PSIFF OPENING NIGHT Story and Photos by Pat Krause

The opening-night film for the Palm Springs International Film Festival was held on Friday night at the Palm Springs High School Auditorium to a sold-out audience. The film was the newly acclaimed film Selma that depicts the struggle within the Black community in their struggle to get the right to vote that was led by Martin Luther King Jr. The film shows the cruelty forced upon the Black people at that time in Alabama under the rule of George Wallace and the prejudice during that time.

It showed the life of Martin Luther King Jr. and his attempts at peaceful demonstrations. The State and the President were against the marches in a destructive way in beatings and other cruelties. They got the white community to back them up in this struggle and finally

got the President to force Alabama to give them the right to vote. It is a very powerful and emotional film. I saw a few hankies come out to wipe away tears from audience members. Actors David Oyelowo and Common were present along with the Director ava DuVernay. Exceptional Acting in the film by David Oyelowo and Oprah Winfrey to name a few.

The opening night is always very special as there is a great after party that was held at the Palm Springs Art Museum with free valet, delicious foods and Desserts and free drinks. Each attending audience member got into the party with their ticket stub, and the Museum was filled with the film goers. Guests got to mingle with the actors from the film. No wonder the opening-night film is always a sold out way in advance

THE PSIFF AFTER PARTY Story and Photos by Pat Krause

There are a lot of after parties that go along with the PSIFF each night. The Gala after party is held at the Parker Hotel in Palm Springs. There was another after party at Gallery 446 on Indian Canyon Dr. in Palm Springs that showed photography by 5 very special artists that was also held after the Gala.

Five renowned photographers, Patrick McMullan, Rob Lebow, Lani Garfield, David Crotty and Dimitri Halkidis, show iconic images in photography that spanned over three decades. This unique photographic exhibition will run from January 3rd to February 1st. The photographs show the creative abilities of each of the five photographers with their own special talents. Short Sale, Reversing Director’s Discipline

By Kelly G. Richardson, Esq. CCALDear Kelly:

As the financial officer of my homeowners association, I am concerned about how we can collect our back dues when the owner goes into foreclosure. Do we get our back dues if they complete a short sale? If a member files for bankruptcy how does this affect their delinquent dues? Should we place a lien on these units? We have four members who recently stopped paying.

Sincerely, V.B., La Habra

Dear V.B.:A short sale is a transaction

in which the parties with liens against the property all allow the owner to sell for less than the total of those liens. If the association does not participate in the short sale, and the short sale proceeds, the lien is not disturbed and the association could proceed with enforcing the lien against the new owner. However, if the short sale fails, a foreclosure will wipe out the association lien. If the association participates in the short sale and accepts a discounted amount (presumably the same discount as the other claimants), the

association normally would be required in the agreement to accept that as payment in full.

If a delinquent member files bankruptcy, the association cannot proceed with a foreclosure sale or lawsuit. However, the ongoing assessments must be paid by the Trustee as an expense of the bankruptcy. An association definitely should contact its lawyer before taking any action regarding such a delinquency.

Thanks, Kelly

Dear Kelly:I was on our board, and

one director was taken to task in Executive session for several inappropriate things he did during the prior year. The remaining directors discussed the issues and reprimanded him verbally, with no punishment. This was detailed in the Executive Minutes, available only to the board. Since that time, two directors have left the board, but the reprimanded director remains.

The sanctioned director

is now pushing to change the minutes, and wants all mention of the reprimand removed.

Is it legal for minutes to be changed by a new board for the above reason?

Thank you, W.R., San Diego

Dear W.R.:A director cannot vote on

their own discipline, past or present, under Civil Code 5350(b)(1). Civil Code 5350, new in 2014, is a small but important step for associations in California. It provides a list of prohibited items of conflict of interest. Under 5350, directors cannot vote on discipline, delinquency, reimbursement or architectural alterations involving themselves.

There are many other situations in which a director could be in conflict, and any time a director has a conflict it should be disclosed to the board before the director leaves the room. It is unfair to stay while the rest of the board discusses the director’s issue, let alone try to participate in discussion before the vote.

So, if the board discusses reversing the past discipline, the subject director should not be present.

However, changing the past minutes would be questionable, if not improper. Reversing the past discipline is one thing, but changing the record of the past corporate actions is a different matter. The director should not push his board colleagues to rewrite history. While closed session minutes do not circulate among the membership, a board should act as properly in private as it does in public.

Thanks for your question, Kelly

By Janice GoughFixed indexed annuities will

continue to be a “bright spot” for the annuity market in 2015,

and the industry can expect a “continued shift” of annuity purchases in the New Year toward principal-protected and income-producing products, as baby boomers confront their retirement realities. As an attractive alternative to certificates of deposit in a low interest rate environment, fixed indexed annuities offer a better retirement savings accumulation vehicle by offering a principal guarantee and growth potential. They are among the safest and best choices for funding retirement. Fixed indexed annuities can provide retirees with one of the most reliable and efficient sources of retirement income.

Savvy savers have long understood the merits of indexed annuities, but now a broader cross-section of the investing public has entered the marketplace in droves. With the economy still on shaky

ground, many near retirees worry they’ll be working much longer than anticipated. Fixed indexed annuities are a virtually recession-proof bulwark against those kinds of concerns.

Several key advantages of fixed indexed annuities: They offer a guaranteed minimum surrender value for the duration of the contract term, and interest earnings during the accumulation phase are tax deferred until the owner begins making withdrawals.

While some financial planners might advise against indexed annuities before the age of 40, it’s never too early to consider an alternative to the conventional wisdom of retirement planning.

Provided that one can avoid depositing funds that might be needed for living expenses or emergencies, there’s no reason not to purchase a fixed indexed annuity at the start of

one’s career in contrast to the middle or the end. A distinct advantage of buying early is that compounding over longer-term results in larger payments during retirement.

