America’s Road Team is a national public outreach pro-gram led by a small group of professional truck driv-ers who share superior driving skills, remarkable safety records and a strong desire to spread the word about safety on the highway.

Gary Schmidt, profes-sional truck driver for Cliff Viessman, Inc., Gary, SD, was select-ed as one of the thirty one semi-finalist to become a Captain on ATA’s Road Team. A total of 3,029 applica-tions were completed by drivers vying to fill one of the nineteen available Road Team Captain positions.

Congratulations Gary for making it that far! We are very proud of your accomplishments.

31 semi-finalist from a pool of 3,029 applicants were flown to Washington D.C. to compete for 1 of the 19 ATA Road Team Captain positions.

I hope everyone is well. Last week we had our Win-ter Board Meeting. It was a full house. Thank you to those who attended. We discussed issues on the state and federal level with much participa-tion from the group. Myron updated us on legisla-tive issues. It appears that the main issue we are concerned with - highway funding, will be argued to the very end of the session. We still have no idea if the lawmakers will agree on a plan that will support our roads and bridges across the state.

Mary and I traveled to Nashville, TN this week to attend the 2014 TMC Annual Meeting & Transportation Technology Exhibition. It is early Monday morning and shortly we will walk over to the Nashville Music Center to partici-pate in the meetings and stroll through the exhibition hall where there are hundreds of booths set up and exhibitors display their products and services. I plan on spending some time with the folks who build the engines. It makes me wonder sometimes if they really know how much trouble we are having with these untested emissions motors. I realize that we can not put all the blame on these guys alone because the EPA, seem-ingly the most powerful agency in the world, has pushed us into this mess we are in. I know I am not the only one disappointed with these new emissions motors because I hear it from my colleagues all the time. For our company, since 2008 our equipment repairs have increased almost 400%. This increase is due to all the problems we have with these new motors. It's not so much the motors as it is all the garbage they put on them to meet the EPA's standards. I'm sure all of us would agree that we want to take care of our environment, but there is a much better way to do it. Humans have been around for centuries, advancing in technologies that contribute to polluting our environment. We all know that. But do we have to change all that in a year or two and at what cost?

I believe we are on the right track to reducing emissions in our industry, but we are going about in the wrong way. This brings me back to emissions motors in class eight trucks. Why in 2008 did we not build about 500 of these new emissions motors, spread them around the country in different applications, give them a five year test, and get all the potential problems worked out of them before mass producing them. Instead, we let the EPA strong arm us into mass producing these untested engines and then forcing us to be the guinea pigs. This has been a tremendous cost to us, our industry, and to our economy as a whole. Going forward, things don't look any better. We have new emissions to meet by 2017 and again by 2020. The list goes on. I am tired of the government running my business. They are horrible at running themselves!

This brings me to another thought I had as we were traveling across the country on our way here. We passed by maybe 13 weigh stations between home and Nashville. Only one of those were open. Why do we spend tax payers money on these facilities and then let them sit empty and closed? A couple of these weigh and inspection stations look like multi million dollar facilities and they are not even open! Is this the best way our government and the DOT can spend our tax dollars? We have a major problem in our country with parking big rigs at night. Should the DOT consider building some parking areas instead of using this valuable property for big fancy weigh stations that they seldom use that have signs posted that say no overnight parking? It seems like such a waste. With today's technology, we could have weigh in motion scales built right in

Since i am very busy in the State capitol, i thought you might enjoy reading an article about lobbyists. in place of my usual ramblings, i offer an article that was written by Representative peggy Gibson from Huron.South Dakota's 90th Legislative Session opens on Tuesday, January 13th in Pierre with the Governor's State of the State Address. Legisla-tors will begin meetings with their respective committees, attending legislative functions,

and drafting bill proposals. Another part of the process is meeting with lobby-ists. Lobbying has been around since governments were formed and political decisions were first made.

Lobbying is simply communicating a point of view to a lawmaker in an attempt to influence government action. The ability of individuals, groups and corpora-tions to lobby the government is protected by the right to petition in the First Amendment to the U.S. Constitution. It is one way different views, concerns,and opinions are expressed. However, the methods in which lobbying is pur-sued sometimes creates controversy.

