Aide-Memoire INDIA: Himachal Pradesh State Roads Project [Ln. 4860-IN, Ln. 8199-IN] Implementation Support Mission (July 11-15, 2016) EXECUTIVE SUMMARY A World Bank mission visited Himachal Pradesh during July 11-15, 2016, to review and evaluate the implementation progress towards the likelihood of achieving the project development objectives, and to provide support to the Government of Himachal Pradesh (GoHP) in the implementation of the Himachal Pradesh State Roads Project (HPSRP). EXECUTIVE SUMMARY

A World Bank mission visited Himachal Pradesh during July 11-15, 2016, to review and evaluate the

implementation progress towards the likelihood of achieving the project development objectives, and to

provide support to the Government of Himachal Pradesh (GoHP) in the implementation of the Himachal

Pradesh State Roads Project (HPSRP).

The achievement of the Project Development Objective is rated Moderately Satisfactory and

Implementation Progress rating has been maintained Moderately Satisfactory on account of the overall

progress of project activities.

1. STATUS OF THE OVERALL PROJECT

1.1. Overall: The project enters its 10 years of implementation. The original loan was closed on June 30,

2016 and the additional loan was extended by one more year to close on June 30, 2017. This will enable

complete outstanding project activities. The overall project progress since the last mission in November 205

has been good, although there is a huge outstanding work remaining to be completed within the remaining

implementation period.

Component-1 comprising of 12 road upgrading and two bridge out of which 7 road contracts have been

completed, 5 in progress and the 2 bridge contracts are also in progress. The overall physical progress has

reached 79% a 10% increase since the last mission. The three road contracts and the two bridge contracts

will be completed well within the loan period, but one of the road contracts may slip behind.

Component-2 comprising of core road network maintenance and related institutional development activities,

Disbursement and Loan Closure: The project disbursed $27.2 million from the original loan Ln-4860 in

FY 16 increasing the total disbursement till the end of June 2016 to $218.089 which represents 99.13% of

the loan. A further about $3 million worth of expenditure was booked during the same month of June 2016

which when claimed would exhaust the original loan amount of $220 million. The original loan was closed

as planned on June 30, 2016.

Project restructuring: Upon the request from the GoHP through DEA, the closing date of the additional

loan ($61.7 million) was extended to June 30, 2017.

1.2. Social and Environment Management

Environmental Safeguards: The implementation of environment management activities/works was rated

Moderately Satisfactory on account of some improvements made to address lists of Bank’s observation in

the last missions on noncompliance to the environmental safeguard requirements. There are however some

issues still recurring and need to be attended diligently including proper temporary water channelization at

bridge sites, workers health and safety, traffic precautionary signs traffic safety.

Social Safeguards: the implementation progress of social safeguards is Satisfactory. R&R activities are

progressing satisfactorily. The field visits revealed good attention paid by the PMU to land acquisition and

R&R aspects. Agreements to complete remaining LA and R&R as follows: (a) finalize inception report for

impact assessment study before August 25, 2016 (b) Complete minor additional LA in Package 5 (1) before

end September 2016; (c) finalize the data base on LA and R&R before end September 2016; (f) initiate

measures for undertaking capacity building and sustainability measures on LA and R&R in the PWD (see

Annex for details).

1.3. Procurement and Financial Management

Procurement is rated Moderately Satisfactory. The mission noted that most of the procurement activities

have been completed. A few under procurement need to be expedited.

Financial Management is rated Moderately Satisfactory. Disbursement from the World Bank as on June

30, 2016 for IBRD 48600 is USD 218.089 million which represents 99.13% of the loan of USD 220 million.

Disbursement under additional financing IBRD 81990, as of June 30, 2016 was NIL. The project progress

has to substantially improve to make use of the additional loan of $61.7 m in the course of the remaining

one year, which has never been the case in the past.

2. KEY ISSUES

2.1. Pace of implementation: the loan closing date has been extended by one year to enable the

completion of outstanding project activities, within which the project is expected to disburse about

$57 m in the loan. The pace of implementation of the two civil works contracts 5-I and 5-II is

critical to achieve this goal. RIDC, the supervising consultant and the contractors need to work as

one unit to this challenge.

2.2. Maintenance funding mechanism: The implementation of a sustainable road maintenance

funding mechanism has been overly delayed despite the issue being flagged in several missions.

This is one of the critical reforms to ensure sustainability of the current and any future investments

and ensure a healthy road network in the state. Recently the state is of the opinion that it does not

need to worry much on this issue, as a bulk of the state highways are now transferred to the National

Highways Authority of India. But the state is still responsible for a huge network of major district

roads and other district roads, which are a vital means of the state's surface transportation.

DETAILED AIDE MEMOIRE

INTRODUCTION 1. A World Bank mission1 visited the state of Himachal Pradesh during July 11-15, 2016, to review

the progress made since the last mission and support the implementation of the Himachal Pradesh State

Roads Project (HPSRP). The mission visited a number of project sites and held extensive discussions with

officials and engineers from the Public Works Department (PWD) and the Himachal Pradesh Roads and

other Infrastructure Development Corporation (RIDC). The mission wishes to thank them for their

hospitality and collaboration.

