More than 100 people gathered at the DoubleTree by Hilton in Tempe on Thursday, July 12 for what was by far the most popular AZBEX Leading Market Series topic: the Public K12 market.

While most LMS events so far have cov-ered projects that are upcoming/in the works and how to get work within the market, this particular topic was more focused on the unexpected K12 procure-ment rule change expected to go into effect by July 1, 2019.

The rule was added to an amendment of the RedforEd Bill and stated that as of July 1, 2019, Alternate Project Delivery Methods for education procurement are to be scrapped, and all State Board of Education procurements for materials, services and construction will be required to be awarded to the lowest qualified bidder. The announcement of the change came after Scottsdale Unified School District came under fire for illegal actions with lax oversight, and AZBEX President Rebekah Morris invited panelists to discuss their opinions on the subject and the impact the change will have on districts.

“Unfortunately, all of my experiences with low bid were not necessarily successes,” explained Kropp. “While the projects still got done, it was company XYZ that would low-ball the bid, but then would change order and by the time the project was done there was no way of knowing whether or not they were indeed still the low bidder.”

Both Kropp and Simpson agreed that the Alternative Project Delivery Method was the better way to go due to the pre-con-struction services a CMAR is able to pro-vide versus a low bid contractor.

“By that low bid rule, you have to award it to that low bidder. You have no idea whether or not they have looked at the entire scope. Whereas with the CMAR you do your job walks, you have your pre-sub-mittal meetings and they know the scope.” Kropp explained.

The second panel, comprised of Bonnie Gonzalez, director of business develop-ment for The H2 Group, and Michael Baer, national division manager for Sunland Asphalt and moderated by Rebekah Morris, echoed similar concerns about the change to low bid.

“If you do low bid, you don’t know the quality of the person. You don’t know the firm, necessarily,” said Gonzalez. “You don’t know whether or not they’ve got the labor force behind them. These are all the questions… we don’t know.”

“It’s About People Behaving Badly.” So How do we Fix It?Both panels were also in agreement that they believed the change was an overre-action to the Scottsdale Unified School District situation, and attendees demon-strated their agreement with the panel by applauding as Kropp mentioned he felt the announcement of the change was a pun-ishment and not necessarily in the best interest of the state.

“It has nothing to do with alternative deliv-ery method or low bid. It has to do with people behaving badly,” said Gonzalez.

During Morris’ presentation early on, she identified a key reason why the rules aren’t always followed, and that’s because some people aren’t fully educated on them.

“There are not a lot of education oppor-tunities for district employees,” said Morris. “One of the things I asked in doing my research… I would go and I say, ‘Who teaches you to abide by procurement rules?’ They didn’t have a good answer… I said, ‘how do you set up a Job Order Contract?’ I asked six different people and got five different answers.”

All speakers agreed that to fix the issue, districts need to hire a strong procure-ment team and to give them the proper education on the procurement rules in order to alleviate any wrong doing.

“This knee-jerk reaction to go just to low bid is going to be very painful to the schools,” said Baer.

Update from the State Board of EducationCatcher Baden, deputy director of the Arizona State Board of Education, also gave an update on new procurement rules that will be coming sooner than July 1, 2019. Some of these rules include:

• Requirements for licensure and documentation for licensure

• Rules on conflict of interest

• Gift and reprisal prohibitionsAccording to Baden, these rules are expected to come out in early August.

(Prescott-area) residents inter-ested in hearing the details of a development proposal in the Granite Dells area will have to wait.

After Arizona Eco Development’s first attempt to file for annexation in the Granite Dells area was rejected by the City of Prescott, devel-opers are working on a revised submittal.

Prescott Planning Manager George Worley reported in early July that city officials had determined that Arizona Eco’s initial application was incom-plete, and the city was asking for more information.

Jason Gisi of Arizona Eco said the company is work-ing to include the additional information.

Among the issues with the orig-inal application was insufficient information on the nearby property owners. Gisi said the initial paperwork omitted the state requirement to include properties in the area – a list that likely will number in the hundreds.

That list will then be used by the city to notify the prop-erty owners of the pending annexation.

Because both of Arizona Eco’s properties exceed 250 acres – 900 acres for the south-ern parcel near the Point of Rocks, and 1,600 for the north-ern portion near the Prescott Airport – they fall under the requirements of the voter-ap-proved Reasonable Growth Initiative, also known as Proposition 400.

That means that a public com-ment period of no less than 60 days must take place after the formal vote on a master plan by the Planning and Zoning Commission.

