Explanatory noteThis Order is made under section 368 of the Mining

The exemption under clause 16 (d) of the Companion Animals Regulation 2008 from the requirements of section 9 of the Companion Animals Act 1998 only applies to an animal in the custody of an organisation listed in Schedule 1 if the organisation maintains a register that is made available to the relevant local council and the Division of Local Government, Department of Premier and Cabinet as requested. The Register must list the names of all carers involved in the rehoming of animals and the locations of all animals received under the exemption while in the custody of the organisation.

Qualifi cation Requirements for an Endorsed Contractor Licence or Supervisor Certifi cate for Residential

Building Work In Various Categories

I, Rod Stowe, Commissioner for Fair Trading, Department of Finance and Services, as the “Director-General” under the Home Building Regulation 2004 (“the Regulation”):

1. revoke all previous instruments in so far as they deal with the same matters as this instrument; and

2. determine, pursuant to clauses 28 (1) (a) and (b) of the Regulation, the possession of qualifi cations or the passing of examinations or practical tests, or both, or the possession of experience of such a kind and for such a period, as specifi ed in the Table to be necessary for an applicant for the issue of a supervisor certifi cate or endorsed contractor licence in the following categories of residential building work:(a) Bricklaying;(b) Carpentry;(c) Decorating;(d) Dry plastering;(e) Erection of pre-fabricated metal-framed home

additions and structures;(f) Fencing;(g) General concreting;(h) Glazing;(i) Joinery;(j) Kitchen, bathroom and laundry

This Instrument commences on the date on which it is signed (“the Commencement Date”).

onto or from a Truck at that Stevedore’s Terminal, which is made using that log-in code.

(f) A Stevedore (and, if applicable, its VBS Service Provider) must allow a Carrier to specify, using the Stevedore’s VBS, that Truck Servicing in respect of the Bookings referred to in clause 25.5 or clause 25.6 is to be performed as one Truck Trip.

[22] Insert the following after Note 2 in clause 14.2 of the mandatory standards:Note 3: It is expected that Sydney Ports will establish

a process that it will apply before giving a notice of the kind referred to in clause 14.2 (e) in respect of a log-in code.

(a) a Truck Arrives at a Terminal at Port Botany;(b) that Truck is manifest in respect of two or more

Bookings that occur in the same Time Zone at that Terminal (whether or not those Bookings are made by the same Carrier or different Carriers); and

(c) prior to the commencement of that Time Zone, a Carrier specifi es, using the relevant Stevedore’s VBS, that Truck Servicing in respect of all those Bookings is to be performed as one Truck Trip,then for the purposes of these mandatory standards the relevant Truck is deemed to have made one Truck Trip in connection with all such Bookings.

25.6 Trucks that are manifest in respect of two or more Bookings in adjacent Time Zones at same Terminal

If:

(a) a Truck Arrives at a Terminal at Port Botany;(b) that Truck is manifest in respect of two or more

Bookings (whether or not those Bookings are made by the same Carrier or different Carriers), where:(i) at least one of those Bookings occurs in a Time

Zone (the primary Time Zone); and(ii) the remainder of those Bookings occurs in a

Time Zone that is either immediately prior to, or immediately after, the primary Time Zone; and

(c) prior to the commencement of the earliest of those Time Zones, a Carrier specifi es, using the relevant Stevedore’s VBS, that Truck Servicing in respect of all those Bookings is to be performed as one Truck Trip; and

(d) a Carrier has not specifi ed that Truck Servicing in respect of any of those Bookings is to be performed as one Truck Trip with Bookings in any other Time Zone,then for the purposes of these mandatory standards the relevant Truck is deemed to have made one Truck Trip in connection with all such Bookings.

Note: Clause 2 prescribes that clauses 25.5 and 25.6 take effect from 3 December 2012.

[35] Insert the following after clause 31 (b) of the mandatory standards:(c) Each time that a Truck which is operated by (or

on behalf of) a Carrier enters a Terminal through an In Gate to complete a Truck Trip in respect of a Booking, the Carrier must:(i) provide to Sydney Ports the vehicle registration

number of that Truck; and(ii) provide such information:

(A) at the time the Truck enters the Terminal; and

(B) by using an RFID Tag which has been fi tted to the Truck.

[36] In section 1 of Schedule 1 of the mandatory standards, insert the following before the defi nition of “Arrive”:ABN means Australian Business Number.

[37] In section 1 of Schedule 1 of the mandatory standards, insert the following before the defi nition of “Import Container”:Incident Report means a report in the form, and containing the details, set out in Schedule 5.

[38] In section 1 of Schedule 1 of the mandatory standards, insert the following before the defi nition of “Service Line”:RFID Tag means a radio frequency identifi cation tag provided by Sydney Ports or its nominated supplier.

[39] Delete the word “and” at the end of section 2 (q) (ii) of Schedule 1 of the mandatory standards.

[40] Delete “.” at the end of section 2 (r) of Schedule 1 of the mandatory standards and substitute “; and”.