Income planning advice and guaranteed retirement income solutions tailored to meet consumers’ demand will be of utmost importance in the New Year, as Americans become more aware of their retirement income needs. The industry is presented with the tremendous marketplace opportunity to innovate and develop new products to match the increasing demand for insured retirement products.

Indeed, 2013 and 2014 were not “significant” growth years for the industry as a whole, with sales beginning to shift away from variable annuities and toward fixed products, with fixed indexed annuities and immediate and deferred income annuities

showing especially strong growth.

Fixed annuity sales were up 25.6% as of the third quarter year-to-date in 2014 versus the prior year-to-date period, while variable annuity sales have remained relatively flat, slipping about 2.5% in the third quarter year-to-date.

SACRAMENTO, Calif. (AP) - As he was sworn in for a record fourth term, Gov. Jerry Brown charted an ambitious new goal on Monday for California in its fight against climate change, challenging the nation’s most populous state to increase renewable energy use to 50 percent in the next 15 years.

Brown, a Democrat, specifically called for the state to increase renewable electricity sources, reduce petroleum use in vehicles, double the energy efficiency of existing buildings and make heating fuels cleaner

by 2030.California already is known

as a leader in far-reaching environmental laws, but Brown said existing efforts were not enough.

The current state goal calls for 33 percent of energy use to come from renewable sources by 2020. As of last year, nearly 25 percent of California’s retail electricity came from renewable energy, not including large dams, the state energy commission said.

“We must demonstrate that reducing carbon is compatible with an abundant economy and human well-being,” Brown said

during his inauguration speech. “So far, we have been able to do that.”

Former Democratic Gov. Gray Davis, who attended the ceremony, called Brown a visionary who knows how to balance the books. He praised the environmental goals and said Brown likely based the targets on achievable science.

“Even if the rhetoric is slightly ahead of reality, he’s always believed that our reach should exceed our grasp,” Davis said.

Some environmental groups urged Brown to go further and ban fracking in California. They argue that tapping the state’s oil reserve will greatly add to carbon pollution.

“The oil and gas boom threatens to undercut all the other progress that our state may make on climate change,” said Kassie Siegel, a senior counsel on climate issues for the Center for Environmental Diversity, an environmental nonprofit.

A state oil-industry group, Western States Petroleum Association, said it was reviewing the governor’s targets.

At 76, Brown is the state’s longest-serving and the nation’s oldest governor. He served from 1975 to 1983 before term limits were implemented and returned for his third term in 2011. He defeated Republican challenger Neel Kashkari in a landslide re-election victory in November.

Since his return as governor, Brown has been credited with helping stabilize state finances.

Cal i fornia’s general- fund spending has grown 25 percent in the past four years, fueled by a statewide economic recovery and the passage of a temporary tax increase.

Brown told the audience at his inauguration in the Assembly chamber that California is at a crossroads for keeping its future golden. He explained that he wants to reduce methane, black carbon and other pollutants as well as manage farms, forests and wetlands to absorb more carbon dioxide.

“All of this is a very tall order,” he said. “It means that we continue to transform our electrical grid, our transportation system and even our communities.”

Brown recalled his father’s first inauguration in 1959 and said many issues that then-Gov. Pat Brown raised haven’t gone away, including discrimination; quality of education and the challenge of recruiting and training teachers; and a realistic water program.

He called for state employees to help start prefunding retiree health obligations. He also urged Republicans and Democrats to tackle the state’s infrastructure needs and implement education, health care and public safety reforms.

Brown’s wife, Anne Gust Brown, introduced her husband at the inauguration, saying his expansive mind and committed heart make him an ideal leader. The governor was sworn in on the same Bible used during their

wedding.“He’s someone that we

know will enthusiastically and creatively forge a new and bold future for us,” she said. “And yet, he will do so grounded enough in wisdom of the past that we won’t drive off a cliff.”

After the ceremony, the two shared a plate of hot dogs at a celebration hosted by labor outside the building.

Brown spoke of the state’s need to address long-term water issues and endorsed one of his showcase proposals, a plan to run two giant tunnels under central California’s San Joaquin Delta to ferry water south to densely populated cities such as Los Angeles.

Assembly Minority Leader Kristin Olsen, R-Modesto, said she was disappointed that Brown had not yet put forward a plan to spur economic growth or to ensure schools are preparing students for a 21st century economy.

Assembly Speaker Toni Atkins said majority Democrats would like to see Brown add funding for social services, a comment that appeared to set up budget friction with members of his own party. Brown indicated he will continue to focus on debt service and saving for a rainy day.

“Not all Californians have come back from the recession,” Atkins said after Brown’s speech.

KMIR News StaffRIVERSIDE COUNTY -

Industry fears of a 10-cent increase in gasoline prices due to a new California carbon

tax seem to have fallen by the wayside, as the retail price in the Inland Empire today was $2.633, up 1.5 cents from yesterday but still 2.2 cents

lower than a week ago.The increase is the second

in a row following a streak of 31 consecutive daily decreases and 88 of the previous 90 days that dropped the average price in Riverside and San Bernardino counties to its lowest amount since May 22, 2009.

The increases come in connection with Thursday’s start of gasoline being covered under California’s Cap-and-Trade Program, which encourages fuel suppliers to reduce greenhouse gas emissions by

taxing the production of fossil fuels. The complicated tax gives incentives for petroleum suppliers to use low-carbon fuel stocks, and requires them to buy pollution permits for the greenhouse gases generated by the fuel they deliver.

Despi te the recent increases, the average price was 40.8 cents lower than one month ago and $1.044 below what it was one year ago, according to figures from the AAA and Oil Price Information Service.

The Cap-and-Trade Program is among the provisions of the Global Warming Solutions Act of 2006, approved by the Legislature and signed into law by then-Gov. Arnold Schwarzenegger.