2. This Aide-Memoire (AM) summarizes the findings, recommendations, and agreements reached

during the mission. The main findings and actions to be taken, an update of actions agreed during the last

mission, were all discussed with PWD and RIDC at a wrap-up meeting in Shimla.

3. Project Development Objective (PDO).The development objective of the Project is to reduce

transport costs and to improve traffic flows on priority segments of the core road network of Himachal

Pradesh. This objective is to be achieved through a package of prioritized infrastructure investments and

improved management practices. The indicators to measure performance in achieving the development

objective are: (i) condition of the core network; (ii) speeds on the project upgrading roads; (iii) fatal accident

rate on the state highways and; (iv) the level of road user satisfaction on the core network. The mission

together with the GoHP reassessed the Project Development Objective (PDO) and concluded that the PDO

remains valid and it is likely to be substantially achieved by the end of the project. The progress in achieving

these performance indicators is presented at Annex 1.

4. Based on the progress of performance indicators, the progress in achieving the PDO is maintained

Moderately Satisfactory. The two PDO indicators namely increased average speed on the completed roads

and user satisfaction surveys have progressed well while the indicators -percentage of network in poor

condition and fatalities in road accident are yet to come down markedly to achieve the end project targets.

III. DETAILED PROJECT IMPLEMENTATION

Overall Implementation Progress: The Project consists of two components. The overall Implementation

Progress is rated as Moderately Satisfactory and the details are as follows.

Component – 1: Core Network Improvement Component (Moderately Satisfactory):

5.1 Overall: The MS rating for Implementation Performance was maintained owing to the average

rate of progress in civil works, i.e. about 10% since the last mission and the completion of two more contracts

namely package 4 bringing the total completed packages to 7. The progress in six of the seven ongoing civil

works promises their substantial completion before the loan closes on June 30, 2017. Improvement in quality,

better site management and compliance to environmental and social management are to be given sufficient

attention as physical progress start to speed up.

5.2 Highlights: As of the current mission, eight out of 14 contracts namely contracts 1, 2,3,4,7,8,

and 10 have been completed and taken over by PWD. Out of the ongoing seven contracts, two are bridge

contracts along packages 1 and 7 roads. The overall physical progress of civil works is 79% compared to

69% in November 2015. Packages 5-I and 5-II remain to be critical for the completion of all project activities

and achieving the PDO. RIDC/CSC and the contractors need to closely working together to ensure

completion of the within the time frame.

5.3 Contract 1: completed with exemplary quality and handed over to the RIDC in December 2014.

Defect liability period will be over in December 2015, no serious defects have been observed, as built

drawings have been submitted to the Employer.

5.4 Contract 1-B bridges: This contract consisting of 6 bridges and 2 minor drainage structures with

approach works has been awarded in August 2014 and works commenced in October 2014. The contractor’s

progress in mobilization, organization of the site and programming of works has continued to be satisfactory

and the physical as well as financial progress is about 63% an increase of by 32% since the last mission. The

likely completion of all works is March 2017.

5.5 Contract 2 has been completed and a final taking over has been made by RIDC, disputed

contractor’s final payment has been amicably settled and payment is being processed.

5.6 Contract 3: The package has been substantially completed and under the defects liability period

of the last section.

5.7 Contract 4 and the realignment section. The package has been substantially completed and under

the defects liability period of the last section.

5.8 Contract 5-I and 5-II: a notable increase in resources hence rate of progress has been noted in

both contracts, as such 5-I achieved 35% (an increase by 17%) since the last mission and 5-II achieved 57%

(an increase by 28% from the last mission). Contract 5-I seems to be needing more resources and better

management given the short period remaining under the contract. Efficient use of the available resources is

critical to increase outputs of all operations. Since both contracts belong to one contractor, the plan to move

resources that will soon be redundant in 5-II, to 5-II and subcontracting the structure works to third parties

by the contractor are all welcomed propositions and need to be pursued without further delay. Drawing

experiences from the management of the relatively performing contract 5-II is also beneficial. While 5-II is

likely be substantially completed on time, 5-I is likely to run beyond the current contractual completion date,

June 30, 2017, which coincides with the closing of the project loan. This calls for GoHP to proactively plan

option to finance the works that may spill over the loan closing date.

5.9 Contract 6-I and 6-II: both contracts continued to move with good pace, achieved 87% and 80%

respectively a huge increase since the last mission; expected to be completed by December 31, 2016. The

delay so far from the original completion time was attributed to the delays in quarry clearance and the

increase in the scope of protection works to minimize land requirements and demolition of properties. RIDC

and the supervision consultant need to ensure consistency in the quality of works and compliance with the

environmental and social safeguards requirements under the contract, which seems to be compromised in a

few sections for want of progress, which was stressed by the bank team as unacceptable and should be

remedied immediately.

5.10 Contract 7: new bridge works has been progressing well, but halted due to a major design change

following an extreme flood event happened in the monsoon of 2015, which was over and above the design

flood level. Both RIDC, CSC and the contractor are hopeful that the works would still be completed befor

June 2017.The contract is likely to be completed as per the plan provided that the current pace of progress

is maintained.

