Dear Sir,

We would like to mention here that we have established a 5 MTPA capacity coal washery at Himgir Tehsil, Sundergarh Dist of Orissa in an area of 13.52 ha for which Environment Clearance was granted by the office of the MoEF as per the EIA Notification of MoEF dated 14th Sep 2006 and subsequent amendments thereof vide letter No. J011015/925/2007-IA.II (M) dated 22nd June 2009 (copy of EC attached as Annexure-I).

In the above mentioned clearance letter we would request for time extension and amendment on the following issues.

The process of Forest Clearance is taking time beyond our schedule period as we had planned while obtaining Environmental Clearance in 2009.

A. The Stage 1 FC is already obtained. Stage 2 Clearance is in the process. The status of approval of forest clearance is mentioned as below:

required for construction of Conveyor Corridor was submitted to the regulatory authority subsequent to which The Special Secretary to Govt. of Odisha, Forest and Env. Department, issued a letter vide letter no. 10F (Cons) 531/2012/12581/F&E dated 18/06/2013 to the Additional Principal Chief Conservator of Forests (Central), MOEFCC, Eastern Regional Office, Bhubaneswar regarding approval for proposal for diversion of 2.699 Ha of forest land for construction of conveyor corridor.

The Conservator of Forests, (Central), Eastern Regional Office, Govt. of India, MOEFCC, Bhubaneswar issued a letter to the Principal Secretary, Forest & Environment Deptt., Govt. of Odisha, vide letter no. No. 5-ORB171/2013-BHU dated 25/02/2014 regarding issue of Stage –I Forest Clearance in favor of M/s ACB (India) limited for diversion of 2.699 Ha of forest land for construction of conveyor corridor.

M/s ACB (India) Ltd., Hemgir Coal Washery asking to the Divisional Forest Officer (DFO), Sundargarh by his letter no. ACB (I) Ltd./F.D./2013-2014/0053 dated 03/03/2014 for issue of Demand Note against conditions Sl. No. 1,3,4 & 6 of Stage –I Forest Clearance. .

The Divisional Forest Officer (DFO), Sundargarh instructed vide his letter no. No. 3179/4F/Misc./2014 Dt. 13.03.2014 to M/s ACB(India) Ltd., Hemgir Coal Washery for deposit of Rs. 25,34,361.00 towards NPV. M/s ACB(India) Ltd., Hemgir Coal Washery deposited Rs. 25,34,361.00 towards NPV on dated 30/07/2014.

The Divisional Forest Officer (DFO), Sundargarh instructed vide his letter no. No. 3182/4F/Misc./2014 Dt. 13.03.2014 to M/s ACB(India) Ltd., Hemgir Coal Washery for deposit of Rs.1,16,057.00 towards RWMPE. M/s ACB(India) Ltd., Hemgir Coal Washery deposited Rs. 1,16,057.00 towards RWMPW on dated 30/07/2014.

The Additional Principal Chief Conservator of Forests, Forest Diversion & Nodal Officer, F.C. Bhubaneswar, in his Memo No. 6753 /9F(MG)-134/09 Dt. 22.04.2014 to the DFO, Sundargarh, regarding deposit of Rs.10,56,500.00 towards Financial Outlay for Compensatory Afforestation Scheme over 2.699 Ha non-forest land at village Kanika. The said amount of Rs.10,56,500.00 deposited by M/s ACB(India) Ltd., Hemgir Coal Washery on 30/07/2014.

M/s ACB (India) Ltd., Hemgir Coal Washery submitted Compliance of conditions mentioned in the Stage –I Forest Clearance, vide letter no. ACB(I)/F.D./Belt/2014-15/0691 dated 12/08/2014 to the Divisional Forest Officer (DFO), Sundargarh, Odisha.

The Divisional Forest Officer (DFO), Sundargarh, Odisha submitted the status of Compliance of conditions mentioned in the Stage –I Forest Clearance, vide Memo No. 8461/4F(Misc) Dt. 26.11.2014 to the Regional Chief Conservator of Forests, Rourkela.

The Regional Chief Conservator of Forests, Rourkela, forwarded the compliance report to The Additional Principal Chief Conservator of Forests, Forest Diversion & Nodal Officer,

Bhubaneswar, submitted by DFO, Sundargarh for validation and necessary action.

