4. Call to the Public Tim Wiggle, 9200 Chilson, addressed the Board. He thanked the Board for granting him the opportunity to serve the community on the Zoning Board of Appeals and the Parks and Recreation Committee. He stated he supports Annettee Koeble, who is running for Township Board Trustee in the November 2016 election.

6. Approval of the Consent Agenda

Motion by Menzies, supported by Negri, to approve the Consent Agenda as presented. Voice Vote: AYES: 7 MOTION CARRIED

8. Tim Wiggle – Resgination and Presentation

Supervisor Hohl and Clerk Neilson presented Mr. Wiggle an award in recognition of his years of service on the Zoning Board of Appeals and Parks and Recreation Committee. Tim Wiggle read his resignation letter aloud for the record.

12151.004 H.E.R.O. – 2016 Fun Fest Fees Motion by Neilson, supported by Hahn, to waive park use fees for the 2016 HERO Family Fun Fest. A damage deposit of $2,000 will be collected. Voice Vote: AYES: 7 MOTION CARRIED 03161.004 Park Use Request – H.E.R.O. Fun Fest – 2017-2021 Hohl introduced the members of the ad-hoc committee. Hahn reported that the committee, comprised of Trustee Dolan, Trustee Negri and himself, met with members of H.E.R.O and came to an agreement, however the suggested layout still kept Fun Fest on the sports fields. After walking the site, it was determined that an area of the park could be leveled out to accommodate the Fun Fest carnival rides. This new leveled areas will increase the usable area in Manly Bennett Park. Motion by Hahn, supported by Dolan, to approve Park Use for HERO – Family Fun Fest, for event years 2017, 2018 & 2019 as detailed in Addendum revised March 11, 2016. Use will be subject to items 1-5 on the addendum, including re-location to an area as identified on the drawing attached to the addendum, which will be leveled to house the carnival rides. No fees will be assessed in excess of what is described in the addendum, and use is subject to all required paperwork being submitted to the satisfaction of the Clerk’s Department. Voice Vote: AYES: 7 MOTION CARRIED Hahn thanked the members of H.E.R.O. for working with the Board, and thanked the Supervisor and Clerk for providing their input. Hohl stated there is money currently in the park reserve, so funding this improvement won’t affect the budget. Joanna Hardesty, H.E.R.O., addressed the Board. She thanked them for their efforts in keeping Hamburg Fun Fest in Hamburg. 03123.005 SAD Crystal Drive/Crystal Beach Road Maintenance Bids 2016 Motion by Hohl, supported by Negri, to award the new 12-month service contract to Alan’s Asphalt Maintenance Inc. beginning on April 9th, 2016 and ending on April 17th, 2017 for the Crystal Dr./Crystal Beach subdivision road maintenance district. Voice Vote: AYES: 7 MOTION CARRIED 04122.004 SAD Downing Drive Road Maintenance Bids 2016 Motion by Hohl, supported by Negri, to award the new two-year service contract to Alan’s Asphalt & Maintenance, Inc. beginning on May 1st, 2016 and ending on April 30th, 2018 for the Downing Drive road maintenance district. Voice Vote: AYES: 7 MOTION CARRIED 03123.006 SAD Rustic Road/Lake Pointe Road Maintenance Bids 2016 Motion by Hohl, supported by Menzies, to award the new twenty-one (21) month service contract to Bob Myers Excavating, Inc. beginning on April 15th, 2016 and ending on January 22nd, 2018 for the Rustic Road/Lake Pointe Drive road maintenance district. 03163.005 Police Department – Fuel Card Policy Motion by Negri, supported by Menzies, to approve the Operational Procedure 300-37 for the Hamburg Township Police Department, to establish guidelines for the use of department fuel cards in the fueling of Hamburg Township police vehicles. Voice Vote: AYES: 7 MOTION CARRIED 03163.006 Salary Adjustment – Fire Inspector Jordan Zernick Motion by Dolan, supported by Neilson, to approve a 4% increase to Inspector Jordan Zernick’s pay for receiving both his Plans Examiner Certification and Fire Inspector II Certification, retroactive to January 31, 2016 when final notification was received. Hourly rate will be increased to $22.07. Voice Vote: AYES: 7 MOTION CARRIED 03163.007 Fire Millage Language Hohl stated a presentation for the Fire Millage was made at Strategic Planning earlier today. Drury stated there is no language regarding a renewal or expiring millage, so there should be no issues at the State level with the wording. Negri moved the Resolution, supported by Hahn, to approve Fire Millage Language for the August Primary Ballot as follows: Shall the limitations on taxes which may be levied against all property in Hamburg Township, Livingston