1.1 TOWN AND COUNTRY PLANNING ACT 1976

1.0 PLANNING STAGE

SECTION 19(1)

No person other than local authority shall carry out any development

unless planning permission has been granted.

SECTION 27(6)

On conviction can be fine not exceeding RM 50,000.00 and to a further

fine which may extend to RM 1,000.00 for each day during which the

development is carried out after the first conviction for the offence.

1.2 PLANNING STAGE CONTROL

SECTION 21A(1) – DEVELOPMENT PROPOSAL REPORT

For erosion and sediment control , the report should contained

the following :-

�Measures for the preservation of its natural topography

�The proposed earthworks and a

2.1 STREET, DRAINAGE AND BUILDING ACT 1974

2.0 EARTHWORKS APPROVAL STAGE

SECTION 70A (1)

No person shall commence or carry out or permit to be commenced or

Carried out any earthworks without having first submitted to the

local authority plans and specifications in respect of the earthworks and

obtained the approval of the local authority thereto.

SECTION 70A (9) - PENALTY

Upon conviction, liable to an imprisonment for a term not exceeding

5 years or fine not exceeding RM 50,000.00 or both

2.2 STREET,DRAINAGE AND BUILDING

(COMPOUNDING OF OFFENCES)

(FEDERAL TERRITORY OF PUTRAJAYA) BY-LAWS 2003

Can be Compounded – not exceeding 50% of the maximum amount

of fine (i.e. RM 25,000.00 )

2.3 EARTHWORKS (PERBADANAN PUTRAJAYA)

BY-LAWS 1996

Upon conviction shall be liable to a fine not exceeding RM 2,000.00

And shall also be liable to a further fine not exceeding RM 100.00 for

2.0 SUBMISSION OF PLANS

PLANS FOR EARTHWORKS APPROVAL SHALL BE SUBMITTED

BY A REGISTERED PROFESSIONAL CIVIL ENGINEER AS

REQUIRED BY THE LAW

Plans submitted by the Consultant should indicate the following :-

1. Cut / Fill Area

2. Location of Silt Traps and Wash Trough

3. Location of Temporary Drainage System etc.

4. And any other measures to control erosion during construction and

5. Permanent protection upon completion of the earthworks.

** (Participant can refer to the Earthworks By-Laws for further details)

3.0 ENFORCEMENT

REGULAR INSPECTIONS BY THE AUTHORITY TO THE CONSTRUCTION

SITE IS A MUST TO ENSURE THAT THE DEVELOPER / CONTRACTOR

FULFILL THE REQUIREMENTS AS PER APPROVED PLAN.

ACTION AS STATED IN THE ACT OR BY-LAWS SHALL BE ENFORCED

IMMEDIATELY TO ENSURE THAT THE DAMAGE DONE BY NOT

FULFILLING THE REQUIREMENTS IS MINIMAL.
