  • authority and responsibility for the development in respect of the type of development and thefunds to be allocated for such development.

    7.5 The constitution of the steering committee shall be determined by agreement between theDLA/Commission, The Communities and the Amahlathi Local Municipality provided that:

    7,6The steering committee will comprise persons appointed to represent parties to this Agreementincluding one representative each from the DLA, the Commission, the Amahlathi LocalMunicipality and seven members appointed by the community from each village.

    7.7 The respective parties shall nominate their representatives within seven days of the signing ofthis agreement and shall advise the Commission of such nomination .

    7.8 The members of the steering committee may by agreement co-opt such other person/s ontothe Steering Committee who, in their view, have the requisite skill, experience and ability tocontribute to the achievement of the objectives of this Agreement.

    7.9 The function of the Steering Committee will be to supervise the developer and to ensure theco-ordination of the activities of the Parties for the purpose of achieving the objectives of thisAgreement, to receive formal written reports on the progress in the matter or the lack ofprogress and reasons for delays and non-performance, to review work , adjust work plans andtime frames where necessary and to consider amendments to this agreement in accordancewith the provisions of clause 12 provided that the reasons for any amendment or adjustmentof time frames must be fully minuted.

    7.10 The Commission shall arrange the first meeting of the Steering Committee within twenty-onedays of the signing of this agreement.

    7.11 The Steering Committee will at its first meeting establish its rules and procedures andappoint the necessary office bearers, provided that:

    7.11.1 at each meeting the parties will agree on the date for the next meeting;7.11.2 any member of the Steering Committee will be entitled to call a meeting on reasonable

    written notification to the other members;7.11.3 unless parties by agreement appoint another party, the Commission will provide the

    secretarial services for the committee and shall prepare and distribute the minutes shortlyafter each meeting to all members;

    7.11.4 it shall be the responsibility of the member who has not been in attendance of a meeting tofind out the date of the next meeting;

    7.11.5 any party will be entitled to call another party to formally and in writing account on theextent to which it has made progress in terms of the Agreement, or in the event of a lack ofprogress, the reasons for the delay or non-performance;

    7.11.6 a duly convened meeting will be a quorut only if at least fifty percent plus one memberare present provided that that at least two members from government institutions are alsopresent.

    hereinafter referred to as " the Parties "

    In this agreement, unless the context clearly indicates otherwise:

    Act means the Restitution of Land Rights Act No. 22 of 1994, as amended.

    Administering Entity means the institution or organisation that will take transferof and administer the restitution award once negotiationsin this respect are concluded.

    the land means the undeveloped commonage land situate at thevillages of Gwili-gwili, Gxulu, MtwakuMnyameni,Ndlovini, Ngobozana, Upper Ngqumeya inKeiskammahoek.

    Claim refers to the claims in respect of the rights in land thatwere lost and refers to one claim although there may bemore than one person entitled to benefit therefrom.

    Claimant Community means the persons listed in Annexure A - being the list offrom each village

  • Development means the development of the land for the benefit of theClaimants.

    Developer means the entity entrusted to undertake thedevelopment or prior to such appointment, theIntegrated Project Steering Committee

    WHEREAS :

    1.1. The Act has been promulgated to provide for restitution to persons or communitiesdispossessed of rights in land , after 19 June 1913 as a result of past racially discriminatorylaws or practices;

    1.2 The Village communities of Gwiii gwili, Gxulu, Mnyameni, Mtwaku, Ndlovini, Ngobozana, andUpper Ngqumeya were forcibly removed from land previously occupied by them or theirancestors through the implementation of the policy of betterment planning from the early1950s onwards. The policy was implemented under the provisions of sections of the NativeAdministration Act 38 of 1927 and the Native Trust and Land Act 18 of 1936 and variousproclamations made in terms of these statutes .The application of these statutes andproclamations constituted discriminatory laws and in their application in the villagesconstituted racially discriminatory practices. The implementation of the betterment policyresulted in the communities and its members being individually and collectively dispossessedof their rights in land .