Industry lobbyists had pressed hard to kill the greenhouse gas fee before it began, calling it a hidden tax that would hurt lowest-paid

Californians particularly hard. Source KMIR

Drunk Driving Arrests Hit 3-Year-High Over New Years

By ANICK JESDANUNAP Technology Writer

LAS VEGAS (AP) - One of the biggest changes in television this year will be more channels available online with no separate cable or satellite subscription. But for would-be cord-cutters, watching live sports online has been elusive - until now. Dish Network Corp. on Monday unveiled an Internet-only subscription offering that includes ESPN.

Here are the television-related highlights from the International CES gadget show in Las Vegas on Monday. The four-day show formally opens Tuesday.

LIVE SPORTS - NO CABLE OR SATELLITE BILL

Dish will offer a package of channels, including ESPN and CNN, starting at $20 a month. The availability of ESPN as part of the Internet package addresses a major reason people were loath to “cut the cord” - live sports. NFL games will be blocked on mobile devices, however, because Verizon has those rights.

Dish said it isn’t worried that its current subscribers will cancel satellite service in favor of the cheaper Internet package. Rather, Dish is hoping to lure those who don’t pay for TV channels at all because they find it too expensive.

“A lot of big incumbents don’t like change, but everything else is changing around you,” says Joe Clayton, Dish’s CEO. “Technology is broadening the consumer viewing opportunity,

and they are taking advantage of that.”

Sony Corp. also has an Internet television service, PlayStation Vue, expected to debut by the end of March, with channels from Viacom, Discovery, CBS, Fox, NBCUniversal and Scripps. HBO and Showtime already have announced plans for stand-alone Internet offerings, and CBS launched one in October. Those are limited in live sports, though, given that ESPN has rights to many of the leading leagues.

The Dish offering, dubbed Sling TV, will launch in a few weeks and also include channels from Disney, Scripps and Time Warner’s Turner. About 20 channels will be available, such as the Disney Channel, ABC Family, the Food Network, HGTV, the Travel Channel, TNT, TBS and the Cartoon Network. Sling TV is not to be confused with the SlingTV device that allows viewers to watch TV remotely. Sling Media, the maker of that device, is owned by EchoStar Corp., which was spun off from Dish in 2008.

The $20 price for Dish’s basic package will be far cheaper than what people would pay for a cable or satellite. (Dish said its average monthly bill is about $85.) Dish says it keeps the Internet service cheap by excluding most over-the-air network channels, which can be costly for pay-TV providers as broadcasters demand higher fees. An Internet service also won’t require special equipment, such as a satellite and receiver

dishes. For those who want more than the basic channels, Dish will offer various add-ons for $5 each, including extra channels for sports and a package for kids.

The catch: Only one person can watch at a time. Family members who want to watch different channels simultaneously will need separate subscriptions.

Meanwhile, Dish is adding Netflix and other video apps to its Hopper set-top boxes, so viewers can watch both traditional channels and online video services through the same device. And anticipating that more Internet video will be shot with an increased resolution known as 4K, Dish is adding 4K capabilities to its Joey devices for multi-room viewing.

NOW, WHAT TO WATCH IT ON?

- SHARPER THAN 4KAlso known as Ultra HD, 4K

offers four times the sharpness of today’s high-definition video. (Not that a lot of content is shot in 4K just yet). Now that 4K TV sets have dropped in price, with some models available for less than $1,000, TV makers are looking for ways to make their sets stand out.

Sharp is turning to an engineering trick to make its high-end 4K set look even sharper. While TVs typically show colors by mixing red, green and blue subpixels, Sharp’s top-of-the-line model will add yellow as a fourth subpixel to improve colors. It then splits each of those subpixels in half, creating a total of eight

subpixels in the space of three.Content isn’t yet available

to take advantage of those extra subpixels, but Sharp uses some mathematical formulas to fill in the blanks. The Aquos Beyond 4K Ultra HD TV will measure about 80 inches diagonally. It will be out in the second half of the year. The price hasn’t been set.

Sony is also introducing new 4K television models this year, and at a news event late Monday, the company promised to create more 4K content to watch on those sets. Sony said four popular shows from its entertainment division - “The Goldbergs,” ‘’The Blacklist,” ‘’Masters of Sex” and “The Night Shift” - will soon be available in 4K. It also said it’s working with partners including Netflix and YouTube to deliver more 4K streaming video.

- BETTER COLORSSamsung is offering a

premium line with better brightness and richer colors, not just increased sharpness. It uses a technology called quantum dot - essentially a layer of materials that allows for purer colors and a wider color range. Samsung says the TV is also brighter because there’s no need for a filter to compensate for color distortion. It will be called SUHD and cost more than regular 4K sets, though specifics haven’t been announced.

Stephen Nakamura, a digital colorist who has worked on Hollywood productions such as “Quantum of Solace” and “The Hurt Locker,” came on stage at

CES to praise Samsung’s new TVs for reproducing colors the way filmmakers intended.

Samsung is also pushing curved TVs, including one high-end model that has a flat screen that can bend, or curve, when the viewer wants a more immersive experience. LG announced quantum-dot and curved sets, too, including a bendable model. LG is also pushing organic LED screens with richer colors and pure black - the kind typically limited to smaller displays such as phones because of price.

Beyond improving picture quality, TV makers are enabling Internet video access right from the set.

STREAMING MEETS DVRTo address the growing

availability of online video, TiVo’s digital video recorders will offer new menu options to bring Internet and traditional TV programs in one place, so past seasons of ongoing shows are easier to find on Netflix or Amazon. Streaming through TiVo was already possible, but shows weren’t as centrally located.

The SlingTV device for viewing television on the go is adding additional functionality for in-home use: a YouTube app for streaming video on regular TV sets without needing a separate streaming device. It won’t have an app for the Dish’s new Sling TV service, though.

California Highway Patrol officers in Indio arrested 28 people for driving under the influence of alcohol or drugs during its beefed-up enforcement period, the highest number during the New Year’s holiday in three years, according to numbers released today.

The office put 18 extra officers on patrol during its maximum enforcement period, starting at 6 p.m. Wednesday and ending at 11:59 p.m. Sunday, CHP Officer Mike Radford said.

