I. INTRODUCTION

A. Background

1. Government of Madhya Pradesh (GoMP) with a sector project loan funding from Asian

Development Bank (ADB) has proposed to implement Madhya Pradesh Urban Services

Improvement Project (MPUSIP), herein after referred as ‘the Project’. Madhya Pradesh

Urban Development Company Limited (MPUDC) shall be the Implementing Agency (IA)

and the State Urban Development and Housing Department (UDHD) shall be the

executing agency for the Project. A project management unit (PMU) created under

MPUDC is implementing MPUSIP.

2. The Resettlement Framework (RF) for MPUSIP outlines the objectives, policy principles

and procedures for land acquisition, if any, compensation and other assistance

measures for Displaced Persons1 (DPs)/Affected Persons (APs), if any.

This framework reflects the borrower’s law on the Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, state

government policies, ADB’s Safeguard Policy Statement (SPS), 2009 and other social

safeguard guidelines. A detailed description of compensation measures and assistance

is provided in the entitlement matrix.

3. An entitlement matrix, consistent with the existing norms and guidelines of the country

and the state government, and ADB’s Safeguard Policy Statement has been prepared

to cover losses identified in this Project. The matrix recognizes that the lack of

title/customary rights recognized under law will not be a bar to entitlement and has

special provisions for non-titled persons. The eligibility for compensation will be

determined through a cut-off date. People moving into the sub-project area after the cut-

off date will not be entitled to compensation or other assistance.

B. Program Description

4. Coverage: MPUSIP’s physical components include (a) improvements to water in 64

project towns; and (b) sewage and storm water collection and treatment services

proposed in two (2) identified towns (Khajuraho, and Rajnagar). The project also includes

an institutional strengthening component and a project management and administrative

support component.

C. Scope of this Report

5. This land acquisition and resettlement due diligence report is prepared for the proposed

Group water supply subproject for Katangi,Bhedaghat,majholi,Panagar,Patan,Sihora

and Tendukheda Nagar Parishads, located in Jabalpur district, under MPUSIP.

Proposed components of the group water supply subproject include construction of

common water intake, and water treatment plant separate storage reservoirs as per

demand of the towns, transmission mains and distribution system. The proposed

subproject will provide metered water supply for domestic, institutional and commercial

users, including metered connections to each household in the towns of the subproject.

All municipal wards of the towns will be covered under the project. The total population

of the town will thus be covered 19040 population as per census 2011) and 28999

population in the design year, 2048.

6. A due diligence process was conducted to examine the land acquisition and resettlement

issues in detail, in line with ADB SPS 2009. This report describes the findings and

provides copies of relevant documents, maps, minutes of meetings and photographs.

This land acquisition and resettlement due diligence report needs to be read along with

the Resettlement Framework prepared for MPUSIP.

7. Upon project implementation, the Social Safeguards Personnel at PMU, MPUDC will be

required to undertake a review of this due diligence report, prepare a confirmation letter

or report documenting any modifications for the subproject and submit to ADB; and

receive a ‘no objection’ confirmation from ADB prior to start of construction in the

subproject.

II. POLICY FRAMEWORK, AND ENTITLEMENTS

8. The Resettlement Framework (RF) prepared for MPUSIP sets out the objectives,

principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and

LARR 2013 as well as national and state laws for protection of street vendors. Until

recently, all activities related to rehabilitation and resettlement in the State of MP had

been based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002

(MPRR) and National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007).

GoMP adopted LARR 2013 on 3rd October, 2014 with some specifications for

operationalizing its implementation in the state 1 . Details of policies are in the

Resettlement Framework for MPUSIP.

III. SUBPROJECT DESCRIPTION

9. Project area of Group water supply subproject towns:

a. Katangi: Geographically Katangi town is located at 23° 27'49’’ North Latitude and

79° 47'38’’ East Latitude, at an average elevation of 373 meters above Mean Sea

Level. The town is situated on State Highway 37 connecting Jabalpur and Damoh.

