    Preamble This RFQ has been developed based on Bharat Petroleum Corporation Limited’s (BPCL) business and technology requirements. It remains the sole property of BPCL and as such its contents may not be disclosed by your Organization to any third party, nor may any original concepts devised by BPCL be used commercially. If BPCL decides not to proceed with the project, selects an alternative Solution Provider, or decides to conduct the project itself, BPCL requests return of this RFQ together with assurances that no copies of this RFQ have been made. Should a breach of confidentiality occur at any time before or after the RFQ proposal deadline, BPCL retains the right to disqualify the proposal and choose not to invite the defaulting organization to any future proposal exercises.

    Notice Inviting tender Dear Sir / Madam,

    Subject: Open tender - Inviting bids for Design, Development, Implementation, hosting & maintenance of Bharat Petroleum Corporation Limited Mobile

    Applications For B2C and B2E Channels

    (CRFQ no. 1000224568, 12th Feb 2015 at 2:00 pm)

    You are invited to submit your offer in a two-part bid (Technical bid and Commercial bid)

    for the following :-

    a. Design, Development, Implementation, hosting & maintenance of Bharat Petroleum Corporation Limited Mobile applications targeted at customers (B2C) and employees of BPCL (B2E)

    b. Hosting of the above applications on the cloud and hosting of application data base in BPCL server

    c. Default warranty of 1 year and 1 year AMC thereafter which could be extended for additional 1 year

    d. Future changes in the application - customizations charges per man day basis.

    1. EMD of Rs. 1,00,000/- (One Lakh) is required to be submitted in physical form (by the

    way of crossed A/c Payee demand draft drawn on any national or scheduled bank in favour of “Bharat Petroleum Corporation Limited” and payable at Mumbai at our office in sealed cover. Please note that non submission of EMD will result in disqualifying the tender.

    2. Vendors, who are enlisted / registered with Bharat Petroleum, also need to submit EMD.

    3. Vendors who successfully qualify in Pre-Qualification Criteria (PQC) would be invited to make a technical presentation to a selection committee, based on a given brief as part of the technical bid. Vendors will be judged based on the given brief and will have to score minimum qualification marks to clear the technical evaluation round.

    4. Vendors who are currently on BPCL’s holiday / Black list will not be considered.

    5. As our company’s guidelines do not permit post-tender negotiations except with the tenderer offering the best financial terms, you are requested to submit your best terms at this stage itself.

    6. Pre – Bid meeting is scheduled on 25th Feb 2015; 10:30 Hrs at the below given venue:- Bharat Petroleum Corporation Limited ERPCC – Building, ‘K’ Installation, Sewree Fort Road, Sewree (East), Mumbai – 400015.

    7. Your bid should be submitted on or before the due date of this tender viz. 5th March

    2015 at 2:00 pm.

    8. Bids submitted after the due date & time of closing of tender or those not in the prescribed format are liable for rejection. BPCL does not take any responsibility for any delay in submission of bid due to any reason. No claims on this account shall be entertained.

    9. It shall be understood that every endeavour has been made to avoid errors which can

    materially affect the basis of the tender and the successful vendor shall take upon himself and provide for risk of any error which may subsequently be discovered and shall make no subsequent claim on account thereof.

    General Instructions to vendors for e-tendering

    1. Tender document with detailed terms and conditions is available on our corporate website (http://www.bharatpetroleum.in), CPP portal (http://eprocure.gov.in) and on our e-tendering website https://bpcl.eproc.in. Interested parties may download the same and participate in the tender as per the instructions given therein, on or before the due date of the tender. The tender available on the BPCL website or on the CPP portal can be downloaded for reading purpose only. The tender shall have to be submitted online through the e-procurement system on https://bpcl.eproc.in.

    2. As a pre-requisite for participation in the tender, vendors are required to obtain a valid Digital Certificate of Class IIB and above as per Indian IT Act from the licensed Certifying Authorities operating under the Root Certifying Authority of India (RCIA), Controller of Certifying Authorities (CCA). The cost of obtaining the digital certificate shall be borne by the vendor. In case any vendor so desires, he may contact our e-procurement service provider M/s C1 India Pvt. Ltd., Mumbai (Contact no. +91-22-32444300 / 65281885 / 65281886) for obtaining the digital signature certificate.

    3. Corrigendum / amendment, if any, shall be notified on the site https://bpcl.eproc.in. In case any corrigendum / amendment is issued after the submission of the bid, then such vendors who have submitted their bids, shall be intimated about the corrigendum / amendment by a system-generated email. It shall be assumed that the information contained therein has been taken into account by the vendor. They have the choice of making changes in their bid before the due date and time.

    4. Vendors are required to complete the following process online on or before the due date of closing of the tender:

    attested by the authorized signatory, before uploading them online.

    B. Price bid

    Online fill in the quotes in the price bid form provided. Please ensure to quote all the price-components specified therein failing which your bid is liable to be rejected.

    5. Price bid of only those vendors shall be opened whose Techno-Commercial bid is found

    to be acceptable to us. The schedule for opening the price bid shall be advised separately.

