Welcome

Welcome to the 2013 White & Case Russian National Championship of the Jessup Competition. It is a fantastic privilege to welcome so many talented and enthusiastic students from all over the country to Moscow to take part in what promises to be a hectic but thrilling few days.

This year, 42 universities and over 200 students from all over Russia will compete in the Championship. The Russian National Championship is now officially recognized as the largest national competition in the world and is even larger than the equivalent regional rounds held in the United States.

Over the course of the competition, students will present complex legal arguments during oral pleadings to experienced professional lawyers and legal scholars in what, for most of them, is a foreign language. Needless to say, this is an incredibly demanding task, and we—the organizers of the Russian National Championship here at White & Case—are extremely impressed by the effort and commitment these gifted young people have shown in taking on this challenge, and we look forward to seeing them grow into the next generation of top legal professionals in the future.

We are extremely lucky that each year as part of the Russian rounds we welcome such a high caliber of judges from all over the world. The competition would not be what it is, were these people not prepared to give up this time in their busy schedules. I would like to take this opportunity to thank the judges and all the other volunteers who have so generously donated their time and energy to make the competition a success.

Maya Melnikas specializes in bank finance and mergers and acquisitions in the financial sector. Maya Melnikas graduated from Harvard University with a degree in Economics in 1987 and from Harvard Law School in 1990. She is admitted to the California State Bar and District of the Columbia Bar.

Natalia Bayurova focuses on corporate, commercial, international trade and investment law matters. She has experience assisting both Russian and international companies in structuring cross-border transactions. Natalia also has experience advising on various investment and international trade matters (including FDI, investments into strategic sectors, trade remedies investigations and technical barriers to trade). She is part of an inter-office team coordinating initiatives relating to Russia’s accession to the WTO, which includes alerting domestic and international clients on topical issues and advising on legal commitments undertaken by Russia.

Aleksandra Ivlieva and Grigory Vaypan participated in the Jessup Competition as members of the Moscow State University team in 2010-2012. They have pleaded in a total of 35 and 40 Jessup rounds, respectively, including in the World Championship Round in Washington, D.C. where they claimed the title of the Jessup World Champion Team in 2012. They have also participated in a number of other international moot court competitions and served as arbitrators of the Willem C. Vis International Commercial Arbitration Moot and the Foreign Direct Investment Moot.

Aleksandra Ivlieva and Grigory Vaypan graduated from Moscow State University in 2011. They are currently pursuing their LL.M. degrees at Harvard Law School.

Anna Kozyakova has been involved with Jessup competition since 2007. She participated in Jessup as a team member, coach and judge and has also relevant experience in other international moot competitions. She is currently specializing in international commercial and investment arbitration.

Anna Kozyakova graduated from Baltic State University in 2008.

The cornerstone of our graduate recruitment efforts, this Program is designed to give Russian law students insight into what it's like to be a White & Case lawyer. The Jessup Competition

The Philip C. Jessup International Law Moot Court CompetitionThe Jessup Competition was the brainchild of Professor Richard R. Baxter at Harvard Law School, who worked with Professor Stephen M. Schwebel (later President of the International Court of Justice) to create a courtroom simulation experience grounded in international law.

For those of you not familiar with “mooting,” it is an exercise in which students make written legal arguments to a court based on a set of facts and plead their case orally before a panel of judges. The Jessup is argued on the basis of public international law as if before the International Court of Justice—two students from a team represent an Applicant country, and the other two students represent the Respondent country. It is a difficult and time-consuming process, and requires a dedicated team of students (especially since the competition is conducted entirely in English).

Originally named the “International Law Moot,” the Jessup Competition held its first round at Harvard University on 8 May 1960. The round, comprised only of Harvard Law students, involved a team of two American law students, Thomas J. Farer and William Zabel, and a team of two foreign LLM students, Ivan L. Head of Canada and Bernard H. Clark of New Zealand. The first Jessup problem was titled, “Cuban Agrarian Reform Case,” and was written by then Professor Schwebel. Since then, the impact of the Jessup Competition has increased dramatically. This year’s Jessup Competition involves more than 600 schools from over 90 countries, making it still by far the largest moot court competition in the world.

From Afghanistan to Zimbabwe, and from the United States to the Congo, former Jessup participants and judges are now entering foreign, finance, and justice ministries in increasing numbers. They can also be found in the world’s finest law firms, corporations, universities, parliaments, and international organizations. Jessup participants worldwide continue to contribute their efforts to the development of international legal education as well as international law itself.

More than a competition, the Jessup is a fraternity of legal professionals, new and old, converging to build bonds and share an invaluable cultural and academic exchange.

