Activities of Dr Muhammad Aslam Chairman Pakistan Poultry Association During Year 2013-2014

During the year 2013-2014 Dr. Muhammad Aslam Esq, Central Chairman, Pakistan Poultry Association carried out all functions of Central Office, Pakistan Poultry Association particularly the issues relating to Poultry Farms Operations with regard to production and Marketing as well as Import and Exports. In order to enable Pakistan Poultry Association to work effectively on all its allied activities, Dr. Muhammad Aslam Esq, Chairman, Pakistan Poultry Association constituted 23 Standing Committees which were assigned responsibilities of Tariff & Taxation/CSR, Central Office Islamabad & Finance, Consumer Education, National Disease Control, Feed Mills Liaison, Layer Liaison, Broilers Liaison, Poultry Chicks & Hatching Eggs Exports, Seminar& Extension Education, Monthly Pakistan Poultry, Coordination for Research of Poultry Products, Membership Drive, Poultry Marketing, Hatchery Affairs, Micro Ingredients (Pharma), Press and Public Relation, Acquiring PPA Central Office Building, Broiler Breeders Operations, Layer Breeders Operations, Inter Zonal Coordination for Farmers Education, Controlled Houses for broilers, Environmentally Controlled Houses for Layer, Poultry Policies Coordination despite the fact that Standing Committees worked under supervision of Convenors but Dr. Muhammmad Aslam Esq exercised over all control and laid down guidelines and Polices for functioning of Standing Committees and thus fully coordinated with all Standing Committees. Beside this Pakistan Poultry Association was projected effectively at National level and International through holding Maga Events such as IPEX every year and participated in the International Poultry Exhibitions which enabled Poultry Farmers from Pakistan to share Technologies with International Poultry communities. In this Report important events have been mentioned for consideration of Stakeholders.

INVITATION OF NOMINATIONS OF MEMBERS FOR GENERAL BODY AND THEEXECUTIVE COMMITTEE OF FPCCI, FOR FPCCI ELECTIONS 2014

In reference to your letter No. FPCCI/DM. LAW/2013-2253 dated October 12 th, 2013 regarding the above cited subject. Nomination papers of bonafide Members of Pakistan Poultry Association for consideration on General Body and Executive Committee of FPCCI for the year 2014 were submitted.

Election Results of Pakistan Poultry Association for the year 2013-14 with regard to Elections of Central Chairman, Senior Vice Chairman, Vice Chairmen and Members of Central Executive Committee were forwarded to all Chambers in Pakistan for their kind information

1. ENDORSEMENT OF MEMORANDUM AND ARTICLES OF ASSOCIATION OF PAKISTAN POULTRY ASSOCAITION

2. APPLICATION FOR RENEWAL OF LICENCE OF PAKISTAN POULTRY ASSOCIATION=CORPORATE COMPLIANCE CERTIFICATE

Through this office letters No.PPA/Central/Application for Renewal of Licence/12-CUIN-0007217-1498-1500 and No. PPA/Central/Endorsement of Memorandum and Article of Association/13-CUIN-0007217-1468 dated 21st August and 12th August, 2013. SECP was requested that the copy of Memorandum and Articles of Association (M&AOA) and Corporate Compliance Certificates may kindly be supplied at the earliest possible so that they are supplied to the Director General Trade Organization (DGTO) Islamabad in connection with Renewal of Licence granted to Pakistan Poultry Association by the Ministry Of Commerce. It may be stated that a copy of M&AOA available with office was earlier supplied to facilitate the processing of case but there is no response so far.

APPOINTMENT OF AUDITOR FOR CENTRAL OFFICE PAKISTAN POULTRYASSOCIATION FOR THE YEAR 2013-2014

In the Central Executive Committee meeting of 34th AGM which was held on 30th September 2013, Appointment of Auditor for Central Office of Pakistan Poultry Association for the year 2013-2014 was approved along with Terms of appointment as intimated vide his letter No.3-24/ PPA/2013/537 dated 02 August, 2013

INCORPORATION CERTIFICATE- COMPLAINACE WITH THE PROVISIONS OF THE COMPANIES ORDINANCE- DOCUMENTS OF PPA

Reference letter No.PPA/II-H (iii) (2013)/709 dated 10 October, 2013 form 29 and Form B along with paid challans in (MCB) were submitted to SECP on time. The SECP challans on Account of payment of filing fee were also submitted along with the return. However original paid challans 4th copy (for deposit) available in this office were sent to in original to SECP for verification of already submitted paid challans. The original 4 th copy was returned to this office for record after verification by SECP

JUDGMENT OF PESHAWAR HIGH COURT: SUO MOTO WP NO. 1516-P/2012 DATED 29/10/2013

Reference telephonic discussion with Advocate dated 7th November, 2013 regarding the subject case. In the said order the matter regarding ban on the Export of Cattle Heads of all kinds including Dairy Products & Poultry Products to Afghanistan stands closed. The respondents-exporters shall approach the Federal Government for clarification whether the meat of the Cattle Heads i.e beef or mutton & Poultry Products is permitted to be Exported or not. In view of above order of Peshawar High Court, the cases filed in the Honourable Supreme Court of Pakistan may be requested to expedite hearings so as to pass judgment on our filed case so that Export of Poultry & Poultry Products to Afghanistan is permanently restored. A copy of subject judgment of PHC was enclosed for his information.

ACTIVITY REPORTS OF STANDING COMMITTEES It is stated that particulars/details of office Bearers of Pakistan Poultry Association and Members of Existing Committee who were elected in 34 th AGM held on 30th Sept, 2013 have been demanded by the Director General of Trade Organization, Islamabad in connection with Renewal of Licence to be granted to Pakistan Poultry Association under Trade Organization Act 2013. A Proforma was enclosed which was to be filled up were necessary along with signatures of respectable Office Bearers/ Members and returned to DGTO with requisite information. The Proforma being enclosed has been taken from Schedule-A under Rule 4(1) Annexure-2of Trade Organization Rules 2013.the provision of requisite information was mandatory.