    6. Directions for submitting online offers, electronically, against e-procurement tenders

    directly through internet:

    (i) Vendors are advised to log on to the website (https://bpcl.eproc.in) and arrange to register themselves at the earliest

    (ii) The system time (IST) that will be displayed on e-Procurement web page shall be the time considered for determining the expiry of due date and time of the tender and no other time shall be taken into cognizance

    (iii) Vendors are advised in their own interest to ensure that their bids are submitted in e-Procurement system well before the closing date and time of bid. If the vendor intends to change / revise the bid already entered, he may do so any number of times till the due date and time of submission deadline. However, no bid can be modified after the deadline for submission of bids

    (iv) Once the entire process of submission of online bid is complete, the vendors are required to go to option ‘own bid view’ through dashboard and take the print of the envelope receipt as a proof of submitted bid

    (v) Bids / Offers shall not be permitted in e-procurement system after the due date / time of tender. Hence, no bid can be submitted after the due date and time of submission has elapsed

    (vi) No manual bids / offers along with electronic bids / offers shall be permitted.

    7. Once the price bids are opened, vendors can see the rates quoted by all the participating bidders by logging on to the portal under their user ID and password and clicking on “Other Bids” view.

    8. No responsibility will be taken by BPCL and / or the e-procurement service provider for any delay due to connectivity and availability of website. They shall not have any liability to vendors for any interruption or delay in access to the site irrespective of the cause. It is advisable that vendors who are not well conversant with e-tendering procedures, start filling up the tenders much before the due date / time so that there is sufficient time available with him / her to acquaint with all the steps and seek help if they so require. Even for those who are conversant with this type of e-tendering, it is suggested to complete all the activities ahead of time. It should be noted that the individual bid becomes viewable only after the opening of the bid on / after the due date and time. Please be reassured that your bid will be viewable only to you and nobody else till the due date / time of the tender opening. The non availability of viewing before due date and time is true for e-tendering service provider as well as BPCL officials.

    9. BPCL and / or the e-procurement service provider shall not be responsible for any direct or indirect loss or damages and or consequential damages, arising out of the bidding process including but not limited to systems problems, inability to use the system, loss of electronic information etc.

    Objectives The oil and gas market is headed towards de-regulation and a fierce war amongst the Oil Marketing companies, both public and private is soon to ensue. Most businesses today are using mobile applications to reach out to their customers, to ease internal processes and also, to simplify business dealings. The shift in computing to mobile devices, and the ongoing trends of mobility and 'bring your own device', mean that BPCL too needs to take a Multi-channel approach to applications across Business-to-Customer [B2C] and Business-to-Employee [B2E] channels. Through this tender, BPCL proposes to join the league of businesses that are currently reaching out to people worldwide through the medium of mobile applications.     Functional Requirements This Section outlines the Functional Requirements for the mobile applications to be designed and developed where the responsibility of the agency includes but is not limited to the following activities:

    1. Design, develop, Implement and maintain 2 separate applications, 1 each for B2C (Customer Centric) and B2E (For Fleet Sales Team) channels of BPCL respectively

    2. Design and develop the applications in HTML 5 based code usable on Android (Smartphone

    and Tablet) (version 2.2 and above), iOS (iPhone and iPad) (iOS 4 and above), Windows (SmartPhone and Tablets) platforms. App should be developed on latest versions of all platforms and same to be maintained for latest versions of client OS platforms till the validity of contract

    3. Content sanitization, formatting, uploading and management

    4. Auto upgradation / updation of app on latest version of all 3 platforms namely Android,

    Windows, iOS, for a period of 2 years plus 1 year extendable. Also, the app should be compatible with all versions of browsers

    5. Maintenance of all features and incorporation of additional features in the applications on

    all 3 platforms iOS, Android and Windows, for a period of 2 years plus 1 year extendable

    6. Suggest quicker and efficient ways to implement a proposition/ feature demanded by BPCL, in any of the applications

    7. Generation and Integration of application middleware (hosted on cloud) with BPCL

    database & servers, SAP and BI for seamless flow of data from backend servers to application

    8. Implement and Install the middleware and applications in BPCL environment (Test as well

    as Production set-up)

    9. Christening of the applications with suitable and appealing names

    10. Bring all testing devices (including phones and tablets) for demonstration and testing environment.

    Creative Strategy These applications will cater to a wide variety of audiences. The applications would also be linked to Social sites / digital platforms like Facebook, Linked-In, Slide share, YouTube, Twitter, Pinterest, Instagram and other portals the company is linked to (or proposed in future). BPCL thus envisages mobile applications, which depict BPCL as a professional and responsible organization. BPCL’s core values of being Innovative, Caring and Reliable have to be reflected through the applications. While the applications are expected to be visually appealing, responsive design and produced to international quality standards, they should be light enough to download swiftly even with 2G speed of internet connection. As far as possible the home screen and all other daughter screens, should have a logical flow and user friendly navigations. The creative strategy should be able to spell out a theme around which the applications should be designed. BPCL desires that the vendors propose at least 3 different themes with alternate design options, for BPCL to decide on a final theme for each of the applications.

    User Interface Requirements

    1. All icons must be crisp, clean, and distinguishable and should be as per guidelines of mobile application

    2. All buttons and objects must be reactive to touch and work as intended

    3. All functions must stay within the mobile screen resolution

    4. All data must be easily viewable on different Mobile platform matrix.

    Technology and Server Requirements

    1. Mobile App development should be in English language and provision for Hindi may be looked into.

    2. Vendor has to ensure the development of mobile application as per guidelines issued by Application stores e.g. Google play store, iTunes, Ovi Store. Vendor has to submit mobile app binary to iTunes app store, Ovi store and Google Play store.