County, Michigan be in the amount of 1.75 mill ($1.75 on each $1,000.00 of taxable valuation) for a period of ten (10) years, 2016 to 2025 inclusive, for the purpose of providing funds for the operation and capital expenditures of the Hamburg Township Fire Department? If approved by the voters, the estimated revenue that would be collected in the first calendar year is $1,689,835.00 Roll call vote: Hohl – Y, Neilson – Y, Carlson – Y, Dolan – Y, Menzies – Y, Negri – Y, Hahn – Y RESOLUTION PASSED 03163.008 Assessing Department Open Position – Deloris Ricchiuti Motion by Neilson, supported by Negri, to approve the hiring of Deloris Ricchiuti as Appraiser for the Assessing Department as outlined in the March 2, 2016 memo from Supervisor Hohl, with a start date of March 29, 2016, and a starting rate of $26 per hour, Grade 9, contingent upon the completion of all pre-employment requirements as outlined in the Personnel Policy & Procedures Manual. She will be given 10 days paid vacation in the first year to be coordinated with Department Head Susan Murray, and will not be eligible for any increase in compensation until July 1, 2017. Voice Vote: AYES: 7 MOTION CARRIED 03163.009 Don Burtraw Compensation Motion by Hohl, supported by Hahn, to approve an additional $3.00 per hour for the 971.5 hours Don Burtraw worked during the time Assessor Susan Murray was ill, as a one-time payment. The Board also approved an increase in Don Burtraw’s hourly compensation from $24.66 to $27.00 per hour effective February 29, 2016. Don will not be eligible for an increase in July of 2016. This increase is based on the initiative and leadership displayed by Don Burtraw in operation of the Assessing Department in the absence of Assessor Susan Murray and Appraiser Barb D’Angelo. 03163.010 DPW Full Time Position – Jonny Sharp Motion by Hohl, supported by Carlson, to approve the hiring of part-time employee Jonny Sharp for the full-time DPW Tech position at a six-month probationary rate of $18.50 per hour, with an increase to $19.00 per hour after successfully completing his probation. This contemplates no compensation increase on July 1, 2016. Pre-employment requirements have been completed as he is an existing Township Employee. The Board approved a $35 monthly phone stipend for Mr. Sharp effective immediately. Voice Vote: AYES: 7 MOTION CARRIED Motion by Hohl, supported by Menzies, to approve a $35 monthly phone stipend for Ryan Ward effective January 1, 2016. Voice Vote: AYES: 7 MOTION CARRIED Motion by Hohl, supported by Negri, to authorize Tony Randazzo to run an advertisement for the part-time DPW position that Mr. Sharp vacated. Voice Vote: AYES: 7 MOTION CARRIED 03163.011 Natural Gas Contract Motion by Hohl, supported by Neilson, to authorize the Supervisor and Clerk to enter into a 2-year agreement with Interstate Gas Supply to secure a fixed price of $3.19 per MCF for all gas delivered during the NGDC billing cycle starting April 2016 and continuing through March 2018. Voice Vote: AYES: 7 MOTION CARRIED 03163.012 Performance Review Procedure & Wage Increases Motion by Neilson, supported by Hohl, to approve revision to Section 5.2 Compensation as presented. Modifications include that mid-year salary adjustments will not be entertained unless accompanied by an employee classification change, and that for a new hire, the hiring Department Head must specify salary progression in their memo to the personnel committee and the Township Board. Voice Vote: AYES: 7 MOTION CARRIED 03163.013 Zoning – Lot Division – Roveka Acres Motion by Menzies, supported by Hohl, to approve the establishment of three (3) separate tax IDs for lots 1, 2 & 3 of the Roveka Acres subdivision recorded in 1953 as #15-28-401-044. Establishment of separate parcel IDs in no way implies to current or future owners that the individual lots are buildable, and the Board further directs the Zoning Administrator to document the parameters for each non-conforming parcel in a filing with Livingston County. Voice Vote: AYES: 7 MOTION CARRIED 03163.014 Zoning Board of Appeals – Appointment – Jim Hollenbeck Motion by Menzies, supported by Neilson, to appoint Jim Hollenbeck as a permanent Member of the ZBA to serve the remainder of Tim Wiggle’s term that expires June 30, 2018. Voice Vote: AYES: 7 MOTION CARRIED 03163.015 A Bridge to Literacy Motion by Negri, supported by Menzies, to direct Supervisor Hohl to sign “A Bridge to Literacy” agreement, to support partnership between the Hamburg Township Library, Pinckney Community Public Library, and Pinckney Community Schools. Voice Vote: AYES: 7 MOTION CARRIED