FREE TRADE AGREEMENT WITH CHINA= LEVEL PLAYING FIELD DENIED

A letter was addressed to the Secretary, Ministry of Commerce, Government of Pakistan, and Islamabad, vide No.P34/CE/451 dated 2nd November, 2013 regarding above cited subject. The Poultry Processing Sector is facing lot of difficulties in exporting the value added Processed Poultry Products and also can’t supply value added Processed Poultry Products to the multinational local Markets such as KFC, MacDonald’s, Hardees and Subway as they have now started importing value added processed Poultry Products from China and Malaysia ,Pakistan being non competitive. A copy of the letter addressed to the Secretary Commerce, Government of Pakistan, Islamabad, was addressed to stakeholders for consideration. It was requested that view point of Ministry of National Food Security & Research, regarding Import Duties as highlighted in the letter addressed to the Secretary, Ministry of

Commerce, may kindly be furnished to the Appropriate Authority to safeguard the nascent Poultry Sector in particular and national interest in general.

ISSUES OF POULTRY SECTOR RELATING TO FEDERAL BOARD OF REVENUE ISLAMABAD

Both ZEC’s were informed that Dr. Muhammad Aslam Esq, Chairamn, Pakistan Poultry Association intends to hold meeting with Chairman, Federal Board of Revenue Islamabad to resolve Taxation issues etc being faced by Stakeholders in Poultry Sector. You are requested to provide details of the issues confronting Poultry Sector duly recommended by your respective Zonal Executive Committees. Such issues may kindly be intimated to this office with in a week i-e up to 30th October 2013. This matter may kindly be assigned top priority.

1. LIFTING OF BAN ON EXPORT OF POULTRY MEAT TO SAUDI ARABIA.2. AN OVERVIEW OF PROBLEMS OF PAKISTAN POULTRY ASSOCIATION RELATED TO FEDERAL GOVERNMENT

Letters No. SO. (I&C)/L&DD/9-5-2013(PE) dated 8th November, 2013on the above cited subject (1) received from Government of Punjab, Livestock & Dairy Development Department, and Letter No. F.2-2/05-Epid dated 20th November, 2013 received from M/O National Food Security & Research (Livestock Wing) on the above subject(2) were forwarded to Vice Chairman NZ & SZ for your kind information, consideration and advice, if any

VISIT OF SAUDI ARABIA’S DELEGATION OF TECHNICAL EXPERTS TO PAKISTAN TO STUDY HEALTH AND VETERINARY CONDITIONS IN PAKISTAN

The Director General (ME), Government of Pakistan, Ministry of Foreign Affairs Islamabad vide his letter No. SAU -2/8/2013-ME-I dated 24 th October, 2013(copy enclosed) intimated that Saudi Ministry of Agriculture has suggested second half of December, 2013 as suitable date for the visit and has demanded to intimate tentative/ proposed visit schedule. Pakistan Poultry Association undertook to invite the Technical Delegation from Kingdom of Saudi Arabia to visit Poultry Companies to inspect the processing facilities and also the Companies dealing with Hatching Eggs and Day Old Chicks. Pakistan Poultry Association submited proposed Schedule of visit which was to be communicated to Kingdom of Saudi Arabia through Ministry of Foreign Affairs, Islamabad. Pakistan Poultry Association proposed 11 Poultry Companies for the visit of Saudi Technical Delegation which would facilitate visit of Poultry Companies and conduct visit of Saudi Technical Delegation through authorized representatives from each Company. Pakistan Poultry Association committed to meet expenses incurred on the visit of Saudi Technical Delegation. The Ministry of National Food Security &

Research was requested to nominate the Quarantine Officer to represent Ministry of National Food Security & Research. A copy of the Schedule of visit as proposed by Pakistan Poultry Association was enclosed for kind consideration and necessary action

VISIT OF SAUDI ARABIA’S DELEGATION OF TECHNICAL EXPERTS TO PAKISTAN TO STUDY HEALTH AND VETERINARY CONDITIONS IN PAKISTAN

Letter No. F.2-2/05-Epid dated 30th October, 2013 received from Mr. Javed Iqbal Khan, Assistant Animal Husbandry Commissioner, Government of Pakistan, Ministry of National Food Security & Research (Livestock Wing) referred. The Assistant Animal Husbandry Commissioner enclosed letter No. U.O No.SAU-2/8/2013-ME-I dated 24th October, 2013 from the Ministry of Foreign Affairs Islamabad to inform Pakistan Poultry Association that Saudi Ministry of Agriculture has suggested 2nd half of December 2013 as suitable dates for the Visit of Saudi Arabian Delegation of Technical Experts to Pakistan to study Health and Veterinary Conditions in Pakistan. The Ministry of Foreign Affairs has called upon Ministry of National Food Security & Research to convey suitable dates along with Tentative Schedule for the visit for onward transmition to Saudi Arabia. The Schedule is to comprise of 3 dates during the 2nd half of December, 2013.

VISIT OF KSA DELEGATION OF TECHNICAL EXPERTS TO PAKISTAN TO STUDY HEALTH AND VETERINARY CONDITIONS IN PAKISTAN

A revised Schedule of Visit of Kingdom of Saudi Arabia (KSA) Delegation of Technical Experts to Pakistan to study Health and Veterinary Conditions in Pakistan was submitted to MFA. The earlier proposed Schedule of Visit of KSA Delegation of Technical Experts was revised by Dr. Muhammad Aslam Esq, Central Chairman, PPA in view of relevant suitability and convenience to the KSA Delegation of Technical Experts and the Pakistan Poultry Companies. M/oNFS&R was requested to communicate the revised schedule to Ministry of Foreign Affairs, Islamabad for the information of visiting Delegation of KSA Technical Experts .The inconvenience caused in this regard is highly regretted

PROVISION OF INFORMATION UNDER COMPETITION ACT, 2010

Reference CCP letter No. 1(109) PPA/ CETA/CCP/13 dated 19th September 2013 and this office letter No. PPA/Centre/Provision of information/13-CUIN-0007217 dated 24th September, 2013 regarding the above cited subject. In the last paragraph of this office letter dated 24 th September, 2013 it was requested that Mr. Khalil A. Sattar Esq, the then Chairman Pakistan Poultry Association would

like to make a presentation before high ups of Competition Commission of Pakistan so that pricing structure of Poultry Sector is clearly understood. Further it was also requested that a copy of the concerns as mentioned in your letter dated 19/9/2013 may kindly be supplied to this office so that the issue is fully understood and addressed in the presentation.

