SUBCHAPTER 1

GENERAL PROVISIONS

§19-10-1 Objectives. The objectives of these rules are to:

(1) Make public parks readily accessible to residents and the public at large;

(2) Prevent camping in public parks that are not designated as campground;

(3) Prevent the storage of personal property in public parks which interferes with the rights of others to use the public parks;

(4) Provide equitable opportunities to use campgrounds through a reservation system;

(5) Prevent abuse and misuse of public parks and facilities, especially to prohibit temporary or permanent housing;

(6) Provide overnight camping areas and facilities in suitable locations away from heavily populated metropolitan and urban centers and where feasible, away from crowded residential areas; and

(7) Establish procedures for the issuance of camping permits and regulations governing camping. [Eff APR 1 2 2018 (Auth: RCH §6- 1403; ROH §§1-9.1, 10-1.3)(Imp: ROH §§10-1.2, 10-1.3)

§19-10-2 Application. This chapter shall govern camping in public parks under the jurisdiction, management, and operation of the department of parks and recreation. [Eff APR 1 2 2018 ] (Auth: RCH §6- 1203, ROH §1-9.1) (Imp: ROH §10-1.3)

§19-10-3 Definitions. As used in this chapter, unless the context requires otherwise:

"Adult" means any person eighteen years or older. "Applicant" means any person eighteen years or

older, group, organization or association which requests a permit to camp in a public park.

"Authorized representative" means any person authorized by the director of the department of parks and recreation to act for the department.

"Camp" or "camping" means the use and occupation of a public park as a temporary or permanent dwelling place or sleeping place between the hours of 10:00 p.m. and 5:00 a.m.

"Camper" means any person engaged in camping.

"Campground" or "designated campground" means an area within a public park designated by the director for camping.

"Camping permit" means a document issued by the department authorizing the holder to camp in a designated campground during a designated period.

"Camping week" means the week beginning each Friday at 8 a.m. and ending 8 a.m. on the following Wednesday, unless otherwise specified in these rules and regulations.

"Campsite" means a designated area within the campgrounds assigned by permit for camping.

"Canopy" means a fabric covering supported on poles without walls with a maximum size not to exceed ten (10) feet by ten (10) feet, except at Ho'omaluhia Botanical Garden where a canopy maximum size shall not exceed twenty-five (25) by twenty-five (25)feet.

"City" means city and county of Honolulu. "Department" means the department of parks and

recreation, city and county of Honolulu. "Director" means the director of the department

of parks and recreation. "Dwelling place" means a place used for human

habitation as an overnight accommodation, lodging, or shelter on either a temporary or permanent basis.

"Family camping" means camping by an individual or a group of persons up to ten people.

"Family-sized tent" means a tent with a maximum size of ten feet by ten feet.

"Fire lane" means an unobstructed path between campsites measuring a minimum width of five feet.

"Group camping" means camping by an organized group of 11 to 250 people.

"Ho'omaluhia campsites" means the campsites within Ho'omaluhia botanical garden located at 45-680 Luluku Road Kaneohe, Hawaii 96744.

"HRS" means Hawaii Revised Statutes, as amended. "Human habitation" means the act of utilizing,

occupying, or inhabiting a place of lodging or shelter on a permanent or temporary basis as a place of residence or sojourn.

"Kualoa A" means the campground in the program camp area located in Kualoa regional park.

"Kualoa B" means the campground located in Kualoa point in Kualoa regional park.

"Nonprofit organization" means an association, corporation or other entity, organized and operated exclusively for religious, charitable, scientific, literary, cultural, educational, recreational or other nonprofit purposes, no part of the assets, income or earning of which inures to the benefit of any individual or member thereof, and whose charter or other enabling act contains a provision that, in the event of dissolution, the assets owned by such association, corporation or other entity shall be distributed to another association, corporation or other entity organized and operated exclusively for nonprofit purposes, and which further qualifies for exemption from the general excise tax provisions of HRS chapter 237 or under IRC section 501, of the Internal Revenue Code of 1954, as amended. Such nonprofit organization must not merely be a sponsor of the event, production, attraction or activity being given, but must actively promote, produce, stage or conduct such event, production, attraction or activity.

