Green Oak Charter Township Board

NOTE: THIS MEETING WILL BE HELD ELECTRONICALLY AS AUTHORIZED UNDER EXECUTIVE ORDER 2020-154. MEMBERS OF THE PUBLIC BODY AND MEMBERS OF THE PUBLIC MAY

PARTICIPATE ELECTRONICALLY, AS DESCRIBED BELOW.

Reason for allowing participation by electronic means: As set forth in Executive Order 2020-154, "To mitigate the spread of COVID-19, protect the public health, and provide essential protections to vulnerable Michiganders, it is crucial that all Michiganders take steps to limit in-person contact. These critical mitigation measures include social distancing and limiting the number of people interacting at public gatherings and at work. Public bodies and entities must continue to conduct public business during this emergency, and the general public must be able to continue to participate in government decision-making and adjudication without unduly compromising public health, safety, and welfare. To that end, it is reasonable and necessary to provide temporary alternative means to conduct public meetings, conduct administrative proceedings, and provide the required notice under tax abatement statutes."

Procedure for public participation by electronic means:

Under Executive Order 2020-154, in order for the Township to allow electronic participation in the meeting, there must be full opportunity for both the general public and the members of the public body to both hear and be heard at appropriate times during the meeting: "A meeting of a public body held electronically must be conducted in a manner that permits two-way communication so that members of the public body can hear and be heard by other members of the public body and so that general public participants can hear members of the public body and can be heard by members of the public body and other participants during a public comment period. The public body may use technology to facilitate typed public comments that may be read to or shared with members of the public body and other participants to satisfy the requirement that members of the public can be heard by others during the meeting."

The Township will be utilizing the video/audio conferencing platform ZOOM. Members of the public body will be able to hear and speak to each other for the entire meeting. Except for any closed session portions of the meeting, members of the public will be able to hear (and possibly see) members of the public body during the entire meeting but will only be able to speak during a public comment period.

Members of the public participating in the public comment via ZOOM will wait in a virtual queue until called during the public comment period. Because of limitations on un-muting and re-muting members of the public, there will be only one public comment period, which will be at the end of the meeting (unless there is a public hearing item, in which case the following procedures will apply to that portion of the meeting as well).

When public comment is permitted, members of the public will be called one at a time, as would happen during an in-person meeting. The Supervisor will determine the order of public speakers. If you want to speak, you must use the "Raise Hand" feature in order for the Supervisor to know you need to be unmuted. When you are unmuted, and you will have three (3) minutes to share your comments to the public body. At the conclusion of your comments or your three (3) minutes, you will be re-muted and then removed from the queue.

Participants may also choose to submit comments that can be read into the record. Comments can be submitted electronically via email to the Township Clerk at: [email protected]. Comments shall be submitted prior to 5:00 p.m. on the day of the meeting.

Procedures for participation by persons with disabilities.

The Township will be following its normal procedures for accommodation of persons with disabilities. Those individuals needing accommodations for effective participation in this meeting should contact the Township Clerk 810-231-1333 ext. 122 at least two working days in advance of the meeting. An attempt will be made to make reasonable accommodations.

Clerk – None 46 47 Supervisor – Supervisor St. Charles reported about the weed control for the Briggs 48 Lake Special Assessment, they are requesting to renew the special assessment district 49 for 10 years with no changes. The contractor is keeping the price the same. Instead of 50 going out and going door to door, he asked if the Board would they consider a Township 51 Board initiated special assessment district. In this case it makes sense. 52 53 PUBLIC HEARINGS 54 55 A. Hillside Lakes of Brighton, Road Paving Special Assessment District 2020 56 57 Supervisor St. Charles opened the public hearing at 7:14 p.m. he explained this is a 58 continuation of the public hearing that was conducted two weeks ago. 59 60 The moderator explained there were no hands raised to comment. 61 62 Supervisor St. Charles closed the public hearing at 7:16 p.m. due to no comments 63 64 B. Huron River Drive Road Maintenance Special Assessment District, 65