REGISTRATION OF POULTRY COMPANIES WITH QUARANTINE OFFICER MINISTRY OF NATIONAL FOOD SECURITY AND RESEARCH, ISLAMABAD

It was advised by Animal Husbandry Commissioner (Livestock Division) Ministry of National Food Security & Research to communicate you to get your those Plant/ Farm/ Unit/ Mill etc registered with the Quarantine Department of Ministry of National Food Security & Research as it is mandatory requirement, where from products are to be exported either to Kingdom of Saudi Arabia or any other Country. The Units were requested to apply to the Animal Husbandry Commissioner for registration of their Poultry Unit giving the following information.

1. Name of the owner of the premises/ Land, if tenant, copy of Lease Agreement of the premises duly endorsed by notary public.

2. Layout Plan/ design of the Unit/ Farm/ Hatchery etc.3. Copy of CNIC of the owner/ Partners of the Company.4. Copy of Regitration of firm with Chamber of Commerce & Industry, if any.5. Copy of NTN & Sales Tax registration. No. if any.6. Copmany profile covering date of establishment, no. of employees, facilities available,

processing procedure, lay out of the unit, source of origin of raw material, product produced, total expected port folio of the business and foreign buyer’s (if any name/ address)/ country of export etc.

An early action in the matter was requested on urgent basis.The visit of the KSA Delegation would commence on29 December, 2013

1. STAKEHOLDERS WORKSHOP/ SEMINAR ON GROWTH FOCUSED SECTORS FOR EXPORT2. IMPROVING THE POULTRY EXPORTS TO US$ 2 BILLIONS IN 5 YEARS.

The Secretary to the Government of the Punjab, Livestock & Dairy Development Department, Lahore convened meeting on 04 Dec 2013 to discus Export of Poultry & Poultry Products to countries such as Muscat, Oman, Yemen, Kuwait, Bahrain, Dubai, Qatar, Afghanistan and Jordan and also issues relating to growth focused Sector for Export. The issues discussed and credible contributions made to the subject issues expressed its inability to attend the meeting of Punjab Livestock & Dairy Development Department as I had to attend personal hearing of the Director General (Regulator) Trade Organization, Government of Pakistan, Ministry of Commerce, Islamabad. Such issues may be intimated to this office with in a week i-e up to 30th October 2013. CONSTITUTION OF ADVISORY COMMITTEE BY THE LIVESTOCK AND DAIRY DEVELOPMENT DEPARTMENT, GOVERNMENT OF PUNJAB

All concerned were informed that Livestock & Dairy Development Department, Government of Punjab has constituted ADVISORY COMMITTEE comprising of retired officers of Livestock and Dairy Development Department vide letter No. SO (I&C)/ L&DD/11-5/2013 dated 22 October, 2013. The Advisory Committee will work under following Terms and conditions.

1. To advise Department on policy formulation regarding Livestock development.2. To assist Department on development of business plan/ feasibility report for Commercial

Dairy/ Poultry Farming.3. To guide the Department for increasing the productivity in Animals particularly in non

descriptive Animals. The undersigned has also been included in the Committee at Serial No. 2 of the Administrative Order.

COMPLIANCE WITH THE PROVISIONS OF THE COMPANIES ORDINANCE, 1984

Reference was made to letter No. K-0007217/Com/2012/19216(1) (2) dated 03/10/2012 regarding the above cited subject. Received from SECP The Financial Statements for the year 2009-2010 and 2010-2011 were enclosed with paid Challans and late fee Challans for kind consideration in connection with grant of Corporate Compliance Certificate which was requested to be expedited. This was in continuation of our letter No.PPA/Centre/ Form-29 and Form B/13-CUIN-0007217-1483 dated 23rd October, 2013.Consequent to efforts Corporate Compliance Certificate was issued which was submitted to DGTO.

JUDGMENT OF PESHAWAR HIGH COURT PESHAWAR DATED 29/10/2013 IN WP No. 1516-P/2012

The Honourable Chief Justice of Peshawar High Court, Peshawar in his subject Judgment directed that as the Federal Government has already imposed Ban on the Export of Cattle heads of all kinds including Dairy Products & Poultry Products to Afghanistan and when such notification is in the field, all the Provincial Authorities and Federal Government Functionaries i.e Police, Khasadar Force, Political Agents, Frontier Constabulary, Federal Force like Customs Officers of any rank & Frontier Corps etc are bound to implement the Notification of the Federal Government in its letter and spirit and to prevent the Smuggling & Export of these products to Afghanistan in view of the Notification of the Federal Government, hence, there is no need to further proceed with the matter being suo moto case and because of the Judgment of the Honourable Apex Court dated 17.09.2013 in C.P No. 1494 of 2013, the matter is closed. In the same Judgment the Chief Justice observed that the respondents-exporters shall approach the Federal Government for clarification whether the Meat of the Cattle heads i.e Beef or Mutton & Poultry Products is permitted to be Exported or not. Pakistan Poultry Association has sought clarification from the Ministry of National Food Security & Research whether any Ban has been imposed in its Notification based on decision of ECC dated 23rd July, 2013 on Export of Poultry & Poultry Products to Afghanistan or not. The clarification issued by Commissioner Animal Husbandry Ministry of National Food Security & Research dated 1st November, 2013 clearly clarified that Ban has been imposed on Commercial Export of Live Animals with effect from 1stOctober2013 .Thus as such there is no ban on export of meat (Beef or Mutton) and Poultry Products (Poultry birds, poultry meat, eggs etc). It was, therefore, emphasised to all concerned authorities that in Export of Poultry & Poultry Products to Afghanistan no restrictions be imposed rather Export of Poultry & Poultry Products to Afghanistan be facilitated in the National interest.

ELECTION RESULTS 2013-2014

The Chairman PPA was informed that Election Results for the year 2013-2014 of Pakistan Poultry Association have been communicated to all Presidents of Chambers of Commerce and Industry and the all Chairmen of Trade and Industry in Pakistan. Letters of felicitation were received from all addressees. Letter of felicitation received from the Presidents are enclosed for information.

Peshawar High Court Peshawar dated 3/6/2013 regarding the above cited subject along with Judgment of PHC dated 29.10.2013. As per Provisions of Memorandum and Articles of Association of Pakistan Poultry Association Licenced under Licence No. 132, duly approved by the Director General of Trade Organization, Ministry of Commerce, Government of Pakistan, Islamabad, Khyber Pakhtunkhwa Poultry Association is not a Chapter of Pakistan Poultry Association to represent the Poultry Sector throughout the Country. The Trade Organizations Act prohibits any group of persons to call themselves an Association for the purpose of representing a Trade Sector unless Licenced under Subsection 2(d) of Section-3 of the Trade Organization Act 2013 by the Ministry of Commerce, Government of Pakistan. Since the group of persons calling themselves Khyber Pakhtunkhwa Poultry Association without holding a Licence to call and act as such, is acting against the Law. This humble observation may kindly be placed on record.