    Testing

    1. Vendor is expected to perform comprehensive BPCL mobile applications testing as part of the project scope

    2. The test plans, test cases and results for each of the phases will be shared by vendor with BPCL

    3. Vendor has to facilitate User Acceptance Testing (UAT) environment for BPCL

    4. A Security Audit of Complete Application has to be done by the Vendor.

    Content Coverage Since the applications will address a variety of audience, the content coverage will target their needs. Further, the content shall be organized in a way that makes it easy for the user to determine what information is available, where it is available and how to reach it. Common content that has to flow across social media sites would be defined by BPCL. A logical architecture would have to be maintained throughout the applications in order to reach the daughter screens through tabs on the Main screen. The content can be aggregated by the vendor from the existing applications, databases, recreated and finally edited by BPCL staff to ensure that appropriate content is available on the applications. The current BPCL Loyalty backend servers have a production environment running on Oracle 11g and application environment on Oracle 10g. The Operating System is Solaris 10. We have separate SAP and BI environment with independent servers.

    B2C Application BPCL has a loyal customer base of around 2.2 million members and garners 13% of its fuel sale from loyalty customers. Recognizing the needs of our customers to make their life more convenient and rewarding, BPCL has decided to launch a mobile application for them that will help them to maintain a continuous relationship with the company.

    Existing Application: BPCL currently has a mobile application for its fuelling customers which is named as BPCL Fuel Finder. This Android based application has a user base of around 1000 people. The size of the app is around 700 kb. It is hosted on BPCL application server that runs on Oracle 10g. Basic features of the application include:

    1. Instant Current location and list of nearby BPCL outlets 2. Value-added services and loyalty card acceptance availability information 3. Distance in KMs of outlet from user location 4. Driving directions and traffic information of selected outlet from user location 5. Near-by hospitals and police stations around selected outlet 6. Diverse search options for routes, outlets.

    BPCL wishes to develop a new application which will have the above features apart from many other new features.

    New Proposed Consumer Application The proposed new Consumer application is expected to have the following features (not limited to):

    1. User Creation and Password: BPCL intends to create a user base for this app and the user data should be stored in the backend servers along with the account and user login details. However users can still access the application without creating the username and password, whenever there is exchange of data (like uploading document or entering personal information), application should prompt for registration. Preferably, the password verification should be done by generation of OTP which will be sent to the users’ mobile number which is used by them to register them with the app. Thereafter, once the user puts the OTP in login credentials, user will be re-directed to change the password for personal usage. Password should be stored in encrypted form throughout network and storage.

    2. User Profile Creation After the username and password has been created, user will be directed to a profile creation page where-in one can input their personal details, important dates, age group, profession etc. Creation of user profile is optional. However, user will have to create profile in order to upload documents in the app. Also option for taking concurrence of user for sending BPCL products & services related SMSs to them. This information should be stored in our backend servers also for future reference.

    3. Vehicle Profile Creation After the user has input his personal details, the app should direct the user to creating vehicle profile for one or more vehicles that he owns, giving their maintenance details, servicing due dates, insurance due dates, PUC, Oil change etc. Vehicle number should be stored in upper case without any special characters. Also provision for storing scan copies of the documents along with the document number and expiry date should be available in the app.

    These details should be stored by the app in the device itself and alert prompts to be generated by app when the due date of any document is nearing. The frequency and number of alerts may be decided between the vendor and BPCL during further meetings with the qualified vendor. In case BPCL ties up with some companies e.g. insurance companies etc., the advertisements for the companies need to be displayed in the alert page itself. Provision should be available for advertisements.

    4. Loyalty Card Gateway

    Integration of our petro-card loyalty gateway with mobile application. The petro-card portal should open with petro-card Customer ID / Password. Details of Transaction, Points statement, special offers, last fuelling value, Name of outlet fuelled at etc. should be displayed in separate tabs. Redemption of petro miles facility should also be included in this feature. We already have a petro-card portal on web www.petrobonus.com. Inputs can be taken from the website for detailed expectation of the features. Provision for features like tracking of redemption gift through courier portal, online enrolment for PetroCard to be added in mobile app.

The feature currently uses GPS, Google maps and our database to plot the petrol pumps on the map. The following additions have to be done in the feature.

    introduced, data for the same has to be updated in the application by the vendor in

    consultation with BPCL.

    9. Tire Pressure Chart

    A chart depicting the tire pressure has to be maintained for each make of vehicle to be

    uploaded in the application.

    Vendor has to obtain this information from external and authentic source. Same will be

    cross checked by BPCL before vendor uploads in application.

    Facility to store favourite petrol pumps and get Automatic updates on their offers and price

    11. Offers Zone

    The current offers running in BPCL will be uploaded in this page. As and when new offers

    are run, the same will be intimated to the vendor and vendor has to push the same into this

    page. Based on expiry date of offer, it should get auto hidden from customers. More options

    have to be explored to display geographically relevant offers to customers.

    There will be admin rights for this where a BPCL admin will monitor and add / delete /

    modify relevant offer.

    12. Plan Your Trip

    Following features need to be incorporated in the app where a traveller can input his

    destination and nearest tourist spots, restaurants on the way, pump facilities, navigation,

    medical help, approx cost of the journey, tire puncture / vehicle repair etc. should appear on

    his screen.

    App should store all the mileages and internally calculate the average mileage that the car is giving. Next time, when the user inputs the initial KM and the amount of fuel re-filled, the app should calculate how many KMs the car can run and suggest BPCL outlets on the way that the user should stop for re-fill.