Amendment of Year 10 66 67 Supervisor St. Charles opened the public hearing at 7:16 p.m. He explained they are 68 looking at a deficit as of September 1, 2020 of $2848.00 with the collection of the winter 69 taxes, this will still leave the fund short with no funds available for snow plowing this 70 winter and grading next year. 71 72 He explained there are two reasons for the shortfall and they are, one, when the snow 73 plowing was added to the SAD in 2015, for whatever reason the resolution was not 74 generated and the SAD amount was not increased to reflect the snow plowing and 75 sanding. Second, the last three years were wetter than anticipated which resulted in 76 increased snow plowing, sanding of the hill and an increase in limestone for the road 77 due to rain events. 78 79 He reviewed a spreadsheet of all invoices connected with Huron River Drive. The 80 tenth-year budget will eliminate the deficit, allow for snow plowing & sanding along with 81 grading during the summer of 2021. To accomplish this the special assessment will be 82 increased to $477.09 per parcel. 83 84 Randy Cassner, 9190 Huron River Drive & Charles Swanson 9199 Huron River Dr. 85 Mr. Swanson noted there is one extra home at the end of the road, he is not sure on the 86 list who it is. Supervisor St. Charles explained they would not be on the list because 87 they were not on the original roll. Mr. Swanson agreed they should do a new 88 assessment roll in order to include them. They also need to look at improving the road 89 to make it more accessible for emergency vehicles especially in the winter. They have 90 discussed altering the top part of the hill without interrupting the driveways that are on 91 that hill, it might make the approach a little easier. 92 93

Supervisor St. Charles added that he thought in setting up the new district going 94 forward, this road has been a very difficult road to try to maintain, and if he could rely on 95 Randy and Charles to work with him, they may need to get their Township Engineer 96 involved too. Mr. Cassner stated he would be more than happy to work with him, he 97 can go door to door, whatever they need to do to get the assessment done. He 98 appreciated everything they do for their road. 99 100 Dale Turner & Kathleen Walsh, 9192 Huron River Dr., He agrees with extending the 101 assessment for year 10 and whatever they want to do to start a new 10 year is fine with 102 them. 103 104 Supervisor St. Charles closed the public hearing at 7:30 pm. 105 106 BUSINESS ITEMS 107 108 A. 2019/2020 Audit Presentation 109 110 Mr. John Pfeffer provided the audit presentation. He noted the Township was granted 111 the unmodified opinion which is the highest level they can issue. The general fund 112 balance is healthy. 113 114 Supervisor St. Charles expressed his concern regarding Covid-19 and small businesses 115 and the snowball effect on revenue sharing and taxes. Treasurer Daugherty and 116 Supervisor St. Charles noted how everyone at the Township Hall works together and 117 only spends when needed, they all work as a team. 118 119

At a regular meeting of the Township Board of the Green Oak Charter Township, Michigan, held electronically and in conformance with Governor Gretchen Whitmer’s Executive Order No. 2020-154, on October 7, 2020, beginning at 7:00 p.m., Eastern Time, there were

RESOLUTION NUMBER 24-2020 RESOLUTION EXTENDING TEMPORARY OUTDOOR USE LICENSE AND REQUIREMENTS FOR REOPENING CERTAIN PERSONAL SERVICE

ESTABLISHMENTS AND RESTAURANT/BAR BUSINESSES IN LIGHT OF COVID-19 PANDEMIC

WHEREAS, on March 10, 2020, the Governor issued Executive Order 2020-4, declaring a State of Emergency across the State of Michigan relating to the novel Coronavirus 19, or COVID-19; and

WHEREAS, on March 16, 2020, the Governor issued Executive Order 2020-9, imposing “Temporary Restrictions on the Use of Places of Public Accommodation,” which resulted in the closure of restaurants and bars across the state, including in the Township, effective March 16, 2020, at 3:00 p.m.; and