Mr. Khalil A. Sattar Senior Vice Chairman PPA was informed that Election Results for the year 2013-2014 of Pakistan Poultry Association have been communicated to all Presidents of Chambers of Commerce and Industry and the all Chairmen of Trade and Industry in Pakistan. Letters of felicitation are being received from all addressees. Letter of felicitation received from the Presidents of The Chambers of Commerce & Industry are enclosed for his information. Mr.Raza Mahmood Khursand Vice Chairman PPA Northern Zone and Mr,Lal.Buksh Kalochi Vice Chairman PPA Southern Zone were informed that Election Results for the year 2013-2014 of Pakistan Poultry Association have been communicated to all Presidents of Chambers of Commerce and Industry and the all Chairmen of Trade and Industry in Pakistan. Letters of felicitation are being received from all addressees. Letter of felicitation received from the Presidents of The Chambers of Commerce & Industry are enclosed for information.

In the said order the matter regarding ban on the Export of Cattle Heads of all kinds including Dairy Products & Poultry Products to Afghanistan stands closed. The respondents-exporters shall approach the Federal Government for clarification whether the meat of the Cattle Heads i.e beef or mutton & Poultry Products is permitted to be Exported or not. In view of above order of Peshawar High Court, the cases filed in the Honourable Supreme Court of Pakistan may be requested to expedite hearings so as to pass judgment on our

The Commissioner AH MNFS&R was informed that the Director General (ME), Government of Pakistan, Ministry of Foreign Affairs Islamabad vide his letter No. SAU -2/8/2013-ME-I dated 24th October, 2013 has intimated that Saudi Ministry of Agriculture has suggested second half of December, 2013 as suitable date for the visit and has demanded to intimate tentative/ proposed visit schedule. Pakistan Poultry Association undertakes to invite the Technical Delegation from Kingdom of Saudi Arabia to visit Poultry Companies to inspect the processing facilities and also the Companies dealing with Hatching Eggs and Day Old Chicks. POULTRY DISEASE DIAGNOSTIC LABS OF OFFICES OF ASSISTANT PROJECT DIRECTOR POULTRY PRODUCTION IN PUNJAB

During meeting with Saudi Delegation of Technical Experts on 9 th January, 2014 at Punjab Agriculture and Meat Company, Lahore in which the undersigned pointed out to Secretary Livestock Punjab that consequent to devolution, 19 Assistant Project Director Poultry Production (APDPP) offices were attached to Extension wing of the Department .As they were providing effective Poultry Disease Diagnostic & Extension services to the Poultry Sector being part and parcel of Directorate of Poultry Research Institute, Rawalpindi, it may be mentioned here that 19 APDPP offices were originally planned and implemented by the Directorate of Poultry Research Institute, Rawalpindi.

In the light of feed back received from Poultry Sector it was stated that the APDPP offices now attached with Extension Wing of the Department are not providing useful and effective services to the Poultry Sector. Their performance has markedly deteriorated.

In the view of above, it was requested that to meet requirements of the Disease Diagnostic & Extension Services to expanding Poultry Sector, 19 APDPP offices may kindly be transferred back to Directorate of Poultry Research Institute, Rawalpindi. In Punjab most of the decisions taken under the umbrella of devolution have been reversed in the interest of efficient performance and, therefore, decision with regard to 19 APDPP offices would be in the right direction which would be highly hailed by the Poultry Sector.

APPLICATION FOR RENEWAL OF LICENCE OF PAKISTAN POULTRY ASSOCIATION.

DGTO was requested that in connection with the subject matter all discrepancies/ requirements have been met except that Corporate Compliance Certificate remains to be received from SECP. The SECP has made observation regarding shifting of Registered office from Karachi to Islamabad which is being attended to. The DGTO has been requested through our Chartered Accountant to issue the Certificate of Renewal of licence pending any other discrepancy.

CORPORATE COMPLIANCE CERTIFICATE

SECP was requested that we have cleared the discrepancies as were pointed out by Securities & Exchange Commission of Pakistan (SECP). A Corporate Compliance Certificate remains to be issued by SECP. We have requested (through PPA Southern Zone) M/s Tanzeem & Company, Chartered Accountants, Karachi to intervene in the matter and use its good offices in getting issued the Corporate Compliance Certificate so that it is submitted to DGTO for Renewal of our Licence M/s Tanzeem & Company, Chartered Accountants, Karachi have inability to address this issue which is being handled by this office.

In reference to DGTO letter No. F.No: 7(1) 2014-TO dated 3 rd March, 2014 , View point\ comments on objections raised by Livestock Exporters Association of Pakistan/ Ibrahim Shinwari Enterprises were submitted here as under.

i. Pakistan Poultry Association is a Trade Organization which is established to represent Trade, Commerce, Industry or service or any combination thereof in poultry Sector on all Pakistan basis.

ii. Livestock Exporters Association of Pakistan has also been granted Licence to represent Trade, Commerce, Industry or service or any combination thereof for Livestock Export on all Pakistan basis.

iii. Both the Associations represents specific Trades such as Pakistan Poultry Association represents Poultry Sector and Livestock Exporters Association of Pakistan (LEAP) represents Livestock Exports.

iv. In reference to LEAP letter No. 01/DGTO/14 dated n01.03.2014, it was submitted that view point of LEAP to allow multiple business to its members including Poultry is contrary to the terms and conditions of Licence so granted by DGTO.

v. The view point of LEAP that PPA is welfare Trade Organization without any profitable business activities is not correct but is contrary to the provisions of Trade Organization Act-2013. This interpretation of LEAP tantamounts to restricting activities of Pakistan Poultry Association without Lawful authority.

