The Great Barrier Reef Marine Park Authority (GBRMPA) and the Queensland Parks and Wildlife Service (QPWS) are calling for applications to conduct the activity of swimming with whales in the Cairns Planning Area of the Great Barrier Reef Marine Park and Great Barrier Reef Coast Marine Park (the Marine Parks).

This document provides information about the available opportunity and instructions about how to lodge an application.

The opportunityOne permission for the activity of swimming with whales is available through the Cairns Area Plan of Management as it is only permitted in the Cairns–Cooktown Management Area (Map 1).

In order to maximise the opportunity, this permission is only available to an existing permitted operator with a crewed vessel or an aircraft operation who can demonstrate that they have daily access to the Planning Area.

This permission provides an opportunity to take visitors to outer coral reef locations and provide them with the unique experience of swimming with dwarf minke whales.

This is the only available permissions to undertake swimming with whales and this type of opportunity is rarely offered.

What the permission allowsThe permission for this activity will be added to the successful applicant’s Marine Parks permit. All applicants must be existing operators who can already access the Planning Area on a daily basis. It will allow the operator to advertise and conduct swimming with dwarf minke whales during the whale migration periods (restrictions apply to the number of people who can undertake the activity at any one time).

There is one swimming with whales permission which is available for allocation within the Cairns Planning Area.

Swimming with dwarf minke whalesThe activity of swimming with whales is defined in the Regulations as “an activity for the purpose of enabling tourists to swim, snorkel or SCUBA dive with cetaceans (other than dolphins); or to observe cetaceans (other than dolphins) while in the water with them; using an aircraft or vessel to find cetaceans for that purpose and placing tourists in the water for that purpose”. The only species of cetacean that GBRMPA permits this activity is dwarf minke whales (Balaenoptera acutorostrata).

Management arrangementsThe Cairns Area Plan of Management requires GBRMPA to take a precautionary approach to minimising the disturbance to whales by limiting the number of permissions to conduct swimming with whales activities. The number of permissions has been capped at nine. The species of whale which GBRMPA has permitted tourism operations to interact with is the dwarf minke whale and the activity occurs in the whale migration period between June and August each year.

The activity of swimming with whales must be conducted in accordance with the specifications in the Great Barrier Reef Marine Park Act (1975), Great Barrier Reef Marine Park Regulations (1983), Code of Practice for dwarf minke whale interactions in the Great Barrier Reef World Heritage Area (2008), and Cairns Area Plan of Management (2008).

Applicants are advised to refer to these documents when preparing their application. The Cairns Area Plan of Management is available at the plans of management web page (http://www.gbrmpa.gov.au/zoning-permits-and-plans/plans-of-management) and the Code of Practice is available from GBRMPA’s website or by contacting GBRMPA.

All operations under this permission must be conducted in accordance with the management settings described under Commonwealth and State government management arrangements. Settings place limits on the number of people, vessel size and type of tourist related activities permitted in a Location. Specifically the operation must be conducted in accordance with the management settings described in the Cairns Area Plan of Management.

There are specific requirements about making use of special permissions relating to commencing operations and reasonable use. Once the permission is granted, the operator is required to start the new operation in the Marine Parks within two years. In addition, upon renewal of the permit the operator will be required to demonstrate a reasonable amount of use in order to retain the first option for keeping the special permission. The level of reasonable use will be an average of 50 days use per year over the life of the permit.

Allocation of special permissionsThe swimming with whales special tourism permission requires a more extensive decision making process than a normal Marine Parks permit assessment. The new permission will be allocated through a clear and transparent expression of interest process, which ensures that all prospective applicants are treated equally.

Application for the special permission opportunityTo apply for this opportunity you must complete an application form, at the end of this package, or available from GBRMPA. Each application must:

1. be in the approved form, at the end of this document2. be submitted to GBRMPA between the advertised opening and closing dates 3. include the non-refundable application lodgement fee of $3004. Address the selection criteria and standard application requirements.

The section on making an application (page 6) will help you correctly complete the application form.