The movies "Thank You for Smoking" (2005), "Casino Jack" (2010) and “Lincoln" (2012) have not been kind to lobbyists. These movies depict people who practice lobbying as conniving and manipulative. Nevertheless, most who practice lobbying feel it's an honorable and respected profession. Lobbying is regulated in all states, and lobbyists are required to register, disclose their activities and limit gifts.

According to South Dakota law, lobbyists are required to register with the Sec-retary of State. Many representatives of organized groups are present during the Legislative Session to protect the interests of their organizations. They are employed to present their opinions to the legislators and to track legislation affecting their interests. Often lobbyists are useful sources of information to legislators.

The Secretary of State maintains a legislative docket that contains the names of all persons who are registered as lobbyist during the Session. This docket is open to the inspection of any citizen at any time during the regular business hours of the Secretary of State. The law relating to lobbyists is contained in SDCL 2-12.

What should South Dakota lawmakers expect from ethical lobbyists? Without exception, they should:

• Maintain trust. Ethical lobbyists build strong relationships, show mutual respect and honor commitments with legislators, staff and fellow lobbyists.

• Conduct business with integrity. Good lobbyists are proud of their profes-sion and see themselves as problem solvers and resources for infor-mation.

Out of the years I have attended the SDTA legislative receptions I think this year was probably one of the best attended by both members and State Legislators. Issues seemed to be minimal this year, so it was really nice to simply show our appreciation for their service to South Dakota. It was nice that they showed up in numbers to show their support for our association and our issues.

We have a number of our Senators and Representatives sponsoring a 1.9 million dol-lar appropriation bill for pine beetle suppression. Myron is keeping a close eye on this and is ready to support and testify on our behalf at any time.

Highway funding is a big issue this year. To say the least, it will be interesting to see what we will finally find at the conclusion of the 2015 session.

We have put a tentative agenda together for the Black Hills Log Haulers Seminar. I think we have covered everyone’s concerns and issues. This shows to be a real plate full! Please get your registration in ASAP so we have plenty of time to finalize plans. Please convince a friend to attend since these are their issues too. All SDTA members are invited and encouraged to register and attend; hopefully you will see a topic or is-sue that is also of your concern.

2014 survey packets have been sent out. Please get them filled out as soon as you can, but in by no later than the April 1st deadline.

We have many of our members who fall under the qualifications and criteria for a SDTA Milestone Award. As independents no one will fill this information out for you so please take a moment and fill it out. You very much deserve to be recognized for your years of service to the industry. (See page 25 of this publication.)

Wade Wagemann, YRC Freight, Sioux Falls, SD, has been selected as the February 2015 Driver of the Month by the South Dakota Safety Management Council.

Mr. Wagemann has logged over 1.1 million miles in his 22+ years as a professional truck driver. The last 10 years have been spent driving for YRC Freight.

the 34-hour restart regulation is what, now?Although the 34-hour restart regulation (49 CFR 395.3) reads the same as it did a few months ago, two key pieces of that regu-lation are no longer being enforced. What brought this on was a provision added at the last minute to the $1.1 trillion spending package that became law in mid-December, which keeps the Federal Government funded through September 30, 2015. The tacked-on provision prevents the Federal Motor Carrier Safety Administration (FMCSA) from using federal dollars to enforce the “two periods from 1 a.m. to 5 a.m.” and the “168 or more consecutive hours” between restarts.

Officially called the Consolidated and Further Continuing Appropriations Act, 2015, the law does not require the FMCSA to change the regulations; it merely says the agency cannot enforce the restrictions it placed on the restart option on July 1, 2013. With the law having been signed by President Obama on December 16, 2014, FMCSA stated that the suspension of enforcement was effective “as of 12:01 a.m. on December 16, 2014.”

The suspension of enforcement is in effect until September 30, 2015. However, if, as of that date, FMCSA has not provided a study justifying the restrictions on the 34-hour restart to Congress, the suspension is to continue until FMCSA does so. In other words, the FMCSA cannot enforce the restart restrictions until September 30, 2015, or until FMCSA provides Congress with a study justifying the rules, whichever is later.

The law requires the FMCSA to undertake a rigorous, independently peer-reviewed, “naturalistic study of the operational, safety, health and fatigue impacts of the restart provisions … on commercial motor vehicle drivers.” A “naturalistic” study involves the studying of actual drivers in the field, not in a lab. The law says the agency has to begin the study within 90 days of the law’s enactment, which would be mid-March.

how is the 34-hour restart being enforced?