    Message like: Your car will run another 10 kms, there is a BPCL outlet in 5 KM, would you

    like to refill?

    15. Toll Free Number BPCL call centre number should be displayed on all screens as a marquee.

    16. Feedback Portal A feedback page should be included in the app where customer can choose the BPCL petrol pump from the drop down list and provide suitable feedback (good or bad) about the pump. The list of pumps for the drop down list will be provided to vendor by BPCL. Similarly, vendor will be provided drop downs about feedback, facilities. So that customer can choose an item from the drop down to give feedback. The feedback should be directed by mail / SMS to respective BPCL territory managers. Territory Manager details will be provided by BPCL. This page will be linked with existing BPCL online feedback management portal.

    17. Shares on Social Media and Work Offline

    App should be sharable on Facebook, Whatsapp, LinkedIn and other social media. App features like RO details, mileage calculator, tire pressure chart, search option; Lube Store should work offline in case Internet connectivity is unavailable. If app is recommended to a friend (mobile number of recommender will be tracked), gift coupon code should be sent to the recommender through SMS which can be redeemed in promotional schemes. (This is only for initial popularity of app and may be discontinued later).

    18. Prompt Next Outlet On identifying the user location, the app should prompt to the user, the next BPCL outlet, its distance, approximate time to reach and the facilities in it.

    19. Offer Push Facility Using GPS tracking, relevant offers of BPCL partners / retail chains around the area of the person should be pushed into the device. BPCL will partner with other retailers and as the app senses the location of the user, it should search for nearby retail partner outlets and display the relevant offers running in those outlets.

    A relevant SMS may be sent to the user if he opts for receiving SMS alerts regarding offers running in other retailers.

    20. Pricing Changes and Schedule With diesel and petrol prices getting de-regulated, competition in the market is increasing. It becomes imperative that the users be aware of BPCL’s competitive prices before choosing their fuel. Price lists will be picked from SAP and pushed into the app for display to the users. Vendor has to develop middleware and access SAP data for displaying in the app.

    21. My Smartfleet

    BPCL already has an Android application called My Smartfleet, which has features like

    transactions view, fleet list, set adhoc limit etc. Smart Fleet app maybe integrated with this

    application and Vehicle Tracking System (VTS) facility for real time tracking of the fleet

    vehicles maybe incorporated in the app. Online enrolment form for SmartFleet card should

    be available.

    22. Bharatgas Application

    BPCL has an Android application called Bharatgas, which has features like Book Cylinder,

    Know Your Distributor, Rate Your Distributor, Bharatgas Services etc. This is used by LPG

    consumers for various purposes. This Bharatgas app needs to be integrated with the new

    application.

    23. Notifications / Advertisements

    All registered users will get notification on the following: -

    a. Offers running on Petrol pumps to relevant customers

    b. BPCL Loyalty point balance

    c. Tender notification ( in synchronization with BPCL e-proc portal)

    The notification will include text message / graphic / video from BPCL to the customer. The

    database will include the status of notifications delivered and not delivered (with reason, if

    possible) to individual users along with IST & date. The database will also capture IST &

    date when the notification is read by the individual user. The bidder must specify the file

    format in which text message/ graphic / video can be sent through push notification.

    24. The customer application should have a “Help File” for easy usage of the “app”.

    B2E: Application

    After the launch of its popular program ‘Petro Bonus’, BPCL observed that there was a very specific need of a dedicated program for Fleet Owners. Today, a ‘SmartFleet’ member (targeted to be a fleet owner) has the convenience of managing their fleet operations, with comfort of security. Facilitating the members with ‘Cashless Transactions’ the other facilities in the program are:

    1. Cash Management System

    2. MIS reports

    3. Rewards for the members

    4. Customer segmentation

    5. Credit Option. The SmartFleet team consists of Fleet sales Officers, Regional Fleet sales Managers and the HQ team (50 Users). The Smart Fleet program is driven in the field by Fleet Sales Officers (FSO) who has the following broad responsibilities: Enrolment: Enrolling New Customers

    Queries: Addressing any customer queries regarding balance amount, reward points etc.

    Information: Informing customers about the SmartFleet Network, ongoing programs etc.

    Currently all the responsibilities are being delivered through an offline method. I.e. the FSO enrols the customer through a physical form. The form is then sent to a central office where the data is uploaded in digital form to the database. The whole process takes more than 2 weeks for completion.

    BPCL’s management wants to create a mobile application which can assist FSOs carry most of their responsibilities through a mobile device.

    It is the vendor’s responsibility to launch the app on ALL the 3 play stores namely Google play, Apple store and Ovi store. Vendor should see to it that the app gets maximum visibility on these play stores and follows all the applicable guidelines to get published on these play stores.

    Traffic Analysis Vendor should use effective analysis tools to give the app download statistics on all 4 platforms. Vendor should analyze the download trends and present the data to BPCL as and when asked for.

    Warranty and AMC Support The successful vendor shall provide warranty for a period of 1 year and thereafter AMC support for a period 1 year, extendable for another 1 year based on the confirmation from BPCL

    Warranty of the solution shall include cover free version upgrades depending on the mobile OS version compatibility, bug fixing, database correction All materials, resource etc required for maintenance of the solution during the Warranty shall be done at the Vendor’s cost and no expenses will be borne by BPCL.

