Most Compassionate, Forgiving, and Loving Father, we know that Thou hast loved us from the beginning of time and hast prompted us t o love Thee in return. We recognize that many times we have failed to measure up to that which Thou hast desired from us, but we pray in Thy faithfulness Thou wilt continue to show us Thy extended mercy.
We beseech Thee, 0 Lord God, to fill us with Thine everlasting love and enable us t o show forth that love in our dealings with all mankind. This we ask that Thy love may be seen not only in our dealings with the sons of men but also with nations and world Dowers. Amen.

Mr. LLOYD. Thank you, Mr. Speaker. This amendment attempts t o clarify two portions of the
bill. First, it attempts t o make clear that the standard by which
coal is to be judged is cost effectiveness when compared to other forms of energy. Secondly, i t is designed lo make clear that the grandfathering in of certain cogeneration projects is to cover those projects which are under way at the present time.

Mr. BURNS. Mr. Speaker, I wonder if I could interrogate Mr. Lloyd for just one moment.
The SPEAKER. Mr. Lloyd indicates he will stand for inter- rogation. The gentleman, Mr. Burns, is in order and he may proceed.
Mr. BURNS. Thank you, Mr. Speaker. Mr. Speaker, as I understand this bill, it would require that
any new State buildings that are built be b u i l ~ so that they would contain a coal heating or coal cooling system; whatever is needed to regulate the temperature in the building would be fired by coal. My question is, I guess, suppose the State would decide to build a building in the Philadelphia area, and because now they have got to put a coal-fired operation in there, it will not meet the air quality controls and so forth that the city and other agencies regulate. Would that mean that we could not build the building?
Mr. LLOYD. No. If you look at the bill on page 2, Mr. Speakcr, starting with
line 8, a heating system is exempt from the coal presumption
if the Department of General Services determines that that presumption would violate either existing or reasonably antic- ipated environmental rules, or if the department were to determine that that presumption would result in doing some- thing which is not cost effective.
Mr. BURNS. Thank you, Mr. Speaker. That is all I wanted to know.

Mr. PRESTON. Thank you, Mr. Sueaker. Will the gentleman, Mr. Lloyd, stand for interrogation? The SPEAKER. The gentleman, Mr. Lloyd, indicates he
will remain standing for interrogation. You may proceed. Mr. PRESTON. Thank you. Mr. Speaker, following along the lines of Mr. Burns, 1 am
concerned also about certain laws it may affect as far as the municipality is concerned. They also have some strict stan- dards, too. How would this affect-1 do not see anything here about any local municipalities or governmental subunits as far as their rules and regulations-would this supersede any rules as far as the city is concerned?
Mr. LLOYD. No; it would not certainly supersede any local ordinance as far as zoning or anything like that is concerned. If there is a local air pollution ordinance, the bill specifically says that you cannot violate any existing or reasonably antici- pated environmental rules or regulations.
Mr. PRESTON. Also, could you give me an example, as far as the Department of Environmental Resources? Would they determine if it may be in violation of anything? Is there a set standard?
Mr. LLOYD. Well, it would be based on whatever the air emissions ceiling is that has been set for the particular air basin. The Department of General Services would be respon- sible for making that inquiry to the Department of Environ- mental Resources. As to the question of what would be rea- sonably anticipated, I think everybody recognizes that there is a move afoot lo impose more stringent air emissions stan- dards, and I certainly would anticipate that the Secretary of General Services would take account of that when he is trying to figure out whether to go ahead with coal or to choose another fuel.
Mr. PRESTON. Would you say then that in most urban areas, such as Philadelphia and Pittsburgh, would they be lbrced to, if they built a building, would they have to have coal?
Mr. LLOYD. No. No. If the presumption exists, it is a presumption; it is not an
absolute mandate. The presumption exists under two circum- stances: if they can comply environmentally, and, two, if that is the most cost-effective thing to do. I f something else is more cost effective, the presumption falls and the department can do whatever it wants to do.