03163.016 Payment Approval – C&E Construction – Invoice No. 1975 Motion by Negri, supported by Menzies, to approve payment to C&E Construction Co. Inc. in the amount of $19,910 for invoice #1975 dated February 12, 2016. Voice Vote: AYES: 7 MOTION CARRIED 03163.017 Payment Approval – Dubois-Cooper – Invoice No. 187039 Motion by Hohl, supported by Negri, to approve payment to Dubois-Cooper in the amount of $11,190 for invoice #187039 dated February 23, 2016. Voice Vote: AYES: 7 MOTION CARRIED 03163.018 Payment Approval – Bob Myers – Invoice No. 2016-18 Motion by Hohl, supported by Neilson, to approve payment to Bob Myers in the amount of $21,290 for invoice #2016-18 dated February 22, 2016. 11. Call to the Public Mike Bitondo, 2020 Darwin, addressed the Board. He thanked the Board for their support of the Fun

Fest, and feels there are benefits that the event provides that aren’t measurable. He stated that Jim Hollenbeck was a Trustee at the same time he was.

6. Strategic Planning Meeting

Fiscal Year 2016-2017 Departmental Presentation of Goals & Objectives

Police Department – Police Chief Rick Duffany Police Chief Duffany reviewed the Goals and Objectives for the Police Department for the 2016/2017 Fiscal Year as provided in the packet. He stated that the first 6 goals listed maintain what is in place now. He stated the response time has been greatly reduced due to the extra patrols, overlapping shift, etc. They are looking for a way to install permanent weight scales, the transportable ones are inefficient. Menzies asked if the Township still received forfeiture funds with Lawnet. Chief Duffany stated there are forfeiture funds coming in, but no funding being distributed to the participating organizations. He stated the funding is being retained in Lawnet, as the participants are most interested in keeping Lawnet in place. They currently have a 2-year rolling cushion. Hohl stated the Township Board will need to address the Police Millage before 2018. Dolan stated the scale cut out will cost thousands, but the return on investment can be high through violation fees.

Treasury – Al Carlson, Treasurer Treasurer Carlson reviewed the Goals & Objectives for the Treasury for the 2016/2017 Fiscal Year as provided in the packet. Hohl asked how the Department was on records retention. Carlson stated they were good, and they were preparing for a new Treasurer in November. Hahn stated it might be a good idea to review process with the people running for the office, to give them an idea of what is involved in the position, specifically as it relates to the Finance Control Book. Hohl stated the Board needs to look at quantifiable returns vs risk. Rabb stated she thinks the Township can go out further than 2 years, to possibly 5 or 10. She stated there aren’t a lot of options at the 2-year mark. She stated other kinds of investments may help. Hohl suggested setting a date for presenting options for changes in the investment policy. He stated data could possibly be presented at the Budget workshop. Hahn stated he would like to be involved in the work group. Supervisor – Pat Hohl, Supervisor Supervisor Hohl reviewed the Goals & Objectives for the Supervisor’s Office for the 2016/2017 Fiscal Year as provided in the packet. He stated he is in the process of developing a Request for Proposal (RFP) for a Single Waste Hauler for the residents as well as a recycling option. He stated the plan would be to go to voters to see if they would support it. Hahn stated he worries about more Government involvement, in his opinion there should be less. Hohl stated if the Board doesn’t want him to pursue options, please let him know. He stated the Township was not awarded the Iron Belle Trail Grant. He would like to revisit a Boat Launch option along the Huron River. Hahn stated he doesn’t ever see the Board in support of the Iron Belle Trail going up McGregor Road and stated perhaps the Board should be pro-active in eliminating that option and telling the State to find another route. Dolan stated he would like to hear resident feedback. Motion by Hohl, supported by Negri, to direct Clerk Neilson to add Single Waste Hauling as an agenda item at the next Township Board meeting in April. Voice Vote: AYES: 7 MOTION CARRIED DPW, Tech Services, Building & Grounds, Cable TV & Computer – Tony Randazzo Randazzo reviewed his Goals & Objectives for the 2016/2017 Fiscal Year, as provided in the packet. He reviewed goals for each Department including: DPW, Cable TV and Computer, Building & Grounds, Tech Services. Dolan asked what could be done to get better programs on the Cable station, or if there was a way to maximize usage such as putting internal programs on the station. Randazzo stated it is difficult to find free/low cost programming with broadcast rights, Brenda does the best she can do. He stated that internal stuff is a great idea, but it can’t be driven by IT, the Departments each need to find time to provide clips. Menzies stated audio is still bad over cable T.V. during the meetings.

Randazzo stated the audio did have issues that didn’t stem from the Township equipment, and the cable company has made some changes which should help moving forward. Planning/Zoning & H.E.R.B. – Scott Pacheco, Zoning Administrator Pacheco reviewed the Goals and Objectives for H.E.R.B. & the Planning and Zoning Department for the 2016/2017 Fiscal Year, as provided in the packet. Dolan asked if anything was happening with the Dewey’s property. Pacheco stated there has been some interest in the property, and the Township is working with Ann Arbor SPARK to promote the area for development. Pacheco stated HERB is not active, and he would like to ask the Board to either re-activate the group or disband it entirely. He stated there are some large projects coming up that would require review. Hohl stated in his opinion the committee members could be reduced to 5 total. He stated the Board needs to decide whether or not to continue to have a HERB Board and if not, the Zoning Ordinance needs to be updated to remove their reference. Dolan asked if the Board was advisory. Hohl stated it was. Pacheco stated if the Township decides the Board should remain intact, the appointments should be qualified and specific to environmental issues. Motion by Dolan, supported by Negri, to direct the Zoning Administrator to provide a report to the Township Board outlining the best options for moving forward with the HERB Board either by re-activating the board with a reduced number of members or dis-continuing the board entirely. Changes would require updates to the Bylaws and Zoning Ordinances. Report to be made at the first meeting in April. Voice Vote: AYES: 7 MOTION CARRIED Pacheco stated the Township can always hire a consultant to do a review. Assessing – Susan Murray, Assessor Murray reviewed the Goals and Objectives for the Assessing Department for the 2016/2017 Fiscal Year, as outlined and provided in the packet. She stated the scanning of their records is approximately 98% done. She stated they finished all of the township re-measuring and drawing and will start back on area 1. She stated the State requires 20% per year be completed so all properties have been visited once every 5 years. Clerk Department – Jim Neilson, Clerk Clerk Neilson reviewed the Clerk Department Goals & Objectives for the 2016/2017 Fiscal Year as provided in the packet, for Clerk, Elections, Cemetery & Senior/Community Center. Negri stated the Clerk’s office should make the Cemetery a priority. Parks & Recreation – Deby Henneman, Parks Coordinator Henneman reviewed the Parks and Recreation Department Goals & Objectives for the 2016/2017 Fiscal Year as provided in the packet. She stated her main focus moving forward is completing safety and compliance with the Americans with Disabilities Act (ADA) Standards. She presented a PowerPoint outlining the expectations of the upcoming Transition Plan audit.