vi. In reference to letter No.01\Export\14\AFG dated 28.02.2014 from Ibrahim Shinwari Enterprises, Peshawar, it was submitted that Pakistan Poultry Association has not restricted 08 Poultry Companies to export their products to Afghanistan. These 08 Poultry Companies which are mentioned in PPA letter dated 23 rd October, 2008 were visited by Afghan Delegation headed by Dr. Azizullah Osmani, D.G Animal Health and Production C.V.O. (Afghanistan), Ministry of Agriculture, Irrigation & Livestock, Kabul during prevalence of Bird Flu when export to Afghanistan was banned. Eight Poultry Companies were recommended for Export by Afghan Delegation. As soon as Pakistan declared itself free from Bird Flu and notified by OIE in the end of year 2008, there was no ban on Export of Poultry and Poultry Products from all other Poultry Companies in Pakistan to Afghanistan which is in vogue up to date, and all Poultry Producing Companies of Pakistan are freely Exporting their Products to Afghanistan without any restriction.

vii. Exports of Poultry and Poultry Products to Afghanistan and other Countries are being carried out as per provisions of Pakistan Export/Import policy-2008. M\s. Aziz Sohrab Mangal (PVT) Ltd was assigned to be coordinator\ facilitator for Poultry sales in Afghanistan in view of their bonafide credentials and their efforts for restoration of Trade between Pakistan and Afghanistan.

SHIFTING OF ADMINISTRATIVE CONTROL OF POULTRY DISEASE DIAGNOSTIC LABORATORIES OF POULTRY RESEARCH INSTITUTE RAWALPINDI

kind attention of Chief Minister Punjab was drawn to the Notification No. 6-20/SO(P)/L&DD/2012 dated 24th February, 2014 issued by the Secretary to Government of Punjab, Livestock & Dairy Development Department, Lahore vide which Poultry Disease Diagnostic Laboratories of Poultry Research Institute (PRI), Rawalpindi have been placed under the Administrative Control of Directorate of Animal Disease Reporting and Surveillance attached with Directorate General (Research) L&DD Punjab. Poultry Disease Diagnostic Laboratories of PRI have been established especially for providing facilities for Poultry Disease Surveillance, Diagnostic and Treatment facilities to the Poultry Sector which is expanding at the

rate of 10 to 12% per annum with total Investment of Rs.703 Billion. The Poultry Sector has been effectively served and facilitated and benefited by the Laboratories of PRI. Further there has also been strong coordination between Poultry Sector and PRI Laboratories. Primarily PRI Poultry Disease Laboratories, Rawalpindi have been established for boosting problem oriented Research and Development to the ultimate benefit of Poultry Sector. Poultry Sector has always been appreciative of services provided by Poultry Disease Diagnostic Laboratories during Epidemics in particular and Development and Extension Services in general. On the eve of devolution, the work of Poultry field Laboratories was adversely affected for which the Admin Department in L&DD Dep’t issued Directives vide No. 1(51) S.O (B&E)/ L&DD/ 2000-II, dated 15.09.2001 and N..3-1-S.O(P) /L&DD/2002, dated 12.02.2002 to make these laboratories re-functional. The latest Notification of L&DD Department dated 24 th February, 2014 has disappointed Poultry Community and it is felt that this decision would damage expanding Poultry Sector to an irreversible adverse state. The Poultry Sector agitate against this decision which has been taken without taking Poultry Stakeholders on board. In view of above, it is strongly demanded that Poultry Sector be safeguarded and Notification under reference may kindly be withdrawn and Poultry Disease Diagnostic Laboratories be allowed to remain attached with Directorate of Poultry Research Institute, Rawalpindi in the National Interest. On 22nd March, 2014 Layer Wing of Pakistan Poultry Association arranged reception in honour of Dr. Muhammad Aslam Esq, Central Chairman, PPA at Kamalia. This reception was arranged by Mr. Khalid Saleem Malik, Convenor Standing Committee Layer Wing in collaboration with Layer Farmers of Kamalia. The reception was attended by renowned personalities and Layer Wing entrepreneurs including Ch. Asad Ur Rehman, MNA, Sardar Raheel, Dr. Arshad Hanif Esq, Rana Ghulam Mustafa, Dr. Rana Sajjad Arshad, Dr. Jamail Rajput, Ch. Muhammad Ahmed Randhawa, Ch. Shahid Gujjar, Haji Altaf Haider, Dr. Zia Ur Rehman, Dr. Hanif Nazeer Ch, Dr. Khalid Mahmood Shouq, Dr. Mustafa Kamal and other renowned personalities.

In his address Dr. Muhammad Aslam, Central Chairman, PPA informed the participants of the reception that Export of Poultry & Poultry Products to Kingdom of Saudi Arabia and other Middle East Countries has been allowed consequent to efforts made by Pakistan Poultry Association in collaboration with M/o Foreign Affairs, M/o Commerce & M/o National Food Security & Research. He emphasized that due to export of Poultry & Poultry Products to KSA & other Middle East Countries Pakistan Poultry Sector would be strengthened and boosted. He emphasized on Farmers to improve managements of their Farms to lower cost of production. He assured the Farmers that facilities for Disease Diagnostics would be provided to Poultry Farmers on priority basis. The Chairman called Kamalia as Manchester of Poultry. In his address Dr. Talat Naseer Pasha assured the Farmers that University would also establish Disease Diagnostic facilities at Kamalia for the benefit of Poultry Farmers within its means. In the end Mr. Khalid Saleem Malik being host of the reception thanked the participants.

VALUE ADDITION TO IMPROVE NATIONAL ECONOMY-CREATION OF RURAL JOBS = COMMUNICATION MADE TO M/O NFS&R & FBR FOR CONSIDERATION Value addition to agro produce could bring in multiple benefits to the National Economy but the Government decision would be the most important factor to bring about a change in the agro economy. Fiscal benefits would be the prime mover of investment in the rural agro economy for the addition.

a) Government will have to announce depreciation on Plant and Machinery in the first year of 75-100% when established in an area of agricultural production activity. For this purpose, the extended municipal boundries for the local Governments be disregarded and treated as rural as long as major activity in the area is agriculture.

b) Should be exempted from turnover Tax until the unit starts to generate income, taxable to Income Tax.

c) Plant, Machinery and implements are exempted from withholding Tax, Sales Tax and Import duties including pre-engineered Buildings. Cold storages, freezing units and all such Machinery that is required for value addition.

d) All value added produce of agriculture including Livestock, Poultry and inland fisheries be zero rated.

e) All imported inputs be free of import duties when imported as a specific bonafide requirement of recognized unit to be authenticated by the Ministry of National Food Security & Research.