The Honorable Philip C. JessupThe Jessup Competition is named after the Honorable Philip C. Jessup. Born in 1897 in New York, Judge Jessup received his bachelor’s degree from Hamilton College and his LLB from Yale. (He also earned a Master’s degree and PhD from Columbia and later, an LLD from Hamilton).

Judge Jessup had a long and distinguished academic, judicial, and diplomatic career. From 1961 to 1970 he was a member of the International Court of Justice.

He practiced law and taught at several American universities until 1961. Jessup was an assistant to Elihu Root during the 1929 Conference of Jurists on the Permanent Court of International Justice. He attended both the Bretton Woods and San Francisco conferences, and played a key role in the formation of the International Law Commission (ILC).

Jessup served as American ambassador to the United Nations from 1948 to 1953. He was President of The American Society of International Law from 1954 to 1955, and a member of the Curatorium of the Hague Academy of International Law from 1957 to 1968.

Judge Jessup’s publications include: The United States and the World Court (1929); International Security (1935); Elihu Root (1938); International Problems of Governing Mankind (1947); A Modern Law of Nations (1948); and Transnational Law (1956). In 1964, he was awarded The American Society of International Law’s Manley O. Hudson Medal for preeminent scholarship and achievement in international law and for the promotion of the establishment and maintenance of international relations on the basis of law and justice. Judge Jessup continued to lecture and teach until his death in 1986.

Friends of the JessupThe Jessup is supported by a worldwide volunteer network of thousands of lawyers, judges, legal scholars, and volunteers devoted to the competition. The network, known as the Friends of the Jessup (FOJ), offers support through monetary contributions and legal expertise, without which the success of the competition would be impossible. ILSA is grateful to all the FOJs for their continuing support at all levels of the Competition.

The Jessup Competition in RussiaIn 2002 White & Case launched the first Russian National Championship of the Philip C. Jessup Competition, one of the firm’s many contributions to legal education in Russia. The 2013 Russian National Championship is the twelfth annual competition that White & Case has organized and sponsored.

Over the past ten years, the Russian National Championship has grown significantly. Fourteen teams from across the country participated in the first National Championship in 2002. By 2008 the competition had grown to about 50 teams and was recognized by the International Law Students Association – the worldwide organizer of the Jessup Competition – as the largest national round in the world. Forty two teams will compete in the Russian National Championship in 2013.

The 2012 Jessup was marked by an unprecedented achievement: a team of law students from Moscow State University won the 2012 White & Case Jessup Cup in Washington DC. The win by Moscow State University is only the seventh time in the 53-year history of Jessup that a non-native English speaking team has won the competition. Moscow State University faced Columbia University (US) in the championship round, which was held on March 31. Judges Joan Donoghue, Kenneth Keith and Hisashi Owada judged the final round representing the first time in Jessup history that three judges from

the International Court of Justice served on the Final Bench. Winning contestant Grigory Vaypan stated: “This is the third time that we’ve participated in the competition which really is an ‘Olympic Games’ for law students. Each year we’ve learnt and improved our overall performance. Winning this year means so much to the team, and is a really positive statement for law students from all over Russia. Experience, hard work and commitment have made this victory possible.”

Particularly noteworthy is the performance of the 2003 Russian National Championship team from Mari State University, who placed second at the World Championship in Washington, DC. Mari State’s success was unprecedented in Jessup history; no university had previously advanced to the final round of the Jessup World Championship within two years of the establishment of a national competition.

The Jessup offers Russian law students a rare opportunity to interact with international legal professionals who come to Moscow to participate as judges from all over the world.

The competition helps students put their legal skills into practice: researching current issues of public international law, preparing written memorials, and presenting their arguments orally before a simulated court. By taking part in the Jessup, students can make a huge jump in their professional development.

International Law Students AssociationThe idea of an organization to serve the needs of students interested in international law first arose shortly after the first Jessup Competition. In 1962, students from a number of campuses founded the Association of Student International Law Societies (ASILS). The Association evolved over the years and, in 1987, reconstituted itself as the International Law Students Association (ILSA). ILSA’s purpose is to promote awareness, study, and understanding of international law and related issues; to

encourage communication and cooperation among law students and lawyers internationally; to contribute to legal education; to promote social responsibility in the field of law; to increase opportunities to learn about other cultures and legal systems worldwide; and to publicize career opportunities in international law.

ILSA is governed by a Board of Directors consisting of 15 members. The Executive Office, staffed by the Executive Director and Executive Assistant, is headquartered in Chicago, IL.

Each year, the ILSA Congress elects the student officers and the ILSA Director. ILSA serves as an umbrella organization for its member chapters (known as International Law Societies) at individual law schools. Chapters exist as independent entities as well as members of the larger Association. ILSA’s structure grants autonomy to its chapters to meet their unique needs locally while making available to them an international network of pooled academic and organizational resources.

Individual membership is available to chapter members, pre-law and post-law students, and all others with an interest in international law and international legal education.