"Online camping reservation system" means an internet accessible reservation and permitting system for the reservation and permitting of campsites.

"Organized youth group" means an organized group of youth under the age of eighteen sponsored by a nonprofit organization.

"Organized youth group camp" means camping by an organized youth group.

"Parks permit section" means the office in the department responsible for the processing and recording of camping permit applications, camping permits, camping permit approvals, and the administration of the online camping permit reservation system.

"Person" means an individual, partnership, corporation, government, or government subdivision or agency, business trust, estate, association, or any other legal entity.

"Permittee" means a natural person eighteen years or older, group, organization or association to which a camping permit is issued

"Public park" means and includes any park, park roadway, playground, athletic field, beach, beach right-of-way, tennis courts, swimming pool, and other recreational areas and facilities under the control, maintenance and management of the department.

"ROH" means the Revised Ordinances of Honolulu 1990, as amended.

"Service animal" means any guide dog, signal dog, or other animal individually trained to provide assistance to an individual with a disability.

"Sleeping place" means a place used by a person for the purpose of sleeping, where the person is asleep inside a tent, sleeping bag, or some form of temporary shelter or is asleep atop of or covered by materials such a cot, mat, bedroll, bedding, sheet, blanket, pillow, bag, cardboard, or newspapers.

"State" means the State of Hawaii. "Structure" means any shelter built with

construction materials, but not including tents or canopies.

"Tent" means a collapsible shelter or canvas, fabric, or other material attached to or draped over frame of poles or a supporting rope that has more than one wall.

"Wall" means an upright, vertical, or slanted structure, partition, or divider serving to enclose, divide, support, or protect. [ Eff APR 1 2 2018 (Auth: RCH §6-1403; ROH §§10-1.3, 10-1.3) (Imp: ROH §§10-1.2, 10-1.3)

§19-10-4 Penalties. (a) Any person violating any provision of this chapter, or any term or condition of any permit issued hereunder, shall upon conviction, be punished by a fine not exceeding $500 or by imprisonment of not more than thirty days, or by both such fine and imprisonment.

(b) A person shall be ineligible to apply for a camping permit for a minimum of one calendar year following revocation of a camping permit.

§19-10-5 Severability. If any section, subsection, sentence, clause, phrase, or portion of this chapter is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. SUBCHAPTER 2

CAMPING PERMIT AND FEES

§19-10-6 Permit required. (a) Camping is permitted only in a public park designated by the director as a campground.

(b) No person shall camp at a public park not designated as a campground.

(c) No person shall camp at a designated campground without first obtaining a camping permit from the department. [Eff APR 1 2 2018] (Auth: RCH §6- 1403; ROH §§1-9.1, 10-1.3) (Imp: ROH §§10-1.2, 10-1.3)

§19-10-7 Camping fees and no-refund policy. (a) The following fees shall be assessed for use of campsites:

(1) $10.00 per day for campsites holding up to 10 people;

(2) $75.00 per day for campsites holding up to 60 people;

(3) $125.00 per day for campsites holding up to 100 people;

(4) $187.50 per day for campsites holding up to 150 people; or

(5) $312.50 per day for campsites holding up to 250 people.

(b) An additional fee of $2.00 per permit shall be assessed for administrative costs associated with the issuance of the camping permit.

(c) An additional convenience fee not to exceed $5.00 shall be assessed for each electronic transaction.

(d) Camping fees, including fees for administrative costs and electronic transactions, may be amended by city ordinance. Camping fees to be assessed shall be the fee set forth in the camping fee ordinance effective at the time of application.

(e) Permits which are paid in full shall remain valid for the entire duration of the permit period.

(f) Acceptable forms of payment for walk-in customers include cash, money order or cashiers' check payable to the city.

(g) Acceptable forms of payment for online customers shall be designated by the online camping reservation system.

(h) All fees are non-refundable except that the director may, in the director's discretion and if consistent with the purposes of these rules and in the public interest, waive the no-refund rule. §19-10-8 General permit application. (a) Applicants for camping permits must be at least eighteen years old and present at the campground.