Accounting Department – Angie Rabb, Accounting Director Rabb reviewed the Goals and Objectives for the Accounting Department for the 2016/2017 Fiscal Year, as provided in the packet. Group Discussion Hohl stated that he and Rabb will be working with all Department heads on reserves and will provide a proposal and draft budget to the Board. He stated the Personnel Committee will need to discuss employee salaries for the upcoming fiscal year. He stated Job performance reviews are due April 1, 2016. Fire Department – Mark Hogrebe, Fire Chief Chief Hogrebe reviewed the Goals and Objectives for the Fire Department for the 2016/2017 Fiscal Year, as provided in the packet. He reviewed the upcoming Capital Improvements as well as response rates, and presented the Millage Language that the sub-committee is proposing for the August Ballot. Negri asked if the millage funding would allow for the Fire Department to remain on the “cutting edge” of technology. Hogrebe stated it would, and that as a Department they always do their research to get the best cost savings when investing in a piece of equipment. Hahn stated it would be nice for the Township Board to have Millage talking points on a 3x5 card.

existing dwelling with a 7-foot south side yard setback and an 8.25-foot north side yard setback where 10-foot side yard setbacks are required (Section 7.6.1.). Also an existing 120-square foot shed will be 6.25 feet from the dwelling where a 10-foot separation between structures is required (Section 8.3.4).

The ZBA’s decisions on these projects will be provided in the March 2016 Planning and Zoning Department Report. PLANNING COMMISSION The Planning Commission held a hearing on February 17, 2016 to discuss the following items:

a. Planning Commission review and approval of lot combination 16-001. The project request is to combine the existing .53 acre developed site at 10102 Imus Road (4715-28-204-059) with the adjacent 1.02 acres undeveloped site (4715-28-200-065).

The Planning Commission approved this lot combination application.

b. Planning Commission review of the administrative requirements for drainage and grading

permits. The Planning Commission made a motion to continue this discussion to future Planning Commission hearing. c. Planning Commission review of Minor Zoning Amendment to Article II, Article VII-

Section 7.6.1 and Article VIII-Section 8.15 and 8.17. The proposed zoning amendment will:

i. Revise the definitions of Balcony, Deck, Patio, Porch, Terrace, Stops and Steps and change the yard encroachment regulations to match the new definitions;

ii. Revise the wording under intersection visibility to allow better enforcement of the section and to better meet the intent of the regulation; and

iii. Revise the definition of Lot Coverage to better clarify the difference between building lot coverage and impermeable surface lot coverage.

The Planning Commission made a motion to continue these amendments and notice items i and iii for public hearings at the March 16, 2016 Planning Commission Hearing.

The Planning Commission held a Public Meeting on March 16, 2016 and March 30, 2016 that will be discussed in the March 2016 Planning and Zoning Department Report. TRAINING On Wednesday February 10, 2016 the MDEQ presented Floodplain Management 101 at the Township Board Room. This training discussed the states building code and local municipalities’ regulations regarding development within the floodplain and floodway. Approximately 20-30 people attended, including local developers and engineers, building department staff, surround township staff and Hamburg Township staff and board members. On February 19, 2016 from 2:30 to 4:40, I participated in the Student Michigan Association of Planners conference as a profession mentor. Mentors where asked questions by students about the professional planning process and different working environments. On February 23, 2016 three people from Hamburg Township, Amy Steffans, Fred Goetz and myself attended “The Basics of Master Plans and Planning” hosted by The Livingston County Planning Department from 7:00-8:30 at Livingston County Public Safety Complex, Howell Auditorium, 1911 Tooley Road, in Howell. This was a very interesting discussion Since Hamburg Township is starting the process to update it Master Plan Documents this presentation should be interesting. The first of a six part workshop on Master Plan. On April 13, 2016 the Livingston County Department of Planning is holding a Brown Bag Lunch Series event at 12:00pm in the Oceola Township Hall, 1577 N. Latson Road, Howell, MI 48843. The guest speaker for this event will be Christopher Patterson, attorney for Fahey, Schultz, Burzych, Rhodes PLC who will focus on sign regulations following the Reed v Gilbert decision

(US Supreme Court, June 2015). The outcome of this important case has become the impetus for many communities updating their sign regulations and is important in understanding how our local governments address signage needs in the future. Mr. Patterson authored the June 2015 township law e-letter on sign regulations for his firm and brings several years of municipal law expertise to better instruct our local governments on this vital issue. As the Township is currently working on revisions to it Sign regulations I would suggest that this would be a good event to attend. On April 14, 2016 the Michigan Association of Planners will be holding its Spring Institute in Lansing, Michigan. This is an all-day conference where you will learn about regulatory and programmatic tools to make affordable housing happen in your community; how missing middle housing is a key solution to keep talent and families in Michigan; and how other states are advancing best planning practices to implement housing solutions. There will also be inspirational national speakers and state and local planning and housing experts to provide the tools and resources to help you create prosperous, safe, healthy, and equitable places.