    The right to manage and allocate land was taken over by the State and resulted in the followingconsequences amongst others:

    a . Families were moved from one piece of land to another and in the processof doing so lost an average of 3 and a 1/2 dwellings per family .

    b. Individual residential sites were reduced by at least 7244 square metres each .

    c. Each family's allotment of arable land was reduced by an average of 0,90hectares .

    d. Arable fields were demarcated some distance away from residential sites.

    e. The community's social structure was disrupted by the forced removal and theallocation of sites on a first come first served basis.

    I The community lost the right of control of the commonage.

  • 1.3 The parties have agreed that whilst the claim has been lodged by the communities the rightsheld and lost (the rights to arable fields and residential sites) were primarily of an individualand/or family nature consisting of exclusive use areas and were akin to ownership rightscapable of being passed from one generation to the next .The parties have also agreed that the community lost control of and lost grazing rights as aresult of the implementation of the betterment policy .

    1.4 The State has accepted the validity of the claim.

    1.5 The claim had been lodged with the Commission before the 31 December 1998.

    1.6 The parties wish to record the manner in which the claim will be settled and the Developmentwill be undertaken.

    NOW THEREFORE IT IS AGREED AS FOLLOWS :

    2.1 The objective of this agreement is to establish the framework for the settlement of thisrestitution claim and the implementation of development.

    2.2 The agreement is drawn in accordance with and in the spirit of the principles of co-operativegovernance contemplated in Chapter 3 of the Constitution of the Republic of South Africa , ActNo 108of 1996.

    2.3 The DLA will transfer ownership of the commonage to the claimants and will pay monetarycompensation in respect of the other rights to land that were lost,

    3. AGREEMENT

    3.1 The DLA/Commission shall provide the necessary resources for, and prepare and facilitate theconclusion of the under-mentioned agreements within a tentative time frame of two monthsfrom date of signature hereof, the latter to be finalised at the first meeting of the IntegratedProject Steering Committee referred to in clause 7.4 and hereinafter referred to as the "steering committee " .The agreement anticipates/contemplates the conclusion of the following:

    3.1.1 A Transfer of Payment and Fund Administration Agreement,3.1.2 Individual Claimant Settlement Agreements,3.1.3 A Project Implementation and Management Agreement, if applicable.

    Hereafter collectively referred to as the-'Implgmentation Agreements".

  • 4. MONETARY VALUE OF THE CLAIMS

    4.1 It is recorded that the DLA and the Community have agreed to equalise disparities and effecta standard settlement award for each successful claimant family and on a total monetary valueof the claims.

    4.2 The method of calculation of the compensation payable was as follows:

    a. The exact nature of the rights lost were determined,b. These rights were in principle and for the purposes of calculation upgraded or

    formalised into the present cost equivalent of freehold or formal rights,c. The value of the rights lost was thus determined,d. In the light of the fact that in many instances no compensation was paid and

    in others the amounts received were minimal and totally inadequate, thecompensation received was disregarded.

    The DLA hereby records its approval of the method employed and the calculationsmade for the purpose of determining the monetary value of the claims.

    4.3 The DLA and the Claimant Community have agreed to the following monetary compensationper claimant family,

    Loss of arable land R 839.00

    Loss of Dwellings R 32 787. 00

    Loss of residential land R 21 938.00

    Total loss per claimant family R 55 564,00

    The maximum compensation payable excluding grants will be:

    1704 families x R55 564,00 = R 94 681 056,00

    4.4 The DLA and the CLAIMANTS have agreed that each duly verified claimant family as perAnnexure C hereto shall receive the amount of twenty seven thousand seven hundred andeighty two rands (i.e. R 27 782,00) as financial compensation payable directly to the claimantfamily by cheque payable within two months of the signing of this agreement by all the partiesand subject to the individual claimant settlement agreement being signed and that theremainder shall be utilised for the development of the community in terms of a developmentplan that will be formulated jointly between the State institutions and the claimant community.