WHEREAS, on March 23, 2020, the Governor issued the first “Stay at Home” Order, Executive Order 2020-21, which ordered non-essential businesses, including retail businesses in the Township, to close to the public; and

WHEREAS, since their initial issuance, those Orders have been extended on various dates for various lengths of time, and as of the date of this Resolution remain generally in full force and effect; and

WHEREAS, as a result of these orders, many personal service establishments and restaurant/bar businesses in the Township have been either closed or open only for restricted hours or purposes for well over two months; and

WHEREAS, the Governor issued Executive Orders 2020-110, 2020-114, and EO 2020-115 which permit the gradual and partial reopening of certain businesses within the Township; and

WHEREAS, under EO 2020-110, EO 2020-114 and EO 2020-115, the reopening of such businesses is subject to limitations on occupancy, requirements for social distancing and other restrictions. In other words, those reopening businesses are not permitted to reopen at full capacity and are not able to use all their existing space as it was before the Orders described above. Consequently, as those businesses seek to reopen, the Township Board expects that they will contemplate alternative means to provide goods and services to the public, but will find that there are complexities and limitations imposed by the Township’s Zoning Ordinance and other Township Code or land use regulations that might affect or limit their ability to take advantage of those alternatives. By way of example only, these could include limitations on the use of adjacent sidewalks and parking areas for outdoor sales and services and/or outdoor seating for food and beverage service, limitations on the number of days and hours of operation for such sales and services, and limitations on zoning districts in which such outdoor sales and services are permitted; and

WHEREAS, while there are options available to reopening businesses to seek interpretations of, relief from, and/or approvals under those regulations, those procedures typically take a significant amount of time to complete, or might not fit the technical requirements for relief, and also require the use of substantial Township resources. Absent some sort of broad relief, the Township believes that a significant number of reopening businesses in the Township can be expected to seek relief from the ZBA, Township Board, or otherwise; and

WHEREAS, the Township Board seeks to avoid overwhelming the ZBA, Planning Commission, and Township Board with individual applications for temporary relief that is needed due to the current pandemic circumstances and emergency orders, and with individual notice and review requirements. The Board has therefore investigated options for temporarily addressing these issues on a Township-wide and expedited basis; and

WHEREAS, the Township Board acknowledges that it has in place a Local Declaration of a State of Emergency, effective March 23, 2020, that can be utilized, under the Emergency Management Act, MCL 30.401 et seq, to waive certain ordinance requirements, but it further acknowledges that the duration of that Local Declaration

has not yet been determined by the Township Board and might not cover the entire period of limited occupancy for restaurant, barbershop, beauty salon and retail businesses; and

WHEREAS, the Township Board also acknowledges the concept of the “moratorium” under which the Township can potentially and temporarily suspend enforcement of provisions of an ordinance, and

WHEREAS, the Township Board finds that the most appropriate way to avoid overwhelming the ZBA, Planning Commission, Township Board, and Township staff and to address the health, safety, and welfare issues caused by the COVID-19 pandemic in a manner that is not detrimental to the public nor contrary to the overall purpose and goals of the Township’s existing ordinances is to temporarily consolidate under and utilize the provisions of the Township’s Code provisions relating to temporary outdoor sales events for purposes of temporarily authorizing the extension of certain permitted uses into outdoor spaces not otherwise allowed to be used, because of the occupancy limitations and social distancing requirements necessary to respond to the COVID-19 pandemic, and for no other purpose or duration.

WHEREAS, on July 1, 2020, the Township Board approved Resolution 14-2020 Regarding Temporary Outdoor Use License and Requirements for Reopening Certain Personal Service Establishments and Restaurant/Bar Businesses in Light of COVID-19 Pandemic; and

WHEREAS, on September 1, 2020, the Michigan Liquor Control Commission approved an Extension for Approval of Limited Permanent Outdoor Service Areas from October 31, 2020 to November 30, 2020.

