system. She will also focus on drugged driving from the stop to the testing to

supervisor training, critical steps to take when setting up a public employer
drug-testing policy, understanding that drug testing of public employees
involved the US Constitution, how to properly handle employees that
voluntarily come forward, and recognizing that personal liability may attach to
a constitutional violation.
Toxicology Monitoring – Emerging Trends

The Center for Disease Control (CDC) has declared the use and abuse
of prescribed opiates is at epidemic levels. The American College of
Occupational and Environmental Medicine (ACOEM) reports that the abuse
of prescription medicine results in four times the number of catastrophic
injuries at work. But, the ADA limits what employers can do in response
to this increasing threat in the workplace. Can you test for prescription
drugs? Can you require workers to report medicines they are taking? Must
you accommodate worker’s use of medications in your workplace? These
and other difficult program management issues will be discussed during
this session.

When an employee or an applicant does not cooperate with the DOT or
HHS drug and alcohol testing process, the Federal regulations provide us
with guidance on what could result in a “Refusal to Test”, which can have
the same consequences for that person as a positive test. But many parties
are involved in this very complicated area of the regulations. What is the
role of the collector? What is the role of the DER? When does the MRO get
involved? Do the HHS rules differ from the DOT regulations? Attendees will
leave with a clear understanding of what constitutes a refusal to test and
who can make those determinations.
