WHEREAS, the purchaser has executed Water Sales Agreement dated 12.06.2008 with the Bulk

supplier. As per the terms of agreement, the agreement was effective for the period of 5 years which

was expired on 11.06.2013

AND WHEREAS, the purchaser vide letter dated 14.07.2014 applied to the Bulk supplier for

renewal of the Agreement for further period of 5 years w.e.f. 12.06.2013

AND WHEREAS, Bulk supplier has agreed to renew the agreement vide letter no

NOW, THEREFORE, in consideration of the mutual promises contained herein, and other good

and valuable consideration the receipt and the sufficiency of which is hereby acknowledged' the

for Purchase ofwater.

The above rate will be applicable subject to revision of rate for industrial Purpose from

time as may be decided by the Government of Gujarat including other terms & conditions

ofthe agreement and the same shall be binding to the parties in this agreement.

Notwithstanding anything contained herein above, the Purchaser agrees and undertakes:

that IWs Kutch Water Distribution Company Ltd. (proposed) shall be constructing 150

MLD Sea Water based desalination plant for industrial water supply in Kutch and after

completion of the plant, Purchaser shall not claim for Narmada Water and instead shall use

desalination waler to be supplied by M/s Kutch Water Distribution Company Ltd- at the

6. Arbitration

appointed pursuant to paragraph (ii) below. Such arbitration shall be subject to the

provisions of the Arbitration and Conciliation Act, 1996'

then the matter should be referred to high court of Gujarat who shall appoint a Sole

as herein above specified.

1. The permission r alid on11 tbr co-processing of @ 50 IIT (Fiffy MT) abovespecified Hazardous rvaste. Prior permission has to be obtained for co-processingof any other Hazardous waste.

2. The cement plant shall obtain the autho'iiZitiori f.om the Gujarat Pollution ControlBoards as required under Hazardous Waste (Management, Handling andTransboundary Movement) Rules, 2008 for storage, handling, transportation and

co-processing of hazardous waste.

3. For transportation of proposed Hazardous wastes for co- processing in cement

kiln, manifest system as per Hazardous Waste (Management, Handling and

Transboundary Movement) Rules, 2008 and guidelines of CPCB shall be followedstrictly.

4. The generator of Hazardous waste. shall obtain authorization from the GujaratPollution Control Board as recuired under Hazardous Waste (Management.

The cement plant shail estimate the quantity.' of Hazardous $'aste required to be

co-processed. Cement industry shall provide adequate & dedicated covered

storage space for the Hazardous waste in accordance with Hazardous \\'asteRules and also ensure that there is no leaching of any pollutant. The actualquantity of Hazardous waste co-processed shall be reported to the CPCB and

CPCB.

6. The cement plant shall ensure the compliance of the conditions stipulated in the

consents issued under the -\ir -\ct - 1981 and \\-ater.\ct - 19--1 durins rhe co-

proce ssing of Hazardou*i \\-a*ste.

cement kiln also. For other polluunts i.e.; CO. TOC, NOx, HCl. SO2 . FIF total

dioxins and furans, Cd + Tl + their compounds, Hg and its compounds, Sb + As *Pb + Co * Cr * Cu + lr,4n + Ni + V + their compounds, the emission values duringco-processing shaii not exceeci * *s base line emissions i.e. during pre-co-

processing phase of trial run. The continues measurement of particulate matter

emission shall be carried out at co-processing plant and the emission data shall be

submined to CPCB and the GPCB. As per direction of CPCB monitoring ofdioxins and furans including other Parameters will be done by the cement plant.

The cement plant shall receive the Hazardous waste only from iWs. Ashapura

monitoring result during co-processing.

10. During co-processing of Hazardous waste in cement kiln, the cement plant

shall comply with all the requirements in accordance with the Public LiabilityInsurance Act, I99l as amended.

11. Generating Industry M/s. Ashapura Volclay Ltd., Plot No:167, Village: Ler, Ta:

Bhuj, Dist: Kutch - 370020, Gujarat shall use Hazardous waste tracking system ofXtended Green Node (XGN) for on line real time data updation on Transportation ofFlazardous waste by them to the receptor ior co-processing in the cement i<iln. The

compilation of real time data for p'ieparing online manifest by the generator,

Transporter and receptor shall have to be maintained on daily basis & submitted by

the generator and receptor of the facility to the concern Regional Office, GPCB and

Head Office, GPCB, Gandhinagar.

Cement plant shall have to transport Hazardous waste for the co-processins purpose

through dedicated tanker with GPS (Global Positioning System) enabled s1*em in

line with Hazardous waste (M,H&TM) Rules-2008.

The composition of the u'aste is to be finalized on-11' by the Cement lndustries hom

the concern generator.

in case of an1' l'ioiation in the conditions stipulatd the permission can be

withdrawn without any prior intimation at any time.

GPCB reserves the right to review / impose additional conditions or revoke,

change or alter any of the terms and conditions.

Cement Plant shall have to arrange for smooth trial run. The Schedule of trial run

shall be communicated to all concem including GPCB / CPCB within a month. The

cement plant shall inform date of trial run wel,l in advance so that GPCB and CPCB

reoresentative can remail present dwing the trial run. Aier the triai run, the studl'

report incorporating the information as ntr Annexure - 8 of the guideline shall be

submitted to GPCB for further forwarding the case to CPCB for its regular

consideration / Permission.
