AFFIDAVIT STATEMENT OF VICKI HACK

I, Vicki Hack, owner and resident of Unit 1005, of The HarboursCondominiums, Jeffersonville, IN, make the following statements of my own freewill and act and that I have not been coerced or promised anything for recordingmy statement.

I have talked to over 100 Homeowners and witnessed many Homeowners atthe Harbours, and renters living in fear of intimidation, harassment and retaliation,they are giving up and moving out, leaving their units abandoned. I have tried tofight for justice and what is right, on behalf of these crime victims and myself. Ibelieve I know of over 25 homeowner reports of theft and vandalism of theirvehicles and home. I believe that fear is-used to target certain people and drivethem out of their homes, so others can profit from Homeowners selling their homesunder duress. In my opinion, the Harbours Vice President.Kevin Zipperle and theManager Cindy Richards are business partners, manipulating everything in orderto buy and sell these units at the Harbours for a huge profit. I believe based 011

many Homeowners accounts that Kevin Zipperle set up the=f'reasurer of the BoardSharon Chandler to sell Real Estate at the Harbours and block sales of innocenthomeowners, to profit for themselves.

I feel that some Board members and staff are using the Harbours Buildingthat is jointly owned by 184 Homeowners, to profit for themselves.

( I feel many Security Guards, Office Staff, Board Members and Homeownersover the past 10 years have identified serious criminal operations at the Harbours.

Many Homeowners, including myself have asked the Harbours Board forsimple detailed financial records that even the Board Attorney, Jack Vissing, toldme last year was reasonable for a Homeowner to request. The Board and Managercontinually have denied these simple financial requests from Homeowners and evenrequests made by other Harbours Board members to view these financial records &documents. (For example a simple record requested, by Unit, date of maintenanceservice & amount paid to association), or (list of parking spaces-owner), theserequests even made by Board members were denied by the Board. The HarboursBoard has no Transparency or Accountability of any records or documents.

I believe that Board members should not profit from their position on theBoard, from parking spaces worth $5,000 to 15,000 a piece to rea] estate steering, toa $700,000 yearly budget with no transparency or accountability. I believe thatmany of the Board members and their friends do not pay for maintenance work andremolding work, done in their units. I have first hand knowledge that some paydirectly to Read Blasi, for maintenance work done in their units and this moneyshould all go toward the association funds. I believe that is why they will notprovide HOmeOV'I'IlerSor other BOARD members a list of units with date of serviceand amount charged for maintenance service. I believe that the Harbours Board

have sold or given parking spaces to their friends that belonged to otherHomeowners and the Homeowner's Association. Handicapped parking spaces havebeen sold, painted over and when Homeowners ask, they get their vehiclesvandalized or harassed. Tim Agee is a homeowner and is in a wheel chair, andwhile he lived at the Harbours, he parked in a Handicapped Association parkingspace 101, now he has been trying to sell his unit along with his deeded parkingspots 118 and 119. I believe that Kevin Zipperle told Agee that the Board does notrecognize him as the owner of those parking spaces that are on his deed and they donot care what is recorded at the courthouse. Zipperle said if Agee or his rentersparked in 118 or 119 they would be towed. Cindy Richards called the title attorneyand tried to have them change Agee's Deed, over to her friend, Dottie Branham forparking spaces 118 and 119 and Mary Fondrese, from the title company, refused,stating that Richards did not have Agee's permission. 1believe Zipperle offeredAgee the association parking spot 101, in exchange for 118 and 119, and Ageerefused knowing that 101 belongs to the Harbours Association, 1believe we need tocorrect these fraudulent scams.

I attended the 2006 annual Harbours election where-s heard Cindy Richards,the Manager, state to some very disgruntled homeowners, "I have control of 51% ofthe proxy votes in my hand, and we can vote on whatever you .want tonight". 1found this to be very alarming, so after the meeting, 1read the Harbours Bylawsand decided that we needed to have an election where all the ballots were mailed out

d .and counted by a 3r party. In 2007, I called over 100 Harbour Homeowners andfound that some were extremely afraid of retaliation when they voted, because thevotes were counted in the office where the Board and the Manager could view theseballots.

I had a Special Harbours Election Meeting called, where over 92 brave andscared Homeowners out of 184 units, signed up to remove the Harbours Board ofDirectors and elect a new Board. I believe due to serious voter irregularities, suchas 2-3 votes heing cast per one unit, per the CPA, illegal Designated Voters, the voteto remove the board did not pass. I feel there is voter fraud and that the Board andthe Manager have become the Designated Voter for units illegally; when our Bylawsclearly state that you must be the owner of that unit to be the Designated Voter. Weneed transparency and accountability at the Harbours instead of criminal actions,delays and confusion.

Last year Homeowners afraid for my safety installed a camera in my door toprotect me. These same Homeowner will not allow their adult daughter to live atthe Harbours because he is afraid for her safety.

Many people, and officials across Jeffersonville and other areas areconcerned with what is going on at the Harbours. I was contacted by IndianaLegislator Phil Hinkle, to testify in Indianapolis, on a Homeowners Association Bill,HR1088; he is trying to pass this Bill to protect the rights of the Homeowners inAssociations.

I would like the prosecutor to investigate and follow the money trail and alsofor the court to appoint a 3rd party mediator or administrator, to run the entireHarbours operations, in order to resolve this criminal behavior, so Homeowners atthe Harbours do not have to live in constant fear. The serious slander, fear,harassment, intimidation, retaliation, steering, vandalism and theft at the Harboursneeds to stop immediately. It is escalating, and I believe due to the false statementsthat the Board tells Homeowners, and I am afraid for my safety and others. TheBoard refuses to ask Ken Quiggins to step down from the Board, after Quiggins wasarrested for theft. Quigglns-states that the Board told him to steal those documentsfrom my unit.

IT IS EXTREMELY IMPORTANT THAT THE BRAVE HOMEOWNERS THATHA VE STEPPED FORWARD TO MAKE THE STATEMENTS ATTACHED ARENOT SUBJECT TO RETALIATION BY THE BOARD OR STAFF AT THEHARBOURS. PLEASE, IF AT ALL POSSIBLE KEEP THEM ANONYMOUSUNTIL THEY NEED TO TESTIFY. IN 2008, SOME OF THE 92HOMEOWNERS WERE SERIOUSLY CONFRONTED, G~LLED, ANDHARASSED AFTER THEY SIGNED THE STATEMENT TO REMOVE THEBOARD AND GET A TIDRD PARTY TO MAIL OUT AND COUNT OURVOTES.