5.11 Contract 8 has been substantially completed and already taken over a year ago. Payment was

suspended on account of some surface cracking observed in few stretches and difference of opinion on final

quantities between the CSC/RIDC and the Contractor.

5.12 Contract 9 could have been completed before the current mission, but unprecedented land slide

has led to the contractor to take up a significant amount of additional works, including removal of slide

material, restoration of the damaged pavement by the slide, additional protection works to protect further

slide. However, all these works are expected to be completed by September 2016.

5.13 Contract 10 completed 3 years ago and all pending claims have been settled.

5.14 The table below summarizes the status of the civil works contract under Component 1.

Component– 2: Core Network Maintenance and Management (Moderately Satisfactory):

5.15 The rating for this component is maintained Moderately Satisfactory. About 98% of the

periodic maintenance works have been completed. Three PBMC contracts have been awarded out of planned

five, cancelling the two as these roads have been re-classified as NH are no more part of PWD’s road

network. RIDC/PWD is now preparing DPRs for 78 km of SH for PBMC, which should be considered

whether it is worth to include it under Bank financing. Important lessons are being drawn from these first

batch of contracts and being taken into account in the design of the second batch. On the institutional

development front, following the issuance of a notification more than a year ago by GoHP to implement the

transfer of the core road network to RIDC, not much has been done since the last one year. The state had

drafted a road policy that emphasizes on maintenance and its funding mechanism, which was considered a

good first step, however establishing the actual move to establishing a sustainable maintenance funding

mechanism did not get much traction. Establishing a sustainable road maintenance funding mechanism and

evolving RIDC into an agency to manage the core road network are activities agreed during the negotiations

of the additional financing to be implemented by PWD. The Bank team noted that PWD did neither seem

interested in these reforms nor did it present a case for their redundancy. The update of the status of each

activity under Component 2 is highlighted as follows.

5.16 Periodic maintenance: All the planned 1481 km periodic maintenance works phased in three

tranches have been procured. Tranche 1- 532 km and Tranche 2- 517 km works have been completed. In

Tranche-3 the maintenance of 394 km roads was completed, which brings the total of the three tranches to

1443 km out of the total planned 1481 km. Works on 2 packages of 8 km was ongoing and is expected to be

completed by December 2016.

5.17 Long Term Performance Based Maintenance Contract (LTPBMC). Three packages (347 km out

of planned 446 km) in Mandi, Hamirpur and Shimla zones have been awarded. The remaining two state

highways in Kangra and Hamirpur zones planned for LTPBMC have recently been reclassified as NH and

taken out of PWD’s mandate hence no further contracts will be processed under the loan. are

5.18 Black spot improvement. 25 blackspot improvement works have been packaged in 9 contract and

awarded. As of the current mission all works have been completed successfully with only one package

remained to be completed. As agreed in the previous missions RIDC has now started to collect crash data

after the improvement in line with the same format used for the baseline, prepare a report about the change

in crash incidences and formulate the lessons learnt to inform the design of similar initiatives in the future.

Initial data shows signs of improvement on crashes, but could not be conclusive as the data is only for short

periods and need to be observed at least for a year at each black spot.

5.19 Road Accident Database Management System (RADMS). The Consultants for establishing

RADMS has completed the development of the system in all districts. The RADMS is now in place and

being implemented in all districts which is going very well. The server is now hosted in the state’s department

data center. 3880 crash data has been entered till July 2016, which TRL expects the annual data to be higher

than hitherto collected manually. The reporting module has the capability to generate ab 19 standard reports.

Thee data entry module for Health & Family Welfare department remains a challenge as the department is

yet to fully subscribe into the system. An Accident Management Cell (ADMC) is functioning well from the

office of the Director General of police. All the additional tablets recently purchased have been distributed

to the local police stations. The consultant has made a brief presentation of the status of implementation and

drew the mission’s attention on the following issues. The following action need to be taken.

Data is so far collected only by the police; important engineering (by PWD) and health (Health and

Welfare department) data related to the crashes are not being collected;

The recurring problem on data quality; and delays in data entry;

PWD/Police need to issue a Government order to users of the system to institutionalize the SOP;

The need for a continuous training for new entrant police officers; establish an in-house training

system to ensure sustainability;

the Possibility of hosting it in a cloud server should be explored vigorously;

Follow up the GIS to be installed through PMGSY to link it with RADMS

Explore the possibility and make a decision to purchase a google map to run the

5.20 Road Maintenance Financing. A year ago PWD shared with the Bank team a draft road policy

which included road maintenance funding. Further PWD agreed to carry out an assessment of the existing

maintenance situation and funding mechanism through an independent consultant with the objective of

identifying the scope for improvements and eventual implementation.

5.21 RIDC’s expanded mandate. The GoHP issued a notification to all concerned that RIDC is

entrusted to manage the state’s core road network. PWD thereafter was supposed to prepare an organization

manual for RIDC’s expanded mandate including structures, functions, responsibilities, workflows, etc. and

this was supposed to be completed in 2015, but was never the case. The mission once again cautioned PWD

that failing on this task would jeopardize a sustainable maintenance management of the road network. While

PWD continues to promise the reform would be done, the Bank team felt that PWD seems to be disinterested

in the reform. Recently PWD informed the mission that a chunk of the core road network (18. SHs 1466.300

Km and 53 MDRs 2144.915 Km) is now reclassified as NH and are to be transferred to National Highways

Authority, and not so much of the network left to be transferred to RIDC.