After the 60-day public com-ment period, the Prescott City Council will then weigh in with meetings of its own.

If all goes as planned, Park Place Condominiums will be more than quadrupling in size – an expansion a decade-plus in the making.

On July 3, the Sedona Planning and Zoning Commission was presented with a conceptual development review for the proposed expansion of the mul-tifamily development in West Sedona.

The item was for discussion only, so the commission did not take any action.

According to a city report, the property owner is proposing to complete development of the site as a multifamily residential project.

The current plat allows for development of a maximum of 88 units. As 12 of those units have been built, the plat would permit an additional 76 units. The current proposal is for an additional 59 units, for a total of 71 units, a reduction of 17 units from what is currently allowed.

In addition, the applicant is pro-posing a clubhouse and pool area. As currently proposed, this would complete development of the parcel; there would be no land available for additional construction or units.

Additional existing site charac-teristics of the project include:

The entire project totals 9.73 acres.

In addition to the construction of 12 condominium units, por-tions of the site were previously graded for the road and addi-tional condominium units that were never constructed.

The property has one primary point of access off State Route 89A. This access is via a private street with a gate.

PROPOSED BANNER HEALTH/ SELECT MEDICALREHABILITATION PROJECT

Banner Health has submit-ted a zoning change and plan approval to build a physical rehabilitation hospital just east of the southeast corner of 7th and Willetta streets in Phoenix.

The project, called Banner Health Acute Inpatient Rehab Hospital, will “improve site con-ditions and expand medical facilities in the area,” according to the proposal. The develop-ment will be part of the Banner University Medical Center campus on McDowell Road in Phoenix.

The new three story, 71KSF building will be built on 2.5 acres and will have 60 beds. The project is valued between $15M-$25M. The surrounding area includes offices and a park-ing lot to the north and medical offices and a parking garage to the west. Interstate 10 borders

the land on the south. On the eastern edge of the lot are other Banner University Medical Facilities.

The project requires a zoning change from a Multifamily Residence District designa-tion with a special permit to an Intermediate Commercial des-ignation. Banner Health’s pro-posal also includes a height waiver to allow a height of 48 feet.

The proposal notes that the request for rezoning is strength-ened by the project’s connec-tion to the Banner University Medical Center, an established medical campus in Phoenix, as well as the project’s consistency with the goals of the Good Samaritan Area Redevelopment Plan that was adopted by the City Council in 1980.

Additionally, while the request includes a height waiver, the building currently on the site exceeds the limit of 30 feet. The new rehab hospital wouldn’t exceed 56 feet, the maximum height allowed by the zoning ordinance. Also, like other Phoenix hospital campuses, many portions of the Banner University hos-pital campus have high rise entitlement.

This rehab hospital will be one of four inpatient rehab hospitals in Phoenix and 38 physical therapy centers in Arizona that are combining operations as part of a joint venture between Banner Health and Select Health. The deal also includes constructing three new similar rehab hospitals to be finished by next year, two of which have already been announced in Sun City and Gilbert. (AZBEX, Jan. 12)

The healthcare providers announced the partnership in January of this year. Banner Health will be the majority owner while Select Health will manage operations. The two partners have big plans for expanding Arizona health care facilities.

“Future plans involve consolidation of the existing hospitals into the new state of the art facilities designed to better serve the needs of patients requiring care resulting from stroke, spinal cord injury, brain injury, amputation, neurological disorders, among other conditions,” a press release said.

Banner Health is the owner/developer. Kimley-Horn & Associates, Inc. is the engineer. Architecture and planning will be handled by Taggart Architects/GWG3 Architecture. The general contractor is Brasfield & Gorrie LLC. •

Officials at City Hall have gained city council’s blessing to implement Old Town develop-ment criteria ultimately being injected into the Scottsdale General Plan, which will help to serve as a guideline to how the area will evolve into the 21st Century.

The decision was unanimous on July 2 to adopt the Old Town Character Area Plan Non-Major General Plan Amendment minus a policy regarding an artist in residence program.

Changes in the plan included introducing new types of devel-opment – type 2.5 and type 3 – to identify existing areas where the highest scale development can occur in Old Town. The new types of development will allow developers an opportu-nity to ask for heights up to 150 feet, city officials say.

City officials say, overall, the proposed changes include:

• Aligning the plan with other city plans that have been reviewed or adopted;

• Updating maps and graphics; and

• Providing clear, understandable and direct goals and policies.

