Over the years, the material, shapes and s t y l e s o f t i l e s have changed tremendously. Today tiles are available for every possible application, and are available in natural stone, or man-made materials such as ceramic, porcelain, glass and others. You have decided to sell your property but have found that the roof needs to be replaced. Do you repair the roof or drop the asking price?

When wanting to sell their home, sellers will generally need to spend a bit of time and money on preparing the home and ensuring that the cosmetics of the property are up to standard.

While it may not necessarily be the roof that needs repairing, many homeowners may find themselves in similar situations and need to decide between taking on the repairs themselves or telling potential buyers and hoping they can still sell their home for a reasonable, market-related price.

Remember, it is far easier to sell a property that is in tip top condition and is visually pleasing.

These preparations will normally include a fresh coat of paint and perhaps some spring cleaning, often it may also require that some easily fixed defects are repaired and that everything is in working order. However, to what extent do sellers need to repair their home before placing it on the market?

Structural defects that are costly to fix such as replacing the roof, pose a challenge to homeowners when deciding to sell. Every home is likely to

have its fair share of defects, some of which will be obvious to spot, while others could be hidden.

Sellers are mistaken if they think that potential buyers will assume that the only defects in the home are the ones they can see. In fact, serious buyers will have the property inspected by a professional company before signing on the bottom line. There are few buyers who will buy a home with the assumption that everything that is not visible must be in working order, he says.

Ideally, homeowners should have the home inspected before they put it on the market so that they are aware of any issues or structural defects that need to be addressed. Sellers are morally obliged to inform the estate agent marketing their property and/or the seller, of any known defects.

Once the property has been inspected and a quote obtained for any necessary repairs, homeowners need to ask themselves whether they will come out better by repairing the defects or dropping their asking price.

The defects cost N$50 000 to repair, but it results in the seller getting their asking price rather than dropping it by N$100 000 or more, the repair is well worth it. However, if the sale price of the property is not really affected by the repairs, then

the homeowner will have to base their decision on that fact. The outcome will depend on the circumstances and the repairs that need to be undertaken.

A compelling circumstance for the seller to take on the repairs is where an interested buyer has the capacity to put down a small deposit, but will not be able to finance any major repairs to the home after buying it. In this way, he says the seller will be securing the sale of the home.

The downside for the seller, should he decide to fix the repairs, is that often major repairs will take a lot of time, which will delay the whole process of selling the property. This may not be an issue for sellers who are not in any particular rush but it may be a massive issue for sellers who have committed to another property and need their home sold as quickly as possible.

Another instance in which it may be better for the buyer to do the repairs or changes is when the fix could be a matter of taste such as the colour of tiles used or design of the deck. If repairs or cosmetic enhancements could be done in a variety of different ways, the buyer may want the option to be able to do it the way they want it.

Ideally, both the seller and buyer should h a v e t h e p r o p e r t y i n s p e c t e d independently to ensure that they're fully aware of all defects before entering into the negotiation process. Whether repairing defects before the sale or not, the crux of the matter is that all parties involved in the sale are happy and agree to the terms and conditions before any contracts are signed.

Is a mediator a marriage counseloror therapist?A mediator does not fulfill the role of either a marriage counselor or therapist.Mediators neither encourage divorce nor encourage people to continue their relationship.The primary purpose of mediation is to encourage couples to reach mutually acceptable decisions. This in itself can have therapeutic benefit for the mediating parties.Mediators may refer couples or their children for therapy and counseling.

How does divorce and family mediation work?Divorce, child custody and other family law matters involve some of the most complex and personal situations any person can encounter in a lifetime.You will have concerns ranging from dividing property and debt to custody and maintenance obligations.Mediation is a voluntary, confidential and practical way to resolve these problems with the assistance of an independent third party.

what needs to be decided or what you may think you can talk about. You might be surprised about you ARE able to do. If you can make decisions together in mediation you control what happen to you in the situation.

Must we both agree to mediation?Yes. Mediation can only work when both parties agree to participate.Never believe that the other party will not be amenable to mediation. Many an opportunity is lost because a person thinks the other party will not mediate.The mediator can also meet with each party individually, if the parties agree to mediation. The mediator however at all times remains neutral.As mediation is completely voluntary any party can withdraw from mediation at any time and for any reason.