5.22 Project Management System: the consultant hired to develop electronic based project

management system, has completed the system development stage, and the data entry task had started by

contractors of active packages. The team was concerned that the data collection from each package is taking

longer. The mission felt that the system faced two key challenges in its implementation; (i) responsible and

reliable unit to enter data on time and, (ii) intensiveness of the data at the current capacity. The last mission

in November 2015, recommended as part of the consultants post system development responsibility, RIDC

needs to work with the consultant to identify a data collection unit and limit the data collection to the

essentials while keeping the flexibility of the system for future expansion as capacity increases. RIDC was

not able to report on the progress in this front rater, recently the corporation requested the Bank’s

concurrence for an amendment to include an annual maintenance contract of one year; and the acquisition

of 85 additional licenses. The bank agreed to the AMC but could not see a clear case for such a huge number

of licenses at the very end of the project.

6. Construction Supervision. The mission observed that the performance of the construction

supervision consultants (CSC) has remained to be a concern with the same gap continued to be seen in this

mission. The mission once again reiterated the CSC pay attention to the following and RIDC ensures these

are complied with by the CSC:

Ensure each contract has a resource based work program, which is a key to manage any civil works

contract, as contractors proved to be weak in this aspect, provide them with guidance as

appropriate for them to be able to produce a realistic work program;

Use the work program to base any communication with the Employer and Contractors, informing

how ahead or behind the actual work progress is w.r.t to the WP, advise if the WP is no more

relevant and its appropriate revision;

Advise the contractor on the adequacy of its human, equipment, material resources in line with

the work program as revised from time to time;

Timely respond to any contractor’s requests for possible variation instruction when required,

process variations including timely issuing the instruction and determining rates for new items,

issuing designs and drawings in a reasonable period of time;

Ensuring the deployment of qualified staff in the CSC’s team;

Produce a quality progress report focusing on every aspect of the contract management, not merely

focusing on physical and financial progress, but the social, environmental, safety, and construction

quality, claims, etc. in a succinct but informative manner;

Revise the cost estimates of each contracts quarterly with appropriate back up for the revisions.

Environmental Management

7. Although the overall compliance with the environmental management in the ongoing contracts is

generally acceptable there are areas which requires proper attention by all the parties in the contract,

Contractor, CSC and RIDC. The most concern has been in contracts 6-I and 6-II namely poor handling of

outflows from road ways, absence of barricades and safety measures on structure construction sites, the

handling of live power cables need to be improved immediately.

Social Safeguards

8. The implementation of R&R activities is progressing satisfactorily. The field visits revealed good

attention paid by the PMU to land acquisition and R&R aspects. Agreements to complete remaining LA and

R&R as follows: (a) finalise inception report for impact assessment study before August 25, 2016 (b)

Complete minor additional LA in Package 5 (1) before end September 2016; (c ) finalise the data base on

LA and R&R before end September 2016; (f) initiate measures for undertaking capacity building and

sustainability measures on LA and R&R in the PWD (see Annex for details).

ICT systems

9. Project management Consultant (for ICT infrastructure): The as-is study identified deficiencies

in the existing systems, there are many applications independently running in the PWD lacking

synchronization with one another; data collected manually in the filed but entered centrally example being

RMMS, which however could easily be done at the filed level with the right system in place. The consultant

recommended 25 modules to efficiently handle the PWD processes. The recommendation provides two

options to PWD to choose from: the option of developing a new system altogether or adopt the e-IHP

software earlier developed in other GoHP department. The mission was informed that there was inter

departmental discussion on the possibilities of adopting e-IHP which was already in advanced stage of

development; but PWD pushed back as e-IPH lacks quite a number of features PWD intends to have as part

of the new IT system. The procurement of the system integrator has to be expedited.

Procurement

10. Procurement performance during the review period is rated as Moderately Satisfactory.

11. This assessment is based on the quality of documentation such as Technical Evaluation reports,

Draft Contracts, Amendments to the contracts etc. submitted for Bank’s review

12. The updated Procurement plan was shared with the mission and the same was discussed. Any

additional packages of goods and equipment being planned for procurement under the project should be

added in the procurement plan and sent across to the Bank for review and acceptance.

13. Civil Works: All the packages of civil works have been awarded. Since the last mission, there has

been progress of the Packages ICB 6 pkg - II, NCB 6 pkg -I and it gives a reasonable assurance that the

works would be completed by the present project closing date.

14. The progress on the ICB 5 pkg-I, NCB 5 pkg -II, is slow and not in line with the implementation

plans. The mission informed the RIDC to critically look into the implementation and carry out close

monitoring of these packages.

15. It is reiterated again that there has to be a credible resource-based work program prepared for each

package and approved by the Engineer which then needs to be monitored by RIDC on a continuous basis so

as to get the works completed prior to the project closing date.

