    CONSENT ORDER

    Respondent, as owner of Rite Care PhysicalTherapy, entered into a businessarrangementwith C. Michael Franklin, who undertook to solicit an agreement with Dr. Todd Cowen inThibodaux under which Dr. Cowen wouldbe compensated as a "medical consultant" on a slidingscalebased upon the number of patients he referred to Rite Care PhysicalTherapy. Dr. Cowenwrote to the LouisianaState BoardofPhysicalTherapyExaminers(the Board), furnishinga copyofthe contract proposed by Rite Care, asking whether such a business arran.gem~t was legal.Respondent indicatesthat no such contract wasentered byRite Care with Dr. Cowenor any otherparty and rhat he has terminated his businessrelationshipwith C. Michael Franklin.

    FINDINGSOF FACT

    Respondententered into a businessarrangementwith C. Michael Franklin to developandexpand his Rite Care PhysicalTherapy businessintOme Paincourtvillearea in conjunction with acomprehensive outpatient rehabilitation facility which Mr. Franklin was trying to establish.RespondentgaveMr.Franklin the apparentauthorityto representhim inidentifyingand negotiatingwith medical personnel for participation in this joint venture. With or without Respondent'sknowledge,Mr. Franklin offered to Dr. Todd Cowen a contract as "medical consultant" which.proposesfeesbased upon the number ofreferralsmade to Rite Care PhysicalTherapy each month.Dr. Cowen questioned the propriety of the proposed contract in a letter to the Board and thecontract wasnever consummated.

    CONCLUSIONS OF LAW

    1. Louisianalaw prohibits any health care provider from offering, making, soliciting orreceivingpayment, directly or indirectly, overtly or covertly, in cash or in.-kind,for referring orsolicitingpatients. La. R. S. 37:1745; 37:2413A(8).

    2. Rule 327F of rhe Board prohibits the exploitation of the physical therapy referralmechanismwherebythe referringpractitioner receivescompensation,paymentor anythingofvaluein return for patient referral. LAC Title 46, Section 327F.

    DECISION

    Pursuam to the foregoingFindingsof Fact and Conclusions of Law, Respondent andthe

    Board,byvote of quorum, agree a.sfollows:A. Respondent is placed on Probation through October 24,2003.B. Respondent shall refrain frombusinesssolicitationor marketing practiceswhich violate

    Louisianalaw.C. Respondentshall seekcompetent legalcounselwithregard to any and allfuture business

    arrangementsand willobtain counsel'swritten advicetha.tanyproposednewbusinessarrangementor conttact is in compliancewith Louisianalaw.

    D. Respondent shall, by December 1, 2002, pay to the LouisianaState Board of PhysicalTherapyExaminersthe sum of$500 asreimbursementforlegaland administrativeexpensesincurredin this matter.

    E. Respondent's failure to complywith anyterm of this Consent Order shallconstitut~juStca.usefor the suspension or revocation of Respondent's license as a PhysicalTherapist under theauspicesof this Board, or for any other disciplinaryaction within the statutory and regulatoryauthority of the Board.

    F. Respondent declares that, beforesigningthis Consent Order, he has carefullyread trusdocument, understands the contents, and freelyconsents to it as valid and binding upon him. Heis awareofrus right to a formalhearing and to representationbycounsel and he freelywaivesthoserights.