The DFO, Sundargarh, submitted the Site Specific Wildlife Conservation Plan in respect of belt conveyor corridor to the Regional Chief Conservator of Forests, Rourkela. Vide Memo No. 2466 /4F Misc. dated Dt.27.05.2015.

The Principal Chief Conservator of Forests (WL) & Chief Wildlife Warden, Bhubaneswar submitted approval of Wildlife Conservation Plan in respect of belt conveyor corridor Activities by user agency Rs 9.914 Lakh, Activities by DFO in project impact area of Rs 44.061 Lakh, amounting to total Rs.53.975 Lakh vide Memo No. 6949/1WL-SSP-177/2015 dated 06.08.2015. And the amount of Rs.44.061 lacs towards activities by DFO was deposited on 01/10/2015.

The Divisional Forest Officer (DFO), Sundargarh issued a letter to M/s ACB (India) Limited, vide his letter no. No. 3776/4F (Misc)/2015 dated 04.09.2015, to submit/deposit Site Specific Wildlife Conservation Plan Fund.

The Additional Principal Chief Conservator of Forests, Bhubaneswar issued a letter vide Memo No. 4184 /4F/Misc. Dt. 01.10.2015, to the Divisional Forest Officer (DFO), Sundargarh informing that M/s ACB (India) Limited has deposited Rs.44.061 Lacs.

Only ROR of land for diversion is pending which will take another 1 to 2 months time.

There after stage II clearance may take another two months time.

01 Specific Condition No. (iii) – The entire coal rejects shall be used in an FBC based TPP. The linked FBC based Thermal Power Plant shall be Commissioned within two years of Operation of the Washery.

1. Here the linked FBC based Thermal Power Plant is the 45 MW TPP to be established at Bomaloi (mentioned wrongly as Bimbloi in the EC Letter) at a distance of 45 Kms and commissioned within two years.

2. The above mentioned TPP is a unit of M/s Aryan Ispat and Power Pvt. Ltd.

3. This was under the same management during the time when the said EC was obtained.

4. But since 2012 the said TPP is no more under the same management.

5. In the above context, we would like to mention that ACB (India) Ltd has a reject based power generation with an installed capacity of 430 MW and another 50 MW based on coal washery rejects shall be added to the capacity by the end of this year, in addition to this, we are also working with the following Units including AIPPL for disposal of Rejects. (1) M/s. Sasan Power Limited of Reliance

Power Limited (2) M/s. OCL India Limited. (3) M/s. Aadhunik Power & Natural

Resources Limited (4) M/s. Aryan Ispat & Power Pvt. Ltd.

6. In the present scenario, we may be allowed

to disposed rejects to other Power Plants having CFBC/AFBC in addition to disposal of

the same to the linked Power Plant of AIPPL, Bomaloi having presently 6 MW AFBC.

7. Copies of MOU attached as Annexure-II.This will help in disposal of entire rejects in aneco friendly manner

In view of the above we would like to request you to kindly extend time for completion of Closed Conveyor from Washery to Railway Siding and amend our environment clearance for disposal of the entire rejects to other power generators with whom MoU’s have been signed.

Sub: Himgir Coal Washery by wet process (5 MTPA of raw coal) of M/s Aryan CoalBeneficiation Pvt. Ltd., located in village Kanika, Tehsil Himgir, districtSundargarh, Orissa - Environmental Clearance - reg.