The benefits of value addition to agro produce to the National economy would be: a) Will create jobs in the rural areas preventing shift of population to the urban cities.

b) The agro produce that contributed no revenue but entering into the value addition chain will become an instrument to increase the GDP of its product in the current form by at least 400-500% brining in revenue for the exchequer and additionally groom all other input sectors by way of increase in their turnover, increase in their earnings prominantly being the packing providers, advertising companies, media, retail chains, distribution Companies and all other Sectors contributing inputs for value addition.

c) The processor, in his own interest, will provide extension service to the agro producers around them to ensure both qualitative and quantitie improvements in the agriculture production activity leading to greater income for the agro producer.

d) The exemption in agriculture activity will bring additional areas under cultivation giving rise to self-employment. Job seekers would become job providers.

e) The processor, under a buy-back agreement, will provide improved seeds for the crops that would give them the highest yield and the desired quality.

f) The bank could safely and confidently finance the agriculture producer for applying improved technology and increased inputs on a guarantee from the processor who would have a buy-back agreement with the grower.

All the above activities will provide increase employment opportunities not only in the rural areas but in the urban areas as well. One could go on and on to enumerate the never-ending benefits.

NOTICE FOR SHIFTING OF TRANSFORMER AND METERING EQUIPMENTS OUT SIDE THE PREMISES. REFERENCE NO. 27 14363 1620103

The Chief Executive IESCO was informed that Transformer and Metering Equipments as referred in their letter NO.161921 dated 11th April, 2014 were installed in the inside Boundry Wall and that they are easily accessible to the Field Staff of IESCO for the purpose of Meter readings and to check Electric supply position from the Transformer. A meeting was held with Chief Executive IESCO, Islamabad on 28 th April, 2014 by the Secretary General, PPA who explained to the authorities that present location of Transformer and Metering equipments is chosen from the point of view of protecting equipments from illegal Public approaches for misuse and theft of Electricity. The Chief Executive IESCO was given assurance that Islamabad Farm Dhamial under takes to provide grantee against any difficulty for reading and also any suspicion against theft of Electricity.

REGISTRATION OF MAREK’S VACCINE SB1

In view of likely widespread incidence of Marek’s Disease in Poultry Flocks, the use of imported Marek’s Vaccine SB1 had become utmost essential. In view thereof the Secretary, M/o National Food Security & Research (MNFS&R) was approached to recommend Registration of Marek’s Vaccine SB1 to Ministry of Health so that it is imported and is used against Poultry Flocks. It is a matter of satisfaction that M/o NFS&R strongly recommended to M/o Health for Registration of Marek’s Vaccine SB1. It is learnt that subject Vaccine was considered in the Drug Registration Board and was approved for Registration. It is further pointed out that in the absence of proposed Vaccination; Poultry Flocks are at risk of contracting Marek’s Disease which will cause heavy mortality throughout Country resulting in shortage of Chicken Meat and escalation of Meat prices particularly during the month of Ramadan. The letter of approval for Registration of subject Vaccine was followed to be issued to safeguard against threats of epidemics to thePoultry Flocks. Marek’s is immuno-suppressive Disease which has the potential to create epidemiological havocs.

PERSONAL HEARING BEFORE REGULATOR OF TRADE ORGANIZATION IN CONNECTION WITH COMPLAINT FILED BY SHAHID MAHMOOD, CHIEF EXECUTIVE, OF M/S CHERRY PHARMACEUTICA INTERNATIONAL AGAINST PAKISTAN POULTRY ASSSOCIATION.

Reference letter dated 30th April, 2014 issued by the Deputy Director, DGTO received on 2nd May, 2014, thereby the respondent is directed to produce Record in respect of Election for the year 2013-2014. In this respect our preliminary objections are submitted as under for your kind consideration and decision.

1. That the Election of PPA was held on 30.9.2013.The said Election can be challenged within 30 days under Section 14(2) by submitting a Complaint by an aggrieved person. In this respect Mr. Shahid Mahmood Submitted his complaint on 06.11.2013 being a time barred Petition without any request for condonation of delay.

2. That the said aggrieved person Mr. Shahid Mahmood submitted application in response to letter dated 23.04.2014 in which he has informed that they are not willing to pursue their complaint. A photocopy of his letter was attached .According to the said request of

an aggrieved person there is no complaint against Election and no further proceedings are necessary under above referred Section.

3. The complaint of aggrieved person Mr. Shahid Mahmood filed Complaint without exhausting the remedy before Regulator as per provisions of Section 21. The present procedure for summoning the record is against the original jurisdiction of Regulator because the Regulator is Appellate Authority under Section 21, therefore, the above referred letter issued by the Deputy Director; DGTO is without Lawful Authority and Legal procedure of Law on the subject.

4. The letter dated 30.04.2014 issued by Deputy Director DGTO is without Lawful authority and legal jusdication because such powers are vested with Regulator.

5. Since we have already denied the allegations of the complainant which may be treated as part of this reply. It is also important to mention that the complainant have no proof or evidence in support of alleged allegations that is why he has withdrawn his complaint unconditionally. It is, therefore, respectfully submitted that the subject matter may be closed as withdrawn and further proceedings may be stopped.

BUDGET PROPOSALS FOR THE YEAR 2014-15

On the eve of announcement of Federal Budget for the year 2014-15. The following representation was made to Speaker National Assembly of Pakistan, Federal Minister for Finance, Minister for Ministry of National Food Security & Research and Chairman Federal Board of Revenue.

SALES TAX ON SOYBEAN MEAL.

In the Budget 2014-15, under the policy of withdrawing of SROs, Soybean Meal an item of Poultry Feed, which was included in SROs 501(I)/2013 dated 12.06.2013 has been subjected to a 5% Sales Tax and is proposed to be transferred to its appropriate schedule. It may be stated that all Poultry Feed ingredients which were free of import duty have been, in this budget, subject to 5% import duty with the exception of Soybean Meal on which not only a 5% import duty has been levied but in addition a 5% Sales Tax has also been levied.

It may be stated that originally Soybean Meal, like all other oilseed meals, was an item of Schedule-VI. Since soybean meal was not being produced in the Country and the Poultry Sector seeing the great benefits of its use worldwide had commenced import of soybean meal to reap the benefits of its quality and cost of production, which indeed was paying dividends to the Poultry Sector, this development of import of soybean meal was vehemently opposed by the bigwigs having a strong political influence in the solvent Extraction Industry.

