Ian McGaughey, City Manager, stated that current term of Francisco Vasquez as the City of Somerton representative on the Yuma County Library District Board of Trustees expires on June 30, 2020. Mr. McGaughey said Mr. Vasquez expressed interest in continuing to serve in this capacity and asked Council to confirm this reappointment for a three-year term so it can go before the Yuma County Board of Supervisors no later than June 1, 2020. There were no questions or comments from Council.

Ian McGaughey, City Manager, stated it had been a wild three weeks since our last Council meeting since at that time, the County had no positive cases of COVID-19. Mr. McGaughey said that the County now has 16 cases. Mr. McGaughey said that the City has been taking proactive safety measures that have been put in place to help slow the spread of the virus. Mr. McGaughey mentioned he authorized department directors to allow select employees to work remotely to limit the number of people together at any given time. He mentioned City employees are doing most meetings over secure Internet using Microsoft Teams to limit the in-person contact we have with one another.

Mr. McGaughey added that the senior phone hotline has been receiving 25 to 30 calls each day and that Parks & Rec staff has been assisting answering questions related to the resources available in the community through the city and nonprofit agencies. He said that the City is providing meals to seniors five times a week in conjunction with the Regional Center for Border Health.

Mr. McGaughey said that Governor Ducey expanded the number of businesses in the state who must cease operations effective this past Saturday, and the city also closed the basketball court and skate park to be in compliance with this order. He mentioned that a significant focus has been placed on supporting our local businesses during this crisis and directed our Economic Development department to be aggressive in ensuring our local business owners are aware of the help that’s available. Mr. McGaughey stated we will be seeing more short videos highlighting the various hours and offerings of local businesses. He said we are working with Radio Sin Fronteras from Somerton on public service announcements to help make sure the word gets out.

Mr. McGaughey said he has been in contact with his counterparts in the county and is participating in weekly calls with Senator Kyrsten Sinema. He stated he met with the leadership of our police and fire departments and also joined by Cocopah emergency personnel to develop an advanced strategy to protect our first responders from the virus. He stated every department is committed to doing what they can to keep their employees healthy while ensuring that the needs of the community are met.

Mayor Gerardo Anaya thanked Mr. McGaughey for his hard work and the employees as well even those working from home. Mayor stated he has been working with other Mayors and following the Governor’s orders.

4. Discussion regarding feedback provided by community on City parks and facilities.

Ian McGaughey, City Manager, stated that at the March 17, 2020 Council Meeting Call to the Public, a group of people including young people spoke about the need for improved and additional parks and sports facilities in the City. Mr. McGaughey introduced Jerry Cabrera from FOCUS Consultants to discuss more about the topic.

Mr. Cabrera stated that he has spoken to various community members as well and one of the things they all mentioned was that we need to do something with our current facilities. Mr. Cabrera said he has been working with Jesus Meza, Parks and Recreation Director from the City of Somerton to compare the level of service he currently has versus the level of service that will be needed to maintain current facilities and bring up to par the number of staff for the level of service that is needed. Mr. Cabrera said this information will be brought to Council in the next Council Meeting for presentation.

Jesus Meza, Parks and Recreation Director mentioned they were working on a maintenance schedule which revolves around the different parameters from parks and recreation. He said it includes anything from maintenance, staff and all the details that goes into the maintenance of parks and recreation. He said this will be presented in the next Council meeting for Council to be able to make specific recommendations for the High School project.

Mr. Cabrera asked Council if there was any guidance that needed to be followed regarding the comments from the public from the last Council meeting. Mayor Anaya said that they understand there are needs but they want to get a better understanding about their financial situation and be able to compare needs versus wants.

Council Member Juan Castillo said we need to take into consideration the comments from the public and understand what the need versus the wants is. Mr. Castillo the important thing for him was the maintenance. He mentioned it doesn’t matter how many fields we get if they can’t maintain the current ones. Mr. Castillo said we need to give the fields adequate maintenance and too get creative by optimizing the resources we have.