16. Consultancy Services: The selection of consultant for feasibility of about 2000 kms and detailed

engineering / safeguard assessment of about 500 kms was unsuccessful, and RIDC is considering a second

round selection process with an intention to seek a preparatory funding from the Bank to finance the services..

The contract for the Consultancy Services for carrying out Terminal Impact Evaluation of the

implementation of RAP for all road upgradation packages of HPSRP, is being awarded

Financial Management

17. Highlights: Financial Management performance is rated Moderately Satisfactory. Disbursement

from the World Bank as on June 30, 2016 for IBRD 48600 is USD 218.089 million which represents 99.13%

of the loan of USD 220 million. After submission of IUFR ending June 30, 2016, the disbursement under

this loan will be 100%. The disbursement under additional financing IBRD 81990, which became effective

on March 8, 2013, is currently NIL. However, it is expected that the entire additional financing (Rs. 4134

million in INR terms) would be disbursed by the extended closing date of the loan. The internal audit function

is working satisfactorily with reports till quarter ending March 2016 have been shared with the Bank. The

report for half year ending September 2016 shall be shared with the Bank by November 30, 2016. The

external audit report for previous FY was submitted in time and is unqualified. However few inconsistencies

were reported in both internal and external audit report, against contract execution particularly in payment

terms, VAT payment etc.

Detailed Status

18. The implementation support mission reviewed the continuing adequacy of the financial

management arrangements at the project and the progress made on the action plan agreed during the previous

mission. The recent developments and key issues are highlighted below:

19. Budget and Disbursements: As against a budgetary grant of Rs 2,900 million for FY 2015-16,

the project has incurred an expenditure of Rs. 3,130 million. The carryforward balance from previous year

was also used for the current year disbursement. For FY 2016-17, a budget of Rs 3,895 million has been

allocated for the project. Expenditure till June 30, 2016 is Rs. 816 million. The project is regular in

submission of IUFRs and claims till month ending June 20, 2016 have been filed. Disbursement from the

World Bank as on date stands at USD 218.089 million, which represents 99.13% of the loan of USD 220

million. The designated account advance has been fully recovered. Disbursement under additional financing

IBRD 81990, which became effective on March 8, 2013, is still NIL.

20. The project team has been advised to submit application for expenditure for the period ending June

30, 2016 to exhaust the remaining balance in IBRD 48600. The balance expenditure which could not be

disbursed under IBRD 48600 can be claimed under the follow on loan IBRD 81990.

21. The closing date of IBRD 81990 has been extended for one year, and the project is optimistic in

withdrawing the maximum loan amount. The project has shared the statement of future commitments.

22. Finance Staffing: During the previous missions, it was informed to the Bank that it had been

proposed to transfer the work of Finance wing of HPRDIC from HPIDB to in-house staff of HPPWD.

However, it has now been decided that the existing arrangements shall continue and any change in the

existing arrangements shall be looked at only for the second phase.

23. Internal audit: The existing internal auditors M/s Soni & Rustogi Chartered Accountants have

been decided to extend the contract till closing of the project in the 80th board meeting held on October 29,

2015. During the last mission, the project was asked to share the internal audit report for period ended

December 31, 2015. The same was shared during the mission. Also the team has shared with the Bank team

that the audit report for the period ending March 31, 2016. Few inconsistencies were reported with respect

to contract execution, particularly in payment terms, VAT payment, non-deduction of works contract tax,

non-recovery of mobilization and material advance etc.

24. It was noticed that the payments were made directly to the sub-contractors and suppliers on behalf

of the contractor under package 3. This amounts to approximately Rs. 144 million. This appears inconsistent

with the contract terms. The project team was advised to stop payments directly to the sub-contractors, unless

agreed with the Bank. Also, the project has been advised to expand the scope of the internal audit in

reviewing the adequacy of the payments with the contract terms.

25. External Audit: The audit report for FY 2014-15, furnished by M/s Anil K Sood & Co, had been

shared with the Bank by the project e-mail dated October 17, 2015. The project audit report submitted by

the AG has been reviewed and found to be acceptable. The project has continued to follow suitable financial

management practices for the benefit of the project. However, there are audit paras in the entity audit report,

which reports few inconsistencies in the contract executions, particularly in payment terms, VAT payment,

non-deduction of works contract tax, non-recovery of mobilization and material advance, pre-release of

retention money, awarding contracts against the guidelines, non-deposit of Government dues, inappropriate

calculation of price escalation etc. There are few audit paras pending since FY 2007-08. The team has been

advised to address these issues and arrange to drop the audit paras as soon as possible.

26. ISR FM Rating: Based on the above, project Financial Management performance is rated

Moderately Satisfactory.

Project Management

28. RIDC Staffing. RIDC is doing reasonably well in terms of discharging its responsibility. As more

contracts are now coming to an end, it is inevitable to settle outstanding disputes, RIDC management staff

need to be harnessed with dispute resolution skills including amicable settlement and arbitrations. When

RIDC assumes its long term responsibility of the core road network management function, the staffing has

to be entirely revisited as part of the task to reorganize RIDC to take over the CRN management

responsibility from PWD. For the current project, GoHP is requested to ensure continuity of the project

management team.