  • 4.5 The DLA will make the following grants available per verified claimant family:

    4.5.1 A restitution discretionary grant of R 3000,00 each and4.5.2 A settlement planning of R 1440,00 each

    1704 x R4440 = R 7 565 760.00

    The total of these funds shall also be deposited with the administering entity to be utilised primarilyfor the surveys and transfer of the land to the claimants . Any balance may thereafter be utilised forthe development.

    5.THE TRANSFER OF DLA FUNDS AND ADMINISTRATION OF THE FUNDS

    5.1 The DLA confirms that an amount to the maximum of R 94 681 056,00as calculated in clause 4.1 is available in the DLA's capital budget.

    - The amount of R 47 340 528,00 shall be transferred to the administering entity whichwill be the Amahlathi Local Municipality and the balance shall be distributed to theclaimant families as stated in clause 4 above.

    - The DLA further confirms that the amount of R 7 565 760, 00 in respect of the Grantsshall also be transferred to the administering entity for the purposes set out herein.

    Thus a total amount of R54 906 288,00 which is made up of the total grants and 50%of the financial award will be transferred to the administering entity .

    5.2 The Commission shall take every reasonable step to finalise the negotiations relating to thetransfer of funds and the fund administration within a period of two months of date of signaturehereof.

    5.3 On frnalisation of the negotiations referred to in 5,2. the DLA shall transfer the said amounts tothe Administering Entity in terms of a Transfer of Payment and Fund Administration Agreementto be entered into between the DLA , the Claimants and the Administering Entity which is theAmahlathi Local Municipality.

    5.4 The Administering Entity shall hold and administer the said amount in trust on behalf of theClaimant community in terms of a Fund Administration Agreement to be concluded betweenthe DLA, the claimant community and the Administering Entity.

    5.5 The Administering Entity shall disburse the said amount according to the Fund AdministrationAgreement and for the purpose of implementing the Development in terms of this Agreementand the clause 3 Implementation Agreements.

  • 5.6.1 Account for and report in respect of the administration of such funds as more fully set outin that agreement;

    5.6.2 invest such funds in trustee-type interest bearing investments.

    6. THE DEVELOPMENT PLAN

    The relevant parties ( as set out below ) shall prepare the sector specific development plans,which shall be submitted to the Integrated Steering Committee for approval, providing for inter alia

    the objectives of this agreement,sound planning and development principles andintegrated planning for sustainable development, maximising the opportunities from theDevelopment for the benefit of the Claimants.

    6.1 The sector specific development plans shall focus on infrastructure and services andagriculture. The development plans shall be implemented with the support of any relevantgovernment department that the ALM deems as a potential interested party to facilitatesuch development.

    INFRASTRUCTURE AND SERVICES

    The ALM will take responsibility for developing an infrastructure plan that will be in line with theneeds of the community and the State's delivery capacity.

    7. PROJECT IMPLEMENTATION AND MANAGEMENT

    7.1 The parties as set out in clause 7.6 hereunder shall form a steering committee to undertakeresponsibility as the decision making body for the implementation of the development inaccordance with the provisions of this Agreement .Each village shall be entitled to appoint onemember to the steering committee.

    7.2 The Amahlathi Local Municipality is hereby appointed as the developer to undertake thephysical implementation of the project .

    73 The Amahlathi Local Municipality can either undertake the project implementation andmanagement itself or with the approval of the steering committee , appoint a project managerto undertake the Development.

    7.4 the parties hereby formally establish an Integrated Project Steering Committee to guide theimplementation of this agreement. The steering committee shall have the decision-making

  • 8 . LAND DEVELOPMENTS: SERVICES AND INFRASTRUCTURE

    8.1 the Development shall comply with the normal approval procedures and the ALM shallassume responsibility for assisting the community to develop and implement aninfrastructure plan to meet the community's needs within it's and the project's budgetaryconstraints.