1. Park Coordinator’s Report

Henneman reviewed Park Coordinator’s Report dated February 19, 2016. ADA Transition Plan presentation will be made at Strategic Planning meeting on March 15, 2016. Inquiries have been made to Livingston County Road Commission (LCRC) for temporary speed limit reductions for large events, costs for second crosswalk and warning to pedestrians using crosswalks that traffic may not stop. Community Garden project has been approved. Park It! event has been discontinued. “As Built” has been ordered from Northwest Design Group (NDG) for the MNRTF #13-014 reimbursement paperwork and a Declaration and Notice will be presented to the Township Board on March 1, 2016. 2. Senior/Community Center Report Hoskins reviewed the Senior Center Report dated February 23, 2016. Senior Advisory Board Meeting: was held on February 17, 2016. They are looking into the feasibility of starting a walking club. There has been good support from seniors in picking up their newsletters. Barry Manilow pot-luck went well. There will be a presentation on Acupuncture and physical therapy. Trips have been successful. 3. Correspondence Letter Dated 2/17/16 from HERO in support of the 2017-2021 Park Use Request 4. Neilson stated that HERO is requesting a 5-year contract for the Family Fun Fest event. He stated he is not in agreement for multi-year contracts, and no other entities are granted use for multiple years. He stated the application is also asking for the same space being used now, but there is a good change that irrigation will be added to the ball diamonds which may prohibit the ability to use heavy equipment in those areas. He stated too many things can change from year to year so a multi-year contract may not be the best for the Township. Bennett stated the fees that have not been collected in past years from this group should be addressed. He stated in his opinion this event shouldn’t be on the East side of the park. Wiggle stated a 1-year approval would prohibit HERO from making multi-year contracts of their own, many of the vendors including the carnivals book 2 to 3 years ahead. He agrees that 5 years may be excessive, but would like the Committee to at least consider 2 or 3 years. As far as the concerns with future irrigation, he stated that HERO has always made and paid for all repairs for damages they have made in the past. He stated he doesn’t feel HERO should be charged fees for their event as they give back to the community. Bennett would like to see a list of their contributions. Park Coordinator to provide. Koeble stated there were several changes to site layout that were made to the 2016 event, so before discussing 2017 and beyond, she would like to see how 2016 works out. She stated she is okay with multi-year contracts, but agrees that 5 years is excessive.

Dolan stated a damage mitigation plan was worked on for 2016, and he would like to see the results of that plan before making a decision on future use. Hoskins stated she appreciated the information packet HERO provided. Dolan asked how, as a committee, it is decided who gets charged and who doesn’t. He pointed out that HCSC was charged for their Tournament. Wiggle stated the Fun Fest is for the Community, he doesn’t feel fees should be charged. Hardesty stated any fees charged to HERO for this event will be prohibitive if the rates are the same as what is expected from the sports groups. Doncea stated the Township Attorney was the original person who came up with the idea to charge $5 per car for parking. Dolan asked Hardesty if she knew when applying for use that the Parks & Recreation Committee was unable to waive fees. Hardesty stated she knew that. She stated the Hamburg Fun Fest is the only thing happening in our town, all the rest of the events are gone. She stated events such as these in other communities have monetary support from their municipalities. She stated HERO is not asking for monetary support, they are only asking to use their own park without a charge. Haag asked if Hardesty was affiliated with Wade Shows, the vendor for the carnival. Hardesty stated she was, and added that Wade Shows had the contract with HERO long before she was given a position with them. She asked why there were field improvements planned for sports fields that are losing participants. Anja Mackey, addressed the Board. She stated she understands the need for irrigation on the soccer fields since there are a number of kids running up and down the fields, but the sport of baseball is not the same. She stated the outfield only has a few kids and gets less wear. She stated in ground irrigation is expensive, and perhaps alternative solutions could be found. Henneman spoke to Hardesty’s concern as to why field improvements were being planned for sports fields when participants in the recreation programs were dwindling. She stated there are other age groups that have requested use in the past and the facilities were unable to accommodate those requests without the improvements that have been made to date. Making improvements to the irrigation and lighting will open up use to all age groups, and allow for evening leagues to occur. Motion by Dolan, supported by Haag, to recommend denial of the H.E.R.O. Family Fun Fest Event application as submitted, on application dated January 21, 2016, based on the request being for a 5-year use, and the concern with the requested site location for the event. Dolan stated Public Safety should determine what is needed, what is required of staff and what the cost would be, then make a recommendation to Parks & the Township Board. Motion by Dolan, supported by Haag, to recommend to the Public Safety Committee that the topic of Public Safety Concerns/Presence at Large Events be made an agenda item and to have the Police Chief and Fire Chief available at a daytime Township Board meeting to discuss the safety concerns and action plan moving forward. He stated the decisions made today were not because of lack of support.

