Amend Sec. 1, page 1, line 14, by inserting after "lines.": The municipahty or authority installing the lines shall have the right to place a !ien against the property for an amount equal to that whlch would have been due and payable by the owner if he were liable for the payment, said lien to be interest free. The lien shall not have priority over any judgment or mortgage placed against the land. No execution may be made on the lien unless the owner avails himself of the services provided by the lines.

of businesses to qualify for unemployment benefits. Mrs. Kay Clarke, Legislative Representative from the Depart- ment of Labor and Industry, stated that Secretary Smith is opposed to the Bill as i t would cause economic impact upon the "unemployment compensation fund", which, at present, is experiencing heavy demands upon it and that it would be very expensive legislation for the number of people who would benefit from it. It was pointed out that Federal Unemployment Tax (F.U.T.A.) applies to all businesses which employ one or more employees. Formerly, F.U.T.A. only covered businesses which had four (4) or more employees. Therefore, it was pointed out by Mrs. Clarke that very few employers would not he contributing to the Federal Unemployment Program and would not qualify for State Unemployment benefits as the Bill is written. However, Rep. Vroon stated that small businessmen should he entitled to some relief when they become unemployed. Mr. John Dankoslry, repre- senting the Pennsylvania Chamber of Commerce, told the Committee that a small businessman would have to pay about $128.00 annually. to the Fund, and he would be eligible to collect unemployment benefits in the sum of $111.00 per week, which be considered a "windfall". Upon motion of Rep. Novak, seconded by Rep. Perry, the Bill, upon unanimous vote, was tabled, pending re- ceipt of a fiscal note.

House Bill No. 811 ( P N 914) was brought UP for dis- cussion. This Bill, as drafted, would allow corporate of- ficials to be eligible to collect unemployment compensa- tion benefits. Mrs. Clarke told the Committee that Secre- tary Smith is opposed to the Bill as it could permit fraudulent claims to be submitted by individuals who have the power to "hire and fire" themselves.

Mrs. Clarke further stated that Secretary Smith is of the opinion that this Bill is an attempt to circumvent various court cases which have denied Unemployment Compensation to such claimants, which would he eligible under the Bill, as drafted. Rep. Hamilton stated that he favors the Bill as there are some individuals as corporate officers, who can be terminated and have no control over their own destiny, and they should qualify for un- employment benefits. The Chairman stated that a fis- cal note had not been received. Upon motion of Rep. Novak, seconded by Rep. Perry, it was, hy unanimous vote, tabled, pending receipt of a fiscal note.

House Bill No. 841 (P N 944) was called UP for con- sideration. This Bill would amend the Administrative Code of 1929, by giving the Department of Labor and Industry the authority to adopt regulations governing fire and safety standards pertaining to public utility buildings, structures and distribution lines to include placing such facilities underground to protect the public. Mrs. Clarke told the Committee that the Department is of the opinion that the Commonwealth may be Pre- empted from this field by cases which hold that the states may not interfere with matters which are engaged in interstate commerce. The Department estimated the fiscal note to be $250,000. Upon motion of R ~ P . Mc- Clatchy, seconded by Rep. Perry, the hill, upon unani- mous vote, was tabled.

House Bill No. 872 ( P N 990) was called up for con- sideration. The Staff pointed out that there was some technical problems with the Bill which is very similar to House Bill No. 565 ( P N 624), which has been con- sidered by the Con~n~i t t ee and which was tabled. I t was pointed out that under a Federal Program (S.U.A.), em-

ployees of political subdivisions, would qualify for bene- fits for 26 weeks, which would expire at the end of March, 1976. Under current State Law, approximately 90 political subdivisions have elected to come under the Unemployment Compensation Act of the Commonwealth, which would give such employees thereof, a maximum of 65 benefit weeks consisting of 30 weeks; 9 weeks ex- tended henefits; and 26 weeks under two Federal pro- grams. The Committee was advised that if political sub- divisions have elected, or do elect, to come under the State Unemployment Compensation Act, the employees hired under the C.E.D.A. Program would be eligible for unemployment benefits when the C.E.D.A. Program would terminate. Under the present .4ct, political subdivisions can elect to participate on a re-imbursable basis or on a rontribul.ing basis. Under the re-imbursable basis, the political subdivision reimburses the fund for any pay- ments made, whereas, under the contributory basis, the political subdivision would contribute to the fund 2% of its total, not taxable payroll. Upon motion by Rep. No- vak, seconded by Rep. illcGraw, the bill, upon unanimous vote, was tabled and the Staff was directed to develop proposed legislation to implement the considerations of this Bill and House Bill No. 565 ( P N 6241, and present ,,me to the Committee for its consideration.

House Bill No. 892 ( P N 1015) was called u p for con- sideration. This Bill would amend Section 306 of the Workmen's Compensation Act, by enabling any individual who is -permanently disabled," prior to the being

This bill amends Section 501, simply stating that a Veteran who has the experience and qualifications for a position should not be denied that position because he has no college education. The bill was supported on the basis and recognition of individual's experience as an equivalent to college credit.

House Bill No. 160, Printer's No. 165-A proposed act additionally defining legal resident of Pennsylvania for eligibility for certain Pennsylvania veterans compensa- tion.

This bill was tabled after much discussion with an affirmative vote with one exception of Rep. Katz. The tabling motion was made by Reps. Salvatore and Pyles.

House Bill No. 615, Printer's No. 693-After much discussion it was agreed that the Chairman check into details further and that we would table the bill until at least the next meeting. Some questioned the defini- tion of total disability under the provisions of the Vet- erans Administration, the impact it would make on local taxing abilities, details of determination of need et al. There was no tabling motion except the Chairman in- dicated this "for further study."

A discussion took place relative to the various "Bonus." Reps. DeMedio, Salvatore and Shuman indicated that some veterans groups wanted the Viet Nam Bonus extended for one year. Col. Lammerson and others indicated it would be too expensive in staffing, etc., to pay the undoubtedly few who have failed to apply.

Rep. Zeller spoke about the need for department heads, etc., to consider veterans on job placement and spoke in particular about openings on the Turnpike and that veterans were not considered as a preference. The Chairman indicated he would contact the department heads recommending that they make a better effort to hire the returned veteran by these agencies.

The matter of National Guardsmen and Reservists being excused from summer camp was discussed on the suggestion of Rep. Miscevich. I t was indicated that this would have to be handled through the local Commanding Officers via higher headquarters. Com- ment was made that approval is only given upon dire hardship cases and decided on an individual case manner.

The meeting was adjourned at 2:30 P. M. on motion by Rep. Zeller and Rep. Shuman.
