TAC §49.302:(c)- ensure that an employee, subcontractor, or volunteer can effectively communicate with an individual/LAR concerning service planning and the provision of services, which may require the contractor to provide an interpreter for the individual(d)- must not allow an individual to perform services under the contract or perform other work that benefits the contractor (e)- comply with the terms of the contract, which requires compliance with federal and state laws, rules, and regulations, including TAC Chapter 49, rules governing services provided under the contract, and applicable reimbursement rules in TAC Chapter 355

reference 40 Texas Administrative Code (TAC) §49.205 (a) (1) (2), which states the following:• To be a contractor, an applicant must have a license,

certification, accreditation, or other document as follows:• CLASS/Support Family Services (SFS) requires a permit to

operate a child-placing agency issued by the Department of Family and Protective Services (DFPS) in accordance with Chapter 745; or

Requesting Contract ChangesProviders must notify HHSC of changes affecting their contracts such as:• An ownership update (or stock transfer) at least

60 days in advance of the date of the change

• A change in the name of the individual(s) authorized to negotiate contracts on behalf of the provider within 30 days of the date of the change.

Requesting a Change of Ownership or Change of Legal Entity

• A change of legal entity will be processed when there’s a change in the EIN, which generally indicates a change in the legal entity responsible for the contract.

• A change of ownership will be processed when, as the result of a stock transfer, one or more persons who collectively had less than 5 percent ownership before the stock transfer will now have at least 50 percent ownership after the stock transfer.