March 19, 2016 To: Parks & Recreation Committee From: Deby Henneman, Parks Coordinator Re: Park Coordinator’s Report The ADA Transition Plan presentation was made at the Strategic Planning meeting for the Township on March 15, 2016. The audit will be scheduled ACT Services, Inc. and will occur this summer. I have not received updates from the Livingston County Road Commission regarding the process for requesting temporary speed reduction on Merrill Road, and will be following up on that request. Our first large event is scheduled for the weekend of May 6, 2016. The MNRTF Grant reimbursement paperwork will be submitted as soon as the filed copy of the Declaration has been received from the Livingston County Clerk’s Department. The “as-builts” have been received from Northwest Design Group. At the March 15, 2016 regular board meeting, the Township Board approved a 3-year park use for H.E.R.O. for their Hamburg Family Fun Fest event. The use is contingent on compliance with 5 addendum items, which have been included in the packet along with an excerpt of the motion. Fees for the 2016 Fun Fest were also addressed by the Board and were waived. Recent inquiries to Parks Department have included:

• Installation of Outdoor Tennis Courts and a hitting wall • Ability to play Disc Golf at night with “glowing discs” – until 1 a.m. • Ability to park overnight in park facilities for carpool

The Goals and Objectives for the Parks Department were presented to the Board at the Strategic Planning meeting held on March 15, 2016. Subject: Intent to Establish a “Trail Town” District – Lakelands Trail Trails can have an impact on the local economy. Trails help attract and support tourism and new businesses to an area. Local residents often spend money on trial related activities and related businesses. Hamburg Township has a great opportunity with the existing Lakelands Trail to utilize this as an economic development tool. The “Trail Town” concept is relatively new to Michigan, but is growing rapidly throughout the state. The “Trail Town” designation is an economic development strategy that utilizes trail systems to help better serve and attract both residents and recreational visitors to an area. This designation also opens up the area to addition grants and state funding opportunities. Over the past few months Hamburg Township has been working in calibration with the Village of Pinckney and Putnam Township to create a “trail town” district along the Lakelands Trail. Currently we are working to find funding for a wayfinding signage program that will direct users of the trails to services and businesses throughout the Township. One of the first steps in becoming a designated “Trail Town” district is for the Board of the local municipal to pass a resolution declaring the intent to establish a district. Attached to this report is a draft resolution for your review and approval. Subject: Hamburg Environmental Review Board (HERB): At the March 15, 2016 Township Board Strategic Planning Meeting the HERB Board was discussed. This HERB has not been utilized since 2006. Planning and Zoning Staff would recommend that the Township Board consider one of the following options:

1) Filling the existing nine member HERB and leaving everything else the same; 2) Changing the HERB by-laws to reduce the number of Board Members from nine to

five, filling the five member board and leaving everything else the same, or 3) Disbanding the HERB and amending the zoning ordinance by removing all references

to HERB and adding an option to request the review of an environmental consultant when deemed necessary.

The Hamburg Township Zoning Ordinance states that HERB can be used in the following ways: The Zoning Administrator of Planning Commission may refer final wetland determination, site plan review, land use permit, land division, subdivision, and condominium applications to the HERB for review under section 3.6.3 (B), 3.7 and 4.5.3 of the Zoning Ordinance. The HERB Board is required to review and make recommendations to the Zoning Administrator or the Planning Commission if there is proposed cutting and removing of vegetation within a natural rivers vegetation strip, or if there is a proposed creation or alteration to a water body under sections 7.5.1 (G) (G) (3), 9.2.2, and 9.2.3. Section 3.6.3 (B) of the zoning ordinance states “The Zoning Administrator or the Planning Commission may refer final wetland determinations to the HERB for review and comment, as described in Section 3.7 below.” Section 3.7 of the Zoning Ordinance states “the Zoning Administrator or the Planning Commission may request HERB review of any land use permit, site plan, subdivision, condominium or land division application to comment on environmental concerns related to the project and compliance with any Township, County, State and/or Federal environmental regulations. The Zoning Administrator shall schedule a meeting date for the HERB to review the

application after all required information is submitted. Following review of the submittal, and other appropriate information, the HERB shall make a recommendation to the Township Planning Commission on the project's compliance with applicable Township, County, State and/or Federal environmental regulations, concerns with significant environmental impacts resulting from the proposal and suggested mitigation measures to minimize the impacts. If there is potential for the project to have a significant impact on the human and natural environment, the HERB may recommend to the Planning Commission that the applicant be require to conduct environmental assessments and/or produce documentation of compliance with any Township, County, State and/or Federal environmental regulations. Such environmental assessments, studies and documentation shall be prepared by a qualified professional and be the responsibility of the applicant. The purpose of this requirement is to ensure necessary analysis on the environmental impact is available to Township officials prior to any decision being made.” Section 4.5.3. of the Zoning Ordinance states “The Zoning Administrator or the Planning Commission, or the Township Board of Trustees may request a review by the Hamburg Environmental Review Board, under the provisions of section 3.7.1, HERB Review, of the environmental concerns with any site plan application and the site plan's compliance with all Township, County, State and/or Federal environmental regulations.” Section 7.5.1(G)(G)(3) of the Zoning Ordinance required that the Hamburg Environmental Review Board review and make a recommendation to the Zoning Administrator prior to allowing any cutting and removing of vegetation within a natural rivers vegetation strip. Section 9.2.2. of the zoning ordinance required a Special Use Permit except for activities which comply with Section 9.2.3. for the creation or alteration of a water body and “if a final wetlands determination is required per Section 3.6.3, the Zoning Administrator shall forward the completed application to the Hamburg Township Environmental Review Board (HERB) for review and recommendation prior to the hearing by the Planning Commission.” Section 9.3.2 of the zoning ordinance lists alterations of a water body that do not require a special use permit. However these alterations require a Land Use Permit and that prior to the issuing a LUP a completed application shall be forwarded to the HERB for review. Following approval by the HERB and subject to the approval and conditions of any applicable MDNR permit, the Zoning Administrator may than issue a Land Use Permit for the following project: A. Filling or dredging activities involving a total of thirty (30) cubic yards or less during a twenty-four (24) month period. B. Construction of a sea wall. C. Filling or dredging of wetlands conducted as part of an activity allowed within a wetland under the Goemere-Anderson Wetland Protection Act, P.A. 203 of 1979, as amended. D. Filling or dredging of wetlands conducted as part of an activity which has received a wetland use permit from the MDNR under the Goemere-Anderson Wetland Protection Act, P.A. 203 of 1979, as amended. These activities shall be subject to the following minimum standards:

1. Any fill, dredging, or construction shall not extend beyond the bulkhead line as established by review of the Michigan Department of Environmental Quality.

2. Shoreline fill, dredging, or construction of bulkheads or seawalls shall be permitted for the following:

a. To stabilize the shoreline; b. To improve access to the water; c. To protect or improve the natural flow of water; and d. To improve the aesthetic value of the property.

3. In no case shall shoreline fill, dredging, or construction of bulkheads or seawalls impede the natural flow of water or obstruct the access of boaters to deeper waters. 4. No bulkheads, seawalls, or fill shall project beyond an existing bulkhead, seawall or shoreline in such a manner as to interfere with the normal flow or water, result in the deposit of debris, or cause a hindrance to navigation. 5. Bulkheads, seawalls, or fill shall not be constructed to exceed six (6) inches above the finished grade, or two (2) feet above the ordinary high water mark whichever is higher. 6. Proposed fill shall avoid the appearance of being added on. Any extension of land shall blend into the existing shoreline in a natural appearing manner including the use of natural materials such as rocks, rip-rapping materials, and native shoreline plant life. 7. Fabric for soil containment shall be used when appropriate. 8. Prior to final inspection of the project for shoreline filling or construction of bulkheads or seawalls, the land shall be graded and seeded so as to provide proper drainage within the applicant=s property, away from buildings and to leave the surface fit for other land uses permitted in the district. The grade must be established with 90 days of the completion of construction. 9. Stabilization of shoreline fill, dredging, or construction of bulkheads or seawalls within the Natural Rivers District shall utilize natural materials approved by the Zoning Administrator. These requirements may be waived where it is demonstrated by the applicant that alternative materials are necessary.

Because the Hamburg Environmental Review Board has not met since 2006, the HERB has not been reviewing the cutting or removal of trees within the natural rivers vegetation strip or any of the projects listed under section 9.2.3 as required in the zoning ordinance and neither the Planning Commission or the Zoning Administrator has request HERB to review a project since 2006. Because of the length of period since last utilizing HERB and to further streamline the development process, Planning and Zoning Staff would suggestion disbanding the HERB and amending the zoning ordinance to allow the Zoning Administrator or Planning Commission to request Environmental Review of a project by a qualified environmental consultant to be paid for by the applicant on any of the project that HERB would have looked at if deemed necessary. The new machine will replace the current mail server which is now better suited for other tasks due to its age. The new server will provide better speed, manageability and reliability of the computer network. I tried to obtain a competing quote from HP on multiple occasions but they failed to respond. At a regular meeting of the Hamburg Township Board of Trustees, held at the Hamburg Township Hall located at 10405 Merrill Road, Hamburg Township, Livingston County, Michigan, on April 5, 2016 beginning at 2:30 p.m., there were:

WHEREAS, Merrill Road, a Livingston County Road, running north and south between Michigan State Highway 36 (M-36) and Strawberry Lake Road bisects Hamburg Township Manly Bennett Park; and

WHEREAS, from June 15, 2016 through June 18, 2016, the Bennett Park facility will host the 11th Annual Hamburg Family Fun Fest. Given the number and types of events, including fireworks shows, concerts, a circus and petting zoo, and amusement rides, it is anticipated that this event will draw thousands of participants to the area; and

WHEREAS, the speed limit on Merrill Road is 55 mph; and

WHEREAS, the Hamburg Township police station is part of the municipal complex located within the park with an indirect access to Merrill Road.

WHEREAS, the Hamburg Township Board recognizes H.E.R.O. as a Township volunteer organization and supports their efforts to further enhance the recreational opportunities at the Manly Bennett Park facility; and

WHEREAS, H.E.R.O. is hosting the 11th Annual Hamburg Family Fun Fest scheduled for June 15, 2016 through June 18, 2016 at Bennett Park; and

WHEREAS, to announce this event and draw the attention of the crowds of people that travel to and from the park facility during the baseball and soccer season, H.E.R.O. wishes to place a banner across Merrill Road on the banner poles permanently installed in the Merrill Road right-of-way located approximately 250 feet south of the railroad track; and

WHEREAS, a permit from the Livingston County Road Commission (LCRC) is required to place the banner and the LCRC will only issue a banner permit to the local municipality.