NOW, THEREFORE, BE IT HEREBY RESOLVED as follows:

1. The Township Board affirms its existing zoning and landuse regulations as reasonable and appropriate in furtherance of the public health, safety, and welfare of the Township, its residents, and businesses.

2. The Township Board finds, however, that the 2020 COVID-19 pandemic represents an unusual and unprecedented event that has caused an interruption in the typical operation of businesses within the Township, but particularly the operation of personal service establishments and restaurants/bars in the Township that rely upon visitors and in-person customers.

3. The Township Board finds that a temporary relaxation ofcertain regulations with respect to the operation of those

businesses, or aspects of those businesses, is an appropriate response to these current unprecedented conditions within the Township, state, and country, and further finds that such temporary relaxation, if properly administered, will not adversely affect the public health, safety, and welfare and will in fact benefit both the businesses and the members of the public affected given COVID-19’s wide-ranging effects.

4. The Township Board hereby determines that it is

appropriate to establish, and it hereby does establish, a Township-wide Temporary Outdoor Use License for (i) outdoor classes or training by businesses such as fitness studios, dog training facilities or other similar uses, (ii) outdoor services for certain personal service establishments, and (ii) outdoor seating and food and beverage service by restaurants/bars, in reliance upon other authorities referred to above, and subject to the following requirements:

a. The provisions of this Resolution and the License

are limited to the outdoor classes or training sessions, personal service establishments (not including massage, ear piercing, waxing/hair removal, tanning, or tattoo services), and restaurants/bars that can meet the requirements of this Resolution;

b. The Township Administration shall establish an initial set of written standards and procedures for receiving and reviewing applications for issuance of licenses for the temporary outdoor uses permitted by this Resolution. Such standards and procedures shall, at a minimum, address and include: i. Operation as part of an existing business with

a valid certificate of occupancy adjacent to or on the same property as the outdoor area.

ii. Compliance with any and all applicable state and local orders related to COVID-19, including social distancing, party size limitations, masking, etc.

iii. Area and location limitations. iv. Required demonstration that indoor capacity

has been limited in accordance with executive orders.

v. Required demonstration that, upon installation of the proposed temporary outdoor sales by retail businesses, temporary outdoor

barber shop and beauty salon services, or temporary outdoor seating and food and beverage service by restaurants/bars, there will remain ample space for parking, vehicular (including emergency vehicles) and pedestrian ingress, egress and circulation, and any other use on the subject site

vi. Spacing limitations for tables, chairs,registers, and the like.

vii. Hours of operation.viii. Temporary structures, such as tents,

canopies/umbrellas, fencing, railings, andthe like.

ix. Separation from parking/vehicular traffic.x. ADA compliance.xi. Compliance with building and fire codes.xii. Provision for litter and waste.Such standards and procedures may be amended fromtime to time, as deemed necessary by and with theapproval of the Township Supervisor.

c. The procedures and requirements for submission andreview of applications and for the approval oflicenses authorized under this Resolution shallinclude, without limitation, the following:i. The application shall be filed with the Zoning

Administrator with a copy to the TownshipSupervisor.

ii. The application shall be on a form provided bythe Planning and Zoning Department, and shallinclude such information as the Planning AndZoning Department determines, including, at aminimum, the information listed in TownshipCode, Chapter 24, Special Events;

iii. The application shall include an accompanyingplan, with the information on the plan toinclude (in addition to the plan informationrequired under Sec. 24-32:1. a scaled layout of premises, any existing

outdoor use areas and expansion area;2. location and clearances to maintain

access to any fire hydrants and FireDepartment connections;

3. dimensioned access to means of egress andbarrier free entrance routes, locationsand sizes of any temporary canopies,umbrellas or tents;

4. locations and description of any fencing or seating area enclosures and egress;

5. location of any relocated barrier free parking; and

6. facilities for waste and trash. iv. Review and approval of the license application

and accompanying plan shall be by the Township’s Administrative Committee, including the Township Supervisor, the Zoning Administrator, the Building Official, and the Township Fire Inspector, with a copy to the Township Clerk, the Police Department. The application and plan may be approved if it provides all of the information and meets the requirements provided herein and under the standards and procedures established under subsection b. above and shall be denied if it does not.

