PUBLIC NOTICE DECLARATION OF BOATING ACTIVITY EXEMPTION Marine Safety Act 2010 (Vic) Section 203(3) I, RACHEL GUALANO, Deputy Director, Operations and delegate of the Director, Transport Safety, make the following declaration under Section 203(3) of the Marine Safety Act 2010 (the Act). For the purposes of the boating activity by Bancoora Surf Life Saving Club, at the waters near Torquay all competing vessels and persons competing in the Fishos Paddle Series are exempt from: Competitor vessels during the event only: 1. 5 knots within 50 metres of another vessel – clause 2(c); 2. 5 knots within 200 meters of the waters’ edge – clause 4(a); 3. Restriction on vessel type in the Special Purpose (Sailing Activities) zone as referred to in Schedule 11.3 (VOZR); 4. Restriction on no vessel zone as referred to in Schedule 11.2 (VOZR). Rescue Vessels when undertaking rescue activities only: 5. 5 knots within 50 metres of a person in the water – clause 2(a); 6. 5 knots within 50 metres of another vessel – clause 2(c); 7. 5 knots within 200 meters of the waters’ edge – clause 4(a); 8. Restriction on vessel type in the Special Purpose (Sailing Activities) zone as referred to in Schedule 11.3 (VOZR). 9. Restriction on no vessel zone as referred to in Schedule 11.2 (VOZR) EXEMPTION CONDITIONS: Competitors are exempt from item 1 – 4 in the above list when competing in the event. Events are the first Friday of the month between November 2017 – March 2018, between 4.00 PM to 8.00 PM, and April 2018 between 4.00 PM to 6.00 PM (see Table 1, below). The masters of rescue vessels are exempt from items 5 – 9 only when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore. Any vessels that are designated for the rescue of persons, must be fitted with propeller guards, in order to minimise the risk of propeller strike injury to people in the water.