In June, Scottsdale Long Range Planning Manager Erin Perreault presented an update to the 2009 Downtown Plan seeking feedback and dis-cussion. On July 2, Perreault presented changes made to the update based on council’s direction.

Changes made between June and July included enhancing shade-and-tree-plan language, adding public outreach compo-nents to the public art process and adding Scottsdale Stadium to the Civic Center district.

Included is a new pedestrian and open space master plan, and the public facilities chap-ter within the downtown crite-ria has been deleted to remove repetition.

Additionally, a hard boundary has been given to the area offi-cials call the “Entertainment District,” where several night clubs, bars and establishments are housed.

The type 2.5 development could include intermediate, higher-scale development on approximately 10 acres in the downtown area, a city staff report states. Type 3 devel-opment is the highest scale development to be consid-ered, allowing up to 150 feet in structure height.

The areas with type 3 designa-tion is generally north of the Arizona Canal, south of Main and Second streets along both the Goldwater and Drinkwater boulevards’ southern curves,

and east and west of the inter-section of Scottsdale Road and Drinkwater Boulevard.

Downtown Scottsdale 2.0 was a 10-month long study aiming to plan the future of down-town and Old Town Scottsdale. The study was born out of a five-year strategic plan for the city’s tourism and events department.

One of the largest medical technology companies in the world will be the first tenant for the new I.D.E.A. Tempe campus. The Peripheral Intervention business of Becton, Dickinson and Company will be the first tenant in a new building at the Tempe Town Lake development. It will open in late 2019.

I.D.E.A. Tempe is a phased development that is focused on bringing new technology companies to Tempe. The 18-acre, 1MSF project includes five commercial office buildings and hotel, restaurant and retail space and two parking structures. I.D.E.A. stands for Innovation, Discovery, Education and Arts. The campus is located adjacent to Tempe Center for the Arts near Tempe Town Lake.

BD is one of the largest global medical technology companies in the world with more than 65,000 employees. The company works to advance the world of health by improving medical dis-covery, diagnostics and the delivery of care. The Peripheral Intervention business develops, manufactures and distributes medical technology and devices that provide clinical benefits to patients suffering from diseases that affect the vascular system.

The Peripheral Intervention business at BD will move to the new 185KSF, 6-story building at IDEA Tempe, by January 2020. Groundbreaking is expected to begin later this summer.

Currently, BD employs 550 people in Tempe, and the company currently has an additional 50 positions they are recruiting for, with expectations to hire even more before the new building opens. The jobs within this business are highly skilled, many of them involve marketing, R&D and quality engineering, clinical, regulatory or medical expertise and experience with highly reg-ulated medical products.

After nearly 16 years of planning, devel-opment plans for a 270-acre swath of land at the intersection of Butler Avenue and Fourth Street are nearing fruition, and new homes could be under construc-tion as soon as 2020.

Investors who own the property are asking the city for a rezoning of 26 acres before the project moves forward, said Brian Rhoton, one of the owners of Capstone Homes, which is managing the property on behalf of investors.

Rhoton said many of the single-family houses built on the site could be on the lower end of the price range and the site could make significant additions to the city’s stock of available apartments.

Investors bought the Canyon Del Rio property in 2002 from the state and immediately began work on developing the site.

Since then, development has occurred on about 45 acres of Canyon Del Rio, with a few apartment buildings constructed on the northern edge.

The current plans have strayed very little from the original 1983 state plans except in one main respect, Rhoton said. The area near the north and center of the property is currently zoned for light industrial but the developers hope to change that. Instead they want to build high-density residential and commercial in the area.

This would mean corner stores, office buildings, apartments and possibly some small retail buildings in the north and center of the site, bordering Butler. Although the site itself is mixed-use, Rhoton said, they don’t expect mixed-use buildings.

Within the city’s regional plan, which was ratified by voters in 2014, the city iden-tifies the area as being suitable for large amounts of residential growth despite

the current light-industrial zoning. It also points to the site as a potential spot for future “activity centers,” places that draw people to them from the immediate sur-roundings, and to a lesser extent, from across town.

Without the zoning change Capstone has requested, Rhoton said, about 30 percent of the project is ready for development, but that is not the only aspect of the proj-ect they are waiting on. There also are a number of public infrastructure improve-ments that need to be started prior to or concurrent with construction.

In all, the development could provide around 1,100 units, with about 500 of those being single-family homes and 600 being apartment units.

