Joshua Skirvin (“defendant”) of the crime of BURGLARY IN THE FIRST DEGREE, a

Class “B” Felony in violation of Iowa Code Sections 713.1, 713.3 committed as

follows: On or about June 25, 2013, in Wall Lake (Sac County), Iowa, defendant

broke into Matt Wessels’ apartment residence (“apartment”) at Apartment 2, 108

West 3rd

Street, Wall Lake, IA 51466. The apartment was an occupied structure as

defined by Iowa Code Section 702.12. One or more persons were present in the

occupied structure. The defendant did not have permission or authority to break into

the apartment. The defendant broke into the apartment with the specific intent to

assault one or more of the persons present in the occupied structure, defendant

intentionally and / or recklessly inflicted bodily injury on the victim, Matt Wessels, and

/ or aided and abetted and / or jointly participated in this crime with another. I OWA

about June 25, 2013, in Wall Lake (Sac County), Iowa, defendant intentionally

confined Ralph Freese, Levi Blum, and Matthew Wessels (“victims”) in Matthew

Wessels’ apartment residence. The victims were confined against their will. The

defendant did not have a reasonable belief that he had a right or authority to confine