Eventually, under tremendous pressure of the solvent Sector, soybean meal, an item of Sixth Schedule was removed by including an exception in the Sixth Schedule solely for the purpose of levying an import Duty and Sales Tax. Poultry Sector is also vehemently opposed

the levy of Import Duty and Sales Tax and was finally able to demonstrate the benefit of the use of Soybean Meal without any adverse effect on solvent Sector. The Government agreed to withdraw the import duty and Sales Tax and found it convenient to do so under SRO rather than transferring it back to Sixth Schedule.

It may be stated that since the relevant schedule of Soybean Meal, being an oilseed residue and an item of Poultry Cattle Feed, should once again be included in Serial No. 28 of the Sixth Schedule where all Poultry Feedstuffs including oilseed Meals, such as Canola Meal, Sunflower Meal, rapeseed Meal, etc. fall. It may be highlighted that all Poultry and Cattle Feedstuff including imported vitamins and amino acids are exempted from the levy of Sales Tax. The most Important Poultry Feed ingredient i.e Soybean Meal should also be exempted from the levy of Sales Tax.

It is further stressed that during the last twelve months, Indian Soybean Meal prices have increased from US$ 700/MT. since this item is not produced in the Country; we rely solely on imports and are affected by the world prices.

Dr. Muhammad Aslam Esq, Chairman, PPA in consultation with Mr. Khalil A. Sattar, Senior Vice Chairman, PPA, Mr. Daud-ur-Rasheed and Dr. Bashir Mahmood Bhatti, Secretary General, PPA prepared the following Budget Proposals for the year 2014-15 which are detailed below. Subsequently Dr. Muhammad Aslam Esq, Chairman, PPA and Mr. Khalil A. Sattar, Senior Vice Chairman, PPA held meeting with Mr. Muhammad Ishaq Dar, Minister for Finance, Revenue, Economic Affairs, Statistics and Privatization, Ministry of Finance, Government of Pakistan, Islamabad and discussed the Budget Proposals in detail explaining the impact of these Proposals on Poultry Sector in particular and National Economy in general.

i. CONTINUATION OF SALE TAX EXEMPTION ON POULTRY FEED AND ITS INGREDIENTS FALLING UNDER SERIAL NO. 28 OF THE SIXTH SCHEDULE OF THE SALES TAX ACT, 1990

Poultry Sector provides employment to over 1.5 Million people predominantly in the rural areas. Poultry Production has abridged the gap between supply and demand of Animal protein. It has kept a check on the prices of Mutton and Beef. Today, Poultry is the lowest priced Meat, which has played an important role in good security.

Poultry feed constitutes between 60 to 70% of the total cost of production of Chicken and Eggs. Poultry Feed remained exempted from Sales Tax. It was brought in the ambit of Sales Tax for a short period from 01.07.1996 to 13.09.1997. The steep rise in price of Poultry Feed due to imposition of sales Tax forced farmers to sell their products below cost of

production resultantly, more than 40% Farms had closed down. The prices of Chicken and Eggs started going up sharply.

Fortunately, the Government changed. It was the acumen of the then Prime Minister, Mian Mummad Nawaz Shariff Sahib, who after a meeting with us, ordered withdrawal of Sales Tax on Poultry Feed w.e.f. 13.09.1997.

The benefit of the exemption of Sales Tax continues to date. Poultry Production continues to expand and, today, Pakistan is the 11th largest Broiler Producer in the World, providing the lowest cost Meat in the Country.

It may be added that UK under Schedule 8 of Group 1 to the VAT Act, 1994 has zero rate Poultry Feed and Feedstuff to ensure provision of low cost Poultry Feed.

In light of the above benefits for the consumers, it was recommended that the exemption from Sales Tax on Poultry Feed and its ingredients may please be continued.

ii. CUSTOM DUTIES The Poultry Sector enjoys exemption on Poultry Machinery from the whole of customs duty under Serial No. 1(G) and on Poultry Meat processing under Serial No. 1(I) and silos under Serial No. 2 of SRO 575(I)/2006.

It has brought about modernization and expansion in poultry Sector particularly, maintaining a continuous supply irrespective of weather conditions brining about stability in supply and prices. Modernization of Poultry Meat processing has culminated into progress in Export of processed Poultry and value added Poultry Products.

It was, emphasized that the exemption from whole of customs duty as provided under SRO 575(I)/2006 may please be continued irrespective whether these items are maintained under the said SRO or moved to the appropriate tariff heading.

SRO 576(I)/2006 Poultry Feed Sector has been provided exemption from whole of custom duties on Import of Poultry Feed Ingredients under Serial 4 of the table 1 of the SRO 567(I)/2006, which has brought a very substantial improvement in the quality of Feed.

It may be stated that Poultry Feed input cost in Chicken and Eggs ranges from 60-75% as such, the cost and quality of Poultry Feed is of paramount importance to the Poultry Sector.

It was, therefore, requested that the exemption from whole of customs duty under SRO 567 (I)/2006 may please be continued irrespective whether these items are maintained under the said SRO or moved to the appropriate tariff heading.

iii. CUSTOM DUTY EXEMPTION ON LYSINE IN ALL FORMS FOR USE IN POULTRY FEED UNDER PCT HEADING 2922.4100, VIDE (S.NO.4) SRO 567(i)/2006 DATED 05.06.2006.

This was to bring notice that Poultry Feed Industry was given exemption from Import Duty on its ingredients under SRO 567 (I)/2006 at Serial 4 of table 1 and Sales Tax exemption was given under SRO 1007(I)/2005.

For the purpose of giving exemption from Sales Tax to amino acid Lysine used in Poultry Feed in SRO for Sales Tax under heading 2922.4100, the nomenclature used was Lysine Mono-Hydrochloride/ Sulphate as per historical importation.

For the purpose of Import Duty exemption, the nomenclature used was only “Lysine” though, historically, when duty was applicable lysine Mono-Hydrochloride/ Sulphate was being imported, thus, the intended benefit of the SRO was to give benefit to Import of Lysine Mono-Hydrochloride/Sulphate. The Custom Authorities are interpreting Lysine as separate amino acid and confusion has been created because of the different inscriptions in the two SROs.

Since pure Lysine is extremely hygroscopic, therefore in order to stabilize it, it is essential to produce it in the form of Lysine mono Hydrochloride or Lysine Sulphate as such it is being so produced and marketed worldwide. Beside, Poultry Industry has never used pure Lysine thus the intended exemption was to be given to a product which is being used by the Poultry Sector.