They don’t expect student housing devel-opments on the site.

While many have speculated on it and few have been able to pro-vide concrete answers, Five Star Development officials contend the Ritz-Carlton, Paradise Valley resort community will begin to sprout sometime over the next calendar year.

The Paradise Valley special-use permit – approved by a 4 to 3 vote in early 2016 – entitles Five Star, through an investment of $130M, to build a Ritz-Carlton-branded resort on more than 100 acres, an arrow’s shot from the intersection of Scottsdale and Lincoln roads.

But many in the community are beginning to wonder when the latest five-star resort will become operational.

Or at least, some say, an indication of when meaningful construc-tion will commence at the coveted site. But work has begun – so far most of it underground and invisible to the casual observer.

Richard Frazee, Five Star Development project manager, says mil-lions of dollars have been spent on subterranean infrastructure – about $10M has gone into the ground for the last year.

Frazee says people will soon begin to see above-ground structures being built.

The development entitlements granted to Five Star Development for the creation of a Ritz-Carlton Paradise Valley resort community are broken into seven development-area characteristics:

• Area A: 200-room resort on 18.1 acres.

• Area A1: 94 resort-branded villas.

• Area B: 66 single-family homes on 31.3 acres.

• Area C: 39 resort-branded, single-family homes on 17.2 acres.

• Area D: 53 townhomes on 8.8 acres.

• Area E1: A 54KSF luxury retail center on 7.2 acres.

• Area E2: Influx design as the use of 5.7 acres is yet to be determined.

Most recently, Paradise Valley Town Council unanimously approved an amended final plat for Area C, 39 lots on 17.2 acres. Original plans called for 45 homes on 22.5 acres.

In addition to Paradise Valley entitlements, Five Star Development also has been granted zoning standards for the project on land that extends into neighboring Scottsdale.

Five Star Development sold 23 acres of land to Shea Homes within the Ritz-Carlton community in Paradise Valley and the City of Scottsdale has approved a new shopping center coined “The Palmeraie” that will, in part, encompass 20 acres of land adja-cent to the forthcoming Ritz-Carlton resort community.

The approved measures will allow for a mixed-use development that can consist of 141 residential units in 170KSF, a maximum of 150 hotel units on 134KSF, 226KSF of commercial space and 80KSF of office space, city officials say.

Meanwhile Shea Homes has announced that it is set to debut an exclusive high-end brand called, Shea Signature, appearing on a 23-acre portion of the Ritz-Carlton project where 66 single-fam-ily luxury homes will be built.

Underlying Concerns AboundIn an early July message to Paradise Valley Town Council, Town Manager Kevin Burke expressed concern regarding changes pur-sued by Five Star officials.

“I am feeling less comfortable with the Ritz Hotel progress lately,” he said. “There are several reasons.” Over the last several months, town officials say, modifications to the approved SUP document have been loosely pursued.

Changes to the original plan, says Burke, could be slowing down construction.

He notified developers that changes could not be approved by the town manager; minor amendments to the plan would need approval from the Planning Commission.

The approved development agreement between Five Star and the municipality also requires the hotel be operational before a certificate of occupancy can be awarded for the housing stock.

But Frazee contends Five Star is determined to meet the tenets of its development agreement, specific to housing stock.

Frazee assures Five Star will deliver on their development promise.

When it comes to land development, some parts of Peoria look like pieces of a puzzle. Paradise @ P83 is a good example of how difficult it can be to draw up a plan, especially when it comes to rezoning for a 352-unit multifamily community.

East of the 75th Avenue and Paradise Lane intersection is a prop-erty containing approximately 16.1 acres. OPUS Development, through its representative, Withey Morris, requested to rezone the property from Planned Light Industrial and General Agricultural zoning to a Planned Area Development (PAD).

The property sits on the east side of 75th Avenue across from a 3.3-acre site Peoria City Council approved in March for develop-ment as a 198-room, four-story Marriott hotel, restaurant and bar.

Staff told City Council at its June 19 meeting the proposed zoning was in conformance with the goals and objectives set forth in the city’s general plan for the sports complex urban design plan. Council was also told the request was consistent with the sports complex mixed-use land use.

Staff said the rezoning amendment better reflects the develop-ment needs of the area while “accounting for the existing built environment.” That environment includes the Bell Road corridor between 75th and 83rd avenues, the already approved Marriott hotel complex, an existing neighborhood retail center at 75th and Bell Road, two large residential subdivisions to the east in Glendale, a large apartment complex to the west at 77th Avenue and Paradise Lane, and the Peoria Sports Complex at 83rd Avenue and Paradise Lane.