29. Project Monitoring and Reporting. The mission requested RIDC to continue to use the agreed

Project Report format (which contains 8 excel-based reports and has been agreed at the project appraisal

stage) to monitor project progress. The mission requested RIDC to regularly update the Project Report and

forward it to the Bank within 15 days after every quarter. The CSC produces a quarterly progress report for

the civil works, excluding maintenance. There is still no mechanism of reporting all other project activities

except the information captured in the above said excel-based tables.

30. Performance Monitoring Indicators (PMI).The mission and RIDC jointly reviewed the PMIs and

updated the value of PMI indicators based on available information. The mission noted that for one of the

outcome indicators to measure increase in average speed in completed roads, RIDC was able to establish

data on baseline and current speed in collaboration with HP Transport Department. The second user

satisfaction survey has been completed and the consultant made a presentation during the mission. The

status of achievement of the performance indicators is presented in Annex 1.

31. Information Disclosure .The mission reviewed two key transparency aspects on the project i.e.

information disclosure and complaint handling mechanism to deal with various types of complaints. RIDC

continued to handle complaints lodged through the website as well as manually.

32. Compliance with Loan Covenants. The status of compliance of the Project and Loan Agreement

covenants is in Annex 2. All covenants are in compliance.

33. Next Implementation Support Mission. The next full implementation support mission is

scheduled for December 2016/January 2017.

Detailed Mission Comments on Upgrading Works

The Component 1 (Core Network Upgrading) of the project envisages upgrading of 437 km of roads in the

Core Road Network (CRN). RIDC initially started implementing this component through 10 contract

packages in two phases. However, in the course of implementation the following changes were made: (a)

packages 5 and 6 performed very badly and were terminated, and later each split into two contracts (5-I, 5-

II, 6-I and 6-II) and retendered; (b) an amicable agreement between RIDC and the contractor led to the

removal of the bridge works from contract 1 and tendered separately; and (c) a missing bridge in contract 7

from the original contract was included in the project and tendered separately; raising the total number of

contracts to 14 (7in phase-I and 7 in Phase-II).

Phase 1 Works: All seven civil works contract packages of phase 1 upgrading works, which constitute a

total length of 232 km, were awarded at a total contract price of Rs 7495 million. Four out of the seven

contracts 1, 2, 3 and 4 have been completed and the three contracts 1-B, 5-I and 5-II are at various stages of

implementation 63, 36 and 57 percent progress respectively.

Phase 2 Works: All seven civil works contracts of phase 2 upgrading works, which constitute a total length

of 203 km, were awarded at a total contract price of Rs 4711 million. Three out of the seven contracts 7, 8,

and 10 have been completed and the four contracts 6-I, 6-II, 7-B and 9 are at various stages of

implementation: 87, 80, 75 and 87 percent progress respectively..

The mission, along with the officials of RIDC, the respective PMUs and the Supervision Consultants, visited

packages 1-B, 5(I), 5 (II), 6 (I), and 6 (II) and then discussed the progress of Works with the respective

contractors and the PIU team.

and taken over by RIDC in October 2014. All outstanding bills have been settled except the labor cess, which

RIDC promised to finalize by the end of July 2015.

Package 1-B: Mehatpur-Una-Jahalera-Amb Structure Works, Contractor: S. P. Singla Pvt. Ltd. The

contract was awarded and signed in October 2014 to M/s S.P. Singla Pvt. Ltd at a contract price of INR660

million. The mission observed that the package continues to progress at moderate speed by taking up five

of the seven major bridge and structure works. However there seem to be an overall slippage compared to

the contract time lapsed, i.e., 62% physical progress vs 72% of the revised time of completion lapsed. The

mission recorded that only one major and one minor bridges have been completed and the remaining seven

structures are at various stages of implementation promising completion by the end of the calendar year.

However the contractor was instructed to construct one 72 m long bridge alongside the same length bridge

at change 16+860 to provide a four lane crossing in line with the road standard in the Una city. This addition

led to the extension of time of completion to June 2017.

The mission noted a state of indecision on the CSC end regarding the type of foundation design given the

physical difficulties of demolishing an existing old bridge foundation. The Bank team urged the contractual

parties to expeditiously resolve based on the available options and finalize the design by mid-August 2016.

Package 2: Una-Bangana-Barsar Road; Contractor: C&C Construction Limited (Length revised to

44.7km from 44.823km): This contract was completed in December 2012 and the DLP of the final

milestone ended in December 2013. Final bills including payments related to disputes settled amicably have

been paid.

Package 3: Barsar-Jahu Road; Contractor: C&C Construction Limited (originally 45.8 km long and

now modified to 46.03km): The contract is now completed and provisionally taken over.

Package 4: Jahu-Kalkhar Road; Contractor: ANS Construction Limited (length about 15.4km): The

contract is now completed and provisionally taken over.

Package 5-I, Theog- Kotkhai- Kharapatthar, Km 0.000 to Km 48.000, Contractor: C & C

Construction limited. The scope of the total works under this project is about 39 km in a stretch of 48 km

of original contract; as some of the works have been executed under the terminated the previous contract.