What is the duration of mediation and the costs involved?The duration will be determined by the issues and the parties generally 3 to 6 sessions are necessary.Each session usually lasts approximately two hours. As the parties stay in full control of the process this substantially reduces the time spent in litigation.Responsibility for payment of fees may be shared by the parties in any way they deem appropriate and is payable before each session.

Rates Clearance Certificates

Before any transfer of immovable property situated within a Local Authority area can be effected, the particular conveyance has to certify in terms of Section 78 of the Local Authority Act (act 23 of 1992) that all rates leviable in respect of such immovable property and all the fees, charges and other moneys due to the Local Authority in respect of any service, amenity or facility supplied to such property in terms of the said Act, inclusive of any availability charge and minimum charge provided for in Section 30(1)(u) of the said Act has been paid up to and including the date of registration thereof.

The Conveyancer attending to the transfer must sign a certificate in the Deeds of Transfer confirming the

a b o v e a n d t h e r e f o r e t h e Conveyancer takes full responsibility that sufficient provision has been made for the settlement of the Seller's liability towards the Local Authority. The Conveyancer is obliged to make sure that there are either sufficient surplus funds from the proceeds of the sale to cover the outstanding debt or the owner must provide additional funds to cover the debt.

It is interesting to note that Section 78 of Act 23 of 1992 does not only refer to the so called “rates and taxes” but also includes consumable items like the supply of electric current and water. This means that even if the owner was not the consumer of the electricity and water for example in case of a tenant, the owner of the

consumable items and the necessary clearance certificate will not be issued unless the full outstanding amount has been settled. Owners of immovable proper ty should therefore make sure that their tenants are indeed keeping up with their respective payments towards the Local Authority.

Special care should be taken where the purchaser takes over the member's interest in a property owning Close Corporation or Company. That particular Close Corporation or Company remains the owner of the immovable property and therefore also remains responsible towards the Local Authority for the full municipal account notwithstanding the change in member's interest or shares.

Most Agapanthus varieties make a spectacular show as mass planting, especially with contrasting plants like Iceberg roses or pink Gauras. However, with gardens getting smaller this concept is no longer as popular as it used to be. Smaller, compacter hybrids are ideal as container plants and can singularly make a stunning statement. BEST CLIMATE? These versatile, grateful plants grow just about anywhere. Foliage of new hybrids might get damaged in areas with a high frost factor and in this case it would be better to opt for the deciduous varieties with rhizomes that will overwinter well in the soil with a protective covering of mulch. • Position – full sun to light shade.• Soil – any soil will do, but for lush growth use ample compost, mix in Efekto’s bone meal, together with their Vitaboost organic pellets (150gr per square meter or pot)

and 60gr of 8:1:5.• Water – they are water wise plants, but even camels get thirsty. Water well (drench) once a week.• Fertilizing – after initial planting, follow up once a month (during active period – beginning August to end of April) with Efekto’s Seagro or Nitrosol or carry on with 8:1:5.• Pests and diseases – Apapanthus are just too healthy for words! They could sometimes have trouble with Lily borers, eating away at foliage and central parts. Nip this in the bud by spraying with Efekto’s Garden Ripcord.

With dense foliage close to ground level, snail love to “habitate” between leaves. Although snail don’t eat way at Agapanthus leaves they might do damage to other plants. 350g butter

1 Cup cream

2 Tablespoons tomato paste

2 onion, finely chopped

2 garlic clove, crushed

2 x 500g chicken livers

125ml brandy or port

4 bay leaves

250g chopped bacon

250g melted butter for topping pate

Clean chicken livers

Fry bacon, onion & garlic in a small amount of the 350g butter

When onions are translucent add brandy/port and burn off

Add tomato paste

Add remaining butter & melt, add bay leaves

Add chicken livers and cook thoroughly

Season with Ina Paarman

Add cream

Cool slightly and then blend until VERY smooth

Place in dip containers & cover with the melted butter