    8.2 The parties agree that the ALM shall prioritize the provision of necessary funding - onapplication if necessary to the relevant State department/s - for the provision of bulk servicesand internal reticulation to the Development.

    8.3 The parties further agree to mutually negotiate the funding of the Area bulk infrastructure,which may be required.

    9. LAND AVAILABILITY

    The Commonage Land

    9.1 The DLA shall make the commonage land available to the Developer in terms of thisagreement and agrees to transfer ownership of the commonage to the claimants .

    9.2 The commonage land shall remain under the control of the Community until such time as thecommunity is ready, willing and able to take transfer of it under the auspices of an entity to bedetermined at the time of transfer in terms of the State's land tenure programme. The Communityundertakes to take transfer within six months from date of this agreement.

    9.3 The DLA shall cover the costs, if any, associated with the transfer of the land.

    9.4 The Residential and Arable Land

    The plots of land presently utilised by the families for residential and arable purposes shall besurveyed and transferred in ownership to the verified claimant family who presently resides on orutilises them.

    10. CLAIMANT SETTLEMENT AGREEMENT

    10. The DLA/ Commission, shall through negotiation with the committee, formulate theterms of the Claimant Settlement Agreements to be concluded between the DLA and eachClaimant in terms of which each such claimant will fully and finally settle his/her claim (s).     10.1.1 Indicate the properties or describe the "rights in land" (as provided for in Section 1 of theAct) that were dispossessed;

    10.1.2 Indicate and determine the monetary value of the Claimant's claim (s);10.1.3 Confirm the claimant's acceptance of the method of calculation and the determination of

    the monetary value of the Claimant's claim (s);10.1.4 Confirm that the monetary value of the claim has been determined for the purpose of the

    Claimant's participation in the Development and to pay monetary compensation for therights to land that were lost;

    10.1.5 Specify the benefits to which the claimant is entitled;10.1.6 Confirm that the claimant has no further claim to any portion of the Earmarked land;10.1.7 Confirm that the Claimant fully appreciates that the development shall be undertaken in

    stages and that the claimant will abide by the development process and time frames;10.1.8 Stipulate the conditions subject to which the clause grants will be made available for the

    Development;10.1.9 Authorise the committee to conclude the remaining implementation agreements on the

    claimants' behalf within the parameters provided by this Agreement;10.1.10 Include a summary of the material terms and conditions of the remaining Implementation

    Agreements that affect the cost of the development;10.1.11 Warrant that no other direct descendents have lodged claims and entitled to claim

    restitution in respect of the dispossessed property or rights in land indicated in theagreement;

    10.1.12 Indemnify the DLA against any future claims made by any person in respect of the claim(s) settled by the claimant;

    10.1.13 Where a claimant has died after the lodgment of his/her claim, indicate whether the claimis being finalised by the executor of the deceased estate of such Claimant either in termsof a last will and testament or in accordance with the rules of intestate succession;

    10.1.14 Indicate the capacity in which the Claimant is acting i.e. in his/her own stead or on behalfof other Claimants. In the case of the latter, the claimant will confirm that he/she is dulyauthorised to conclude settlement on behalf of other descendents;

    10.1.15 Consent to the Claimant Settlement Agreement and this Agreement being made an orderof Court as provided for in clause 12;

    10.1.16 Stipulate the method of allocation of restitution resources in accordance with clause4 .

    11. TIME FRAMES

    11.1 The Parties undertake to do all things possible and to use their best endeavours, in aspirit of co-operation and good faith, to ensure that the Implementation Agreements areconcluded and implemented in accordance with negotiated time frames,,

    11.2 A variation of the time frames may be effected by the Steering Committee, or by theDeveloper with the consent of the Steering committee , on good cause shown.