    AMC of the solution shall include cover free version upgrades depending on the mobile OS version compatibility, bug fixing, database correction All materials, resource etc required for such maintenance of the solution during the AMC period shall be done at the Vendor’s cost and no expenses will be borne by BPCL except the fixed AMC charges. Breach of the above conditions under warranty and AMC, BPCL will arrange to get the work done by an alternate party and charge the cost to the vendor by invoking the Performance Bank Guarantee.

    Post completion maintenance The following activities will fall within the scope of work of this RFQ and vendor to build in this component in the Technical / Price Bids:

    1) The vendor will be responsible to provide technical assistance to BPCL for a period of 2 (one) Year from acceptance of the tender

    2) Vendor to analyze download trends periodically and suggest ways to improve downloads of application

    3) Vendor to update the data on the application regarding various content as and when provided by BPCL

    4) Vendor to provision optimum capacity of app server on cloud, in order to handle estimated users of more than one lakhs for both the applications.

    5) Vendor should provide the cumulative number of downloads of the app every month 6) There may be other relevant contents as identified jointly by BPCL and the vendor during

    7) Vendor must ensure up to date info with respect to current trends in fuel retailing in India or abroad by changing or promoting corresponding content (text, photos or other) or display theme at periodic intervals

    9) BPCL will assist the vendor in obtaining all internal content. However, sourcing of external content & requisite pictures or images to go with the description will be the sole responsibility of the vendor and within the scope of this RFQ. Care should be taken to build this price component while quoting. Images and Information required will be “India-centric”.

    Training Content Management and Traffic Analysis on Google analytic or any other Analytical tool would be required. Training has to be provided by Solution Provider for the Retail Technology team to enhance its Digital Fitness, soon after the development of the mobile applications. Training will be 2 to 3-days. Solution Provider to provide one set of training material to BPCL. There will be no separate charge for this activity.

    Deliverables and Scope of work The successful vendor is expected to Design, Development, Implementation, hosting & maintenance of Bharat Petroleum Corporation Limited Mobile Applications for B2C and B2E Channels. The detailed requirements are mentioned above. The project is to be completed to the full satisfaction of BPCL by time lines specified by BPCL. The initial frame work (Phase -1) by 1st week April 2015 and complete applications within 45 days of award / acceptance of the LOI. Delivery of all the 2 applications will be in phases, contents of which will be identified by BPCL during the Project Planning stage.

    Project initiating and planning

    1) Vendor to designate Project Manager. 2) Identify Project activities for phases, duration of each phase, milestones, responsibilities

    and roles with BPCL’s approval. 3) Create Basic structure and site maps of multiple alternate prototypes for approval by BPCL.

    (To be ready for initial activation by 1st week April 2015) 4) Finalize application structure & Road Map with BPCL’s approval.

    Application Content

    1) Liaison with BPCL Business / Entity representatives along with BPCL Retail Technology team / nominated BPCL personnel for obtaining internal content.

    Documentation Documentation related to the above, including user and systems manual for application development and training modules. Vendor to provide 2 sets of CD’s / DVD’s with all source file related to the applications, structure & for all new features or modules developed subsequently during the contract.

    Configuration Configuration details of the applications have to be submitted to BPCL

    Application Software All Applications Software developed and accepted by BPCL shall be the express property of BPCL and developed source code and documentation shall be submitted to BPCL within one month from completion of the application. Future upgrades source code and documentation shall be submitted to BPCL within one month from the date of release of the version.

    Hosting of applications Hosting of both the applications (B2C and B2E) is in scope of vendor. BPCL will prefer to host the applications to cloud. However the database of the application may be hosted in BPCL server.

    a) Vendor need to have back to back arrangement with cloud space providers for hosting the

    applications on cloud and submit the hosting cost separately to BPCL as prescribed in the Price Bid format. BPCL will then enter into agreement with the cloud space provider for hosting the applications for duration of 3 years and will make direct payment to the cloud space provider on quarterly basis. Agreement between BPCL and Cloud space provider will have termination clause of 30 days notice period.

    b) Cloud space provider should provide all required hardware and related software like Operation system, database, etc., connectivity, local backup on need basis, DR backup, administrative rights, required for hosting and managing the mobile application.

    c) Cloud space provider must have ISO 27001 certification, failing which the offer will not be

    considered for tender evaluation.

    d) The Uptime of the application should not be less than 99.99%

    Project Management The project activities start immediately after acceptance of the LOI / signing of the contract. On award of the job, the Solution Provider will have to commence work on the project within 7 days of acceptance of LOI.

    Project Planning & Monitoring The overall project plan will be jointly validated by BPCL and vendor based on which the schedule of activities will be prepared. The project is time bound and the time for completion of the project shall be – initial structure by 1st week April 2015 and the complete application within 45 days from date of LOI. It is mandatory for the vendor’s Project Manager to schedule and monitor the project closely to ensure timely completion. The project will be reviewed on a weekly basis with the BPCL Project Manager at BPCL premises in Mumbai.

    Project phases For purposes of convenience, the application development will be done in phases that will be identified by BPCL during the project planning stage. However, it is reiterated that at least 70% of the development will have to be completed and at least 1 application hosted within 30 days of acceptance of the LOI by the Solution Provider.