The additional officers focused on DUI enforcement during the period in which 12 accidents occurred.

Best and Worst Cities for Singles

In the next three weeks issues with groups, friends, hopes, wishes, dreams all blend your professional and spiritual life with the future. Everything concerning these realms, if incomplete and unforgiven, will re-appear seeking explanations, forgiveness, re-assessments, review. You will feel like you’re on a precipice. Maintain poise like the mountain goat. But really like the unicorn.

There’s a quiet stillness you possess which often translates into reticence (not speaking much). This is good. However, sometimes the time comes when you must share the information your illumined mind has received. Soon it will be one of those times. If you are Mercury retro (at birth), now’s the time. If not, then next week. You above all understand life’s earthly rhythms (music too).

Your eagerness to understand the present time and to have knowledge that can impart information to others is dependent upon you studying the correct materials. Much new age information is not only incorrect but judgmental. A new level of discrimination begins to appear in your mind. This is most important for you must put all the

puzzle pieces together now and act on them.

You will move into deeper thoughts and contemplation. You will perhaps think about your own and loved ones’ deaths. It’s important to understand death is actually liberation and the “Great Adventure.” When loved ones have died we recite Ohm Mani Padme Hum (mantram). This directs them (and ourselves) to the “Love underlying all events in our worlds” here and hereafter.

You review relationships, their importance and meaning. Do you need to consult someone about a situation, a need, repair, or for assistance? Another’s responses to your ideas, thoughts and problems offer you perspective, clarity and clarification. Should there be difficulties in any area of your life an inner review and reassessment over the next month lead to greater understanding of reasons and intentions.

The combined themes of health and daily life’s work continue in coming weeks. Your excellent attention to detail will be called in to plan carefully in these two areas of life so that the outcomes

have your signature on them and so you feel a greater sense of purpose. You know that it’s only you who can accomplish what’s needed properly. This isn’t a compliment. It’s a Virgo reality.

A mental withdrawal occurs in the next weeks so you can ponder upon choices made within and concerning family. Soon it will be a time of deep reflection, evaluating emotional needs of self and others. You will both focus on the past as it affects your present/future. Separations created outwardly create inner separations. Communication with family is important. Cultivate Love.

You want to communicate with others. Your activated intelligence wonders about many things especially future companionship and. It’s not time to externalize your thoughts and ideas yet, except in writing. Let them work themselves out naturally. Allow yourself to consider all possibilities, reaching no conclusions. Listen to others. They have the other half of the information you hold.

You’re internally working how you value yourself. Perhaps you

define your resources and values based others. We need others to reflect our goodness. That’s how we learn. You may have to explain yourself to another so they understand you better. It may be that some financial and/or business affairs need tending. Future life’s planning is occurring quietly within. Patience.

You’re experiencing multiple thoughts at once, jumping here, there and everywhere. Others may be confused by this seeing you as constantly changing. Your thoughts influence others. Explain you’re redefining yourself. Relax in the coming weeks doing what is most creative. Our thoughts create template for the future that later appear in form and matter. What in your future is most important?

You’re examining yourself, ideas, intentions and present state of being, reviewing past year accomplishments. You realize what more you want to accomplish. In coming weeks wherein you reflect on your life, write down all that you hope to fulfill in the New Year. This anchors your thoughts and ideas. There’s much to do this year for Aquarians. They are to initiate the love central to the new culture and civilization.

We find you quietly in solitude for the next several weeks, withdrawing to study and think on the future. You’re encountering many non-rational elements reflecting the changing times. Peace and quiet are beneficial for you. Hidden areas of your character, goals, hopes, wishes and dreams are revealed. You may be thinking about death and mortality. It is a good time to write down how you want your death handled. It’s practical and spiritual.

Gold Mines and Golden Apple Pies In Julian

By Pam Price The two-hour drive between

Palm Springs and Julian is a golden opportunity for a day trippers. It all starts at the Eagle Mining Company tucked away at 2320 C Street, up to a winding road. It was 1870 when the Eagle and High Peak Mines attracted prospectors to this Mountain Village. Today the site has been preserved and welcomes guests for a fascinating tour through 1,000 feet of underground hard rock tunnels, well lit and expertly narrated by a guide, with tales to tell. The three Nelson brothers operate the mine now and are on hand to answer questions from visitors. Rusting antique cars and trucks reveal the past while picnic

tables welcome guests. Gold-bearing quartz veins

remind visitors that gold dust can still be panned (but left for others to discover), and that it was the lure of gold that preceded the treasure to follow, apple pies!

Yes, at 4,226 ft., the town of Julian (population 1, 502) has more apple trees than people it seems, once you stroll down Main Street, and follow the delicious aroma of apple pies, with crusts flaky and crumbly, some mixed with peaches and cherries, others with pumpkin and berries ready to be warmed and slices.

Whether you stop for a slice at the Apple Alley Bakery, Mom’s Pies, the Julian Pie Company

or the Julian Cafe, you’re sure to become a fan and return for more.

It’s a taste of vintage memories for many, and if you want to stay longer there are several comfortable bed and breakfast inns where you will find hospitable accommodations, such as the Julian Country Inn, Julian Pines Country Cottage, and The Two Sisters’ Cottage where dogs are welcome. Wikiup Bed & Breakfast Inn is AAA Three Diamonds rated with feather beds, fireplaces and luxurious guestrooms with spa tubs.

Quilt fans will find Julian’s new Backcountry Quilt Trail fascinating. This is a driving route where properties have

decorated their barns, residences and outbuildings with vibrant painted wooded quilt squares-all viewable from the road. This is the first in Southern California and has the distinction of being third in the state reports the Julian Woman’s Club.

There’s more to discover in Julian than apple pie; take time to enjoy this historic community, which, like an apple, ripens with time.

LOS ANGELES (AP) - “American Idol” is practicing addition and subtraction in its 14th season.