    12. LAND CLAIMS COURT

    12.1 The parties hereby consent that this Agreement may, on application by any Party, bemade an order of Court in terms of Section 38(B) of the Act

    12.2 The provisions of the Act shall apply in relation to any dispute regarding the interpretationand implementation of this Agreement

    13. AMENDMENTS

    Any amendment to this Agreement shall be in writing and be signed by the parties affectedthereby, provided that:

    13.1 The consent of the DLA and the community shall be obtained for any amendment to be ofany force and effect;

    13.2 The Party wanting to effect an amendment will give the other parties at least three weeksadvance notice and call for their comments, which comments, if received will beconsidered by the amending parties;

    13.3 The DLA / Commission will ensure that any amendment is incorporated into theAgreement and will secure the signature of the relevant parties.

    14. NOTICES

    All notices to be given in terms of this Agreement shall be given in writing and shall be addressedand delivered to the Parties either by registered mail or by hand delivery to their postal or streetaddress, as set out in Annexure B ,

    14.1 A copy of the notice to the DLA shall be sent to the East London Regional Office ofthe DLA and will include a notice to the Chief Land Claims Commissioner and to the RegionalLand Claims Commissioner for the Eastern Cape.

    14.2 Any party may change their address and nominated officers afore-mentioned bygiving seven (7) days written notice to that effect to the other parties.

    15. ASSIGNMENT

    No party shall be entitled to assign its rights and obligations under this agreement without priorwritten consent of the other parties.

    16. WAIVER

    No relaxation which any party may give in regard to the performance of the other parties'obligations in terms of this Agreement shall constitute a waiver of rights unless reduced to writingand signed by such party.

    17. FORMALITY

    This agreement shall only take effect and become binding upon the parties when signed by all theparties, failing which no party may claim the existence of an agreement from negotiations havingbeen conducted or concluded in regard thereto or by reason of this agreement having been draftedor signed by any of the parties.

    18. AUTHORITY

    The signatories to this agreement warrant that they are duly authorised to sign this agreement onbehalf of the parties hereto.

    1. PURPOSE

    To request the Chief Land Claims Commissioner, the Chief Financial Officer, the

    Director General and the Minister to approve a negotiation framework and a

    mandate to negotiate in terms of a proposed monetary value of the betterment

    claims lodged by occupiers who had exclusive usage rights over the areas under

    claim. The claim is for the restitution of land rights in the form of monetary

    compensation and development by utilisation of the restitution award, as

    restoration is not feasible.

    2. BACKGROUND

    2.1 Description and Extent of the Claim

    The claims herein arose as a result of removals by the implementation of the "

    betterment " policies and programmes of the government at the time of the

    removals. Most of the villages in Keiskammahoek were settled by Blacks around

    the 1850/s. Each household had strong individual rights to residential and arable

    land and common group rights to commonage land. Households lived on large

    residential sites and were scattered rather than concentrated in specific

    areas.The community allocated land and regulated the use of the land through

    the application of customary rules and practices via traditional structures.

    Betterment policy which is said to have given rise to the most widespread form

    of resettlement in South Africa, involved the centrally planned and imposed re

    organisation of rural communities by changing where people lived, how they

    used their land and how much land was available to them.

    The keiskammahoek communal claims are carbon copies of the precedent

    setting Chata claim that recognised that Betterment dispossessions do in fact

    satisfy the criteria of the Restitution of Land Rights Act. Hence the Chata claim

    'is a result of the successful implementation of policy on betterment claims"

    2.2 The Claimants

    Representatives of the various villages, which have formed themselves into

    representative committees, lodged the claims. Claimants from each village have

    been identified and claimant lists have been compiled for each village as per

    Annexure A herein.