d. A License approved under this Resolution shall expire and the permitted temporary outdoor uses, shall immediately cease and be discontinued, on the same date that the authorizations set forth in this Resolution expire, are revoked, or become null and void under paragraph 7 of this Resolution.

e. A License approved under this Resolution may be

revoked by the Zoning Administrator (or designee) if the applicant fails, neglects, or refuses to fully comply with any and all provisions and requirements set forth in or established under this Resolution, any applicable Executive Order issued by the Governor of Michigan, or any and all provisions, regulations, ordinances, statutes, or other law referenced in this Resolution or otherwise applicable to the business undertaken.

f. Restaurant/bar uses must comply with requirements

of the Livingston County Environmental Health Department and the Michigan Liquor Control Commission.

g. Temporary outdoor restaurant/bar uses that involve

the sale or consumption of alcoholic beverages shall comply with all requirements of the Michigan Liquor Control Act and related laws, including administrative regulations adopted thereunder.

5. The authorizations set forth in this Resolution shallbecome effective immediately and shall expire along with Executive Orders which impose restrictions on reopening businesses, unless extended by the Township Board, subject to the following:

a. If the Governor revokes the Stay at Home Order, orthe Stay at Home Order is otherwise revoked byoperation of law or by court order, and theoccupancy limitations and social distancinglimitations are no longer in force and effect, thisauthorization shall be null and void, and anyactivities authorized shall cease immediately.

b. If the Township adopts an ordinance or ordinancesrelating to the subject matter of this Resolution,this Resolution shall be considered revoked uponthe effective date thereof.

c. The Township Board may revoke or amend thisResolution at any time, and such revocation oramendment shall be effective immediately.

6. There shall be no fees charged for the submission of theapplication or the Township’s review of the application.

7. The Township Administration is directed to review andevaluate the Township’s zoning ordinance and Township Code provisions in light of the recent events related to COVID-19 and the various orders and limitations imposed in response and report to the Township Board any recommended changes thereto as a result of its evaluation.

8. Violation of the requirements of this Resolution and/orany permit authorized hereunder shall be considered violations of the Township Code.

WHEREAS, Starlight MHC has hired a certified operator and possesses the ability and willingness to continue effective operation and maintenance of said system; and

WHEREAS, Green Oak Charter Township recognizes the need for effective and continued operation and maintenance of said system to protect the public health; and

WHEREAS, Green Oak Charter Township deems it impractical for the Township to own, operate, and administer this particular drinking water supply;

NOW THEREFORE, BE IT RESOLVED that Green Oak Charter Township refuses to accept ownership of or operation, maintenance, and administrative Responsibilities for said particular drinking water supply. Green Oak Charter Township endorses the application of Starlight MHC to continue these responsibilities under state permit.

RE: Green Oak Township 2021- 2025 Recreation Plan

Dear Supervisor St. Charles:

Carlisle/Wortman Associates is pleased to submit a proposal of services for preparing the Green Oak

Township Recreation Plan. Our previous work with the community and our recreation planning

experience makes us well-qualified to assist you in the development of this plan. In addition, we are well­

acquainted with the current Michigan Department of Natural Resources (MDNR) requirements for

recreation plan and grant application submittals. Adoption of the plan will be critical for the community

as you pursue grant funding in the coming years.

We are enclosing a work plan, timeline, and fees for your review. Since the completion of your previous

plan, the DNR has changed submission deadline for Recreation Master Plans to February 1, 2020. We

propose completion of the plan by December with adoption of the plan at the first Township Board

meeting in January (January 6, 2021). This schedule will provide time to collect the official minutes and

resolutions with adequate time left to submit the plan. Once submitted, the Township will qualify for state

grant applications. Paul Montagna will act as the Project Manager and primary contact for this project.

Chris Nordstrom will manage the remainder of the work.