This means enforcement is now based on the 34-hour restart as it stood before July 1, 2013 – before the two restrictions were added. The 34-hour restart (Section 395.3(c)) used to read – and is now be-ing enforced – like this:

§395.3(c)(1) Any period of 7 consecutive days may end with the beginning of any off-duty period of 34 or more con-secutive hours.

§395.3(c)(2) Any period of 8 consecutive days may end with the beginning of any off-duty period of 34 or more con-secutive hours.

What this means is that interstate drivers of property-carrying commercial motor vehicles are able to get a restart by taking any period of 34 consecutive hours off duty, with no other restrictions. The off-duty time may be taken as off duty, in a sleeper berth, or using any combination of the two. This is the same way the rules applied prior to July 1, 2013.

Enforcement on intrastate operations is not quite as cut-and-dried. The law prohibits the spending of federal dollars for en-forcement — including the reimbursement of states for their enforcement practices. However, states may not be using federal dollars to enforce intrastate regulations, and states’ laws and/or regulations may not be enacted through a process similar to how federal regulations are enacted. It is best to check with the particular state in question as to how it is handling this “restart rollback.”

is the 30-minute break requirement also suspended?With this change in enforcement for the 34-hour restart, we have gotten questions about the status of the 30-minute break requirement as well. Even though compliance with the new 30-minute break requirement also began on July 1, 2013, it was not included in the law that required the suspension of enforcement of the 34-hour restart. Therefore the 30-minute break require-ment continues to be in force.

eLds make the spending bill tooAnother provision in this same law speaks to the electronic logging device (ELD) rulemaking timetable. To put this provision into perspective, we need to go back to MAP-21 – short for Moving Ahead for Progress in the 21st Century. This was the highway re-

Much of this could be done without people sitting in these massive scale houses watching trucks roll by during only certain hours of the week. I guess the DOT forgets that the transpor-tation rolls 24/7. Anyway, we certainly have a boat load of issues to deal with now and in the future. For today I am going to educate myself further on the latest and greatest technologies available to our industry. authorization bill that was signed into law in July of 2012 and required FMCSA to issue a regulation mandating ELDs by October 1, 2013.

FMCSA had said it could not meet that deadline because of “…the need for notice and comment on these proposals.” FMCSA published a proposal mandating ELDs on March 28, 2014, and took public comments until June 26.

Getting back to the ELD provision in the spending bill just signed into law, the provision requires FMCSA to complete the ELD rulemaking by June 1, 2015. DOT’s current Significant Rulemaking Agenda projects the ELD final rule going to the Office of Man-agement and Budget (OMB) on June 16, 2015. The OMB normally takes about 3 months to review and (usually) clear a rulemak-ing for publication. At this time FMCSA expects the publication date of a final rule to be the end of September.

State education officials agreed to borrow $20 million Thursday to pay for a new building for Southeast Technical Institute’s automotive programs.

Classes are packed full in the auto-technician, diesel technician and auto body programs at STI. Educators at the tech school expect the 91,000-square-foot building to accomodate an influx of prospective technicians and industry demand for more workers.

Each of the three programs at STI will be able to double its capacity when the proj-ect is finished.

Members of the state's education board approved a bond-ing resolution to fund the plan, but it will cost students.

Students will pay higher fees, also approved by the board to pay off debt on STI's facilities and projects at Western Dakota Technical Institutes. Students programs will pay $2 more per-credit in 2015 and then an additional $5 in 2017. Total facilities fee for students will hold at $35 until 2037.

Officials said the fees increase was steep but necessary to pay down the schools' share of the bonds. The state will cover one third of the debt, with the tech schools paying the rest.

"The improvements that have been made on the campuses have made a tremendous impact," said Deb Shephard, board member and former president of Lake Area Technical Institute. "This is worthy of this raise at this time."

Southeast's automotive programs enroll near or above capacity every year. Meanwhile, projections indicate there will be a greater demand for workers in South Dakota and the rest of the nation in the next seven years.

The new auto-tech building at STI is slated for a site across Career Avenue from the Ed Wood Center, which

currently houses the programs.