It is located 38 km from Jabalpur towards the North-West and 22 km North of

Katangi. The town area is divided in 15 wards

b. Patan: Patan geographically lies between 220 31’ 48’’ north latitude and 790 25’

12’’ east Longitude, at an altitude of 379 meters above mean sea level and is

nearly 33 Km from Jabalpur. The municipal council was constituted in the year

1981, with an area of 13.06 sq. kms and comprising of 15 municipal wards.

c. Majholi: Geographically Majholi town is located at 23° 30' 0’’ North Latitude and

79° 55' 12’’ East Latitude, at an altitude of 385 meters above mean sea level. The

town is situated on Road connecting Sihora Gubra. The distance from Jabalpur is

around 47 km. Majholi Town is located at distance of 30 kms for Sihora. The area

of the town is spread over in 629.00 Ha (6.29 Sq Kms ) as per 2011 data.

d. Sihora: Geographically Sihora town is located at Latitude 23° 28’ 48’’ N

Longitude 80° 7' 12’’ E, Town is situated at average elevation of 386 m from Mean

Sea Level. The year of Establishment of Sihora ULB is 1967. The area of the town

is spread over in 2302.00 Ha (23.02 Sq Kms ) as per 2011 data. The town area is

divided in 18 wards.

e. Bhedaghat: Geographically, Bhedaghat lies between 23°08’N 79°48’E, 23°13°N

79°80°E. Bhedaghat is located at 25 km from Jabalpur and 5 km eastern side on

the State Highway 12A leading towards Bhopal- Jabalpur. Presently Bhedaghat has

10 wards.

f. Panagar: Geographically, Panagar lies between 23°9'58"N and 79°56'33"E.

Panagar is situated on NH – 7 connecting Nagpur – Katni. The distance from

Jabalpur is about 16 Km. Panagar is divided into total 15 Wards.

g. Tendukheda: Geographically Tendukheda town is located at Latitude 23° 23'59’’

N Longitude 79° 32'59’’E.It is 260 km. from the state capital of Bhopal and around

52 km from district headquarter Damoh. Town is situated at average elevation of

398 m from Mean Sea Level. The area of the town is spread over in 1400.00 Ha

(14.00 Sq Kms ) as per 2011 data. The year of Establishment of Tendukheda ULB

is 1984. The town area is divided in 15 wards.

B. Proposed Group Water Supply System

10. Sihora , Katangi, Panagar, Patan, Majholi (jbp), Bhedaghat(jbp) and Tendukheda

(Damoh) town is having acute water problem. Sustainable source are not available

near to these towns. Reliable source for Panagar, Bhedaghat town is River Narmada

near Jabalpur. Reliable source for Patan town is River Narmada. Both towns are

approximately 25 km from Jabalpur. Sihora is approximately 25 km from Panagar

,Majholi (jbp) is approximately 20 km from Sihora, Katangi is 20 km from Majholi and

Tedukheda is nearly 20 km from Patan. A common scheme for all these towns

including Tendukheda can be framed from the river Narmada. If combined scheme

is framed; then storage structure cost & intake structure cost can be avoided. The

feasibility & viability is worked out after survey & investigation.

Hence from the above facts it is justified that Narmada River is as final and common

source for Katangi, Patan, Majholi, Sihora, Panagar, Bhedaghat and Tendukheda

Nagar Parishad.

11. Proposed subproject components. The proposed subproject components of Group

water supply of Katangi are presented in Table 2:

12. Intake well: The common intake well is proposed for Katangi, Patan, Majholi,

Sihora, Panagar, Bhedaghat and Tendukheda Nagar Parishad at Bhedaghat. At

Bhedaghat in the bank of Narmada River, there is proposed R.C.C. intake well of 10

m diameter and 14 m height to collect and lift water up to treatment works.

13. Raw Water Rising Main: There will be common raw water rising main for Katangi,

Patan, Majholi, Sihora, Bhedaghat,and Panagar city. The proposed raw water rising

main is 338 m long 600 mm dia. DI K9 from proposed Intake well to proposed WTP.

14. Water Treatment Plant: The common WTP for all these cities having capacity of

27.00 MLD considering 22 Hrs of pumping has been proposed for the ultimate year

of 2048 at Bhedaghat.