Council Member Villalpando said he was in line with what the Mayor and Council Member Castillo said in regard to the needs versus wants. Mr. Villalpando said that he is also concerned with what Mr. Cabrera said about the quality of the parks we currently have and take that into consideration in analyzing how much money we want to spend in the parks.

5. Discussion and possible action to authorize the Mayor to execute an agreement engaging GreenbergTraurig for bond/special counsel services for the City of Somerton.

Jerry Cabrera from FOCUS Consultants stated that GreenbergTraurig was the same firm the City used on the last bond election. Mr. Cabrera presented the proposal along with the fee schedule that is using state contract. There were no questions or comments from Council.

6. Discussion and possible action to award the lowest responsible bidder for the repair and/or for the new 1.2 million gallon storage tank project.

Sam Palacios, Public Works Director, provided a summary background of this item by stating that an invitation to bid for the construction of both projects were advertised in the Yuma Daily Sun. Mr. Palacios stated that the repair of the existing 1.2M gallon storage water tank project and the new 1.2M gallon bolted storage water tank project design work and specifications were prepared by James Davey and Associates. Mr. Palacios said their goal is to explore and analyze the cost of both options once the bid packages are received.

Mr. Palacios said that on Thursday March 26, 2020, they opened three sealed bids for the repair of the existing 1.2M gallon storage water tank project and three sealed bids for the construction of the new 1.2M gallon bolted storage water tank project. He said staff reviewed and analyzed the bid submittals for both projects and the results are attached in the bid tabulation record.

Mr. Palacios stated that the lowest bidder for the tank repair was Revolution Industrial LLC with a base bid of $601,165.95 and the lowest bidder for the new tank was Darrel Thompson Tank Inc. with a base bid of $650,601.00. Mr. Palacios provided the pros and cons for both options. Mr. Palacios recommended moving forward with the repair of the existing tank and to award the bid to Revolution Industrial LLC.

Mr. Palacios said he wanted to discuss the welded tank versus the bolted tank. He said the reason why they choose the option of the bolted tank was because it is cheaper than a new welded tank on the new tank bid option. He said it is more expensive to construct a new welded tank, that is why this option was not considered. He said both options were good options the tank repair and the new tank if we decide for either one but the reason why they are recommending the repair is because the welded tank is more secure than a bolted tank. Mr. Palacios said an issue with the bolted tank is that there is a dome on the roof that is about 6 to 8 feet higher than the existing tank and the possible issues on an earthquake because bolted tanks are constructed in sections. He added that the bolted tank requires less maintenance.

Mr. Palacios added that he received a call from Council Member Galindo asking him why they decide to go with the repair. He stated again that either option is good and that there is minimal saving of less than 10 percent. He said if we decide to go with the repair, there will be maintenance required every 10 to 15 years.

Council Member Juan Castillo asked Mr. Palacios for the life expectancy for both options. Mr. Palacios said the aluminum one would be better because less maintenance would be required but that they both had the same life expectancy of about thirty years or more. Mr. Castillo asked about the repair costs to which Mr. Palacios replied the periodic repair would be every 10 to 15 years and cost approximately between $25,000 to $40,000.

Council Member Carlos Gonzalez asked Mr. Palacios where the money was coming from for this project. Mr. Palacios replied that the water CIP account currently had allocated $400,000 this fiscal year and that he was planning to allocate the rest for next fiscal year.

Council Member Miguel Villalpando asked what type of warranty was available for each option. Mr. Palacios stated he didn’t have that information in his packet, but he was going to look into it.

He added that most likely it would be one- year warranty, but he would look into the warranty of the paint and coating for both options. Mr. Villalpando said it might be better to go with the new tank because it is going to be under warranty.

