Trail Mileposts 16 and 16.5 (vicinity of and 'Y2 mile east of the Catherine Bridge trail parking lot on County Rd. 100, approximately 3'Y2 miles east of the Town of Carbondale)

Public Right-of-Way

I. BACKGROUND - DESCRIPTION OF PROPOSAL

Four new public structures, two vault toilets and two picnic/shade shelters, are proposed by the Rio Grande Trail Enhancement Project. The Roaring Fork Transit Authority will be constructing the facilities as funded by a Great Outdoors Colorado Grant jointly applied for with Garfield County.

The toilets and picnic/shade shelters are proposed for two locations in the vicinity of Cattle Creek along Hwy. 82 and near the Catherine Store Bridge along County Road 100. The toilets will be self contained, constructed off-site and delivered to RFTA for installation. The toilets will be made of concrete with a barn wood finish/texture and will be roughly 6.5 ft. by 15 ft. in size and 9.5 ft. in height. The sites will be accessible for construction/installation and for ongoing access by septic trucks for servicing and pumping out the toilet vaults. The picnic shelters are being designed by . a local architecture firm (Land and Shelter) and will be constructed on site. The picnic shelters will cover approximately 200 sq.ft. of area. All the proposed structures will be

constructed using materials consistent with the appearance of existing signs, fencing and natural material found along the trail.

The improvements proposed are consistent with RFTA trail planning and in some cases existing trail components are in place anticipating the proposed improvements. All construction shall be subject to all required permitting from the Garfield County Building and Planning Department including but not limited to building permits and septic permits (vault and haul).

The sites are zoned Public Right-of-Way. The zoning adjacent to the Cattle Creek site is Residential/Suburban and adjacent to the Catherine Bridge site it is Rural and Residentiai/Subu rban.

II. AUTHORITY - CRITERIA

A. The Colorado Revised Statutes (§30-28-110(1)(a)) requires that ... Whenever any county planning commission ... has adopted a master plan of the county ... no road, park, or other public way, ground, or space, no public building or structure, or no public utility, whether publicly or privately owned, shall be constructed or authorized in the unincorporated territory of the county until and unless the proposed location and extent thereof has been submitted to and approved by such county planning commission. More specifically, (CRS §30-28-110(1)(d)) requires that the acceptance, widening, removal, extension, relocation, narrowing, vacation, abandonment, change of use, or sale or lease of or acquisition of land for any road, park, or other public way, ground, place, property, or structure shall be subject to similar submission and approval, and the failure to approve may be similarly overruled.

B. Sections 4-112 and 7-102 of the ULUR address Location and Extent Review including the criteria for the Planning Commission review and approval. Excerpts from the ULUR criteria are provided below:

SECTION 4-112

H. Conformance with Comprehensive Plan. The Planning Commission shall determine whether the project conforms to the Comprehensive Plan. The findings of the Planning Commission shall be communicated to the applicant.

SECTION 7-102 COMPLIANCE WITH COMPREHENSIVE PLAN AND INTERGOVERNMENTAL AGREEMENTS.

The land use change is consistent with applicable provisions of the Garfield County Comprehensive Plan and any intergovernmental agreements between the County and a municipality that applies to the area where the use will occur.

Ill. COMPREHENSIVE PLAN

A. The Cattle Creek location is in an area adjacent to a "Greenway Trail" designation. It is technically mapped as Unincorporated Community, Water and Sewer Service Area, and Residential Medium High density. Most of these designations reflect the status of properties adjacent to the Rio Grande Right-of-Way that may be the subject of future residential development.

B. The Catherine Bridge location is designated "Greenway Trail" and is adjacent to areas designated as Residential Medium High density.

C. Selected excerpts from the text of the Comprehensive Plan 2030 are provided below and reflect the general conformity of the RFT A proposal with the Comprehensive Plan. Excerpts from Section 4, Economics, Employment and Tourism and Section 5, Recreation, Open Space and Trails are provided below.