    Project organization and staffing a. The vendor will appoint a Project Manager for the project, who will be assisted by an

    experienced and qualified technical team for project delivery to BPCL’s full satisfaction. b. The vendor will provide details on proposed Project Team, roles of each team member with

    experience, viz. Project Manager, Programmers, copywriters, etc.

    c. The vendor shall provide a technically competent person to provide 24 x 7 support to BPCL for Critical updates.

    d. BPCL reserves the right to review the competency of resources provided, and request for

    change, which has to be responded to within one week of receipt of such request The respective Project Managers of vendor and BPCL Retail Technology team will be the points of contact and interface between the two parties. The vendor`s Project Manager will keep the BPCL team fully informed and updated with the project status and progress.

    Acceptance procedure for project This Section sets out the procedure for acceptance by BPCL of each of the Deliverables Items and the Application System as mentioned in the Section on “Deliverables”. Acceptance Procedure Each Deliverable Item will be accepted in accordance with one of the following procedures: I – Inspection: This procedure involves the visual inspection of the item where applicable to ensure that it confirms to the Specifications D – Demonstration: This procedure involves a demonstration of the functions where applicable provided by the item to ensure that it conforms to the Specifications A – Analysis: This procedure involves the use of analytical techniques, such as sampling, where applicable to ensure that the item confirms to the Specifications T – Test: This procedure involves the testing of the item where applicable in accordance with an agreed upon test plan to ensure that it confirms to the Specifications. Programs will be accepted by the inspection or demonstration procedures. Vendor will ensure that the applications are well tested before they are rolled out and launched to the public. The system has to be formally accepted by BPCL in writing before it is exposed for public viewing. This would mean that BPCL would need to signoff the Acceptance Test Report for each module. Preliminary Acceptance testing shall be done by BPCL on receipt in the presence of representatives of the vendor and a preliminary test certificate will be prepared in 4 copies out of which three copies will be issued by the consignee. One copy shall be handed over to the supplier and one copy each shall be kept with BPCL. Preliminary inspection will comprise of the following:

    1) Verification of software licenses, other documentation and certificates (which shall also include Installation tie-up and Support certificates from OEM) as per tender.

    2) Submission of implementation plan by bidder after mutual discussion with BPCL. 3) Submission of training plan by bidder after mutual discussion with BPCL. 4) Installation and configuration of software in the development server. 5) Demonstration of features specified in technical requirements.

    A Final Commissioning Certificate will be issued by the consignee in three copies retaining one copy for record. One copy shall be handed over to the supplier and one copy each shall be kept with BPCL. The final commissioning will comprise of the following:

    1) Development of mobile applications in co-ordination with the vendor 2) Successful functioning of application along BPCL applications for 1 month from the date of

    commissioning which is termed as Date of acceptance 3) The warranty period will be calculated by the bidder from date of acceptance 4) The bidder should submit warranty agreement letter to BPCL upon which final payment

    will be made to the bidder.

    Vendor’s roles and responsibilities a. Vendor must appoint a Project Manager to co-ordinate with the BPCL Team b. Bank Guarantee needs to be furnished as per the Tender

    c. Vendor must work closely with BPCL Retail Technology Team and finalize the Sitemap,

    Functionality and application Theme/Design in the stipulated time.

    d. Vendor must collate / update / clear all content from existing applications as well as from BPCL SBU’s with the help of BPCL Retail Technology Team

    e. Vendor must source Images relevant to each section and get approval from BPCL Retail Technology Team

    f. Vendor must set up a “Test environment” to “Demo” the completed application

    g. Vendor is responsible for Testing, Debugging the application and making it error free.

    h. Vendor to provide a solution of backing-up of database and application of the proposed solution and the restoration of same during a disaster. Bidder will conduct a drill of the same as a part of the deliverable.

    i. Vendor must develop, modify or customize the applications to meet exact BPCL requirements.

    j. Vendor needs to co-ordinate with BPCL IS Team to ensure that any data exchange with BPCL SAP or internal Complaints Software is seamlessly done.

    k. Vendor needs to co-ordinate with different SBU’s and Divisions of BPCL to ensure that the multiple modules like MAK Advisor are working seamlessly and all Historic data is imported in the new applications.

    l. Vendor needs to be able to provide 24 x 7 Support to BPCL for Critical updates.

    m. Vendor needs to do “periodic” review meetings to update BPCL Team on Project Status.

    n. Vendor needs to activate a middleware to cross-pollinate BPCL information / images from servers to applications.

    o. Maintenance (Add / Delete / Update of records) of the logs generated through the application in consultation with BPCL will be the responsibility of the Vendor.

    p. Vendor needs to ascertain that CMS tool and other modules developed for BPCL applications ensure Security of the applications from Hacking; and periodic action must be taken to make sure that the website is safe and secure.

    q. BPCL IT Team runs a “Vulnerability Assessment Test” daily on the BPCL applications. If any vulnerability is thrown up, vendor is responsible to resolve and clear all “Vulnerabilities” in association with the Data Center.

    r. Vendor needs to have dedicated person/s for monitoring social media posts, activities and its

    analytics.

    s. Vendor needs to have dedicated person/s for analytics

    t. Vendor to enable Google / other Analytics on the applications.

    u. Vendor need to provide Monthly analysis of downloads to BPCL RTC Team.

    v. Vendor is required to attend meetings with Data Center or BPCL SAP Team or other BPCL SBU’s for understanding requirements, suggesting new developments or for giving inputs or any development which impact the BPCL Website. There will be no charges levied for such meetings irrespective of the number or duration of such meetings.

    w. Vendor is responsible to give timelines for any updates that come and the work must be completed within the stipulated downtime. Ideally no update, unless very extensive, should take more than 24 hours.