    2.3 Acceptability of the Claim in terms of the Restitution of Land Rights Act

    The Act has been promulgated to provide for restitution to persons or

    communities dispossessed of rights in land, after 19 June 1913 as a result of

    past racially-discriminatory laws or practices;

    The claims were lodged with the Regional Land Claims Commission: Eastern

    Cape in December 1998They were accepted as meeting the criteria as

    provided for by Section 11(1) read together with Section 2 of Act 22 of 1994 as

    amended, and amplified by Rules 2 and 3 of the Rules of the Commission in

    that:

    2.3.1 the land claim submitted by the claimants substantially meets the criteria of

    the prescribed claim form;

    2.3.2 the claimants are persons as defined in terms of section 1 of Act 22 of

    1994,as amended and therefore competent in terms of section 2 of Act 22 of

    1994,to bring restitution claim as individuals and/or a community as defined

    in Section 1 of Act 22 of 1994 in respect of those land rights commonly held ;

    2.3.3 the claim is not precluded by the provisions of section 2(1) or 1(a) of Act 22 of

    1994 in that:

    2.3.3.1 the claimants were dispossessed of their right to the beneficial and

    •exclusive use of the claimed land both individually and communally .The

    claimants were forcibly removed for the purposes of furthering the objects

    of a racially discriminatory law or practice; namely by the implementation of

    betterment schemes on the land through the implementation of the Native

    Administration Act of 1927, Proclamation 117 of 1931, the Land Act of 1936

    and Proclamation 116 of 1949. Under these legislation and proclamations

    the areas were declared betterment areas in 1959 and 1961 and the

    implementation of new land rights and use regime began in the 1960*s. The

    State demarcated and allocated residential and arable sites and demarcated

    common use areas on the commonage. The State's programme amounted to

    a unilateral annulment and/or restriction of the individual and communal rights

    of the villagers and regulated the use of the land in respect of residential

    sites,arable sites .grazing and the utilisation of its natural resources. These

    restrictions resulted in the villagers being forced to move into concentrated

    (villagisation) areas, reduced the extent of their residential and arable and

    grazing sites and settled them some distance away from rather than alongside

    the areas previously utilised by them .

    2.3.3.2 the dispossession was effected after 13 June 1913, as stipulated in

    Section 2(1 )(a) of Act 22 of 1994 and Section 25(7) of the

    Constitution of South Africa;

    2.3.3.3 just and equitable compensation was not paid at the time of

    dispossession and in fact no compensation was paid;

    2.3.3.4 the claim was lodged prior to the cut-off date of the 31st December

    1998 as set out in terms of section 2(1) (c) of Act 22 of 1994;

    2.3.3.5 the claim is not frivolous or vexatious;

    2.3.3.6 no court order has been made by the Land Claims Court in respect

    of the claimed property.

    2.4 Gazetting

    The Regional Land Claims Commission is in the process of gazetting the claim.

    3 HISTORY OF DISPOSSESSION

    NATURE OF THE RIGHTS LOST

    The rights held were primarily of an individual/family nature and also of a communal

    nature . The rights to arable fields and residential sites were fundamentally

    individualized rights and it is on this basis that they were strong, enforceable rights.

    The policy of betterment planning dispossessed members of the community of their

    individual and collective rights in land. Before betterment, people had rights to

    residential sites and arable land that were passed on from one generation to the

    next. These were individuai or family based rights to exclusive use areas which were

    equivalent to at least perpetual usufruct rights or "beneficial occupation" as referred

    to in the Restitution of Land Rights Act

    Before the implementation of betterment planning the community, through the

    headman and his Council, had the right to allocate and decide on land use. This was

    particularly important in relation to common or grazing land. The communities were

    dispossessed of their right to manage common land when this control was placed in

    the hands of government officials.

    HISTORY OF DISPOSSESSION

    The policy of betterment planning was implemented in the Keiskammahoek area in

    terms of the provisions of Proclamation 31 of 1939 and 116 of 1949 made in terms

    of the Native Administration Act 38 of 1927 (Section 25) and the Native Trust and

    Land Act 18 of 1936. Through the implementation of the policy of betterment

    planning the members of the community were dispossessed individually and

    collectively of their rights in land. The right to allocate land and manage land use

    was given to the State, which ultimately had the following consequences:

    3.1 Families were moved from one piece of land to another and in the process of

    moving, households lost their dwellings.