(b) Camping permits are issued for tent camping only.

(c) Camping permits shall be issued on a first-come first-served basis.

(d) Camping permits cannot be changed or altered after the permits are issued.

(e) Permittee shall not transfer, assign, or sell any or all rights granted by the permit to a third party or relinquish possession or use of the whole or any parts of the park granted to permittee under the permit.

(f) Camping permits shall be issued for either three-day or five-day periods during the applicable time periods specified in exhibit A attached hereto. Permittee shall use the permitted campsite only during the dates and times specified on the issued camping permit.

(g) All campgrounds are closed from 8:00 a.m. Wednesday through 8:00 a.m. Friday.

(h) There are three types of camping permits: family camping permits, group camping permits, and organized youth group camping permits.

(1) Family camping permits shall be subject to the following: (A) Any person requesting a family camping

permit shall submit a permit application via the online camping reservation system at https://camping.honolulu.gov/ or to the parks permit section at 650 South King Street, Honolulu, HI 96813.

(B) The department may accept applications for family camping permits via the online camping reservation system beginning at 5:00 p.m. (HST) two Fridays prior to the beginning of the requested camping week. Any application submitted prior to this time period will not be processed.

(C) Camping permits may also be obtained from the parks permit section from 7:45 a.m. to 4:00 p.m. on the next business day following the Friday online release of camping permits.

(D) Each permittee shall be limited to no more than one family camping permit per camping week.

(2) Group camping permit shall be subject to the following: (A) Any person requesting a group camping

permit shall submit a permit application to the parks permit section or via the online camping reservation system.

(B) Subject to park availability, the department may accept applications for group camping permits via the online camping reservation system beginning at 5:00 p.m. (HST) twenty-six Fridays prior to the beginning of the requested camping week. Any application submitted prior to this time period shall not be processed.

(C) Subject to campsite availability, camping permits may be obtained from the parks permit section from 7:45 a.m. to 4:00 p.m. on the next business day following the Friday online release of camping permits.

(D) Subject to campsite availability, no more than five permits may be issued for each group campsite per month.

(3) Organized youth group camping permits shall be subject to the following: (A) Organized youth group camping permits

are available for only camping weeks which do not include three-day weekends.

(B) An applicant requesting an organized youth group camping permit shall submit a completed Youth Group Camping Application and a copy of the by-laws of the sponsor organization to the parks permit section.

(C) The department may accept applications for organized youth group camping permits beginning ninety (90) days prior to the requested camping week. Any application submitted prior to this time period or within thirty (30) days prior to the requested camping week shall not be processed.

(D) No more than fifty percent (500) of the available campsites at any designated campground may be made available for organized youth group camping.

(E) A youth group must be accompanied by a minimum of two adults who have been designated by the organized youth group to provide supervision, guidance, and instruction to the youth group.

(F) An assigned adult shall be present during the entire camping period and shall serve as the contact person for the department.

(G) Where the majority of campers are 13 years or older, the number of adults accompanying the campers shall not exceed fifty percent (50%) of the camping group. Where the majority of campers are under the age of 13 years, the number of adults accompanying the campers shall not exceed a ratio of 2:1 of adults to campers.

(H) The sponsoring organization shall be responsible for all acts of the camping group and shall be liable for acts of vandalism and damages to persons and property. [Eff AM I 2 20-18 (Auth: RCH § 6-1403; ROH §§1-9.1, 10-1.3) (Imp. ROH §§ 10-1.2, 10-1.3)

§19-10-9 Special camping permit procedures. (a) Group camping is permitted only at the Ho'omaluhia botanical garden, Kokololio beach park, Kualoa regional park, Ma'ili beach park and any such park as designated by the Director.

(b) Ho'omaluhia botanical garden. (1) Camping is available in Kahua Kuou and Kahua

Lehua for family camping and Kahua Nui for family and group camping.

(2) All vehicles must park in the designated parking stalls.

(3) Driving on the grass or into a camping site is prohibited.

(4) Each vehicle parked in a designated parking stall shall display a valid printed parking permit in clear view on the windshield on

the dashboard of the vehicle. Failure to display the required parking permit shall be grounds for a parking citation and cited vehicles will be subject to tow.