15. Clear Water Sump well at new WTP: The clear water sump is proposed to 850 KL of

sump well at WTP for storing Clear water after treatment from WTP.

intake

The common intake well is proposed for Katangi, Patan, Majholi, Sihora, Panagar,

Bhedaghat and Tendukheda Nagar Parishad at Bhedaghat. At Bhedaghat in the bank of

Narmada River, there is proposed R.C.C. intake well of 10 m diameter and 14 m height

2 Pumping

Three nos. vertical turbine type pump with 50% as standby is proposed at intake well. The

discharge of each pump is (20.53 MLD) 259.22 LPS and head is 36.56 meter at

intermediate stage Yr.2033. The rating of each pump is 58.92 KW (say 59.0 KW). Two

nos. working and one pump will be as a standby. This will be replaced by 24.68 MLD or

311.62 LPS discharging capacity at 36.73 m head pumps of 71.5 KW in year 2048. The

pumping is proposed for 22 hours.

3 Raw water

Rising Main

There will be common raw water rising main for Katangi, Patan, Majholi,

Sihora, Bhedaghat,and Panagar city. The proposed raw water rising main is

338 m long 600 mm dia. DI K9 from proposed Intake well to proposed WTP.

4 WTP A common WTP for all these cities having capacity of 27.00 MLD considering 22 Hours of

pumping has been proposed for the ultimate year of 2048 at Bhedaghat

Process/components (same for all towns): Coagulation &flocculation,

sedimentation, rapid gravity filtration, chlorination, wash water recovery, sludge drying

beds, tube settlers & miscellaneous infra (compound wall, landscaping, lighting, rest

rooms etc)

Location: On a government land (1.5 ha available) in Northern outskirts of the town near

the intake Site is partly cultivated by neighboring farmers

8 Bulk flow

meters

Electromagnetic Bulk flow meter will be installed to monitor the bulk flow in the main

components i.e. at the inlet of the raw water mains to know the quantity of water coming

to the WTP, outlet of the clear water sump to know the quantity of water going for the

distribution, outlet of the service reservoirs to know the quantity of water going in the

distribution zone or DMA. This will help in maintaining the UFW in the limit and also

equitable distribution of the water.

IV. FIELD WORK AND PUBLIC CONSULTATION

A. Public Consultation

15. Stakeholder mapping was undertaken as the first step and the major potential

stakeholders listed:

(a) The municipality, its elected members and staff who will be required to oversee

the construction of the distribution networks and WTP as well as be directly

responsible for the maintenance of the installations

(b) Concerned government departments (Water Resources Department, Revenue

Department)

(c) Local residents who will take initiative to connect their houses with the water

distribution line.

(d) Local business persons and traders

(e) School and College Students

(f) Opinion makers or prominent citizens/residents, who are intimately acquainted to

and well regarded by the community. They need to be enlisted in spreading

environmental awareness within the community as well as in conveying the

benefits of the project.

16. Consultations were undertaken with key stakeholders in line with ADB’s requirements

pertaining to environment and social considerations. Tools used for consultation were

formal stakeholder meetings and focus group discussions (FGD). Extensive

consultations with stakeholders (municipality, concerned government departments,

community members including slum dwellers, and traders associations) including

individual face to face interviews and public consultations were conducted. No users

(boatmen and washermen) were found at the intake site which is vacant and unused,

hence no special consultation was conducted with them.

17. Field visits were made to all proposed sites and pipeline alignments and the potential

impacts and mitigation measures discussed with stakeholders. These consultations

helped identify the felt needs/concerns and apprehensions of the communities related to

the project and priorities of concerned stakeholders. Discussions were held with people

residing at and/or having businesses at/near the proposed subproject locations.

Consultations revealed that people are aware of the problems of the existing water

supply system in the city as they are getting 35 lpcd and are willing to cooperate in the

proposed project. The field visits and interactions done with community persons of towns

Katangi, Patan, Majholi, Sihora, Panagar, Bhedaghat and Tendukheda Nagar Parishad

at Bhedaghat helped ascertain that no further survey and inventories are required.