    3.2 Individual residential sites were reduced by an average of 7 244 square metres,

    3.3 Each household lost an average of 0,9 hectares as their arable land was

    reduced

    3 4 The reduction of arable land led to loss of production of agricultural products,

    (maize, pumpkins, beans etc.),

    3.5 The reduction of homestead gardens ted to a loss of vegetable production,

    3.6 The community lost graves, or space for graves within each homestead,

    3.7 The community's social structure was disrupted by the internal forced removal

    and first come first serve site allocation,

    3.8 most of the arable land was taken out of cultivation,

    3.9 arable fields were placed some distance away from residential sites,

    4 PARTIES INVOLVED IN NEGOTIATION OF CLAIM

    4.1 THE POSITION OF THE DEPARTMENT OF LAND AFFAIRS

    4.1.1 The DLA accepts, for the purposes of negotiations, that the loss of rights in

    land, as set out above, was the result of racially discriminatory practices and

    therefore does not contest the validity of the claims.

    4.1.2 The DLA accepts that individual households lost beneficial occupation rights

    to arable and residential land. These were long term historical rights, which should

    be treated as ownership rights. The rights lost should, in principle and for purposes

    of calculation, be upgraded or formalised into the present cost of formal freehold

    rights.

    4.1.3 The DLA accepts that the village communities as a whole lost control over

    grazing land, that this was a right in land removed by racial law and practice

    and that the government should undertake to restore this to them .

    4.1.4 The DLA is committed to reaching an out of Court settlement with the

    . community. It has been stressed throughout the negotiations thus far,

    however, that any positions taken by the DLA is strictly on a without prejudice

    basis until an agreement is signed by duly mandated representatives of all

    parties and by the Minister of Land Affairs.

    4.1.5 That given that differing valuations of the value of the claims have been

    obtained for the different villages , that for the sake of consistency and to

    avoid conflict between the villages , that an averaged settlement offer be

    made to all claimants .

    4.2 THE CLAIMANTS

    4.2,1 The claimants have agreed to negotiate their various claims jointly and have

    committed themselves to a common settlement with the State.The Border Rural

    Committee and the Land Claims Commission is in the process of verifying the

    identity of individual claimants. The process of verification being followed is that

    beneficiary tists drawn up by the community is being verified by the BRC following

    the instructions and requirements set out by the Commission Any offer made prior

    to the completion of that process would be subject to proper verification of claimants.

    5 CALCULATING THE MONETARY VALUE QF THE CLAIMS

    5.1 Ths DLA wishes to reach agreement with the appropriate members of the

    community on the monetary value of individual ciaims. A substantial amount of

    work has been done in this regard and negotiations are at an advanced stage.

    5.2 The basis for negotiation of the quantum of the claims is the report compiled by

    sworn valuers, commissioned by the Commission on Restitution of Land Rights.

    5.3 Method of calculation:

    STEP 1: Determine the exact nature of the rights lost

    STEP 2; In view of the fact that the rights lost were informal rights, determine

    whether these rights can, in principle and for purposes of

    calculation, be "upgraded11 or "formalised" into the present cost

    STEP 3: Determine the value of the rights lost

    STEP 4; Consider compensation received at the time of dispossession

    5.4 Calculation:

    A. STEP 1: Determine the exact nature of the rights lost

    The community had beneficial individual occupation rights to

    arable and residential land and to communally controlled land .

    These rights were long term historical rights, which dated back

    to 1853 and were passed on from one generation to the next.

