Fine Denier Polyester Staple Fiber from China, India, Korea, and Taiwan
DETERMINATIONS
On the basis of the record1 developed in the subject investigations, the United States International Trade Commission (“Commission”) determines, pursuant to the Tariff Act of 1930 (“the Act”), that an industry in the United States is materially injured by reason of imports of fine denier polyester staple fiber (“fine denier PSF”) from China, India, Korea, and Taiwan that have been found by the U.S. Department of Commerce (“Commerce”) to be sold in the United States at less than fair value (“LTFV”).2 3
BACKGROUND
The Commission, pursuant to section 735(b) of the Act (19 U.S.C. 1673d(b)), instituted these investigations effective May 31, 2017, following receipt of a petition filed with the Commission and Commerce by DAK Americas LLC, Charlotte, NC; Nan Ya Plastics Corporation, America, Lake City, SC; and Auriga Polymers Inc., Charlotte, NC. Effective November 6, 2017, the Commission established a general schedule for the conduct of the final phase of its investigations on fine denier PSF, following preliminary determinations by Commerce that imports of the subject fine denier PSF were subsidized by the governments of China and India. Notice of the scheduling of the final phase of the Commission’s investigations and of a public hearing to be held in connection therewith was given by posting copies of the notice in the Office of the Secretary, U.S. International Trade Commission, Washington, DC, and by publishing the notice in the Federal Register of November 27, 2017 (82 FR 56050). The hearing was held in Washington, DC, on January 17, 2018, and all persons who requested the opportunity were permitted to appear in person or by counsel.

Following notification of final determinations by Commerce that imports of fine denier PSF from China, India, Korea, and Taiwan were being sold at LTFV within the meaning of section 735(b) of the Act (19 U.S.C. 1673d(a)), notice of the supplemental scheduling of the final phase of the Commission’s antidumping duty investigations was given by posting copies of the notice in the Office of the Secretary, U.S. International Trade Commission, Washington, DC, and by publishing the notice in the Federal Register of June 6, 2018 (83 FR 26308).

VIEWS OF THE COMMISSION
Based on the record in the final phase of these investigations, we determine that an industry in the United States is materially injured by reason of imports of fine denier polyester staple fiber (“PSF”) from China, India, Korea, and Taiwan found by the U.S. Department of Commerce (“Commerce”) to be sold in the United States at less than fair value (“LTFV”).1
I. Background The petitions in these investigations were filed on May 31, 2017, by DAK Americas LLC; Nan Ya Plastics Corporation; and Auriga Polymers, Inc., domestic producers of fine denier PSF.2 Petitions for antidumping duty investigations concerning such imports of fine denier PSF from China, India, Korea, and Taiwan were filed on the same day as the petitions for the countervailing duty investigations concerning imports of fine denier PSF from China and India. The investigation schedules, however, became staggered when Commerce did not align its final countervailing duty determinations with its final antidumping duty determinations, thereby necessitating that the Commission reach earlier final determinations in the countervailing duty investigations than in the antidumping duty investigations.3 The Commission previously made affirmative determinations on the basis of cumulated subject imports from China, India, Korea, and Taiwan in its countervailing duty investigations of fine denier PSF from China and India.4 Pursuant to the statutory provision regarding staggered investigations, the record for these antidumping investigations closed on February 9, 2018, the same closing date for the countervailing duty investigations on subject imports from China and India. The only additions to the record, as allowed by the statute, have been Commerce’s final dumping determinations on subject imports from China, India, Korea and Taiwan and the parties’ final comments concerning those determinations.5

II. Material Injury by Reason of Subject Imports Pursuant to section 771(7)(G)(iii) of the Tariff Act of 1930, as amended (“the Act”), the Commission must make its material injury determinations in the instant investigations on the basis of the same record as that in the countervailing duty investigations regarding imports from China and India, except to the extent discussed above.6 Therefore, in these investigations, we adopt the findings and analyses in our determination and views regarding subsidized subject imports from China and India with respect to the issues of domestic like product, domestic industry, cumulation, conditions of competition, and material injury by reason of cumulated subject imports.7 Accordingly, we determine that the domestic industry producing fine denier PSF is materially injured by reason of subject imports from China, India, Korea, and Taiwan that Commerce determined were sold in the U.S. market at LTFV.8 9
demand in the United States. Parkdale also admitted in its comments that it was providing new factual information in support of its arguments. See Parkdale Supplemental Comments at 1‐5, note 1, and Attachments. Because these data were beyond the scope of the supplemental comments and constituted new factual information not permitted by the statute, we have disregarded both the new information and the comments made by Parkdale on this new information for the purposes of our final determinations in these investigations 6 19 U.S.C. § 1677(7)(G)(iii).

corresponding to a domestic like product that account for less than 3 percent of all such merchandise imported into the United States during the most recent 12 months for which data are available preceding the filing of the petition shall be deemed negligible. 19 U.S.C. § 1677(24)(A)(i).
During the 12‐month period prior to the filing of the petition, May 2016 through April 2017, subject imports from China, India, Korea, and Taiwan, accounted for *** percent, *** percent, *** percent, and *** percent of the quantity of total imports respectively, all of which are above the 3 percent individual subject country statutory negligibility threshold applicable to the antidumping and countervailing duty investigations. Confidential Report, INV‐QQ‐017 at Table IV‐4; Fine Denier PSF, USITC Pub. 4765 at Table IV‐4. Accordingly, we find that the subject imports from each of the subject countries are not negligible.

III. Conclusion
For the reasons stated above, we determine that an industry in the United States is materially injured by reason of imports of fine denier polyester staple fiber from China, India, Korea, and Taiwan that are sold in the United States at LTFV.

We take into account that Commerce calculated a zero dumping margin for Toray Chemical and excluded this firm from the antidumping duty order on fine denier PSF from Korea in its final determination and that it also calculated a zero dumping margin for Taiwan Spinning and excluded this firm from the antidumping duty order on fine denier PSF from Taiwan in its final determination. See 83 Fed. Reg. at 24744 and 83 Fed. Reg. at 24746.
We also take into account in our analysis the fact that Commerce has made final findings that most producers in the four subject countries are selling subject imports in the United States at LTFV. In addition to this consideration, our impact analysis has considered other factors affecting domestic prices. Our analysis of the price effects of the subject imports, particularly significant underselling, set out in the final countervailing duty determinations are particularly probative to an assessment of the impact of subject imports. PART I: INTRODUCTION
BACKGROUND
These investigations result from petitions filed with the U.S. Department of Commerce (“Commerce”) and the U.S. International Trade Commission (“USITC” or “Commission”) by DAK Americas LLC, Charlotte, North Carolina (“DAK Americas”); Nan Ya Plastics Corporation, America, Lake City, South Carolina (“Nan Ya”); and Auriga Polymers Inc., Charlotte, North Carolina (“Auriga”) on May 31, 2017, alleging that an industry in the United States is materially injured and threatened with material injury by reason of less‐than‐fair‐value (“LTFV”) imports of fine denier polyester staple fiber (“fine denier PSF”) 1 from China, India, Korea, and Taiwan, and subsidized by the Governments of China and India.2 The following tabulation provides information relating to the background of these investigations.3