The physical progress at the end of June 2015 was 36 %, vs 76% of the revised contract time, and 17%

progress since the last mission in November 2015. This is an improved rate of progress, but by far less than

required to complete the works within the revised contract time. The available construction period is about

6 months and the contractor is expected to achieve about 11% per working month or 6.3% in each calendar

month, which was never the case in the contract’s life. The only positive aspect to hope for is the difficult

task of earthwork and rock cutting is by and large completed, resources from the neighboring contract (which

belong to the same contractor) could be shifted to boost the contractor’s performance in the following months.

One of the major problem in this contract is the absence of a qualified project manager capable of putting

together a resource based work program and able to use the existing physical and resources efficiently.

Package 5 II: Kharapatthar-Hatkoti-Rohru, Km 48.000 to Km 80.684; Contractor: C & C

Construction limited. The progress made by June 30, 2015 was (57 %) within 76% of the revised contract

time, and 29% progress since the last mission in November 2015. This is a reasonable progress given the

available short dry weather period since then, and the challenges in dealing with traffic in one of the hilliest

corridor of the state with heavy freight traffic. However the progress is far from the level to achieve

completion by the planned contractual completion date. The contractor deployed a reasonable size of

earthwork machinery and opened a multiple operations in as many fronts as the terrain allows it to do so

thereby completing 24 km out of 25 km of earthworks as per the contracts scope; including gravelling of

this work by a granular sub base layer. About 19 km of this section is also covered by a bituminous macadam,

which provided a smoother riding surface and improved traffic flows in otherwise a difficult corridor. The

drainage and protection works could not keep up with the pace due to the shear increase in the scope, which

was not foreseen at the design stage. Deploying more teams as required should be done without further delay.

Package 6-I and 6-II: Sarkaghat- Jahu Road, Km 61.920 to Km 79.100; and Jahu-Ghumarwin Road,

Km 79.100 to Km 103.370M/s, M. G. Contractors Private Limited: The physical progress as of June 30,

2015 was- 87% in contract –I and 80% in contract-II against 81 % of the revised contract time. This is an

increase of 43% and 31% respectively, which was considered good, and the contracts are on course to be

completed within the revised contractual period. The mission however noted some lapses in the management

of environmental aspects at site. The contractor needs to take care of live electric wires lying on the ground,

proper conveyance of drainage outflows from the carriageway to the natural drainage system, improve

pavement edge alignment and, avoid loose compaction at the edges, etc., proper barricading at cross drainage

construction sites.

draft final statement and processed by the Engineer. The mission was informed that all outstanding bills due

to amicable settlement are now paid..

Package 7-B Ranital Bridge: Contractor: J.C. Gupta Engineers & Contractors, Length – 102 M (3

X34 M+ Approach Length 200 M Approx.): The contract is moving at a good speed, with a progress of

75%. Due to unprecedented rainfall and rise in water level on 08.08.2015, the bridge design flood level was

overtopped by 2.561m. In consideration of the safety of Bridge structure, CSC and RIDC agreed to raise

the soffit level of the superstructure by increasing the heights of the supporting structures and changing the

design of superstructure in to a lighter one to compensate for the added weight of the substructure. The

Bank team suggested a further analysis of the design flood and whether the occurred flood has a frequent

return which undermines the original design before making the final decision. The completion is set for

September 14, 2016.

Package 8: Kumarhatti-Nahan Road; Contractor: Somdatt Builders Pvt. Ltd (about 71.7 km): The

contract is in its DLP and the contractor is attending to the defects notified by the Engineer as per the

recommendation of the independent assessment made by a professor from Punjab University. The mission

noted the difference in opinions regarding the final quantities of the work have been resolved, and the related

payment including for the rectification work if eligible, is yet to be settled, 2015.

Package 9: Draman-Sihunta Road; Contractor: NKG Infrastructure Ltd: The progress remains 87%

as recorded in the last mission due to the increase in scope triggered by unanticipated land lide in a number

of spots along the road, and the contractor would have to remove the slide, restore the damaged road, and

construct protection works, all of which have not been part of the original scope of work. The contract is

expected to be substantially completed by end September 2015.

Package 10: Bhawarna-Lambagaon Road; Contractor: Valecha – Dilip JV (approx length of road

26.28 km of Intermediate Lane road): The mission was informed that the DLP period is over and RIDC

took over the road; and the contractor submitted a draft final statement and being processed by the Engineer.

All outstanding bills are now settled.

Construction Supervision Consultant Contract (Louis Berger Group): During the site visits to the roads,

and subsequent discussions, it was clear that the supervision consultant has a lot to improve to play its role

as the Engineer under the contract. First and foremost the consultant is plagued by a frequent turnover of

resident engineers and replacing those takes longer and contracts are supervised by the RE from adjacent

contracts. Secondly, those REs on site are not conversant with the conditions of the contract and do not seem

to manage the contracts accordingly. They are not that helpful in analyzing what the implication of the delays

in the contracts, alerting the contractor on the amount of slippages, indication to the contractor and the

Employer the details of remedies to be done to catch up progress and other contractual actions to be taken.

RIDC needs to work better with the consultant to get proper reports with credible data on costs, progress and

claims. The quality of progress reports remains unreliable and inconsistent.