    Source code ownership should rest with BPCL. BPCL reserves the right to close the tender giving 15 days advance notice. All changes in the source code should be routed through BPCL authorities. BPCL authorities should only have the password and access to make changes in the code. Vendor should interact and take inputs from Creative / Graphic / Brand department of

    BPCL. The app should be launched through Google and apple in the name of BPCL app. Vendor

    should not mention vendor name anywhere in any of the play stores while publishing the app.

    BPCL’s Roles and Responsibilities This section specifies the responsibilities to be carried out by BPCL in order to facilitate the vendor to design, develop and deploy the mobile applications to BPCL’s full satisfaction. Generic Vendor’s Project Manager & Retail Technology team will act as the main catalyst and liaison in order to facilitate sourcing of BPCL internal content from Businesses / Entities. Hardware, Software and Networking BPCL will provide vendor with visual design elements for the applications like logos and other standard visible manifestations of BPCL that are required for the system in digital format. BPCL will be responsible for providing necessary communication equipment at its end.

    BPCL will ensure that required data from SAP, loyalty database, BI are provided to vendor.

    Other items It shall be the responsibility of Vendor to implement any procedures necessary to safeguard the integrity and security of software and data used in this project, from access by unauthorized persons. The content of any data file, the selection and implementation of controls on its access and use, and the security of stored data is the responsibility of Vendor. The vendor is responsible in identifying such areas where procedures are necessary to safeguard the integrity and security of software and data used in this project. a. Both parties shall agree upon publicity and reference to the project mutually. b. Vendor to agree that all materials / information / documentation / data exchanged is treated confidential, handled with due care and is not shared outside the authorized group

    Facilities The solution will be temp developed at vendor’s premises. TEST servers would be used by the vendor for demonstrating the application. However, final acceptance of the production level application would be done by BPCL after testing the solution installed by vendor in the production system. BPCL shall ensure that vendor personnel are allowed necessary access to the project / production system.

    Personnel BPCL shall designate one person from Retail Technology Team, who will act as the points of contact to whom all vendor communications may be addressed. They would be the Primary team.

    General Terms Over and above the enclosed General contract condition, the following are the general terms to be adhered to:

    1) Vendor will make delivery of software objects and source code to BPCL. It is assumed that the software delivered in phases (if any) will be used for content validation and approval of presentation only. It will be implemented in live environment after each phase of the application is developed and tested.

    2) BPCL will provide necessary internal documentation, data files, test suites etc. from the existing system implementation and / or any other available sources / agencies as may be required or useful for the development. External content will have to be sourced by the vendor and approved by BPCL prior to hosting / using such data.

    3) While at BPCL premises, vendor representative(s) will observe normal security, safety and

    other office procedures of BPCL.

    4) vendor is required to ensure to hold Information of BPCL disclosed to vendor or if vendor shall gain access to any Confidential Information relating or pertaining to BPCL in the strictest confidence and that the knowledge of such Confidential Information of BPCL is restricted to those of its employees who require such knowledge in the ordinary course and scope of their employment. Vendor shall not use BPCL’s name or logo for any purpose whatsoever without the prior written consent of BPCL

    Compliance with laws and permits The successful vendor shall comply with all applicable Acts, Rules thereon, local / state & Central Government Notifications / Order / rules, regulations, ordinances and Judicial Judgment / order relating to the conduct thereof and shall secure and obtain approvals, permits and licenses as necessary from time to time at their cost and responsibility for the execution of the work.

    Preparation of proposal and presentation This RFQ does not commit BPCL to pay any costs incurred in the preparation / presentation of proposals. Furthermore, BPCL reserves the right to accept or reject any or all proposals or any part of a proposal without assigning any reason whatsoever thereof.

    Liability insurance The vendor shall agree to maintain General Liability Insurance, Workers compensation and Employers Liability Insurance at their cost to cover all its Personnel engaged in the performance of the work prescribed in the contract as well as damages arising out of a result of such workings. The terms and conditions for this project are given below. The scope of the work is as stated in this document.

    Resource Mobilization Vendor will complete mobilization and put up a team for this project within one (1) week of the acceptance of LOI / signing of Contract. Mobilization cost shall be on account of Vendor.

    Offer Validity All proposals in response to this RFQ will remain valid for 120 days from the last date of bid submission, and for the successful vendor, till the conclusion of the project / post-completion maintenance period, as applicable.

    Use of licensed soft wares Vendor should use only legal / valid software for development of the application; BPCL would not be responsible for any use, either direct or indirect, of illegal software by the Solution Provider. Solution Provider would indemnify BPCL against the same. Vendor will be responsible for procurement of licenses for any software which is used for this solution. Vendor must have In-house CMS tool with Source Code which is Customizable, Easy to Manage, Creates pages with Responsive Design, Supports multiple Languages, Uses Web 2.0 tools, is W3C Compliant and can run on the latest Windows Server / IIS / SQL.

    Other condition

    1. In case of any damage or loss caused to BPCL due to breach of terms or conditions of the tender document / Work Order, negligence, carelessness, inefficiency, fraud, mischief and misappropriation or any other type of misconduct of the Tenderer or its staff, employees, representatives, agents, the Tenderer shall make the loss good. BPCL shall have right to adjust the damage / loss suffered by it from the security deposit / earnest money deposit / bank guarantee and / or to charge penalty as decided by BPCL. The Decision of BPCL in this respect shall be final & binding.