Assessment of applicationsInterest for the permission is likely to be greater that the opportunity available and as such GBRMPA and QPWS will rank the applications to identify the most suitable.

The highest ranked applicant will be offered the opportunity to apply for the special tourism permission through a Marine Parks permit application.

The selection criteria which applicants will need to address are:1. Demonstrated competence and knowledge relevant to the tourism opportunity

including evidence that the applicant has the ability to access the Cairns Planning Area, on a daily basis, in an environmentally sustainable manner.

2. Demonstrated knowledge of the specific requirements to undertake swimming with whales, in this case dwarf minke whales (Balaenoptera acutorostrata).

3. Describe the extent to which the operation will enhance protection of Marine Park values, for example through adoption of best practices, Eco Certification, implementing environmentally friendly technology or use of existing moorings.

4. Describe the extent to which the operation will enhance presentation of Marine Park values, for example the quality and quantity of interpretation or education and the standard of client services and infrastructure.

5. Value of contributions that directly assist the Great Barrier Reef Marine Park Authority to fulfil its management responsibilities, for example direct financial contributions to management activities and/or undertaking specific management tasks.

Selection criteria 1, 2 and 3 will have the highest weighting for this assessment.

You must provide all the relevant information in response to the selection criteria at the time of applying. The Marine Parks delegates will base their decision on the information provided in the application and will not seek further information during this process.

An advisory panel comprising suitably qualified people from GBRMPA, QPWS and people with relevant expertise from the broader community will provide advice to the Marine Parks delegate on the ranking of applications based on the quality of the responses to selection criteria.

Decision – Stage 1Applications will be ranked on how well the selection criteria have been addressed. Where two or more suitable applications are considered of equal ranking, GBRMPA will conduct a ballot to separate the applications and select the successful applicant.

The top ranking applicant will be offered the opportunity to apply for the special tourism permission, through a Marine Parks permit application, within 15 business days of the ranking decision.

Applicants will be notified individually of the decision in relation to their application. Notification of all Marine Parks permit decisions will be published in the Commonwealth Gazette as soon as practical after the decisions are finalised.

Stage 2The highest ranking applicant will be required to pay a non-refundable permit application assessment fee upon application for the Marine Parks permit which includes the special tourism permission.

The delegates will assess any Marine Parks permit application against the mandatory and discretionary assessment criteria in the Great Barrier Reef Marine Park Regulations 1983 and the Marine Park Regulations 2006 as per a standard permit assessment.

For the successful applicant, any commitments that were made during the application process may be reflected in permit conditions should a permit be granted.

Review procedures and rightsApplicants have review rights available, subject to exceptions identified under the Regulations. A written statement of reasons or a reconsideration of the decision can be requested, providing an application describing the reasons for the request is made in writing.

Documentation associated with the decision is available by a request made under the Freedom of Information Act 1982, if the request is accompanied by the relevant fee and the documents sought are specified.

Application to the Administrative Appeals Tribunal may be sought in respect to a decision that has already undergone reconsideration.

Making an application

An application form is at the end of this document or can be downloaded from: GBRMPA's website (www.gbrmpa.gov.au) or by contacting the senior project officer, Tourism and Stewardship.

Information to help you fill out the application form and address the selection criteria can be found in this document.

Individual operators may make more than one application. Joint applications will be accepted where the applicants have formed a partnership and therefore are not individually liable.

Please note: One application form and associated application fee is required for each primary vessel or aircraft application.

Part A–applicant and activity details

Questions 1–4 These questions ask who is applying for the opportunity including the contact details of the person or company. Please nominate a contact person who is authorised to discuss matters relating to this application and is available during working hours throughout the evaluation period.

Questions 5–8 These questions ask for information about where you are going to operate, what type of craft you intend to use, whether you will be using ancillary crafts, what activities you intend to undertake and whether the operation extends to an island national park. If your proposal is likely to significantly affect other users of the Marine Parks, you may be required to fulfil public advertising requirements and additional costs will be involved.