This has reference to letter No. ACBPL/MOEF/07-08/1048 dated 14.08.2007 along withapplication for Terms of Reference (TOR) and this Ministry's grant of TOR vide letter dated16.01.2008 and subsequent application dated 05.01.2009 for environmental clearance and lettersdated 02.03.2009, 16.06.2009 and 19.05.2009 enclosing letter No. III-CON (NOC) -148/2008-2009dated 12.05.2009 from Orissa State Pollution Control Board. on the above-mentioned subject. TheMinistry of Environment & Forests has considered the application. The proposal is for establishing astand-alone Himgir Coal Washery of 5 million tonnes per annum (MTPA) capacity of rawcoal by wet process in a total area of 13.7 ha. There are no National Parks, Wildlife Sanctuary,Biosphere Reserves found in the 15 km buffer zone. Of the project area, area for CHP is 1.5 ha, greenbelt is 4.0 ha, crushing yard is 0:1 ha, reservoir 0.1 ha, washery equipment 3 ha, bUilding &infrastructure 0.3 ha, conveyor system 0.2 ha, storage yard for coal (raw, clean and rejects is 4.5 ha.Transport of 15151 TPD of raw coal from coalmines of M/s Mahanadi Coalfields Ltd. to the Himgircoal washery would be by trucks covering a distance of 40 km and transport of washed coal torailway siding at Himgir covering a distance of 6 km both by trucks via a dedicated road for coaltransportation and thereafter by rail. The area between Himgir Washery and the railway siding isforestland and hence a closed conveyor from the washery to the railway siding is presently notfeasible, however efforts are presently on to establish a closed conveyor system between the coalwashery and the railway siding within 3 years. The Washery unit would consist of two processingunits of 400 TPH each. It is a zero-discharge unit. The maximum generation of rejects would be 1MTPA, which would be fully utilised in an FBC based 45 MW TPP to be established at Bimbloi at adistance of 45km and commissioned within 2 years. Groundwater table is in the range of 6-8m belowground level (bgl). Peak water requirement is 280 m3/d, which would be met from Brahmanai Nala.Public Hearing was conducted on 18.11.2008. Capital cost of the project is Rs. 20 crores.

2. The Ministry of Environment & Forests hereby accords environmental clearance for theabove-mentioned Himgir Coal Washery unit of 5 million tonnes per annum (MTPA) of rawcoal under the provisions of the Environmental Impact Assessment Notification, 2006 and subsequentamendments thereto and under various MOEFCirculars thereunder and subject to conditions specifiedbelow:·

(i) The company shall prepare a Plan for transportation of the entire washed coal by rail modeonly. The internal transport of the entire raw coal and clean coal within the washery shall beby closed belt conveyors only.

The proponent shall establish a closed conveyor system within 3 years for transportation ofwashed coal between the washery and the railway siding at Himgir and prior forestryclearance shall be obtained under the provisions of the FCAct, 1980.

The entire coal rejects shall be used in an FBC based TPP. The linked FBC based ThermalPower Plant shall be commissioned within 2 years of operation of the washery.

The raw coal, washed coal and coal wastes (rejects) shall be stacked properly at earmarkedsite(s) within stockyards fitted with wind breakers/shields. Adequate measures hall be takento ensure that the stored minerals do not catch fire.

Hoppers of the coal crushing unit and washery unit shall be fitted with high efficiency bagfilters and mist spray water sprinkling system shall be installed and operated effectively at alltimes of operation to check fugitive emissions from crushing operations, transfer points ofclosed belt conveyor systems and from transportation roads.

All internal roads shall be concretised. The roads shall be regularly cleaned with mechanicalsweepers. A 3-tier avenue plantation developed along the main transportation roads, and

approach roads to the washery.

Trucks engaged for mineral transportation outside the washery shall be optimally loaded andcovered with tarpaulin with no spillage en route. The trucks shall be properly maintained andemissions shall be below notified limits.

The company shall not use groundwater for the washery operations. Permission from theState Government shall be obtained for sourcing Brahmani Nala water for the washeryoperations Any additional water requirement envisaged shall be obtained by recycle/reuse tothe maximum extent and from rainwater harvesting measures.

Industrial wastewater "(workshop and wastewater' from the washery) shall be properlycollected, treated so as to conform to the standards prescribed under GSR422 (E) dated 19th

May 1993 and 31st December 1993 or as amended from time to time before discharge. Oiland grease trap shall be installed for treatment of workshop effluents.

The Washery unit shall be a zero-discharge facility and no wastewater shall be dischargedfrom the washery into the drains/natural watercourses. Recycled water shall be used fordevelopment and maintenance of green belt and in the Plant Operations.

(xi) Green belt of 4 ha shall be developed all along the periphery of the site, along the areas suchas the washery unit, crushing unit, and stockyard.