The Arizona Department of Transportation in conjunction with the Federal Highway Administration, is planning four safety and roadway/bridge improvement projects on or adja-cent to State Route 89A between the cities of Sedona and Flagstaff. Three of the projects will require traffic restrictions and are being coordinated to minimize traffic impacts. The four projects are:

• Pumphouse Wash Bridge Rehabilitation (H8778)

• Sedona City Limits to Bear Howard Drive Pavement Rehabilitation (F0047)

• Rockfall Mitigation (F0154)

• Oak Creek Drainage and Sediment Control (H8907)

Pumphouse Wash Bridge RehabilitationPumphouse Wash Bridge was constructed in 1931 and is located on SR 89A. Options to rehabilitate or replace the exist-ing bridge have been under evaluation since October 2006. Pumphouse Wash Bridge is a historic structure listed on the National Register of Historic Places and full replacement of the bridge would negatively impact endangered species, stream water quality, and the historic nature of the bridge. These fac-tors led to the determination that the bridge will be rehabili-tated to extend its service life.

Work to rehabilitate the bridge will result in single lane closures along SR 89A for approximately three months.

Sedona City Limits to Bear Howard Drive Pavement RehabilitationSR 89A north of Sedona has experienced rapid degradation due to significant winter weather conditions in recent years. Pavement preservation work will be completed on SR 89A, from Sedona City Limits to south of Pumphouse Wash Bridge from milepost 374.5 to 386.6, to extend the life of the pave-ment. This project will also include replacing guardrail along the roadway to meet current safety standards and turnout modifi-cations to improve safety. Work is tentatively scheduled for late summer to winter 2019.

Rockfall MitigationThe rockfall mitigation project will reduce the potential of rocks falling onto the travel lanes at two (2) locations. The first loca-tion is near Sedona City Limits at milepost 375.1; the second location is located in the switchback section at milepost 389.2.

Rockfall mitigation work is tentatively scheduled for fall 2020.

Oak Creek Drainage and Sediment ControlThe erosion control project includes installing retaining walls, stabilizing slopes, increasing roadside ditch capacity, and adding inlets and roadway cross-culverts to preserve deteriorating slopes and reduce sediment transport between mileposts 387.9 to 389. Drainage and Sediment Control project work is antici-pated to occur in the fall of 2019. •

No further action is required at this time, the Scottsdale City Clerk’s Office told Desert EDGE Advocates and Desert Discovery Center Scottsdale, Inc., fol-lowing campaign finance violations filed against the entities.

A campaign finance complaint addressed to City Clerk Carolyn Jagger on May 25 by attorney Roopali H. Desai, on behalf of the Protect Our Preserve political action com-mittee, outlines three alleged violations surrounding practices and an alleged lack of transparency by a group called “Desert EDGE Advocates and Desert Discovery Center Scottsdale, Inc.”

In July 2017, Desert Discovery Center Scottsdale unveiled its plans for a pro-posed desert-appreciation venue envis-aged on less than 6 acres just south of the established Gateway trailhead within the McDowell Sonoran Preserve.

The facility includes a series of structures coined “pavilions” and has an asking price of $61.2M.

The document, filed on behalf of Protect Our Preserve PAC, states their com-plaint is against Desert Discovery Center Scottsdale, Inc. and Desert EDGE Advocates. Specifically, Protect Our Preserve alleges that paid operatives of Desert EDGE and Desert EDGE Advocates have followed individuals circulating initia-tive petitions.

On July 3, Jagger sent both Desert EDGE Advocates and DDCSI letters stating three categories that the complaint falls into: “Paid for By” disclosure; failure to register as a political action committee; and failure to file campaign finance reports.

“It is my determination that no further action is required at this time,” Jagger stated as the conclusion of her findings.

For the “paid for by” disclosure, Jagger says at the time of the complaint, the peti-tion had not been certified for inclusion on the Nov. 6 ballot, and had not been assigned a ballot measure number.

“The crux of the complaint is that Desert Edge Advocates is making expenditures for the purpose of influencing the outcome of an election by circulating material that would dissuade potential initiative signers from signing Protect Our Preserve’s peti-tion,” Jagger writes in her letter.

“Because IT-2017-02 has not yet qualified for the ballot there is no ballot measure, therefore, there is not yet an ‘election’ under the statutory definition.”