Annex 7

Mission Comments on Maintenance Works

The Project includes maintenance of about 2000 km of roads in CRN [Core Road Network] of the State. The

works have been taken up in three tranches. Periodic maintenance of 1338 km of roads in CRN has been

completed, works in 2 roads of about 38 km of are in progress. Four packages of total length 347 km have

been awarded on long term performance based maintenance contracts, the procurement for another approx.

79 km i.e. Una-Barsar-Bhota-Jahu-Kalkhar road (C2, C3 & C4) has recently been upgraded as National

Highway (NH) and there being no provision for maintenance component in the additional financing loan of

US$ 61.70 million, as such the remaining package for OPBMC shall now be taken care by the State

PWD/NH Authorities.

Implementation of Tranche-1: Periodic maintenance of 532 km of roads in 25 contract packages has been

completed.

Implementation of Tranche-2: 517 km of roads are being improved in tranche-2 maintenance works all of

which have been completed.

Implementation of Tranche-3: Periodic maintenance of 432 km of roads is taken up in tranche-3 in 22

packages. Works in 20 contracts covering about 394 km of roads have been completed. The remaining 2

packages of 38 km, are in progress. It is expected that in all these roads the works will be completed by end

December 2016.

Long Term Performance Based Maintenance Contracts (LTPBMC). Four packages (347 km out of

planned 425 km) in Mandi, Hamirpur and Shimla zones have been awarded. There being no provision for

maintenance component in the additional financing loan of US$ 61.70 million, the remaining roads shall

now be maintained by the State PWD/ NH Authorities because the same have recently been upgraded as

National Highway (NH). And no further payment shall be made for the ongoing maintenance contracts from

the additional loan.

Detailed Discussions on Social Issues and Agreed Actions

Land Acquisition: The final assessment reveals that a total of 131.48 hectares of private land has been

acquired for the project. Only 4.7 percent of the awarded amount remained to be disbursed which is pending

due to litigation and court disputes with the land owners. For all practical purposes, LA is complete except

for minor acquisition requirement of additional land about 158 sq mts at chainage 24.750 kms in package 5.

PMU is acquiring through direct purchase. This has slipped timelines agreed during last mission. It is agreed

that the PMU will complete the LA before end September 2016.

Impact Assessment Study: The PMU has hired the consulting agency for conducting Impact Assessment

Study of R&R implementation. Along with the PMU, the mission had a discussion with the Agency on the

study methodology and timelines. The Agency will submit the inception report before August 16, 2016 based

on preliminary field assessments and discussions with the field and head office staff. Incorporating the PMU

and Banks comments, the report will be finalized before August 25, 2016.

Capacity building: To promote and sustain the capacities build on R&R implementation under the HPSRP,

the PMU has agreed last mission to undertake capacity building measures such as exposure visits to other

states where R&R activities are under implementation; deputing the key staff for R&R training; orientation

programs to the staff on R&R. It has been agreed that the PMU will initiate several of these measures

particularly exposure visits to promote the capacities in implementing R&R activities in the state. To

promote R&R implementation a special cell on LA and R&R is under constitution in the PWD; in the past

the PMU has placed Retired Senior Revenue Officer (Retd Special Secretary, Revenue) as Social

Development Officer for HPSRP; the mission appreciates these intiatives which will help in building R&R

systems in the PWD. Very slow progress has been reported on capacity building proposals.

Construction related disturbances Packages 5(1) and 5 (2): The contractor has taken necessary

precautions to avoid construction related impacts on the adjacent communities. However it is agreed that the

PMU with the assistance of CMU will monitor such issues from recurring.

Update the data base: The database has been updated and as per this only 4.8 percent remained to be

disbursed.

22. Consultancy Services for Feasibility of about 2000 Kms.

and detailed engineering / safeguard assessment of about

500 Kms. of roads for the proposed H.P. State Roads

Project-II in the State of H.P.

Request for Proposal issued to the shortlisted

consultants on April 06, 2016 and proposal conference

held on April 21, 2016. The reply to queries as

received from the Consultants is being sent to them.

23. Consultancy Services Technical assistance to upgrade

the Road Maintenances Management System to Road

Management System in HPPWD & HPRIDC

Contract signed with Consultant M/S HIMS Ltd-

SATRA Infrastructure Management Services Pvt.

Ltd.(JV) 605, Ashoka Bhoopal Chambers, SP Road,

Begumpet, Secunderabad, Andhra Pradesh, INDIA-

500003 (India) on April 26,2016 and Consultant has

mobilized its resources and has submitted the draft

inception report which is being reviewed.

24. Consultancy Services required for carrying out Terminal

Impact Evaluation of the Implementation of RAP for all

packages of upgrading roads in the State of Himachal

Pradesh under Himachal Pradesh State Roads Project

(HPSRP) (Loan no. 4860-IN & 8199-IN).

Negotiations on technical proposal and financial

proposals received from the Consultant M/s

Haskoning DHV India, Green Boulevard, Plot 9A,

Tower B, 4th Floor, Sector 62, Noida-201301, India

held with the Consultant on May 24, 2016 and draft

contract was also signed. The Minutes & draft contract

has been sent to the World Bank on June 25, 2016 for

review & No Objection.