Longtime judge, short-time mentor Randy Jackson is gone.

Music executive Scott Borchetta, whose impressive credentials include acting as mentor to Taylor Swift, will play that role for contestants and the winner will be signed to Borchetta’s Big Machine Records.

There’s another shake up

ahead for the series, which returns with an hour-long episode Wednesday (8 p.m. EST) and a two-hour episode Thursday (8 p.m. EST): Starting with the live shows in mid-March, “American Idol” will cut back to a two-hour show once a week, on

Wednesday. It’s a logical move given the

aging show’s ratings decline in an increasingly competitive entertainment landscape, said analyst Brad Adgate of Horizon Media. “American Idol” dipped last season to an all-time low weekly average of 10.2 million viewers, according to Nielsen company figures.

That’s about a third of the 30.2 million the singing contest hit at its peak in 2006, when Taylor Hicks claimed the title over runner-up Katharine McPhee. But “Idol” remains a relatively strong performer for Fox, one the network seeks to protect, Adgate said.

“Whatever audience erosion will happen this year will be mitigated by limiting the show to one night,” he said.

It’s only fair to viewers to reduce the demand on their time, said executive producer Trish Kinane, given that the once-unique “American Idol” is now part of a flood of talent shows, including NBC’s popular “The Voice.”

“To commit to three hours a week for our or any other of the shows is too much, even if you adore these (talent) shows,” she said.

The compressed schedule will allow for a better program, one that combines performances with the results of viewer voting for the previous week’s competition, Kinane said.

All the contestants will be on hand for the live episodes, “dressed, ready and with their songs rehearsed,” only to find out who is being eliminated, according to Kinane. The results won’t be announced at the

beginning of the show, but in a “more dramatic way,” she said, holding details back for now.

The show will retain a familiar look. Ryan Seacrest, the sole original cast member, is returning as host, and Harry Connick Jr., Jennifer Lopez and Keith Urban will be back for their second year together as judges.

All that’s needed now is the kind of compelling contestants and future stars that “American Idol” has discovered in the past, including Kelly Clarkson, Carrie Underwood and Jennifer Hudson.

“If I have a criticism of the show for us last year, it is that we haven’t found, in the last two years, a group of kids who have captured the imagination of the public,” Peter Rice, chairman and CEO of Fox Networks Group, told a news conference after the 2014 season’s conclusion.

That bar will be met, Kinane said, with outstanding performers discovered in auditions held in Nashville, Tennessee; New Orleans; San Francisco; and elsewhere. She offered hints about one contestant, whom she described “as a girl who had never sung in public before the first audition” but ended up in the top 24.

“She’s really good, but whether she’ll win or not is unsure because she’s quite raw. Can her raw talent develop through the process” is the question, Kinane said.

As is the performance of “American Idol” itself.

The Hollywood musical, once a staple on the silver screen, has been absent for quite a while, replaced by Marvel-ous movie scenarios and comic book heroes and villains. But on Christmas day things changed with the release of the sumptuous Disney musical “Into the Woods,” based on the enduring and endearing Broadway hit by composer Stephen Sondhein and librettist James Lapine.

The film, directed by “Chicago’s” Rob Marshall, stars Meryl Streep as the Witch, British actor James Corden as the Baker, Emily Blunt as the Baker’s Wife and Johnny Depp as the big, bad Wolf. And, like “Chicago,” this new movie musical could be destined for Oscar’s gold.

Speaking of gold, there’s plenty of on screen gold—like the large golden eggs laid by the Giant’s very special hen and a beautiful golden harp owned by Mr. and Mrs. Giant who live atop the beanstalk that Jack accidentally planted. Ah, but that’s just one of the many mingled stories that take place in this little kingdom.

If you aren’t familiar with the storyline for this Sondheim fairytale, it’s about what happens after the “happily ever after” part, when real-life sets in and the prince turns out to be not quite so charming after all.

Things start out on a happy note as we meet the various fairytale folks who inhabit a kingdom near the woods. First, there is the Baker and his wife who wants to start a family, but

the witch who lives next door has put a curse on them. She will remove the spell if they promise to go to the woods in search of four very particular items. Once they have found all four they are to bring them back to the witch, and all will be well—and with those instructions, the Baker goes in the woods, leaving his wife behind.

Little Red Riding is already out there, heading to Grandma’s house. On her way, she meets the Wolf who is wolf-like in more ways than one. Depp not only alludes to eating her up, and Grandma too, he also comes across as a lecherous chap in wolf’s clothing who is charming, devious and definitely not to be trusted. They are destined to meet again.

Director Marshall has done a great job of using actors who can also sing their own songs, and the songs move the story along beautifully without ever feeling forced or out of place. They flow together and seamlessly intertwine with the spoken words. One of my favorite songs is “Agony,” sung by the two handsome princes who can’t understand why their lives have hit a big snag in the romance department. Chris Pine plays the totally charming prince who is sure he is in love with Cinderella. Unfortunately for him, she has run away, leaving only one golden slipper behind. (Here comes movie gold again—her shoes are golden, not glass.) The other prince laments the fact that his true love, Rapunzel, is equally hard to get. To be with her, he must climb her long, long

hair which is really hard on both of them. It’s actually “Agony” times two.

Another song, tinged with melancholy, is “Stay With Me,” sung by Streep as the Witch who tells her daughter that because she loves her so much she has kept her locked away in the tower to protect her from the dangers of the world. My dear editor friend Kathleen said she lost it when the song was being sung because her daughter had just moved to an apartment near her new job. Luckily Kathleen, unlike the Witch, knew how to let go.

In a recent interview, Sondheim said the musical is based upon two things. “One is about the relationship between parents and children. And

the other is about community responsibility.” It’s a blend that presents the fairytale characters with tough choices as they try to find their way in and out of the woods. “Into The Woods” is rated PG-13.