ILSA is now comprised of chapters and individual members from around the world. Local ILSA chapters have found that working under the scope of a larger organization has allowed them to enhance the quality of their local programming and to tap the larger network of global resources. ILSA supports student international law journals through the Conference of International Law Journals, advises students on opportunities in international law, and provides other general education programs and support to ILSA Chapters and individual members.

MGIMOThe Moscow State Institute of International Relations (MGIMO) is one of the oldest universities in Russia preparing specialists in various aspects of international relations. MGIMO is believed to have been founded on October 14, 1944, when the USSR Council of People’s Commissars reorganized the School of International Relations of the Lomonosov Moscow State University into an autonomous Institute. After more than six decades of development, MGIMO is a well-known university and research center offering a variety of courses in 12 fields: International Relations and Diplomacy, Regional Studies and World Politics, World Economy and Commerce, International Public, Private and Finance Law, EU Law, Political Science, Governmental and Municipal Government, Journalism and Public Relations. The University’s structure comprises eight Schools and four Institutes. Fifty-three languages are taught at MGIMO.

Championship Round JudgesErik Møse is a European Court of Human Rights judge elected in respect for Norway. Møse holds law degree from University of Oslo, 1976. In 1977 he became Counsellor, then Head of Division, Ministry of Justice, 1981-1986. He participated in the drafting process of Protocols No. 6 to No. 11 of the European Convention on Human Rights in 1977-1994. From 1981 to 2003 he was Part-time lecturer in human rights, University of Oslo. From 1984 to 1985 – Chairman of the Committee of Experts for the drafting of the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment. In 1985-1986 he became Deputy Judge, Eiker, Modum and Sigdal, and was Agent of the Government before the European Commission and the European Court of Human Rights, until 1993. Since 1986 he acted as advocate in the Attorney General’s Office (Civil Affairs), then as Supreme Court Barrister in 1989-1993. In 1993 he was appointed as Chairman of the Steering Committee for Human Rights, Council of Europe. In 1993-1999 Erik Møse was Judge in Borgarting Court of Appeals in Oslo. Since 1995 he has been fellow at the Human Rights Institute, University of Essex (UK). In 2007 he was nominated honorary doctor. From 1995 to 1999 he acted as member of the Board of the Norwegian Institute of Human Rights. As for International Criminal Tribunal for Rwanda (ICTR), Erik moved up the career ladder from Judge (1999-2009) to Vice-President (1999-2003) to become President in 2003 (until 2007). Since 2007 he has been member of the UN Secretary-General’s Selection Panel for the appointment of judges of the Special Tribunal for Lebanon. In 2009 he was appointed as Justice of Supreme Court of Norway (until 2011). Since 1 September 2011 Erik Møse has been Judge of the European Court  of Human Rights.

Guy S. Goodwin Gill, MA, DPhil (Oxon), is a Senior Research Fellow of All Souls College, Oxford and Professor of International Refugee Law in the University of Oxford. During the academic yeaer 2010-2011, he was also a Visiting Professor at the Académie de droit international humanitaire et de droits humains in Geneva, and holder of the Ganshof van der Meersch Chair at the Université libre de Bruxelles. William Burke-White is Deputy Dean and Professor of Law at the University of Pennsylvania Law School. Burke-White is a leading expert on international law, international institutions, and global governance. From 2009-2011 he served in the Obama Administration on Secretary of State Clinton’s Policy Planning Staff, providing the Secretary direct policy advice on multilateral affairs, international institutions, and the Russian Federation. He was Principal Drafter of the Quadrennial Diplomacy and Development Review (QDDR), Secretary Clinton’s hallmark effort to reform the Department of State and reshape US foreign policy. Burke-White helped lead the implementation of the QDDR and oversaw numerous elements of institutional reform.

Burke-White has written extensively in the fields of international law and institutions, with particular focus on international criminal, international financial law, and international institutional design. Artem Vladimirovich Malgin is currently Counselor-Chief of the Rector’s Office of MGIMO-University. He is coordinating several MGIMO cooperation projects with business entities and government agencies. Among his main responsibilities is MGIMO-BP (British Petroleum) cooperation project and MGIMO-IFRI (French Institute of International Relations) partnership.

Dr. Malgin also holds the position of Associate Professor at the Department of International Relations and Foreign Policy of Russia at MGIMO-University with his main expertise being focused on European affairs, EU-Russian relations, CIS issues. His special scientific interest lies in Poland’s domestic and foreign policies as well as Polish-Russian relations.

Marat Davletbaev recently joined Threefold Legal Advisors LLC as a partner specializing in business & human rights and corporate issues.

His professional experience includes leadership of various legal departments at Russia's largest energy companies, such as Gazprom and Inter RAO UES, and international holdings.