    2. Whenever under this tender document / Work Order any sum of money is recoverable from and or payable by the tenderer, BPCL shall be entitled to recover such sum by appropriating either in part or in whole from the security deposit / bank guarantee / earnest money deposit of the Tenderer. In the event of the security deposit / bank guarantee / earnest money deposit being insufficient, the balance or the total sum recoverable, the case as may be, shall be deducted from any other sum due to the Bidder which at any time thereafter may become due to the Bidder under this or any other tender / contract with BPCL. If this sum is not sufficient to cover the full amount recoverable, the Bidder shall pay BPCL on demand the remaining balance.

    Confidentiality Please note that the "Mobile App" related activities as specified in this Tender document are confidential. It shall be responsibility of the Tenderer to take all necessary precautions and measures to maintain utmost confidentiality with regard to each and every stage of work.

    Further, Tenderer shall not use or disclose any Confidential Information of BPCL except as specifically contemplated herein. For the purposes of this Contract / Tender, "Confidential Information" includes information includes as:

    (i) is sufficiently secret to derive economic value, actual or potential, from not being generally known to other persons who can obtain economic value from its disclosure or use; and

    (ii) is the subject of efforts that are reasonable under the circumstances to maintain its secrecy or confidentiality.

    Force majeure Notwithstanding anything contained in the Tender Documents, neither party shall be liable for any failure to fulfil any of its obligations under this agreement where that performance is delayed, prevented, restricted or interfered with for any reasons / circumstances beyond its reasonable control (including without limitation any delay caused by the Acts of Governments, Acts of God, Natural or social calamities, Strikes, Riots in any region, network failure, terrorist attack, war declared and undeclared) provided however that any delay by the supplier of the Party so delaying shall not relieve that Party from liability for delay except where such delay is beyond the reasonable control of the supplier concerned.

    Termination of the Contract BPCL, without prejudice to any other remedy and rights, reserves the right to cancel / terminate the tender / Work Order in whole or in part by giving at least 15 (fifteen) days’ prior written notice thereof in case Vendor fails to honor his bid / Work Contract or found guilty for breach of condition /s of the tender documents / Work Order or negligence, carelessness, inefficiency, fraud, mischief, misappropriation or any other type of misconduct by himself or by its employees, staff, agents, representatives etc. or by any other person directly or indirectly employed by him. In case of such termination, BPCL shall have the right to put in place any other agency for carrying out the remaining work. Any extra expenditure being borne by HTC on this account be recovered from the Vendor from Security Deposit. In additions to above, BPCL may also cancel / terminate the tender / Work Order in whole or in part for its convenience at any time for any reasons, by giving the Bidder at least 10 days’ prior written notice thereof. The notice period may be extended by mutual agreement till alternate arrangements are made. Further, any pending or unresolved service, function, task, performance, unpaid fees and any other remedies shall continue by the parties during the period of termination notice and the same must be satisfied before the tender / Work Order is cancelled / terminated. In case of such cancellation / termination / Work Order or curtailment of the work by BPCL, the Vendor shall have no claim to any payment or compensation whatsoever on account of any profit or advantage, which would have derived by it from the execution of the work in full, but which he did not derive in consequences of the full amount of the work not having been carried out. Neither shall he have any claim of compensation / damage for the loss suffered by him by reason of cancellation / termination of the tender / Work Order and of any alterations having been made by BPCL in the

    original specification or the designs and instruction which shall involve any curtailment of the work contemplated. However, BPCL shall pay the Vendor for such portions of the Work as are due and properly invoiced under the provisions prior to termination. In no event, shall the total payments made to the Vendor exceed the Contract Price.

    Blacklisting BPCL without prejudice to any other remedy and rights, reserves the right to blacklist the Vendor for a suitable period Tender in case he fails to honour his bid / Work Order or found guilty for breach / violation / contravention of terms(s) and condition(s) of the tender / Work Order or negligence, carelessness, inefficiency, fraud, mischief, misappropriation or any other type of misconduct by Vendor or by its staff, agent, employee or officer etc. or by any either by himself other person directly or indirectly employed by him

    Penalty Any deviations whatsoever from the timelines mentioned below would result in penalty and the same will be recovered from the vendor.

    The price offered to BPCL must be in Indian Rupees, inclusive of all presently applicable taxes and duties. Any new taxes/ increase in taxes introduced by Govt. / State Govt. / Municipal Corporation or local bodies which is subject matter of the contract, if it is a liability of Bank shall be borne by the Bank and shall become payable by the Bank on production of documentary proof by the bidder. The price should be inclusive of VAT if VAT is already implemented in the place of billing. If VAT is currently not applicable but will become applicable on implementation at the place of billing subsequently, the difference between the sales tax component included in the price and the VAT component (either reduction or addition) will be on Bank account only after implementation of VAT. If the Government brings in any changes to the tax structure resulting in reduction of the cost, the benefit arising out of such reduction or changes or abolition shall be passed on to BPCL. However, any item not mentioned in the Scope but necessary to complete the project will be the Sole responsibility of the bidder and will be deemed to have been included in the price. Prices, which are not quoted as above, can be rejected. BPCL reserves its right to reject any bid submitted with an adjustable price quotation.

    TECHNICAL TEAM- 7 members with minimum qualification of BE / MCA with minimum 1 year experience in mobile application development.

    GRAPHIC DESIGN TEAM – 3 members with