(xii) Socio-economic and welfare measures for the local communities shall be implemented underCSRwith a capital outlay of Rs 1 crore and an annual revenue expenditure of Rs. 35 lakhs.

(x) Mercury content before and after washing of coal shall be estimated once in six months andrecords maintained thereof.

(i) No change in technology and scope of working shall be made without prior approval of theMinistry of Environment and Forests.

(ii) No change in the calendar plan for washing the quantum of mineral coal and waste producedshall be made.

Four ambient air quality monitoring stations shall be established in the core zone as well as inthe buffer zone for monitoring SPM, RSPM,S02, NOx and heavy metals such as Hg, Pb, As,Cr, etc. Locations of the stations shall be decided based on the meteorological data,topographical features and environmentally and ecologically sensitive targets in consultationwith the State Pollution Control Board.

Fugitive dust emissions (SPM and RSPM) from all the sources shall be regularly monitoredand data recorded properly. Water spraying arrangement on roads, wagon loading, dumptrucks (loading and unloading) points shall be provided and properly maintained. Monitoringof heavy metals such as Hg, Pb, As, Cr, etc shall be done once in six months and recordsmaintained thereof.

Periodic monitoring report with data on ambient air quality (SPM, RSPM,S02, NOx and heavymetals such as Hg, Pb, As, Cr, etc) shall be regularly submitted to the Ministry including itsRegional Office at Bhunbaneshwar and to the State Pollution Control Board and the CentralPollution Control Board once in six months.

Adequate measures shall be taken for ·control of noise levels below 85 dBA in the workenvironment. Workers engaged in blasting and drilling operations, operation of HEMM, etcshall be provided with ear plugs/muffs.

Vehicular emissions shall be kept under control and regularly monitored. Vehicles used fortransporting the mineral shall be covered with tarpaulins and optimally loaded.

Environmental quality shall be regularly monitored and got analysed through anEnvironmental laboratory established under the Environment (Protection) Act, 1986.

Personnel working in dusty areas shall wear protective respiratory devices and they shall alsobe provided with adequate training and information on safety and health aspects.

Occupa 'onal health surveillance programme of-the workers shall be undertakenperiodically to observe any contractions due to exposure to dust and to take correctivemeasures, if needed.

An environmental management cell with suitable qualified personnel shall be set up under thecontrol of a Senior Executive, who will report directly to the Head of the company.

The funds earmarked for environmental protection measures shall e kept in separate accountand shall not be diverted for other purpose. Year-wise expenditure shall be reported to thisMinistry and its Regional Office at Bhunbaneshwar.

The Regional Office of this Ministry located at Bhunbaneshwar shall monitor compliance ofthe stipulated conditions. The Project authorities shall extend full cooperation to the office(s)of the Regional Office by furnishing the requisite datal information/monitoring reports.

A copy of the will be marked to concerned Panchayat/ local NGO, if any, from whom anysuggestion/representation has been received while processing the proposal.

State Pollution Control Board shall display a copy of the clearance letter at the RegionalOffice, District Industry Centre and Collector's OfficejTehsildar's Office for 30 days.

The Project authorities shall advertise at least in two local newspapers Widely circulatedaround the project, one of which shall be in the vernacular language of the locality concernedwithin seven days of the clearance letter informing that the project has been accordedenvironmental clearance and a copy of the clearance letter is available with the StatePollution control Board and may also be seen at the website of the ministry of Environment &Forests at http://envfor.nic.in. The compliance status shall also be uploaded by the projectauthorities in their website and regularly updated at least once in six months so as to bring

the same in the public domain. The monitoring data on environmental parameters (air!water! soil and noise) shall also be displayed at the entrance of the project premises andmines office and in corporate office and on the company website and update once in sixmonths.

3. The Ministry or any other competent authority may stipulate any further condition forenvironmental protection.

4. Failure to comply with any of the conditions mentioned above may result in withdrawal of thisclearance and attract the provisions of the Environment (Protection) Act! 1986.

5. The above conditions will be enforced inter-alia! under the provisions of the Water(Prevention & Control of Pollution) Act! 1974! the Air (Prevention & Control of Pollution) Act! 1981!the Environment (Protection) Act! 1986 and the Public Liability Insurance Act! 1991 alo w~h theiramendments and Rules.