(5) All vehicles with parking permits must comply with the Ho'omaluhia botanical garden published gate schedule.

(6) Ho'omaluhia botanical garden main gate for camping access is open from 9:00 a.m. to 4:00 p.m. On Friday, Saturday and Sunday, vehicles with permits or passes may enter and exit from 5:30 p.m. to 6:30 p.m. or exit only from 9:00 p.m. to 9:15 p.m.

(c) Bellows beach park. (1) Camping at Bellows beach park shall be

allowed only when the beach area is not required for military use.

(2) Each permittee may request up to three parking permits to park up to three vehicles.

(3) Each vehicle parked in the camp area shall display a valid printed parking permit in clear view of the windshield on the dashboard of the vehicle. Failure to display the required parking permit shall be considered grounds for a parking citation and cited vehicles will be subject to tow.

(4) Bellows beach park main gate shall be closed to public access from 8:00 p.m. through 6:00 a.m. Vehicles are allowed to exit Bellows beach park after 8:00 p.m. Vehicles are not allowed entry into Bellows beach park after 8:00 p.m. [Eff APR 1 2 2018 ] (Auth: RCH §6-1403; ROH §§1-9.1, 10-1.3)(Imp: ROH §§10-1.2, 10-1.3)

§19-10-10 List of campgrounds and campsites. (a) The list of campgrounds, availability of campgrounds, and number of campsites are contained in attached exhibit A.

(b) The director may at his or her discretion amend the list of campgrounds, availability of

campgrounds, and number of campsites which shall be posted on the city's website at https://camping.honolulu.gov/, as amended. [Eff APR 1 2 2018 ](Auth: RCH §6-1403; ROH §§1-9.1, 10-1.3) (Imp: ROH §§10-1.2, 10-1.3)

S19-10-11 Permit conditions. (a) A valid printed permit shall be in the possession of the permittee at all times and permittee shall, upon request, show the permit to any law enforcement officer or park employee.

(b) Permittee shall be present during the entire camping period and shall serve as the contact person for the department.

(c) Campgrounds shall be used for tent camping purposes only. Permanent use or use of the campground as a principal residence is prohibited.

(d) Camping permits are issued for tent camping only. Camping in trailers, trucks, vans, automobiles, or other vehicles is strictly prohibited.

(e) Permittee shall camp during the permitted camping period only in the campsite designated on the camping permit.

(f) Family campsites are approximately 900 square feet. No more than three family-sized tents measuring 10 ft. x 10 ft. or one 25 ft. x 25 ft. canopy are permitted within a family campsite. The total area occupied by the tents and/or canopies in a family campsite shall not exceed a maximum of 650 square feet or four-fifths of the total campsite area. All tents must fit under a 25 ft. x 25 ft. canopy if used.

(g) Campsites shall not be combined. Tents and canopies shall not be erected across adjacent campsites.

(h) Individual campsites shall be separated by a fire lane measuring a minimum width of five feet. Access within the fire lanes may not be blocked by any structure, vehicle, person or object.

(i) Permittee may request up to a maximum of three parking permits per campsite, except for campsites at Lualualei beach park and Kalanianaole

beach park (Nanakuli) where only one parking permit per campsite is permitted. No parking permit will be issued for camping at Hau'ula beach park. Each vehicle parked in the camp area shall display a valid printed parking permit in clear view of the windshield on the dashboard of the vehicle. Failure to display the required parking permit shall be considered grounds for a parking citation and cited vehicles will be subject to tow. The possession of a parking permit does not release the vehicle owner and/or permittee from paying any appropriate parking fee and/or fine if applicable.

(j) The parking stall directly adjacent to a campsite at Lualualei beach park and Kalanianaole beach park (Nanakuli) shall be for the expressed use of the permittee awarded the camping permit for that campsite for the camping week.

(k) Reserving parking stalls in marked parking lots is prohibited.

(1) Parking or driving on the grass is prohibited.

(m) Permittee may use only tents and canopies for camping. All other structures and shelters are prohibited. Use of unauthorized structures constitutes a permit violation.