Appendix 2 provides a summary of consultations and discussions held in above

mentioned towns.

V. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

18. No land acquisition or resettlement impacts are anticipated for any of the proposed civil

works for Group water supply subproject. Narmada River is selected as common

source for Katangi, Patan, Majholi, Sihora, Panagar, Bhedaghat and Tendukheda

Nagar Parishad. Proposed Common Intake well, Common WTP, Common Raw

water rising main, the Clear water feeder main and water distribution network are

separate for towns etc.

19. Common Intake well: Proposed Intake well-constructed at Bhedaghat on the bank of

Narmada River, there is proposed R.C.C. intake well of 10 m diameter and 14 m

height to collect and lift water up to treatment works. The permission from Water

Resource Department for extraction and construction is to be taken, making sure that its

conditions for granting of NOC

20. Raw water rising main: Proposed common raw water rising main for Katangi, Patan,

Majholi, Sihora, Bhedaghat,and Panagar towns. The proposed raw water rising main

is 338 m long 600 mm dia. DI K9 from proposed Intake well to proposed WTP. 26

Common Water Treatment Plant: common WTP for all these cities having capacity

of 27.00 MLD. The land identified for WTP is at distance of 338 m from intake well.

The land is in possession of revenue department from years, it is not anticipated

under MPUSIP.

21. Clear Water Sump well at new WTP: It is proposed of capacity of 850 KL of sump

well at WTP for storing Clear water after treatment from WTP. The land belongs to

Revenue department.

22. Clear water sump at Majholi: There are four existing OHTs having 2 nos. 15 m

staging and 2 nos. 18 m staging height. A huge head of pumps will be required to

feed these tanks directly from the WTP., to avoid this an Intermediate pumping station

at junction point (elevation 393.39m) a sump well of capacity 35KL is proposed

considering 30 minutes detention time. The land is identified for pumping station is in

possession of Revenue Department.

23. Clear Water Sump well at Sihora: There are four proposed OHTs having 2 nos. 10 m

staging and 2 nos. 8 m & 11 m staging height, at ground level 401.47m, 418.62 m 418.09

m and 403.70 m. A huge head of pumps will be required to feed these tanks directly

from the WTP., to avoid this a intermediate pumping station has been proposed for

boosting the water at required head. An Intermediate pumping station at junction point

(elevation 393.39m) a sump well of capacity 35KL is proposed considering 30 minutes

detention time.

24. Clear Water Sump well near Basan and Break Pressure Tank (For Tendukheda): In

Tendukheda there are two proposed OHTs having 13 m staging and 9 m staging height.

For storing clear water by direct pumping from WTP sump to overhead tanks there will

be not getting required pressure. An intermediate pumping station with a sump well of

capacity 52 KL is proposed for 30 minutes detention time at junction point near Basan

village (elevation 413.35m) where a break pressure tank on hill (capacity 52 KL) is also

proposed.

25. Clear Water common Pump at WTP at Bhedaghat:It is proposed that clear water

common pump for Katangi, Patan, Sihora, Panagar, Majholi, and Tendukheda except

Bhedaghat Nagar Parishad. Separate pumping is proposed for Bhedaghat. Provision of

3 numbers Centrifugal type pump having discharge 18.34 MLD or 231.57 LPS and head

of 99.37 m with suitable motor is proposed with 50 percent standby.

33. Overhead Tank for Katangi: As per mass curve the total storage required is 0.705 ML.

The cumulative existing storage capacity in the town is 0.60 ML. Hence additional

storage of 0.105 ML or 105 KL is required. One ESR of 120 KL of 12 m staging height

will be taken in the proposed scheme.

34. Overhead Tanks at Sihora: As per mass curve the total storage required is 3.182 ML.

Presently there not OHT only GSRs exist. From GSR required pressure is not found in

distribution line so GSRs are not taken into account. Total 3.182 ML storage is required.

Hence 4 nos. of ESR of total 3190 KL will be taken in the proposed scheme.