It was, therefore, requested that a directive may kindly be issued to FBR to clarify that Lysine for the purpose of Poultry Feed would mean and includes both forms of Lysine i.e Lysine Mono-Hydrochloride as well as Lysine Sulphate as also provided in the Sales Tax SRO.

RECEPTION IN HONOUR OF DR. KHALID NAEEM KHAWAJA

On 19th June, 2014 a Reception was arranged in honour of Dr. Khalid Naeem Khawaja at Best Western Hotel, Islamabad. This Reception was arranged by Dr. Muhammad Aslam, Chairman, PPA, Mr. Raza Mahmood Khursand, Chairman, PPA (NZ) and Members of Central Executive Committee on the eve of Retirement of Dr. Khalid Naeem Khawaja from Government Services on proceeding to leave preparatory to Retirement. This Reception was attended by

Members of PPA from Islamabad, Rawalpindi and Lahore. This Reception was presided over by Dr. Muhammad Sadiq. The Guest of Honours included, Chairman PARC,Dr Iftikhar Ahmad , Animal Husbandry Commissioner, Dr. Qurban Ali and Ex CAH . Dr. Usmani, Among Ex. Chairmen PPA Dr. Muhammad Sadiq, Dr. Muhammad Amjad, Qazi Muhammad Akbar, Mr. Khalid Saleem Malik and Mr. Raza Mahmood Khursand.also attended. All participants’ appreciated services of Dr. Khalid Naeem Khawaja for his untiring services for the cause of Poultry Sector in the area of Poultry Health. Dr. Khawaja would start his own Laboratory in private sector. Dr. Khawaja was assured by PPA speakers unanimously of full support in connection with his Lab Diagnostic Operations. Dr. Khawaja in turn assured PPA of his fullest support and assistance in Poultry Disease Diagnostic work.

HARASSMENT AND USE OF COERCIVE MEASURES AGAINST POULTRY PRODUCT DEALERS

It was with serious concern that we brought to kind notice of the Commissioner KPK the fact that it has become a regular practice of the local administration/ police in Peshawar to intercept vehicles of dealers/wholesalers carrying frozen poultry by-parts such as Chicken Liver, Gizzard, Heart, Soup bones, Wings and Wing Tips, etc. Proceedings are initiated initially by claiming that the products have been taken from dead chicken, even though these products are in the branded packs of renowned producers like Menu and K&N’s, the evidence of which in the form of invoices is carried by them. Pressure is exerted on the dealers that the stock would be destroyed or fine would be levied and then regular practice of bargaining commences. Finally, the product is released against heavy fines.

A recent incident is that of July 4 th when at around 11:30 p.m., a team of administrative staff raided the premises of a Cold Store of dealer Zakir in the limits of Chamani Police Station and took away a reefer container loaded with approximately 25 tons of frozen by-parts such as above, purchased on July 03rd from the Processing Plant of K&N’s and Menu at Lahore by six different dealers, which was to be unloaded in their cold store in the morning.

The raiding staff claimed that the parts were from dead chicken. The container was taken to Chamani Police Station and four employees of the dealers were locked up in the Police Station. The next morning Samaa and GEO TV channel, who had accompanied the raiding staff, aired the raid proceedings depicting the achievement of the administration staff.

In the morning of July 05 th, the usual proceedings were initiated by asserting that the products would be destroyed and the owners jailed. Subsequently, negotiation for fine commenced and finally a fine of Rs 100,000 was levied through three different receipts issued in names different than any of the owners of the goods, received in cash by the Police Station before releasing the container and the personnel. A meeting was held with the Commissioner KPK on 16 July and discussed the issue. He assured action against defaulters and assured to take steps to prevent similar action in future.

1. VERBAL ORDERS OF ASSISTANT COMMISSIONER

On Sunday, July 13, 2014, Assistant Commissioner, Mr. Mumtaz Khan visited one of our member, K&N’s Foods (Pvt) Limited’s company outlet at Main GT Road, Opposite Jinnah Park, Peshawar. This outlet sells by-parts of chicken, which are frozen and packed in K&N’s branded packaging. The Assistant Commissioner issued verbal orders directing the staff to stop sale of Soup Bones. We would like to state that Soup Bones, which also have some meat on them, are a valuable, very inexpensive source of protein for the lower income group. They are being sold throughout the country. No provincial food authority or local administration has stopped their sale. We are surprised at such an order particularly in light of the fact that even in Peshawar, every chicken shop has been selling Soup Bones since many years. The setting up of the company outlet does provide competition to traders who were earlier making huge profits. Implementation of such orders would once again make sale of Soup Bones and other by-parts, available in the far flung areas of Peshawar and adjoining areas out of Peshawar administrative boundary, at higher prices to the disadvantage of the consumers. A meeting was held with Commissioner; KPK to discus above issues, the meeting was participated by Mr. Khalil A. Sattar and Dr. Bashir Mahmood Bhatti, Secretary General, PPA. After listening to the details, the Commissioner, KPK, Peshawar assured that such incidences will not take place in future.

CONTROL OF PRICES OF CHICKEN AND EGGS DURING THE MONTH OF RAMADAN IN JULY-2014

All Commissioners in the Province of Punjab fixed rate of Chicken and Eggs and this Policy was notified through Orders by the DCOs in the Province of Punjab. The rates of Chicken was fixed as Rs.125/- per Kg and Eggs as Rs.70/- per Dozen. This fixation of rates of Poultry Products caused lot of harassment and resentment because the fixed rates were even below the cost of Production. Dr. Muhammad Aslam, Chairman, Pakistan Poultry Association along with Mr. Raza Mahmood Khursand, Chairman, Pakistan Poultry Association (Northern Zone) and Dr. Muhammad Arshad, Chief Executive, Hi-Tech Feeds held meetings with Chief Secretary, Punjab and explained to him the cost of Production and reaction of poultry Farmers as it adversely affected their business. Consequent to meetings of Dr. Muhammad Aslam, Chairman, PPA, all Notifications were withdrawn on the same day. This action on the part of Dr. Muhammad Aslam, Chairman, PPA was highly appreciated by the Poultry Farming Community as it was in the overall interest of Poultry Sector. Further to this action on the part of Government, Dr. Muhammad Aslam, Chairman, PPA thanked Chief Secretary, Punjab for his timely rational action for benefit of Poultry Sector.