(n) Digging or grading of the ground at any campsite is prohibited.

(o) Water and electricity at the campgrounds are provided only for comfort station and official city purposes. Campers are not allowed to hook up to any city utility at the campsite. Washing of vehicles or boats is prohibited.

(p) Camping equipment left unattended beyond the term of the existing camping permit shall be subject to removal.

(q) Kindling, building or maintenance of campfires is prohibited, except in fire pits provided by the department. Charcoal fueled fires are allowed in grills and braziers, which shall be 12" above the ground, for cooking purposes only. Grills and braziers are not allowed on picnic tables. Ash and charcoal shall not be deposited near trees, shrubs or

vines, but shall be left or deposited in designated receptacles.

(r) Special care shall be taken in order that trees, shrubs and vines are not damaged or destroyed. Nails, screws or spikes shall not be driven into trees, plants, or structures.

(s) Tents, canopies, camping structures, or camping equipment shall not be attached in any manner to any park building, structure, or vegetation, including trees.

(t) Tent stakes longer than 10 inches are prohibited in all campgrounds.

(u) Camping areas shall be kept clear of litter and trash at all times, and refuse shall be placed in trash receptacles.

(v) Except for service animals, all animals, including pets, are prohibited in all campsites.

(w) The use of fireworks is prohibited at any campground.

(x) The use of a generators is prohibited in all campgrounds.

(y) Items not commonly used for camping, such as pool tables, furniture, appliances, inflatable bouncers, water features, carpets, wading pools, shower tents, etc., are prohibited in campgrounds.

(z) Washing of dishes or equipment in shower rooms or open showers is prohibited.

(aa) Quiet hours are from 10:00 p.m. to 6:00 a.m. During quiet hours, use or operation of noise-producing devices, including radios, televisions, musical instruments, vehicles, or public address systems in a manner disturbing to other campers is prohibited. Campers should refrain from any loud activities or noises during quiet hours.

(bb) Smoking, consumption of alcoholic beverages, alcoholic beverages or displaying of alcoholic beverages are prohibited at the campsites and in the park.

(cc) By the expiration of the camping permit period, permittee shall have dismantled and removed all tents, canopies and camping equipment from the campground. The department reserves the right to remove any personal property or vehicles left in the

park beyond the permit period or remove equipment and vehicles left in the park by persons without camping permits. Permittee and persons without camping permits shall be liable for all costs incurred by the department for the removal of the personal property and vehicles. All personal items left in the park shall be inventoried and removed to an appropriate location within the park district that the park is located. The items will be stored and disposed on in accordance with ROH Section 29-19.1 et. seq., as amended. All vehicles illegally left in the park shall be cited and towed in accordance with HRS Section 290-11, as amended.

(dd) When a permittee vacates a camping area, the permittee shall restore the campsite to its original condition.

(ee) No person shall engage in commercial activities of any kind while camping at a designated campground.

(ff) The issuance of a camping permit shall not constitute a vested property interest, but is a privilege granted for the use of the campsite for camping during the permitted period.

(gg) Permittee shall comply with all applicable laws, rules, and regulations of the federal, state and county governments.

(hh) The camping permit may contain such conditions as are reasonably consistent with the protection and use of the park for the purpose for which the park is managed.

(ii) Except as authorized by permit, no person shall use any sound-amplifying equipment while camping. Amplified sound is prohibited.

(jj) Parking within campsites is prohibited. (kk) A camping permit does not authorize the

permittee to use the campsite for private parties, including baby luaus, graduation parties, memorial or celebration of life services, wedding or reception parties. [Eff APR 1 2 2018 ] (Auth: RCH §6-1403; ROH §§1-9.1, 10-1.3) (Imp. ROH §§10-1.2, 10-1.3)

§19-10-12 Denial of a permit application. (a) An application for a camping permit may be denied by the director or an authorized representative when:

(1) The requested campground is closed or will be closed because of damage, or because of scheduled or ongoing construction, repair, or maintenance activities.

(2) A state of emergency is declared by the director or other proper authorities.