35. Overhead Tanks at Panagar: total storage required is 1.040 ML. The cumulative

existing storage capacity in the town is 0.55 ML. Hence additional storage of 0.49 ML or

490 KL is required. Total 570 KL will be taken in the proposed scheme.

36. Overhead Tanks at Bhedaghat: Intermediate Clear Water demand is 1.14 MLD. As per

mass curve the total storage required is 0.415 ML. There is no existing OHT and

requirement is 415 KL capacity of OHT. Hence 2 nos of total 420 KL capacity of OHT is

proposed. 37. Overhead Tanks at Tendukheda: Intermediate Clear Water demand is 1.70 MLD.

There is no existing OHT and requirement is 618 KL capacity of OHT. Hence 2 nos of

total 625 KL capacity of OHT is proposed.

38. The Distribution network design of Katangi, Patan, Majholi, Sihora, Panagar, Bhedaghat

and Tendukheda Nagar Parishad is done separately. These have been divided into

different no. of zones. The total length of the proposed network is around 268032 m of

diameter 110 mm to 280 mm HDPE PN 10 pipe. The minimum size of pipeline taken is

110 mm as per CPHEEO manual for population less than 50000.

61. The ULBs shall apply for No Objection Certificate (NOC) from WRD for raw water

extraction and construction of Intake well at source. The other sites are revenue land

(GoMP), for construction of the proposed water works ULB has to take NOC or transfer

of land.

62. Measures will be taken to minimize excavation, disturbance to pedestrians and traffic

and avoid income loss to businesses, while minimizing road reconstruction costs.

Temporary impacts to traffic/access to shops and residences due to digging of pits for

trenchless pipe laying are possible during construction; however, these will be mitigated

by ensuring access to properties through provision of pedestrian planks, provision of

adequate signage, and careful traffic management.

63. Mobile hawkers will be assisted to move to places nearby, to ensure their earnings are

not affected. The weekly market day will be avoided for construction. Only mobile

vendors will be shifted to a nearby location during the period of construction and

assistance to shift will be provided by the contactor. No income loss is anticipated.

64. In case temporary shifting of vendors with temporary structures is necessary, such

shifting will be undertaken on a weekly holiday, to avoid income loss on the day(s) of

shifting. The vendors will be assisted to shift and will be able to continue plying their trade

during the construction period at the alternative location. Potential disruption of water

supply to existing consumers is possible during construction, and will be mitigated

through supply by water tankers.

65. House Service connections: Provision of house service connections will involve tapping

from a distribution main/ sub-main including one tapping saddles, elbows, service pipe

from tapping point to the chamber near property boundary or inside the property

boundary .The work will involve excavation and road restoration. Each connection will

include a domestic water meter: Installation of AMR compatible water meters for each

house service water connection is envisaged.

66. Potential temporary impacts to traffic/access to shops and residences due to digging and

excavation for pipe laying are possible during construction; however, these will be

VI. BUDGET

67. A provisional budget for consultation, communication, grievance redress, awareness

generation, and mitigation measures such as tanker supply to existing consumers if

supply is affected during construction is included in the DDR for Katangi, Patan, Majholi,

Tendukheda, Sihora, Bedaghat, Panagar and overall subproject costs.

VII. CONCLUSIONS

A. Summary and Conclusions

68. No IR impacts are assessed at identified sites for sub-project components of Katangi ,

Patan,Majholi , Tendukheda , Sihora , Bedaghat, Panagar, as adequate vacant land is

available for the proposed facilities, within the compounds of government lands. The

intake well is proposed to be constructed on Water Resource Department Land, for which

NOC is under approval. The proposed site WTP and OHTs is under the possession of

revenue Department. The land record of this sites are appended to the DDR. For linear

components (pipe laying) or those proposed along government road ROWs, temporary

disruption to road users, pedestrians and community members will be avoided. In the

most congested zones of Katangi , Patan,Majholi , Tendukheda , Sihora , Bedaghat,

Panagar safety measures and simple mitigation measures during construction by the

contractor such as provision of planks for pedestrian access to shops, avoidance of

weekly haat days for construction, undertaking construction on weekly market holidays,

and proper traffic management and information sharing with the public, will be adopted.

A budgetary provision is made for costs likely to be incurred for impact mitigation.