Ian McGaughey, City Manager, stated he will be participating in a briefing from the AZ Department of Emergency Management to learn how the city can be reimbursed for its COVID-19 related expenses. He said Chiefs Juarez and De Anda, Finance Director Gallegos and Vice Mayor Garcia will be joining him for this briefing. Mr. McGaughey said he will also be participating in a webinar detailing how to navigate COVID-19 related grant funding. Mr. McGaughey has been working closely with the Community Development Department as well as Mayor Anaya to develop ways to encourage Somerton residents to complete the 2020 Census. Mr. McGaughey added that Public Works has engaged the services of a consultant to complete a review of the current state of our solar installations.

Sam Palacios, Public Works Director, provided an update on the Zocalo Garden Project, a project from CDBG. They sent an order to proceed to CEMEX Construction and will start construction this coming Monday. The new 12-inch water stub-out was installed in Cesar Chavez and Main Street. The purpose for this is to continue the line to the west Valley Vista Project and also to avoid any traffic signal issues on Cesar Chavez. In addition to this Cesar Chavez Project, they had money left from the design portion of the project and was able to transfer about 80,000 for the construction portion of project.

Jesus Meza, Parks and Recreation Director, stated they established an Emergency Preparedness Plan in response to the Covid-19 as a proactive measure in order to protect our employees and continue with our operational matters. Mr. Meza added that our skate park was pending in regard to closing it, but it was going to be taken care of by the following day. He said they are going to continue moving forward with their projects. They will continue with their summer projects with on boarding lifeguards and hopefully have a regular season but if not at least reschedule them. Mr. Meza said they will be having their Parks and Rec Commission meeting next week and will be addressing the spring 2020 activities.

Araceli Juarez, Police Chief, said they had been working with the Emergency Management from the Tribal Reservation along with Chief Jenkins. Also, they had been sending kids home from skate parks. She added to keep reminding the public to stay at home. Thanked Regional Center for Border Health for providing masks and shields for their faces.

Community Development: 1. Census 2020, self-response percentages as of today indicate that Somerton is very low (14.3%) compared to the state (42.5%), the city is looking for additional ways to incentivize residents to fill out their questionnaires. 2. 21 new construction permits were issued in March, all applications were submitted prior to March 23rd to avoid paying the new impact fees that went into effect on that date. 3. The Infill, Incentive Overlay Plan presentation to the community has been postponed until the COVID-19 restrictions are lifted. Staff continue receiving calls from residents asking if this plan has been approved yet. 4. General Plan 2020, the Planning and Zoning Commission will be presented with this draft document on April 20th for their review and comments before presenting it to Council for potential adoption.

Economic Development: 1. Main Street Façade Improvement Program. The new owners of the building located at 316 West Main Street will start the façade improvement of this building. Work on this project may start within the next three weeks. 2. On March 30, Radio Sin Fronteras started announcing that Somerton’s restaurants are open for business, take out and that some offer delivery (in Spanish). The first run is until Sunday April 12. Another two weeks will be necessary to continue with this message. 3. Approved local banks to lend to small businesses based on the Small Business Administration (SBA): 1st Bank Yuma, National Bank of Arizona, and Wells Fargo.

Finance: 1. Working with ADP to set up pay codes for COVID-19 schedules in case of additional funding Preparing for the Public Assistance Program meeting on Tuesday, April 8.

2. Working on FTE information for the 2021 Budget. 3. Working with Parks and Recreation regarding additional COVID-19 Funding for the Senior Center. 4. Working on Improvement District Budget with Parks and Public Works. 5. Working with staff on telecommuting as two staff members this week will be working off sight.

Council Member Carlos Gonzalez thanked staff, City Manager, Mayor and the rest of Council. He said we are all in this together and thanked everyone for doing their best to keep us healthy and safe.