Gilbert plans to auction off 138 acres of land nearly a decade after the town took heat for buying the property without a certi-fied appraisal and at a price far above the going rate.

The town has set no minimum bid prices for the auction, although the Gilbert Town Council has sole discretion to reject any bids.

Gilbert purchased the properties for $50.2M in a complex land deal in 2009, envisioning the land as future parks. The town has since opted to build the parks elsewhere after a parks planning process found the land to be unnecessary.

The land, which will be auctioned separately, encompasses:

• 58 acres at the SWC of Germann and Greenfield roads

• 80 acres at the SWC of Chandler Heights and Greenfield roads

A Land-buy Turns into a Debacle In 2010, the land sale became a full-blown debacle for Gilbert officials when critics discovered the town never got a certified appraisal. The sale price, at nearly $300K/acre, was almost 10 times the price paid in similar private sales in the area. The sale price was particularly jarring as land values were plummeting amid the Great Recession.

The town purchased the land from dairy farmer Bernard Zinke. At the time, town officials defended the purchase, saying they worried that potential park land would soon be sparse.

Linda Abbott, a councilwoman at the time, said this week that it was vital to secure land in the southern part of town as the area grew more popular.

Records show the town got early estimates on the land. An esti-mate in August 2007 valued much of the land at around $67KSF/acre, about $233K less than what Gilbert paid.

Scottsdale is spending $11.5M to finish the final three sig-nificant trailheads in the city’s McDowell Sonoran Preserve, adding amenities for hikers from shade structures to an amphitheater.

Once completed, the 30.5K-acre preserve will have eight signifi-cant trailheads leading to more than 180 miles of trails through pristine desert.

The Pima and Dynamite Trailhead, a popular starting point at 28777 N. Pima Road, will transform from a gravel to paved parking area with $4.5M in upgrades by spring 2020.

Two other trailheads will each get $3.5M in upgrades that will be completed next spring. The Fraesfield Trailhead is near Rio Verde Drive and 136th Street and the Granite Mountain Trailhead is at 31402 N 136th St.

Restrooms and Other UpgradesGravel lots at the three trail-heads will be paved, with restrooms, shaded seating, elec-tricity and equestrian staging.

Two of the three also will have water fountains. Granite Trailhead is too far from the nearest water source.

The Pima and Dynamite Trailhead also will be home to a small amphitheater used for educational sessions hosted through the McDowell Sonoran Conservancy. The amphithe-ater will be named after Art Decabooter, a former Scottsdale Community College president.

As demand for apartments and rental housing grows in the Phoenix area, find-ing the perfect spot to build a multifamily development is a critical puzzle piece for builders.

Co-founder and CEO of Christopher Todd Communities, Todd Wood’s com-pany specializes in a hybrid multifam-ily development, which builds detached units akin to single-family homes rather than traditional apartments. As a result, those developments require more land. In the first half of 2018, Christopher Todd Communities purchased 34.5 acres to develop two communities, one in Peoria and one in west Phoenix, according to data provided by Ramey Peru of Colliers International.

Apartment development is a big driver of real estate buying and building in the Phoenix region. Most land purchases total-ing $1M or more in the city of Phoenix for multifamily development this year were

centered on downtown, and most were less than 5 acres, according to Colliers.

Outside Phoenix, all but two of the 10 land purchases of $1M or more for multi-family housing were 5 acres or more. The largest parcel purchased was 41 acres of unimproved desert at Hayden Road and Princess Boulevard in Scottsdale.

Phoenix had eight land purchases for mul-tifamily development worth $1M or more, followed by Tempe, which had five.

Former real estate broker Pete Bolton commended the approach tradi-tional apartments are taking for infill, and said new development has improved many areas that were formerly blighted and encourages density.

A contrite charter school board for American Leadership Academy held an emergency budget hearing Saturday night, acknowledging it did not follow state law when it blocked public comment at a similar meeting two days earlier.

The new meeting was announced after The Arizona Republic reported that ALA had refused to allow public com-ment at its original budget hearing Thursday, possi-bly violating the state’s Open Meetings Law. At least three people at that meeting said they wanted to address the board, but were barred from speaking.

A day earlier, the Republic first published an investigation on azcentral.com that found busi-nesses tied to ALA founder,

Glenn Way had made millions of dollars building campuses for the charter chain.

The Republic found that Way or his companies – thanks partly to Arizona’s favorable char-ter-school laws and lucrative no-bid deals with ALA – have made millions of dollars build-ing, leasing, selling and manag-ing the 12-school chain. Way was ALA’s board chairman until last year.