    STEP 2: In view of the fact that the rights lost were informal rights,

    determine whether these rights can, in principle and for

    purposes of calculation, be "upgraded" or "formalised" into the

    present cost equivalent of freehold, formal rights

    Though informal rights, the relationship families had with the

    land was of longstanding and permanent nature. It would not be

    in the State's interest to recreate informal rights and take on the

    role of landlord. It will also not be in line with the longer term

    tenure policies of State. The answer would therefore be yes.

    STEP 3: Determine the value of the rights lost

    With reference to the valuation the values of the rights lost are

    set as follows:

    6.1 The land is presently utilised primarily for residential purposes.

    6.2 The claimants shall benefit by the installation of infrastructure such as

    electricity, water and housing.

    6.3 In the light of the above restoration of the rights lost is not feasible.

    6 .4 The claimants have elected to receive monetary compensation,

    6,5 The DLA will transfer ownership of the commonage to the claimants

    and will pay monetary compensation in respect of the other rights to land that were

    lost.

    7 MONETARY VALUE OF THE CLAIMS

    7.1 It is recorded that the DLA and the Claimants have agreed to equalise

    disparities and effect a standard settlement award for each successful claimant

    family and on a total monetary value of the claims. It was further agreed that in

    as much as different monetary values were received in respect of each village ,

    that an equalised and averaged settlement offer be made to all the villages and

    its members ,The DLA hereby records its approval of the method employed and

    the calculations made for the purpose of determining the monetary value of the

    claims.

    7.2 The DLA and the Claimant Communities have agreed to the following monetary

    compensation:

    Loss of arable land average of 1.05 morgen R 839.00

    Loss of Dwellings average of 109 m2 R 32 787.00

    Loss of residential land average 7244 m2 R 21938. 00

    Total loss per claimant family R 55 565 .00

    7.3 The DLA will make the following grants available per verified claimant family:

    7.3.1 A restitution discretionary grant of R 3000,00 each and thus R3000 x R1717

    =R5151 000

    7.3.2 A settlement planning of R 1440,00 each and thus R1440 X R1717

    = R2 472 480

    7.3.3 The total cost of this claim will thus be R103 028 585

    The total of these funds shall also be deposited with the administering entity to be

    transfer of the land to the claimants .Any balance may be utilised for the

    development.

    7.4 The commonage land shall remain under the nominal ownership of the State

    until such time as the community is ready, willing and able to take transfer of same

    under the auspices of an entity to be determined at the time of transfer in terms of

    the State's land tenure programme. The Community undertakes to take transfer

    within a year of the passing by parliament of the proposed Communal Land Rights

    Bill.

    7.5 The DLA shall cover the costs, if any , associated with the transfer of the land.

    7.6 The Residential and Arable Land -The plots of land presently utilised by the

    families for residential and arable purposes shall be surveyed and transferred in

    ownership to the verified claimant family who presently reside on or utilise them.

    8 CLAIMANT SETTLEMENT AGREEMENT

    The DLA/ Commission, shall through negotiation with the committee, formulate the

    terms of the Claimant Settlement Agreements to be concluded between the DLA and

    each Claimant in ternns of which each such claimant willfully and finally settle his/her

    claim (s).

    9 POLICY IMPLICATION

    These claims are similar in nature to that of the Chatha settlement and

    therefore should be accepted as valid restitution claims.

    duly verified claimant family, is approved, on condition that part of this amount be

    paid as financial compensation, and part be utilised for development purposes.

    The distribution will be agreed upon prior to the signing of the settlement

    agreement

    10.3 Payment of the part of the financial compensation amount be made to each duly

    verified individual claimant family, while payment of the balance and the grants is

    made to the administrative entity appointed for the purpose;

    10-4 The State agrees to the restoration to the claimant community of any control over

    and usage of communal land lost as a result of Betterment, via existing and

    future tenure upgrade programmes of the Department of Land Affairs;

    10.5 That Mr . T. T. Gwanya be mandated to present the offer to the claimants on

    behalf of the Department of Land Affairs / RLCC.