Council Member Juan Castillo thanked all City Staff for their hard work with this unexpected pandemic that is happening. Mr. Castillo gave kudos to Mayor Anaya for his response to his pandemic. Mr. Castillo said we should look into the supply and demand of our City. Mr. Castillo said when he ran for Council, he ran under the idea that he wanted to focus on bringing in a grocery store to Somerton. Mr. Castillo added that he wants to make sure that during his tenure if that doesn’t happen, he doesn’t want it to be because of lack of effort. Mr. Castillo stated that he has asked for documentation on the effort that has been placed of bringing another grocery store. He said he has talked to Ian McGaughey, City Manager, about meeting with the Economic Development Director on a monthly basis to follow up with this issue.

Vice Mayor Martha Garcia thanked the Chiefs for the efforts on being flexible on something we haven’t been through before. Mrs. Garcia also thanked IT for their hard work. Mrs. Garcia said she had a phone call with YMPO about the funds approved for the City. She added she would like to meet with Mayor Anaya and Sam Palacios on how to make Somerton be a priority to YMPO.

Mayor Gerardo Anaya said that the Census has been low for Somerton and asked Council Members for any ideas on how to motivate people. Mayor talked about reaching out to the City’s small businesses to talk about the help the Government is offering. He added that now that playgrounds are closed, we can concentrate on their maintenance. Mayor stated that the important thing here is to keep our employees safe. Asked Council to promote the stay at home policy because it is important because of our limited resources.

Dear Secretary Chao:

As Mayor of the City of Somerton and regional partner, I am writing in support of an application by the City of Yuma, Arizona (City) for an estimated $11,975,691 Better Utilizing Investments to Leverage Development (BUILD) Transportation Grant to help support the development of a Multi-Modal Transportation Center (Center) in downtown Yuma. The Center is part of an ambitious economic revitalization plan for the region, where the unemployment rate is extremely high. The new Center will strengthen the mobility and safety of citizens, consolidate several modes of transportation at one location, transform the heart of the City, and most of all, support the movement of citizens to and from school and work as they pursue opportunities to improve their quality of life. Businesses located in downtown Yuma will directly benefit as citizens and tourists are provided with more robust transportation alternatives.

The Center will include, at a minimum, bus bays for Greyhound and Yuma County Area Transit vehicles, a renovated pedestrian pathway to the Amtrak platform, an indoor passenger waiting area with ticketing kiosks, waiting areas for bus, rail and taxi/shuttle providers, and office space for Yuma County Intergovernmental Public Transportation Authority. The location of the project will also provide efficient access to jobs and services by enhancing transit access to the historic downtown, one of the community’s largest job centers with thousands of City, County, and Federal employees working in the area. Other benefits of the project include an expected reduction of congestion and environmental impacts from single vehicle traffic while providing residents with alternative methods of transportation to augment the automobile.

The total project cost of the Center is estimated to be $18.51 million. Of this total, the City of Yuma is prepared to contribute an estimated $3.88 million; providing a non-federal match of 20 percent of the total project cost. The investment will promote transportation change, help create opportunities for citizens to advance their lives educationally, professionally, and economically, support job creation, enhance job transportation opportunities for low-income citizens, and stimulate the economic development of one of the nation’s most economically distressed areas.

On behalf of the City Council of the City of Somerton, I express my strong support for the Center project as we work to advance and improve the quality of life within the Yuma region. These efforts would not be made possible without the partnerships forged within the City and County of Yuma. These agencies support and share our vision of being a more livable and sustainable community, providing insight and expertise to augment the resources and enthusiasm of our citizens. Socialdistancing is a priority worldwide, and no set timeline is currently in place to regulate social interactionsin association with recreational activities. Following recommendations by the applicable organizations like CDC or Department of Health, socialdistancing is crucial right now to reduce the spread of COVID-19. As of today, March 30th, 2020, thegovernor of Arizona, Doug Ducey, issued a "stay at home" order until April 30th, 2020. Due toscheduling & unpredictable timelines at this moment, it's simply unsafe & not viable to move forwardwith spring 2020 activities. If things hopefully go back to normal in the next few months, our plan is toprogram sports clinics & short tournaments to incentivize the community to "jump back" into recreationtowards the summer/early fall. If activities are cancelled we can move forward with reimbursements. SUGGESTED ACTIONTo follow the Parks & Recreation Commission's recommendation to cancel all spring 2020 recreationalactivities due to COVID-19 pandemic, and issue partial reimbursement to the soccer league (deductinguniforms that were already provided) and full reimbursements to activities that were unable to start dueto the pandemic (Baseball, Tee-Ball, & Girl's Softball).