After discussion at the Parks and Recreation meeting on March 22, 2016, it was suggested that a sub-committee be formed with select members of Parks & Recreation, Township Board, and Public Safety, to address the following:

I have included this application in the packet for discussion. Should the Parks and Recreation Committee decide to support this type of activity, approval of this application would require changes to the current Park Use Policy and its procedures as well as possible changes to the Park Use Fee Schedule. There is currently no mechanism to allow use to “for-profit” entities. I believe we will be seeing more requests of this nature, not only for Manly Bennett Park, but also for the Lakelands Trail, and feel we need to be prepared to either deny them entirely or have them incorporated into our Fee Schedule and policy. A work group to analyze the data as relates to fees we are currently collecting, expenses that we occur to maintain the fields as sports fields, the expectations from Public Safety, etc. may be a good start. Once the data is analyzed, a proposal could be presented to the Parks & Recreation Committee for their recommendation to the Board. The applicant would like a response within 1-year of the proposed event, so we have a couple of months to make a decision. I would recommend forming a work-group with members of Public Safety to work on proposed changes to the park fee schedule.

Food I beverage sales are not permitted in any booth. Smoking, alcohol and pets are strictly prohibited.

All items for sale MUST be of antique origin. Collectibles such as fast food memorabilia, Pez dispensers, Nascar, and all other such collectibles are strictly prohibited. Antique Mercantile reserves the right to remove any such items from a ven­dor booth at any time. Acceptable items are genuine antique items, furniture, repurposed items, primitives, vintage and industrial. Any children's toy must be pre-1950 in manufacture to qualify. Glass pieces are permitted however, no 'all glass' booths will be permitted.

The October 2014 Compensation Study recommended that the Township review the wage scales (min, midpoint, max) on an annual basis and adjust as appropriate, and that the Bureau of Labor Statistics (BLS) Employment Cost Index (ECI) for state and local government workers is a good source of the data. On January 29, 2016 the BLS released the following: for state and local government workers wages and salaries increased 1.8 percent for the 12-month period ending in December 2015. MOTION BY NEGRI, SUPPORTED BY HAHN, TO ADJUST THE SALARY RANGES IN THE COMPENSATION STUDY BY A 1.8% INCREASE FOR FY 2016/17 AND TO RECOMMEND A 1.8% ECI WAGE INCREASE FOR ALL EMPLOYEES WHO ARE ELIGIBLE WITH THEIR SUPERVISORS APPROVAL EFFECTIVE JULY 1, 2016.

It is important to note that market data is simply data and does not represent an absolute indication of the value of any position. Accordingly, a classification and compensation structure that balances external competitiveness with internal equity was developed for use by the Township in administering employee compensation. Employees should be paid at least the minimum rate established for their assigned grade, but not more than the maximum. In general, the midpoint of the range is aligned with the market. The specific rate of pay for any given employee should be determined based on factors such as the experience of the individual in the role, the skills and abilities of the individual, market demand, and the financial wherewithal of the Township. If properly maintained, the classification and compensation structure can serve the Township for many years. It is recommended that the Township review the wage scales on an annual basis and adjust as appropriate. A good source of data can be found in the U.S. Department of Labor, Bureau of Labor Statistics. On an annual basis, the Bureau of Labor Statistics releases an Employment Cost Index (ECI), which can be obtained specifically for state and local government workers. ECI data is available on the www.bls.gov website.

Re: Tanker #12 Repairs

Tanker #12 is currently at B&B Truck – Fire Division getting the repairs completed from the accident in late 2015. These repairs cost are being covered with our departments insurance. While Tanker #12 is at the repair facility we asked them to complete a thorough inspection of the apparatus. They were looking for any structural concerns or major repairs that have to be completed. This was done to hopefully increase the longevity of the service years of the apparatus. As well as to ensure the overall safe operation of Tanker #12. We had also sent a list of known concerns or repairs needed when the apparatus was sent to them.

We are asking that the Township Board approve the following maintenance, repairs and modifications to Tanker #12.

1. Maintenance – Completing the yearly required DOT inspection and maintenance. This was done on all our apparatus while Tanker #12 was in for repairs. This will ensure that is done on the same schedule as all our other apparatus. Estimated Cost $975.34

2. Modification – Inside the cab they will remove two seats (leaving 4) and install a large compartment with a roll up door in the cab. Tanker #12 has limited compartment space and this will work toward standardizing the apparatus. We have this same style compartment in other apparatus. Cost $2,832.20

3. Repairs – During the apparatus inspection for any structural problems or major safety

issues a few items were discovered that need to be addressed. The attached quote #00141019 has a complete breakdown of the needed items. The only structural concern that was found was around the pump house (center part of apparatus). Broken welds and lots of flexing in the metal. Multiple small concerns were also found during this process. This list also addresses the concerns that we had prior to it being inspected. Cost $5,680.43

4. Total cost for all three jobs is $9,487.97 from B&B Truck – Fire Division. This is the

amount we are requesting for approval with funds to come out of the fire departments fund reserve account. Attached are quotes for each of the requested items.

Tanker #12 was purchased in 2004 with a 20 year projected life expediency (2024). These repairs will not necessarily guarantee a longer life expectancy but will help ensure that the apparatus will be ready to safely perform over the next 10 years. B&B Truck is the same company that completed the repairs to Tanker #11 in 2015 and the repairs they did were of the highest quality.