••••••••••••••“Into the Woods” trivia. Here

are a few fun facts from a recent LA Times feature by Rebecca Keegan. Before Rob Marshall, another Marshall had considered directing the film version of the popular Broadway show—and that Marshall was Garry Marshall’s sister, Penny. The cast she in mind included Robin Williams as the Baker, Goldie Hawn as the Baker’s wife, Cher as the Witch, Steve Martin as the Wolf and Roseanne Barr as Jack’s mother.

Fun fact number two. Years earlier, Bernadette Peters played the Witch on Broadway. Now Meryl Streep has stepped into the role of the Witch in the Disney film version. According to Sondheim, a wizard with words and music, it was “ordained because the lady, who’s played the Witch on stage and the lady, who’s playing the Witch in the movie, their last names are anagrams of each other” (Streep/ Peters). Wow! Not only can Sondheim compose and write lyrics, he must also be a wiz at word puzzles and Scrabble.

Happy New Year to all of my readers and thanks to Stephen Sondheim, Rob Marshall and Disney for creating such a masterful movie musical.

MUS I C BY ROBERT KINSLER

Music fans looking forward to getting a closer look at Billy Idol, AC/DC and a slew of progressive rock heroes should check out brand new titles on shelves now.

Title: Dancing With Myself Author: Billy Idol Publisher: Touchstone

Tell me more: In his new tell-all, first-person account of his life and career, rocker Billy Idol pulls no punches. An autobiography with bite, Idol’s Dancing With Myself weaves together the forces that shaped his childhood spent on two sides of the Atlantic, his early love of rock ‘n’ roll and

the highs and lows of a life that has been marked hit records, sold-out tours and struggles with drug use. The Hardcover edition also features a wealth of photos from throughout his childhood and pioneering days in the 1970s and ‘80s. Information: BillyIdol.net.

Title: The Youngs: The Brothers Who Built AC/DC Author: Jesse Fink

Publisher: St. Martin’s Press Tell me more: Although AC/

DC has sold more than 200 million albums since the mid-1970s, relatively little has been written about the rockers at

the center of the band. In his fascinating The Youngs: The Brothers Who Built AC/DC, Australian author Jesse Fink illustrates the life of Scottish-Australian brothers Malcolm, George and Angus Young via 11 classic songs. An original approach to be sure that yields a wealth of nuggets about what went into the creation of the classics. Many key figures involved in AC/DC’s rise open up over the course of the book, and Fink’s passionate connection with the band shines bright throughout. Information: stmartins.com.

Title: Prog Rock FAQ Author: Will Romano Publisher: Backbeat Books

Tell me more: While not everyone appreciates progressive rock music (better known by the faithful as “prog rock”), fans (including yours truly) of the enduring genre will want to get a copy of Will Romano’s 400-page Prog Rock FAQ: All That’s Let to Know About Rock’s Most Progressive Music. The author has taken a well-researched and reasoned approach in looking behind the scenes at a myriad of artists and seminal releases issued over the long history of prog rock. He champions

overlooked albums (Rush’s 1975 LP “Caress of Steel” and ASIAs 1983 album “Alpha” for example) and delves into the reasons that progressive rock has returned as a major force today. Those looking for a simple introduction to prog rock should turn their attention elsewhere. Those who simply can’t get enough of Yes, ELP, Jethro Tull, Genesis, Porcupine Tree and more, you have found the perfect read. Information: backbeatbooks.com.

The street address and other common designa-tion, if any, of the real property described above is purported to be: 69309 Woodside Avenue, Ca-thedral City, CA 92234 The undersigned Trustee disclaims any liability for any incorrectness of the street address and other common designation, if any, shown herein. Said sale will be made without covenant or warranty, express or implied, regard-ing title, possession, or encumbrances, to pay the remaining principal sum of the Note(s) secured by said Deed of Trust, with interest thereon, as provided in said Note(s), advances if any, under the terms of the Deed of Trust, estimated fees, charges and expenses of the Trustee and of the trusts created by said Deed of Trust. The total amount of the unpaid balance of the obligations secured by the property to be sold and reason-able estimated costs, expenses and advances at the time of the initial publication of this Notice of Trustee’s Sale is estimated to be $501,543.23 (Estimated). The property offered for sale excludes all funds held on account by the property receiver, if applicable. If the Trustee is unable to convey title for any reason, the successful bidder’s sole and exclusive remedy shall be the return of monies paid to the Trustee and the successful bidder shall have no further recourse. Notice to Potential Bidders If you are considering bidding on this property lien, you should understand that there are risks involved in bidding at a Trustee auction. You will be bidding on a lien, not on the property itself. Placing the highest bid at a Trustee auction does not automatically entitle you to free and clear own-ership of the property. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same Lender may hold more than one mortgage or Deed of Trust on the property. Notice to Property Owner The sale date shown on this Notice of Sale may be postponed one or more times by the Mortgagee, Beneficiary, Trustee, or a court, pursuant to Section 2924g of the California Civil Code. NFL Players’ Lawsuit vs. Video-Game Maker to AdvanceBy SUDHIN THANAWALAAssociated Press

SAN FRANCISCO (AP) - A federal appeals court gave the green light Tuesday to a lawsuit by former NFL players against video-game maker Electronic Arts over the use of their avatars in the company’s Madden NFL series.

The 9th U.S. Circuit Court of Appeals sided with a district court that rejected Electronic Arts’ attempt to have the lawsuit thrown out. The 9th Circuit said EA was not likely to prevail on its argument that its use of the former players’ likenesses was incidental and therefore protected

by the First Amendment.“We hold EA’s use of the

former players’ likenesses is not incidental because it is central to EA’s main commercial purpose - to create a realistic virtual simulation of football games involving current and former NFL teams,” Circuit Judge Raymond Fisher wrote in the opinion.

The players, including former Los Angeles Rams quarterback Vince Ferragamo, said the Madden NFL game had players with their exact characteristics, but EA had not obtained their permission to use the figures.