Hello, Just to informed you that Parks & Recreation Commission recommended on 4/15/20 meeting that all spring 2020 activities are cancelled. They mentioned that the “ripple effect” cause by COVID-19 has disabled our spring 2020 schedule, and the most convenient option not to tweak our yearly calendar. Commission mentioned that our plan to continue with applicable recreational activities asap depending on health recommendations by our government or applicable organizations was most convenient. They provided good feedback on current virtual activities we are promoting, and our plans to keep promoting virtual recreational activities. Also, I mentioned that all departments around the state are in a holding pattern until we find out if orders from state/federal government are extended. We are preparing for summer 2020 activities in the hopes of being able to open the pool sometime this summer (lifeguard positions are open and hiring process in our the way; we are also connecting with San Luis for trainings as usual even though everything is on hold with City of San Luis). Our action plan as a department is to move forward with programming for summer/fall 2020 activities, and start activities asap (depending on timing try to link it as much as possible to closest applicable season). Also, considering the overall impact of COVID-19, our plan is to institute a few clinics & short tournaments before re-starting regular activities to incentivize & motivate community in participating in recreational activities once again. Home Rule Option allows the City to adopt its own budget limits based on local needs, service levelsand available resources. Without this Home Rule Option, Somerton expenditures would be limited tothe State's imposed formula resulting in a reduction in City services for next fiscal year 2020-2021.

The State of Arizona Constitution imposes a formula-based budget spending limit on Arizona cities andtowns, including the City of Somerton. This formula-based spending limit does not take intoconsideration the services and programs provided to citizens. There is an alternative to this formula-based limit and the State Constitution allows voters to approve a local Alternative ExpenditureLimitation – Home Rule Option.

Prior to scheduling an election for the Home Rule Option, the City is required to publish pursuantArizona Revised Statute section 41-563.01 to hold first and second notice of public hearings. Thepublic hearings are set to be held on June 2 and June 16, 2020 at the regular Council meetings. After thesecond public hearing, Council may consider the adoption of a resolution authorizing the AlternativeExpenditure Limitation – Home Rule Option to be submitted to the voters of the City of Somerton atthe same time as candidate elections.

SUGGESTED ACTIONApprove the publication of notice for public hearings to adopt an Alternative Expenditure Limitation forthe City of Somerton.

Factum,L.L.C., purchased approximately 5 acres of undeveloped real property locatedat 260 South Avenue B, Somerton, Arizona which Factum plans to develop for a new 50,000 s.f.industrial warehouse building for Factor Sales as a central distribution location. The City presently has a10-inch water main located in County 16th Street which the City desires to extend Southward to the 260South Avenue B Property to facilitate development within the City limits. Due to the Yuma County'sAvenue B pavement improvement work, the City and a contractor need to start ahead of the pavementimprovement work. The City's Public Works Staff solicited bid proposals and Taylor Engineering wasselected to work on this project for the amount of $92,952. Based on a City Council's approveddevelopment agreement, Factum L.L.C. will share the cost of the waterline extension for future creditduring the building permit process. The waterline contractor starting time is critical due to YumaCounty's pavement work on Avenue B. The pavement contractor will start during the first week of May2020. Public Work's recommendation, as an emergency, is to select and approve Taylor Engineering forthe construction of the waterline from the County 16th Street and Avenue B intersection up to 260South Avenue B location. SUGGESTED ACTIONTo approve the contractor, Taylor Engineering, for the waterline extension project to be located onAvenue B and County 16th Street.