The board allowed members of the public to speak as long as they wanted if the ques-tions were about the 2018-19 budget.

The tenor was in contrast from Thursday, when the board refused to allow the public to comment, saying it did so on the advice of its attorney.

During that meeting, ALA executive Brent McArthur confronted Jim Hall, a char-ter schools watchdog who has been critical of ALA and had filed a complaint against ALA with the state Charter Board.

Hall had claimed in his Charter Board complaint that finan-cial records ALA had submitted to the Charter Board and the Internal Revenue Service had “significant errors and omis-sions that could be hiding mil-lions of dollars in waste and possible fraud.”

Board Chairman Dal Zemp also spoke with Hall after the meet-ing, assuring him ALA wanted to be transparent and accurate in its financial reporting.

During the meeting, commu-nity member Travis Miller asked

why ALA didn’t get competi-tive bids to build its schools and whether there was a conflict of interest in awarding multi-mil-lion dollar contracts to Way.

He was told ALA, like other charter schools, is exempt from the state’s procurement laws. But Zemp assured him ALA paid less than market value for the schools, and the profit made by Way’s companies was less than a traditional developer.

After the meeting, Zemp told The Republic that board members no longer have relat-ed-party business transactions with ALA.

Zemp in an interview said the contracts with Way were legal, yet he acknowledged “the optics” are not good.

Design-Bid-Build is the most widely used project delivery method in the United States, according to the Lean Construction Institute of America and other groups. Under this method, an owner contracts separately with a designer, who provides com-plete design documents, and a contractor, who provides the most attractive price bid to execute that design.

But new research from consulting firm Fails Management Institute indicates that the Design-Build delivery method, where an owner contracts with a single entity to perform both design and construction, is quickly gaining traction in the indus-try. According to the June 2018 “Design-Build Utilization” report, DB methods will represent nearly half, or 44 percent, of Construction Put-in-Place spending across many market seg-ments by 2021.

FMI’s findings were based on 82 interviews and 101 survey responses from construction firms in all revenue categories, ranging from ENR top-10 ranked companies to small firms. FMI assessed 13 construction market segments.

FMI predicted that collective DB CPiP spending in these seg-ments will increase 18 percent between 2018 and 2021, swelling from $274B to $324B in value. Manufacturing, educational and highway/street segments are expected to comprise the top three market shares of 16 percent, 15 percent and 14 percent by 2021, respectively, followed by commercial with a 13 percent share.

No Longer the “Alternative”Design-build and other alternative delivery methods like Construction Manager at Risk and Construction Manager/General Contractor have become more attractive options to owners wanting to tighten up project budgets and/or timelines, according to the study. Alternative methods were “indicated to provide the best avenue to achieve the originally identified cost,” the report found.

While 82 percent of owner respondents said they’ve used or plan to use DBB in the next five years, 58 percent of owners said they’ve used or plan to use DB.

Given the popularity of DBB, just over half of owners surveyed said usage would stay about the same over the next five years while 32 percent predicted a decrease and only 15 percent predicted an increase. Meanwhile, 29 percent of owners said DB adoption would stay the same while 67 percent predicted increased utilization.

“The use of alternative delivery methods in general is growing and will continue to do so, particularly design-build, as projects become more complex and need to be delivered in an expedited fashion,” said FMI consultant Paul Trombitas.

3 Stark Enterprises purchased $49.1M to acquire 285KSF of retail space in The Market at Estrella Falls retail center. The 40.17 acres of retail buildings was developed from 2008-2016 by Macerich affiliate Westcor Partners and Globe Corporation. While the new owner is set to take over leasing, NAI Horizon’s Gabe Ortega, Shelby Tworek, Chris Gerow, and Patrick Anthon have been handing it prior to the purchase.

4 Churchill Commercial Capital, Inc. arranged a $25.5M permanent loan for Skysong Office 4, LLC and the master developer, the Plaza Companies, on the fourth office building within the Skysong development.

5 A Tempe address and quality tenancy were key to the $23M sale of Warner Courtyards, completed by the Phoenix office of JLL. The seller was locally based building owner and manager Hannay Realty Advisors. The property buyer, Simone Charitable Foundation Inc., acquired a 95 percent interest in the office building. Hannay retained 5 percent ownership interest in the property.