(3) Natural or civil disturbances, including, but not limited to, tsunamis, floods, earthquakes, storms, riots, demonstrations, or employee strikes, which may be occurring or threatening to occur.

(4) The park or requested campground is inadequate to meet the needs of the anticipated activity.

(5) The requested campground is booked to capacity.

(6) A prior application for a permit for the same time and place has been made that has been granted or will be granted.

(7) It reasonably appears that based upon the information provided that the anticipated activity presents a clear and present danger to the health, safety, or welfare of persons within the premises.

(8) The permit application was not received by the department within the time specified by these rules.

(9) The failure of the applicant to abide by these rules and/or the terms and conditions of any previously issued permit.

(10) The applicant has violated or has previously violated permit conditions or provisions of this chapter within a year of a permit application.

(11) Issuance of a permit will result in a violation of city, state, or federal rules, regulations, statutes, or ordinances.

(b) If a permit application is denied, the applicant shall be informed in writing, with the reasons for the denial set forth, except written

S19-10-13 Revocation of a permit. (a) A permit may be revoked under any of the conditions listed in §19-10-12 that constitute grounds for denial of a permit application.

(b) If a permit is revoked the permittee shall be informed in writing, with the reasons for the revocation clearly set forth, except under emergency circumstances, when an immediate verbal revocation or suspension of the permit may be made, to be followed by written confirmation by the department within seventy-two hours after revocation. The department shall send the notification of revocation to the permittee's email address of record or the permittee's last known mailing address.

(c) Any permittee aggrieved by a revocation of a permit may request reconsideration of the revocation by filing a written petition for reconsideration with the department within thirty (30) days from the date the notice of revocation is emailed or mailed to the permittee's last known mailing address.

(d) A petition for reconsideration shall be in writing and submitted to the parks permit section at 650 South King Street, Honolulu, HI 96813.

(e) The petition for reconsideration shall contain:

(1) The petitioner's name, address and telephone number.

(2) Identification of the permit which the petitioner requests the director reconsider.

(3) A statement of the petitioner's reasons for requesting reconsideration of the permit revocation.

(4) A statement identifying any new evidence which may be the basis for requesting reconsideration of the original revocation decision.

(f) The director shall acknowledge receipt of the petition in writing.

(g) The director may reject a petition for reconsideration which was not timely filed.

(h) Within forty five (45) days of receipt of the petition, the director shall act to affirm or reverse the previous decision. [Eff APR 1 2 2018 (Auth: RCH §6-1403; ROH §§1-9.1, 10 1.3) (Imp: ROH §§10-1.2, 10-1.3)

§19-10-14 Indemnification and assumption of risk. (a) In accepting a camping permit, the permittee assumes all risks of personal injury or wrongful death and of loss or damage to property by whomsoever owned, arising out of or in connection with permittee's use of the park facilities under such permit; and agrees to indemnify, hold harmless and defend the city against any claim, cause of action, liability, loss, damage, cost or expense for bodily injury, wrongful death, or property damage, arising or resulting from permittee, its agents, employees, contractors or invitees use of the park facilities under such permit, as well as any breach of regulations or ordinances, except where such injury, death or property damage is cause by the willful act or gross negligence of the city.

(b) The city shall not be responsible for any personal injury or loss or damage to any personal property sustained by the permittee or permittee's invitees caused by the permittee, its agents, emploirws, contractors, invitees, or third-parties. §19-10-15 Closing of areas. (a) The director or an authorized representative may close campgrounds and restrict public use of all or any portion thereof, for the protection, restoration, and preservation of areas and facilities, or the health, safety, and welfare of person or property.

The repeal of the Department of Parks and Recreation Amended Camping Policy, Rules and Regulations Governing Camping at City Parks and the adoption of Title 19, Chapter 10, City and County of Honolulu Administrative Rules, entitled "Camping", that was adopted on March 7, 2018, following a public hearing held on November 28, 2017 and on January 14, 2015, after public notice was given on October 25, 2017 and on December 8, 2014, in the Honolulu Star Advertiser.

This chapter shall take effect ten (10) days after filing with the Office of the City Clerk.