Building plans include a food area and an auditorium. The new space would have wings dedi-cated to diesel and auto-tech classes. Auto body students, meanwhile, would take over vacated space in the Ed Wood building.

The project has the support of industry leaders in the Sioux Falls area, Holcomb said. The school hosted forums with local companies to get input for the project.

Construction is expected to finish in summer 2016, and the three automotive programs would be able to serve more students by 2017.

"The only way that we can increase those numbers is to increase the training space provided,” Holcomb said.

The SD Chapter of the World’s Largest Convoy for Special Olympics has been successfully held every year since 2002.

The first convoy started with 18 trucks in 2002. In 2014 a record setting 145 trucks participated in one of the two convoys held in South Dakota: 127 in Sioux Falls and 18 Rapid City. The 2014 Convoy raised a record setting $52,079.00 for Special Olympics. South Dakota held the 4th largest convoy In the WorlD!

In 2012 the Law Enforcement Torch Run for Special Olympics created the Guard-ian Award, given for the commitment and dedication to growing the cause of Special Olympics. Fourteen WorlD-WIDe regional winners were evaluated by the Law Enforcement Torch Run Exec-utive Council. South Dakota was selected as the recipient of the 2014 Guardian Award. Congratulations!

In America, 67 million people suffer from high blood pressure and only half of them have their condi-tion under control. Having high blood pressure can be deadly, especially since it often has no symp-toms or warning signs. But keeping your blood pressure at a healthy level is doable with just a few simple lifestyle changes.

Your blood pressure becomes high when your arterial walls stiffen forcing your heart to pump with greater force in order to deliver blood to the body. It can start to happen once you pass the age of 50, but other factors can contribute to this hardening as well. A diet high in salt, caffeine and fatty foods can contribute to the constricting of blood vessels. While these things in small amounts won’t do too much damage, drinking strong coffee or soda all day long will definitely affect your blood pressure.

When your blood pressure reaches dangerously high levels around 240/120, you are at risk for a number of problems. When it is that high, there is the possibility of bursting a vessel and causing a stroke, heart attack or aneurysm. Also if your blood pressure is constantly high, it can do severe dam-age to your kidneys, the walls of your heart and even your eyes.

As a trucker, developing high blood pressure can happen pretty easily. Being on the road for hours and days at a time, it can be hard to find the energy to eat healthy or to exercise. But it is essential to your health and safety to make conscious decisions about your diet and exercise regime.

One of the easiest things to do is walk. When you pull over for a break, walk around instead of sitting in your truck. Keep track of your steps and try to go a little further each break. Exercise will not only make you feel better and more alert behind the wheel, but it can also be a great stress reliever, which can lower your blood pressure even further.

Choosing to eat healthy foods can be hard. Most truck stops are packed with sugary and salty snacks filled with preservatives and empty calories. Follow the healthy eating guidelines below whenever you prepare to have a meal.

• Slow down. Make sure your meal takes you at least 20 minutes to finish.

• Think about portion size. At any one meal, your protein should be no larger than the size of your palm. Limit bread to one or two pieces; pasta, rice or potatoes shouldn’t cover more than one-fourth of your plate.

• Balance your day. Try to have one serving of fruit and one of vegetables at both lunch and din-ner. Aim for two servings of dairy a day, and keep a balance of carbohydrates and protein at each meal. Some good choices include:

International Registration Plan (IRP) UpdateFull Reciprocity Plan: On January 1, 2015, the new IRP Full Reciprocity Plan (FRP) goes into effect. This major change to the Plan im-pacts the distance reporting and registration authority for all inter-state motor carriers registered under IRP including new and expanded operations.Cabcardsforbothfirst-timeregistrantsandrenewingcarrierswilldisplayalljurisdictionsandthevehicle’sappropriatereg-istration weight.Thischange,themostfar-reachingsincetheIRPfirstwentintoeffect,willgivemostinterstatecarriersmoreoperationalflexibilitythanthey have had in the past. The FRP will reduce the number of permits carriers have needed to buy and fees they have paid for added states. IRP registrants renewing for an effective date of January 1, 2015 and beyond will be registered under FRP as will any new reg-istrantsregisteringforthefirsttimeonJanuary1,2015orafter.Forexample,acarrierwhosecurrentregistrationsexpireonMarch31,2015, they will renew under FRP effective April 1, 2015.