A call to Redwood City, California-based Electronic Arts

was not immediately returned. The 9th Circuit ruled against

EA in 2013 in a similar lawsuit brought by former Arizona State University quarterback Sam Keller over the company’s use of college athletes’ likenesses without compensation.

The court, which allowed the lawsuit to continue, concluded that the company did little to transform the avatars into works of art. Electronic Arts agreed last year to a $40 million settlement of the allegations by Keller and other college athletes.

In Tuesday’s ruling, the court reached the same conclusion, saying EA had done little to transform the players’ likenesses

in Madden NFL. It rejected other arguments by EA as well.

“Like NCAA Football, Madden NFL replicates players’ physical characteristics and allows users to manipulate them

in the performance of the same activity for which they are known in real life - playing football for an NFL team,” Fisher wrote. Source KMIR

COACHELLA VALLEY – The Desert Valley League boys’ soccer regular season is about to hit its’ stride and the La Quinta Blackhawks and Cathedral City Lions have shown to be true league and section champion contenders.

After getting ousted from the playoffs by the Centennial Huskies last year, the Blackhawks (1-0 in DVL, 9-3-2 Overall) are back and hungrier than ever in 2015. La Quinta head coach Gary Nadler’s senior-laden team returns one of the top goal scorers in the DVL last year, this year’s leading goal scorer (11 goals) Jesus Avalos. In addition to Avalos, the Blackhawks are lucky to have Adam Lopez, who is second in the DVL with seven goals.

La Quinta scheduled its’ season very intelligently, gradually increasing matchup difficulty as the final stretch approaches. Two games ago, Nadler’s team defeated the Rancho Verde Mustangs 2-0 in the Riverside Poly Tournament. The Blackhawks had been playing lower ranked teams prior to

the Mustangs – one of the best teams in California and a top-150 team nationally per MaxPreps. On Monday, however, La Quinta fell 1-0 to the Valley View Eagles, the nation’s 82nd and California’s 31st best team per MaxPreps.

From here on out, the Blackhawks play league games. La Quinta could run the table the rest of the season except there will be two difficult tests: the road battle at Cathedral City on Jan. 16 and the Lions (1-0-1 in DVL, 8-2-2 Overall) travel to La Quinta on Feb. 10.

If the Blackhawks are not crowned league champs at the end of the season it will likely be the Lions – MaxPreps’ 55th best team in California. Head Coach Rafael Ruiz lost nine seniors from last year’s squad but still, impressively has one of the best soccer teams in the Valley.

Cathedral City’s last game was over two weeks ago and it was not too much of a confidence booster. The Lions ended up tying against a less than subpar Heritage team. Though Cathedral City has one of the top defenses in the league with only eight goals

allowed, Coach Ruiz’ team will have to generate more offense to finish at the top.

Last year’s co-champion Coachella Valley Arabs will also be in the mix come the end of the season. Off to a decent start but with a small nonconference schedule, the Arabs have yet to prove themselves as true contenders in the DVL.

The La Quinta Blackhawks continue its league schedule today at Coachella Valley High School. If the Arabs look to get their season on track, this matchup presents a huge opportunity. The Lions are also on the road today at Palm Desert High School to take on the Aztecs. The Palm Springs Indians are at Xavier Prep taking on the Saints today, as well. The Indio Rajahs continue their season on Friday at home against Palm Desert. All games start at 5:00 pm.

Cathedral City and La Quinta Soccer will Contend for CIF TitleS P O RT S BY DANIEL MARINELLI

Johnson, Martinez, Smoltz, Biggio Elected to Hall of FameBy RONALD BLUMAP Sports Writer

NEW YORK (AP) - Randy Johnson, Pedro Martinez and John Smoltz, a trio of star pitchers who dominated in an era of offense, were elected to baseball’s Hall of Fame on Tuesday along with Craig Biggio, the first time since 1955 writers selected four players in one year.

The Big Unit, Martinez and Smoltz easily earned induction on their first tries, and Biggio made it on the third attempt after falling two votes shy last year. Steroids-tainted stars Roger Clemens, Barry Bonds, Mark McGwire and Sammy Sosa remained far from election.

Johnson, a five-time Cy Young Award winner with 303 victories and 4,875 strikeouts, was selected on 534 of 549 ballots by veteran members of the Baseball Writers’ Association of America.

“The Hall of Fame was never something that I surely ever thought about,” said Johnson, who has been pursuing a photography career since his retirement.

The left-hander’s 97.3 percentage was the eighth-highest in the history of voting.

“I don’t think people quite understand how difficult it is to be 6-foot-10 and be throwing a ball 60 feet, 6 inches away,” Johnson said. “In order to do that,

you have to consistent with your release point and where you’re landing and your arm slot and all that. For someone 6-1, 6-2, there’s less body to keep under control, so it’s a lot easier.”

Martinez, a three-time Cy Young winner with flamboyance to go along with his fastball, appeared on 500 ballots (91.1 percent). Martinez was 219-100, struck out 3,154, led the major leagues in ERA five times and in 2004 helped the Boston Red Sox to their first World Series title in 86 years.

“My body would change half an hour before the game, and I would just become this serious, focused person because my dad reminded me you’ve got to be serious about your job,” Martinez recalled. “I saw everybody as an enemy, and I saw everybody as like in a jungle: You just kill to survive. And that’s the intensity and the focus I had to keep to do it every day on a day-to-day basis. And that’s the kind of chip on the shoulder that people thought I had, even though that was my way to concentrate and do the day to day things that I did in baseball.”

Smoltz was picked on 455 ballots (82.9 percent) and will join former Atlanta teammates Greg Maddux and Tom Glavine, who were inducted last summer along with Chicago White Sox slugger Frank Thomas. Smoltz,

the 1996 NL Cy Young winner, was 213-155 with 154 saves, the only pitcher with 200 wins and 150 saves. He went 15-4 in the postseason.