Application lodgement feeAn application lodgement fee of $300 is required with the lodgement of your application. Each application can only provide for the use of one primary aircraft or vessel (ancillary craft should be listed). Where more than one application is lodged, then separate lodgement fees will apply for each. The application form has a section

Your application must include the completed application form and payment slip provided at the end of this document. You must complete all relevant questions and address the selection criteria for your application to be considered valid.

Part A establishes the applicant, the contact details and general information about the tourism operation proposed such as types of craft to be used, structures to be built and activities to be undertaken. You are required to provide payment of the application lodgement fee at the time of application. During the application period, GBRMPA will register Part A of your application and receipt your application lodgement fee.

for the payment details. Applications lodged by email must be paid by credit card.

Part B–responses to selection criteria

There are two sets of selection criteria in Part B of the application form. Only answer those criteria specific to the special permission for which you are applying.

Applicant’s declarationYou must confirm that all the information you provided is correct and that you are willing to have the information you provided in your answers to the selection criteria reflected in the permission.

Additional feesIf your application is the highest ranked, the opportunity will be offered to you. If you choose to apply for the Marine Parks permit including the special tourism permission, your application will need to be assessed against the assessment criteria in the Regulations. You will be required to pay the permit application assessment fee (PAAF). This fee is

based on the passenger capacity of

each vessel or aircraft.

Lodgement Each application must include:1. Part A: Completed and signed application form and payment slip. 2. Lodgement fee $300 (note the 2% surcharge if paying by credit card).3. Part B: Statement addressing the selection criteria – if posting your application or

delivering it in person please include Part B in a separate sealed envelope and clearly label that envelope “In Confidence – selection criteria for special permission”. Include this sealed envelope inside the envelope containing Part A.

Part B is where you respond to the advertised selection criteria. If you are posting or hand delivering your application, you must place this part in a separate sealed envelope with your application. Part B of your application will be treated as commercially sensitive and will not be provided to the advisory panel until the end of the application period when all applications will be assessed.

Important considerationsGeneral The onus is on the applicant to understand this

application process and the implications of being involved in the process. GBRMPA will not accept responsibility for any misunderstanding arising from an applicant’s failure to comply with the application process. The applicant is advised to examine the information provided in this call for applications document, the application form, web pages and information in the Regulations, Act and Plans of Management when preparing the application.

The applicant involves themselves in this process at their own expense and without any costs being payable by GBRMPA.

GBRMPA and QPWS reserve the right to add to, delete from, vary, withdraw or reissue the call for expressions of interest (including conditions in this call for expressions of interest documentation) at any time whatsoever. GBRMPA will make reasonable endeavours to inform any affected parties.

An applicant, on submitting an application, shall have granted GBRMPA a permanent, irrevocable, royalty-free licence to copy the application and any supporting material for the purpose of the allocation process.

Applying for a special permission during this application process does not constitute a binding agreement for either party.

GBRMPA and QPWS will rank the applications and only offer the opportunities to those applications that meet the selection criteria to the highest standard. GBRMPA may rank by ballot any applications of equal merit. GBRMPA and QPWS reserve the right to not allocate all, or any, of the opportunities available, if there are insufficient applications that adequately meet the selection criteria.

Actions of the applicants Applicants and their employees must not place

themselves in a position that may or does create a conflict of interest.

Applicants and their employees must not engage in any collusive bidding, anti-competitive conduct or similar conduct with any other applicant.

Applicants must not engage in misleading or deceptive conduct, including making a statement or representation during this process. Prior to completing the application form you should review relevant sections of the Commonwealth Trade Practices Act 1974.

Joint applications will only be accepted where the applicants have formed a partnership and are therefore are not individually liable.

The successful applicants will not make press or other media announcements or releases relating to this allocation process unless approved by GBRMPA.

Application information made available Please be aware that GBRMPA makes basic

information about all current permit applications and decisions available on its website.

The information that may be made publicly available about an application are: applicant’s name, date of application, application number, permit type requested, section of Marine Park to be used, type of craft to be used, structures to be built and activities to be undertaken

All other information in the application (including supporting material) shall be treated by GBRMPA as commercially sensitive and protected from disclosure unless required to be disclosed by law, by the Parliament or a committee of the Parliament, or to be disclosed for the purpose of evaluation (e.g. internal audit). In this case, any third parties shall be informed of the sensitivity attached to that material or information and required to protect it accordingly.