Section 4 - Economics, Employment and Tourism

Policies:

6. The county recognizes that the tourism industry is an important part of the regional economy and the County recognizes that the tourism industry is enhanced by (1) open space and scenic vistas (2) public trails and other recreational opportunities (3) public access to public lands (4) a healthy environment and habitats for hunting and fishing (5) green belts and open area between communities (6) clean air and water (7) local foods and local produce.

Section 5- Recreation, Open Space, and Trails Vision Open spaces, recreational trails and parks are available throughout the county and access to public lands and river corridors have been preserved and enhanced. Recreation and tourism industries are encouraged and supported in appropriate locations throughout the county.

Issues: ilf The County has traditionally supported (contributed to) the efforts of other organizations to create trails in the county. ilf A regional trail already exists in the Roaring Fork Valley. ilf County policy regarding trail systems should reflect regional goals and be consistent and complementary with other jurisdictional efforts. ilf In comprehensive plan public meetings and a 2008 survey, strong public support was indicated for the County to take a more active role in both trails and open space.

Goals: 3. Provide opportunities for the tourism industry to utilize recreational resources as well as to preserve recreation resources for local access. 4. Support the development of a continuous trail system within Garfield County and along both major river corridors.

IV. STAFF ANALYSIS

A Staff supports a finding of general conformance with the Comprehensive Plan based on the excerpts noted above, consistency with the Greenway Trail designations, and consistency with the overall RFTA plans for the Trail Corridor.

B. The County's cooperation with the grant application for the proposed improvements is further indication of the County's support. A copy of the original Intergovernmental Agreement regarding the grant was included with the Application and an extension of the agreement was recently approved by the Board of County Commissioners.

C. The Application was referred to the City of Glenwood Springs and the Town of Carbondale in accordance with the ULUR and intergovernmental agreements with the City and the Town. Comments from the City of Glenwood Springs have been received and are attached as an exhibit.

D. The Application was referred to several County Departments and the Colorado Department of Transportation (COOT). Comments from the County Departments are attached. Environmental Health and Vegetation Managers comments generally indicate no issues with the application. Road and Bridge recommended that the County Road 100 parking area in the vicinity of the Catherine Bridge proposed picnic shelter be looked at in terms of traffic safety. No comments have been received from COOT at this time.

E. The improvements have been designed to be consistent with the overall trail plans and will be an important enhancement for trail users. The Applicant will comply with the County's septic permitting requirements (vault and haul permit) and building permits if required by code. The Application demonstrates adequate plans for access for both construction and maintenance.

F. Public Notice for the Planning Commission's hearing is required by the ULUR. The Applicant should provide proof of compliance with the notice requirements at or prior to the hearing.

V. SUGGESTED FINDINGS

Approval of a Location and Extent Review should include the following findings in accordance with Section 4-112 and 7-102 of the ULUR: (1) The Roaring Fork Transit Authority Rio Grande Trail Enhancement Plans for picnic shelters and self contained toilets facilities are consistent with the applicable provisions of the Garfield County Comprehensive Plan; and (2) The Location and Extent review was referred to the neighboring municipalities consistent with intergovernmental agreements.

Separate from the formal Location and Extent review, Staff supports a cooperative effort between RFTA and the County Road and Bridge Department to ensure the safety of the existing traffic circulation at the County Road 100, Catherine Bridge Parking Area and implement signage, striping, or similar traffic controls as appropriate.

VI. SUGGESTED RECOMMENDATION

A draft resolution including the suggested findings noted above and the general provision outlined below will be provided for consideration by the Planning Commission. A motion by the Planning Commission for approval may include authorization for the Chairman to sign the Resolution.

• The Planning Commission approval is based upon the representations of the Applicant contained in the application submittals and made during the Planning Commission public hearing.

After reviewing , I see that RFTA recognizes and use a parking area along County Road 100 near the Catherine Store bridge. I do see sign age put up by RFT A at this sight. I don't know the history of how that became a parking lot. But I would recommend this parking area be looked at in regards to safety to the traffic on County Road 100.

Road & Bridge has no other concerns.
