoix has been re-

searching ways to makeoutdoor dining a reality

for downtown businessowners within the Down-

    town Development Au-thority district. During

the summer of 2014 an of-

ficial subcommittee wascreated to tackle the issue

that consisted of membersof the DDA, city staff,

    Council, and downtownbusiness owners. Since

    that time, council mem-

bers have revisited thetopic to create regulations

that would allow for out-door caf style dining dur-

ing the summer seasonbetween April 1 and Octo-

    ber 31 every year.

Bethany Pearson of theDDA presented the

agenda item and delin-eated several revisions

made since it was lastbrought before council.

    The revisions included

    mandating the removal of

barriers and tables afterOctober 31 which wouldmark the end of the sea-

son for outdoor seating.Additionally, all chairs

    must stay within regu-

lated areas and all sign or-dinances apply to the

    outdoor seating areas.These changes were

    made at the request of

    various council members

    whose concerns with the

    program have caused

citystaff to change theproposal several times.

    However, this time, it was

not only members ofcouncil who voiced con-cerns. City Planner

    Michael Spencer shared

his opinion that the feescharged for having out-

door seating seemed high, and that he would like to

see them lowered. Hestated that as the side-

    walks the seating would

be on are not maintainedby the city, but rather by

the business ownersthemselves, he felt the

fees should be lowered, and that the initial fee to

    have outdoor seating

    should be the only feecharged.

The sidewalk areas arenot maintained by the

    citythese outdoor seat-

ing areas can improve thesidewalk space, said

Spencer, who added laterthat for a space that

isnt maintained by thecityit should just be a

    one-time fee.

His sentiments wereswiftly responded to how-

    ever by council member

    Jeffrey Porter of the First

Ward, who indicated thatthe fees would be a way to

    keep violators of the pro-

gram in line. Porter feltthat the program offeredbenefits to a select num-

    ber of business owners,

but may be unfair to thepublic in general whose

taxes paid for the side-walks that the dining

would be located on.Porters thoughts were

echoed by downtown busi-ness owner Kirby Dipert,

    who took the podium to

share his concerns withthe outdoor dining pro-

gram during the publichearing held directly after

    the proposal was pre-sented.

    Im not quite sure why

anyone would want to eatdinner next to a U.S. High-

wayI think the feeshould be considerably

more than proposedwhyis it the restaurant owners

get to use city property for

free while business own-ers, like myself, cannot?

    asked Dipert.Diperts concerns were

    taken to heart by council,

    who attempted to hash

out the specifics of thefees with Pearson. Pear-

son responded that thefees were based on what

    several other areas inMichigan currently

    charge for outdoor dining.

Council requested thatcity staff research a better

fee schedule before theyagree to change the city

    code to allow outdoor din-ing.

    The proposal was thus

tabled until the nextscheduled meeting of

council, when it will be re-visited with hopefully

more input from down-town business owners

    without restaurants, and

more information can beresearched on fees. That

meeting is set for Decem-ber 15th at City Hall in

    council chambers.