6 CBRE has completed the $16.6M sale of Plaza at Power Marketplace, a 71KSF shopping center located in Queen Creek. Philip Voorhees and Jimmy Slusher with CBRE National Retail Partners – West, and Steve Julius with CBRE’s Phoenix office, arranged the sale on behalf

of a private seller from New York and private buyer from California.

7 Lee & Associates Arizona brokered the sale of the 146-unit Connect on Union in Phoenix for 16.5M. Lee & Associates’ Todd Braun represented the seller, Union Hills Equity LLC, and the buyer, Western Wealth Capital, was assisted by Ric Holway of Berkadia Real Estate Advisors.

8 Tower Capital closed four loans totaling $14.6M. The properties were: Highland Park Apartments, Tucson, $3.32M; Carole Arms Apartments, Phoenix, $2M; Villa Sorrento Apartments, Tucson, $1.47M; Land Development, Phoenix; 7.8M (Construction loan).

9 HFF announced financing totaling $14.5M for 101 Gateway and Paradise Valley Professional, two medical office properties in Phoenix. HFF worked on behalf of the borrower, Cypress West Partners, to secure two floating-rate acquisition loans through CIT Group Inc.’s Healthcare Finance unit. A $6.7M, 36-month loan was arranged for 101 Gateway, and a $7.8M, 60-month loan was secured for Paradise Valley Professional. The HFF debt placement team representing the borrower included Aldon Cole and Taylor Bergthold.

10 The Holiday Inn & Suites Phoenix-Mesa/Chandler in Mesa has been sold to a Canadian investor for $13.1M. The Manitoba-based company plans to renovate and add mixed-use elements to the existing hotel property. Jon Grantham and James Meng of Colliers International in Greater Phoenix negotiated the sale transaction. A conglomerate of five separate limited liability corporations sold the property to AP2 Development. Kirk Pankey of Lagundi Hotels & Resorts represented the buyer in the transaction.

11 Thorofare Capital has funded a $13M short-term bridge loan for the refinance and renovation of Park Terrace at Gateway, a 277-unit assisted and independent living facility in North Phoenix.

12 ABI Multifamily announced the $9.5M sale of the 93 unit, six building The Vue on Camelback in Phoenix. The buyer is a private investor with offices in Phoenix and Canada. The seller is a private investment partnership based in Phoenix. The multifamily brokerage team of Rue Bax, Alon Shnitzer, John Kobierowski, Doug Lazovick and Eddie Chang represented both the buyer and seller in this transaction.

13 Marcus & Millichap announced the sale of three apartment properties in Tucson: River View Villas (80-units), Santa Cruz Vista (56-units), and Westlake Village (100-units), according to Ryan Sarbinoff, regional manager of the firm’s Phoenix/Tucson office. The portfolio, totaling 236 units, sold for $8.6M.

14 CBRE has arranged the $7M sale of 801 Turney, a 61-unit garden-style apartment community in Phoenix. Brian Smuckler, Jeff Seaman and Derek Smigiel with CBRE represented both the seller, 801 West Turney, LLC, and the buyer, Geiger Properties I, LLC.

15 Phoenician Villa Apartments in Phoenix has sold for $5.5M to Thomas Pride International

and ECOHAUS Real Estate. The seller was Neilstate Investment Properties, LLC. Kidder Mathews multifamily investment broker, Karl Abert, represented Thomas Pride International and ECOHAUS Real Estate in the transaction.

16 Cushman & Wakefield announced TA Realty purchased a building in the Warner Commerce Park, Chandler, from Del Mar Partnership for $5.2M. Bob Buckley, Tracy Cartledge and Steve Lindley of Cushman & Wakefield Phoenix negotiated the transaction on behalf of the seller. Built in 2008, the property is 50KSF and is currently leased to Jumpstreet – an indoor trampoline park, and Gold Medal Gymnastics.

17 CBRE has arranged the sale of Parkview on 5th, a 17-unit apartment community in Tempe. The property sold for $2.52. Brian Smuckler, Jeff Seaman and Derek Smigiel with CBRE Phoenix represented the seller, VVP, LLC, and the buyer, Luna Bear Denton, LLC, in the transaction.

18 CBRE arranged the $2.065M sale of a single-tenant retail property leased to Carl’s Jr., a 4KSF building located at 1070 E. Ajo Way in Tucson. Nancy McClure with CBRE’s Tucson office and Andrew Fosberg with CBRE’s Phoenix office represented the seller, Cumming D. Carl’s, LLC. The buyer was JGNK Investments Arizona.
