Please see below. More discussions will be needed regarding a new MOA.

However, Vickie Caraway also believes that more funding will be needed. I'm not sure about what or how much is needed, and consequently, more discussions will also be needed in regards to this issue.

Hey Nelson, The issue will be if the land in question is included within the HCP agreement. You will need to check the tax map keys to see if the lands in question are included. Hopefully, they are. If not, the rail may have to do another agreement/HCP.

Also, if the land is included in the HCP, the project may need to add to the HCP funds. Construction on that scale will have a much larger impact, especially since it is so close to the contingency area (see bold area below). Not sure who makes that call, it may be one for the Endangered Species Recovery Committee or DOFAW.

The email from Parsons is not totally accurate, (see bold area below). The DLNR horticulturist will assist the applicant (see #4 in the MOA) in moving plants, if found on site. I believe the applicant has rented a tree spade to move plants under the supervision of the horticulturist.

Bill has left us for the USFWS but we have Paula Hartzell on board now. I have cc'ed her with this email if you need to contact her directly.

Paul or Vickie,

The City wants another Certificate of Inclusion for their Rapid Transit line and parking lot (please see below). First, do we have sufficient funding to continue our efforts for the A. menziesii? Could you please check on this or please let me know who to contact.

This is a copy of the MOA with the City and County of Honolulu, Department of Design and Construction. (See attached file: D0C320.PDF) Another MOA may not be necessary, if additional funding or other changes are not now needed. Could we just revise or prepare another COI to include the City's Rapid Transit Project in the projects covered by this document (the COI)? Is a meeting with the City needed prior to the execution of this document?

Lastly, has Bill Standley left us for greener pastures? We're gonna miss him. Who replaced him?

Dear Sagum Nelson,

We understand you are the person at HDOT to contact about the Certificate of Inclusion for Abutilon menziesii at Kapolei. I work for Parsons Brinckerhoff and am doing environmental work for the Honolulu Rail Project for DTS. Ko'oloa'ula or red 'ilima (Abutilon menziesii) is prevalent on vacant land in the vicinity of the proposed East Kapolei Station and the proposed alignment along North-South Road. This extant population has been well documented in a Habitat Conservation Plan (HCP) since its discovery in 1996. Although plants have been observed in the area in the past, no plants were observed during field studies performed for the proposed rail project. The HCP for Abutilon menziesii at Kapolei (Ohashi 2004) was approved and is managed by the State Department of Land and Natural Resources-Division of Forestry and Wildlife (DLNR-DOFAW) in collaboration with the U.S. Fish and Wildlife Service (USFWS). The HCP included the establishment of an on-site 18-acre contingency reserve for Abutilon menziesii. The HCP process involved a formal biological assessment and opinion of no jeopardy for the species, based on the fulfillment of mitigation measures outlined in the HCP. A State Incidental Take License (ITL-05) was issued in March 2005 to the Hawai'i State Department of Transportation (HDOT) for the North-South Road Project. The ITL allows the removal of Abutilon menziesii plants within the surrounding land area, with the exception of plants within the 18-acre contingency reserve. The reserve will remain in place until off-site mitigation measures are fulfilled over the 20-year duration of the HCP. The Honolulu Rail Project will require a Certificate of Inclusion to the ITL from HDOT. Below I have also added a paragraph from a letter we received from USFWS describing the need for the Certificate of Inclusion. Honolulu Rail Transit components that may directly affect Abutilon menziesii include a 12-acre park-and-ride lot, the East Kapolei Station, and the fixed guideway, which are situated less than 200-feet from the 18-acre contingency reserve. We understand that continuing consultation with DLNR will be necessary, and the construction impact area will need to be resurveyed prior to construction. If any Abutilon menziesii plants are found, a DLNR horticulturist would remove the plants and transplant them to the contingency reserve. All applicable protective measures of the HCP would apply to construction practices, including the installation of construction fencing, implementation of fire control measures, and establishment of appropriate buffers for fire control.
