    Nowhere in the COMELEC Rules does it allow a Commissioner to voluntarily inhibit with reservation.

    FACTS: Rolando Salvador was proclaimed winner in a mayoralty race in May 14, 2001 elections. His opponent,

    Romeo Estrella, filed before Regional rial !o"rt #R!$ an election protest w%ic% conse&"ently ann"lled Salvador's

    proclamation and declared Estrella as t%e d"ly elected mayor and event"ally iss"ed writ of e(ec"tion. )%ile

    Salvador filed a petition for certiorari before t%e !ommission on Elections #!*ME+E!$, raffled to t%e Second

    ivision t%ereof, Estrella moved for in%ibition of !ommissioner Ralp% +antion, b"t a Stat"s -"o nte *rder was

    iss"ed. However, !ommissioner +antion vol"ntarily in%ibited %imself and designated anot%er !ommissioner to

    s"bstit"te %im. %e Second ivision, wit% t%e new /"dge, affirmed wit% modifications t%e R! decision and declared

    Estrella as t%e d"ly elected mayor. Salvador filed a Motion for Reconsideration w%ic% was elevated to t%e

    !*ME+E! En anc, in w%ic% t%is time, !ommissioner +antion participated by virt"e of Stat"s -"o nte *rder