Biggio appeared on 454 ballots, 42 more than the 75 percent needed and up from 68.2 percent in his first appearance and 74.8 percent last year. A catcher who shifted to second base and spent three seasons in the outfielder, he had 3,060 hits and 668 doubles in 20 big league seasons, all with the Houston Astros.

The quartet will be inducted in Cooperstown on July 26. The BBWAA had not voted in four players together since selecting Joe DiMaggio, Gabby Hartnett, Ted Lyons and Dazzy Vance 60 years earlier.

Mike Piazza fell 28 votes short but increased his percentage to

69.9 from 57.8 in 2013 and 62.2 last year.

Clemens received 37.5 percent and Bonds 36.8 percent. Clemens, the only seven-time Cy Young winner, started at 37.6 percent in 2013 and dropped to 35.4 last year; Bonds, the only seven-time MVP, began at 36.2 and fell to 34.7.

McGwire, in his ninth and next-to-last year of eligibility, received 10 percent, down from 11 last year and less than half his peak of 23.6 percent in 2008. Sosa was on 6.6 percent of the ballot, down from 12.5 in 2013 and 7.2 last year but above the 5 percent threshold for remaining on next year’s list.

Jeff Bagwell was at 55.7 percent, followed by Tim Raines at 55 percent and Curt Schilling at 39.2 percent. Other players included Lee Smith (30.2), Edgar

Martinez (27), Alan Trammell (25.1) and Mike Mussina (24.6).

Don Mattingly received 9.1 percent in his 15th and final appearance on the ballot. Under a change made by the Hall’s board last summer, players’ eligibility was cut from 15 years to 10 but the 11-15 group was grandfathered.

Gary Sheffield (11.7 percent) and Nomar Garciaparra (5.5) will remain on the ballot. Among the 17 first-time eligibles who will be dropped are Carlos Delgado (3.8 percent) and players’ association head Tony Clark, who did not get any votes.

Ken Griffey Jr., Trevor Hoffman and Billy Wagner are among the players eligible for the first time in next year’s ballot. Source KMIR

By Dan MarinelliINDIO – One of the most

anticipated music events in America, the Coachella Valley Music and Arts Festival finally released its’ coveted lineup for the 2015 edition of the annual, two-weekend, three-day party in the desert.

The eclectic lineup feature artists of past and present, with long-time 80’s rock band ACDC headlining the opening night, to multi-talented hip-hop superstar Drake closing out the final night on Sunday – and everything in between.

ACDC is coming off last year’s release of Rock Or Bust. The two weekends at Coachella will kick-off the group’s Rock or Bust World Tour set to officially start on May 5th. In addition to ACDC on Friday night (April 10 & 17), music fans will have the pleasure of seeing Tame Impala, Steely Dan, Alesso, Nero, Porter Robinson, Interpol, Alabama Shakes, Ride and plenty of other artists to scratch that musical itch.

Saturday’s (April 11 & 18) headliner is none other than Mr. White Stripes – Jack White. Over the summer, the Grammy-award winner released a new album Lazaretto. Also performing Saturday will be the Weeknd,

Axwell & Ingrosso, Ratatat, Hozier, Bad Religion, Flosstradamus, Tyler the Creator, Deorro and FKA Twigs.

Some Coachellafest purists will likely cringe at the site of Drake as the closeout headliner for the massive music festival. Just be thankful it is not Justin Bieber gracing the Coachella Stage. Let’s be honest, Drake will be decent, plus, do not forget his endless catalogue of A-list guests he could bring out with him on stage. Have fun speculating for the next few months.

Drake will cap off Coachella 2015 on Sunday (April 12 & 19) but leading up to him will be some serious must-see performances. Florence & the Machine return to the Polo Grounds along with some serious electronic producers. Kaskade, David Guetta, Dirty South, Martin Solveig, Madeon, Cedric Gervais and R3hab round out a huge lineup that will be sure to attract an upbeat, ready-to-dance crowd. Fitz & the Tantrums, Marina and the Diamonds and St. Vincent are also slated to play on the last day.

The lineup has finally arrived. There may be some serious hits on the lineup; there may be a lot of misses. Some will view the lineup as house-music heavy,

others might say it has the same genre breakdown as every other year, but one thing is for certain, the Coachella Valley will be alive and packed with full of life, music-loving hipsters that continue to aid festival’s annual growth. Enjoy good people and friends. Enjoy

the artists you want to see, and go enlighten yourself and see an artist that you may not have given the time of day to in another circumstance. Bring on April. Bring on Coachella 2015!

Tickets will go on sale at noon Wednesday for the festival,

which will be held April 10-12 and April 17-19, with the same lineup performing both weekends.

General admission passes are $375 each and VIP admission is $899.

Robert Cray

By Carolyn W. Gaines Robert Cray’s Show was a

blues nature’s volcanic bliss for his Saban Theatre fans.

Cray’s blues qualities and really hard-core experience of guitar playing and singing teaches the world: How to listen to the Blues and not close the door. That has been his victory for forty-years. His Blues Concert was unthinkable from beginning to end of his interpretation. He is the best that I have ever seen besides Buddy Guy, and my father Roy Gaines these days.

The Giant’s vocals were pure, clear powerful with each of his many years of singing the blues. Robert Cray cooked the blues without an opening act like Billy Holiday’s last living guitar player Roy Gaines. Cray excited his fans

inside a large-living room loaded of American Blues. He led his fans into a blues full episode of ‘Sweet Potatoes Pie’, and ‘I Can’t Quit’. The Headliner songs were unforgettably, incredibleness blues for that evening.

Cray connected with his Beverly Hills fans like old time, country friends. Robert gifted his fans who evening with contemporary blues. Watching him on his guitar was like observing his You-Tube Heroes: Albert Collins, Freddie King, and Muddy Waters. Cray is pure ‘Rhythm and Blues’ for the next centuries to occur like Bobby Rush, Guitar Shorty, Buddy Guy, B.B. King, Ric Hall, Eric Clayton and Roy Gaines Robert Cray is a culture microorganism of the Blues.