Applications will remain on the premises of GBRMPA and hardcopy and computer security will be maintained as per Australian Government requirements.

Permits, once granted, are publicly available documents and any commitments made against the selection criteria by successful applicants are likely to be reflected in permit conditions and therefore be available to the public.

Questions from applicants Where prospective applicants ask for further

information or clarification from GBRMPA, questions should be addressed to the Senior Project Officer and provided either verbally or in writing (preferably email). The Senior Project Officer will respond to the individual prospective applicant and where it is deemed the answer is of importance to all applicants, and not confidential in nature, the advice will be placed on the web at www.gbrmpa.gov.au. A list of advice will be kept on the web page for all applicants to view. Correspondence between the Senior Project Officer and applicants will be noted on the GBRMPA files.

Providing all the required information You must provide all the relevant information

about your proposal, including your response to the selection criteria, at the time of applying. GBRMPA and QPWS will base its decision on the information you provide.

GBRMPA and QPWS may request further information on the application but there is not the capacity for applicants to amend their offer as expressed in their response to the selection criteria.

GBRMPA and QPWS may seek validation of your claims or extra information about other parts of your application. Where GBRMPA

requests information from the applicant, during the evaluation process, a reasonable response will be required in 21 days after the request is made. If no response is made the application is

taken to be withdrawn by the applicant. GBRMPA is not under any obligation to take into account further information.

Special permissionsSpecial permissions allow operators to undertake an activity or operation that is limited or capped under the current management arrangements for the Great Barrier Reef Marine Park. These permissions may only be allocated through an expression of interest process. The expression of interest process is used to rank applications and will not necessarily result in the offer of an opportunity. Only the highest ranked applicant(s) will have the opportunity to go on and apply for a Marine Parks permit including the special tourism permission. Application fees will not be refunded to unsuccessful applicants.

Privacy notice 1.1 Personal information that Great Barrier Reef Marine Park Authority (GBRMPA) collects from you is protected by

1.2 The information provided by you will be used by GBRMPA when assessing and ranking expressions of interest in accordance with Division 2A.3 of the Regulations. GBRMPA collects your personal information for several reasons, including:

1.2.1 to contact you in order to discuss any aspects of expression of interest1.2.2 to assess your suitability for a permission under the Regulations 1.2.3 to notify you of the outcome of the expression of interest process1.2.4 in the event that you are granted a permission in accordance with the Regulations, to notify you of any

changes to your permission 1.2.5 to include you in GBRMPAs contacts database1.2.6 to generate statistical data.

1.3 In submitting your expression of interest you agree that we will store your telephone number, postal and property addresses, general location (GPS and sub-catchment), and email address in GBRMPA’s contacts database. Information stored in the GBRMPA contacts database can only be accessed by officers of the GBRMPA.

1.4 To properly assess your expression of interest, the GBRMPA may also need to share your information with an advisory panel that will be established to advise the GBRMPA on the expressions of interest received. The advisory panel will be comprised of suitably qualified people from GBRMPA, Queensland Parks and Wildlife Service (QPWS) and other people with relevant expertise from the broader community.

1.5 In the event that you are declared to be an entitled person to make an application for a special permission under Regulation 88A, the GBRMPA may also disclose your personal information to other State government agencies that have responsibility for managing activities associated with any special tourism permission you may apply for.

1.6 If you are granted a special permission, a copy of the permit document and other details about your application, such as your name and address, will be published on the Internet.

1.7 The GBRMPA may use your personal information to produce statistical data that will identify you personally. This data will be used internally by the GBRMPA.

1.8 The GBRMPA will not otherwise disclose your personal information to any third party without your consent, unless otherwise authorised by law. However, the GBRMPA may use your personal information to produce aggregated, de-identified data for statistical purposes and this data may be made publically available. Such data will not allow you to be personally identified in any way.
